HomeMy WebLinkAbout1953/08/05 - ADMIN - Minutes - City Council - Regular August 5, 1953 ADJOURNED MEETING OF AUGUST 3, 1953 — AUGUST 5, 1953 The adjourned meeting of August 3, 1953 was called to order by Mayor C. L. Hurd at 7:29 P. M. The following Council Members were present at roll call: Trustee Bolmgren Trustee Jorvig Trustee Middleton Clerk Justad Mayor Hurd Village Attorney, E. T. Montgomery was also present. Widening Cedar Lake Road Near Westwood Luthern Church Mr. Lindquist and Attorney and Member of Westwood Luthern Church appeared regarding the widening of Cedar Lake Road near the Church. Said authority was invested in the Building Committee to speak for congregation on this matter. He asked Mr. Gilbertson, Architect to state their side of the problem. Excavation needed will be approximately 18,000 cubic yards at 35¢ per cubic yard, or $6,321.00. Stock pile will be 3,080 cubic yards at 50¢ per cubic yard or $1,540.00, a total of $7.,861.00, — Due to cut in road (all in ffont of proposed site for new church building). They would like to have a large tree on edge of road at west end of church property saved. (County profiles asks for grubbing said tree out) Mayor Hurd said that is--your damage figure?. Mr. Lindquist said that we understand that witnesses of the Village brought in damages of $500.00. Their witness, $4,000.00 to $5,000.00. The Commissioners brought in an $2,700.00 award for taking of road easement. The consensus of opinion is that although the figure of $2,700.00 is lower than they asked, they feel that they will go along on this figure. Mayor Hurd asked, is your settle— ment based on depth of 651 from the road? The answer was yes. Mayor Hurd asked if 65 feet is necessary. Mr. Lindquist said if your award can be stated to state the exact amount needed, we would cut our request for award accordingly. Village Attorney, E. T. Montgomery asked what increase in value to low property will be caused by the fill to be made. Mr. Gilbertson said not much different, but just as valueable as it is now, before the road is cut. Trustee Bolmgren asked if the 15,000 cubic yards you are moving fill entirely the low spot. Mr. Gilbertson asnwered that they do not know. Someone mentioned that you could have had the easement for $1.00 if gravel could-have been moved free. Mayor said you could have had that. Someone asked why the Contractors are putting dirt from the road onto Ecklund & Swedlund property? Mr. Lindquist said that the land cost about $2,000.00 per acre; the 91 acres costing $19,000.00... we will make a deal for what land is tkken on the basis of $2,000.00. " The Church group recessed to Clerk's Office for conference. Later Group returned. Someone asked if a lake was government property. Mr. Lindquist said if we can have damages for property taken from the east end of their property to the spot where west driveway starts, approximately 600 feet, on the b4sis of $2,000.00 per acre, we would waive any claim for damages west of this point. On the question of grade level, $7,861.00 is our figure for damages, but if the Village can do the job cheaper, they would let the Village do it. �- Mayor Hurd said you have no right of possession to property until the Jensen's move? Mr. ,Lindquist said they have a right to live in the house until about October 1,1953• Mayor Hurd asked would a firm bid for moving the dirt be acceptable at this time, as to figure of damage? The answer was yes. The group left with the idea that Mr. Lindquist would contact Village Attorney, E. T. Montgomery as to when the Jensen's would release the property; also as to whether they will get competitive bids for excavation or if the Village should. Hearing on Proposed Grading and Storm Sewer (Action Deferred to this Meeting)_ Separate hearings were had on each of the public improvements described in the following resolution on August 3, 1953, and action deferred to this meeting. 412 August 5, 1953 Hearings on Grading & Storm Sewer, Continued CAW Resolution On motion of Trustee Bolmgren, seconded by Trustee Middleton, the following resolution was adopted by unanimous vote of all Members of the Council present: RESOLUTION ORDERING GRADING AND STORM 6F9ER PROJECT WHEREAS, the Village Council has met at the time and place specified in the notices published in the St. Louis Park Dispatch July 23 and 30, 1953, relating to the improvements herein described, and has heard all interested persons appearing at said meeting, therefore BE IT RESOLVED by the Village Council of the Village of St. Louis Park that the following grading and storm sewer project be hereby ordered, in accord- ance with plans and specifications prepared by the Village Engineer and which are hereby approvedr IMPROVEMENT NUMBER LOCATION 53-108 Grading of West 25th Street from Inglewood Avenue to West 26th Street. 53-107 Storm Sewer in France Avenue from West 25th Street to a point approximately 60 feet north of West 24th Street. The Village Clerk is directed to advertise for separate bids for said im- provements to be opened at the meeting of the Council August 24, 1953• Patrolman Appointed - David Schaefer On motion' of- Trustee Jorvig, seconded by Trustee Bolmgren, the appointment of David Schaefer, 5900 Goodrich Avenue, St. Louis Park as Patrolman on Village Police Department, effective August 15, 1953, at a starting wage of x$323.30 per month, was approved by unanimous vote of all Members of the Council present. Petition for Sidewalk, Curb and Gutter - P-1326, 1327 Petition signed by E. A. Arp, 3352 France Avenue South and others, received August 3, 1953, for the construction of sidewalk, curb and gutter on the West side of France Avenue between 34th Street and Randall Street, was read. Paul R. Phillips, 3316 France Avenue asked for action, after some dis- cussion. On motion of Trustee Bolmgren, seconded by Trustee Middleton, the Village Engineer was instructed to direct Contractor, Art Bolier to construct sidewalk, curb and gutter at location stated in above petition, by unanimous vote of all Members of the Council present. New Employee for Engineering Department - Willard K. Schwartz On the recommendation of Village Engineer, Phil W. Smith, it was moved by Trustee Jorvig, seconded by Trustee Middleton, that-Willard K. Schwarz be placed on the Engineering payroll as of August 10, 1953, at the rate of x$1.722 per hour, by unanimous vote of all Members of the Council present. Program - Play Day and Final Field Da;,r at Oak Hill Park Program from St. Louis Park Recreation Planning Committee for Play Day and Final Field Day at Oak Hill Park to be held on August 6th, 1953 from 9:00 AM to 5:00 PM, was read. Minutes The minutes of meetings held July 20, 27, August 1 and 3, 1953, were read. On motion of Trustee Middleton, seconded by Trustee Bol.mgren, the minutes of meetings held July 20,27, and August 1 and 3, 1953, were approved as read, by unanimous vote of all Members of the Council present. Meeting Adjourned On motion of Trustee Jorvig, seconded by Trustee Middleton, the meeting was adjourned at 11:00 PM, by unanimous vote of all Members of_the Council present.
