On motion of Trustee Bolmgren, seconded by Trustee Middleton, the above request was referred to the Planning Commission for checking and recommendation, by unanimous vote of all Members of the Council. Recommendation for Setbacks - Building Inspector - Letter from Building Inspector, Peter Stienstra, dated July 31; 1953, with regard to the setback of houses proposed to be built by Ecklund and Swedlund Cons- truction Company on Sumter Avenue between 31st Street and 32md Street, was read. On motion of Trustee Middleton, seconded by Trustee Bolmgren, the Building Inspector's recommendation for a staggered setback of houses to be built by Ecklund and Swedlund Construction Company on Sumter Avenue between 31st and 32nd Streets, was approved by unanimous vote of all Members of the Council. Hearing on Proposed Acquisition and Extension of Streets A hearing was had on proposed extension and acquisition of West 29th Street from Texas Avenue to Pennsylvania Avenue and Pennsylvania Avenue from West 29th Street to West 28th Street. No persons appeared. Resolution On motion of Trustee Bo1mgf°en, seconded by Trustee Middleton, the following resolution was adopted by unanimous vote of all Members of the Council present: RESOLUTION ORDERING ACQUISITION OF STREET EXTENSIONS WHEREAS, the Village Council has met at the time and place specified in the notice relating to street acquisition herein described, published in the St. Louis Park Dispatch July 23, and 30, 1953, and has heard all interested persons appear- ing at said meeting, therefore BE IT RESOLVED, that West 29th Street be extended from Texas Avenue to Pennsylvania Avenue by acquisition of the South 25 feet of the East 158 feet of the North Half, and the East 30 feet of the South 225.3 feet of the North Half of the SEy, of the SW4, Section 8, Township *117, Range 21. BE IT FURTHER RESOLVED that the Clerk be authorized io negotiate with the owner of said premises for dedication thereof, and if unsuccessful the Village Attorney be authorized to commence proceedings in behalf of the Village in the District Court of Hennepin County, for acquisition thereof as provided by law, for use as a public street. August 3, 1953 Hearing on Proposed Grading and Storm Sewer Pursuant to notices published in the St. Louis Park Dispatch July 23, 1953, a public hearing was had on proposed grading and storm sewer projectsdescribed as follows: Improvement No. 53-108 Grading of West 25th Street from Inglewood Avenue to West 26th Street Improvement No. 53-107 Storm Sewer in France Avenue from West 25th Street to a point approximately 60 ft. North of West 24th Street. The following persons appeared. A member of the audience was about the boundaries of the area to be assessed. Mayor Hurd produced the plat and read the boundaries. He then read the entire descripti6n. Mr. I. S. Joseph said he opposes the entire project as far as the assessment is concerned. Said we need storm drainage. Mentioned some covenants that should be fulfilled. Mayor Hurd said the assessment of the project would be heard at a later date. Oscar Victor, 3917 West 24th Street said he feels that France Avenue is a public street and used by others, and area should be made larger. Feels that a $400.00 assessment is too high. David Lubit, 2530 Joppa Avenue concurred with Mr. Victor. Theodore Herman, 2532 Joppa Avenue objected to the project if assessed. Said it was not needed, and if the Village needs same they should take cost out of the General Fund. Max-Rappaport, 2501 France said that we do need this project but the assessment should be wider spread. Sidney Cohen, 3916 Basswood Road said he understands that France Avenue is a County Road and as same is a thoroughfare it should be assessed to the Park as a whole. He suggested that the County be contacted. Trustee Bolmgren answered that the County had been contacted and that they would assume no responsibility. He also explained how storm sewers have been built in the past. B. F. Kirschbaum, 2520 Inglewood Avenue called attention to a petition sent in at the time the Plat of Cedarwood was approved. Mayor Hurd read the petition dated August 29, 1950, and said that the grading assessment should be considered in light of said petition. Mr. Joseph said that the storm sewer is necessary, but we want an equitable assessment; that he is willing to be one of those who pay the most. As to the grading job, he feels "hands off" should be the policy. Mayor Hurd said the assessment would be confined to area described in publication. Sam Polski, 4200 West 25th Street asked if owners in new platted area of Cedarwood Second Addition would be assessed. The answer was 11no", as this territory will drain west into lake area west and north of plat. • Mr. Joseph suggested that action be deferred in order to check with the Village Engineer as to need for Project No. 53-108--Grading West 25th Street from Inglewood Avenue to West 26th Street. Mayor Hurd said this meeting will be adjourned until Wednesday, August 5, 1953 and this matter can be taken up with the Village Engineer and determined at that time. Mr. J. J. Liebenberg, representing Harry Bloom came in late and asked to be heard. Mentioned working with our Village Engineer when building his house. Mr. Joseph said if there was any agreement between the Village Engineer and Harry Bloom's Contractor it should be considered. Mr. P. 0. Leonard, 2537 Joppa Avenue called the Council's attention to a letter dated April 25, 1953, written to Phil W. Smith, Village Engineer by Liebenberg and Kaplan. On motion of Trustee Bolmgren, seconded by Trustee Middleton, action on this hearing was deferred to august 5, 1953, by unanimous vote of all Members of the Council present. Sidewalk, Curb & Gutter Ellis Bursell, 3348 France Avenue spoke regarding sidewalk, curb and gutter for the west side of France Avenue from Randall to 34th Street. Said he understood that work had been abandoned by the Village. He presented a petition for same, signed by 9 property owners to go ahead with the work. Mr. Bursell was asked to get additional signers and bring in petition to the August 5th meeting. Setbacks in 3100 Block, Sumter William Wynn, 3131 Sumter Avenue appeared regarding setbacks at the north end of his block. Asked assurance that the lots south of him will not be allowed to come in front of his home, if and when built. 406 August 3, 1953 Setbacks in 3100 Block, Sumter On motion of Trustee Bolmgren, seconded by Trustee Middleton, the Build- ing Inspector was instructed to make proper note of this situation and see that when building permits are requested for Lots 10, 11, and 12, Block 6, Roanoke Acres and Lots 35, 36, 37, 38 and 39, Rearrangement of Block 291, that setback line of existing building on Lot 13, Block 6, Roanoke Acres be observed, by unanimous vote of all Members of the Council present. Petition for Sewer and Water Letter from A. C. Godward, Richard B. Thomson and Maurice E. Scroggins, Jr. dated August 3, 1953, requesting that sewer and watermains be constructed in the plat known as Cedarwood Second Addition, was read. On motion of Trustee Middleton, seconded by Trustee Bolmgren, the above request was referred to the Village Engineer and Chairman of the Sewer and Water Department Committee for checking and recommendation to be brought in as soon as possible, by unanimous vote of all Members of the Council present. Mayor Hurd suggested that this work if ordered would likely be assessed 6n estimate this year and all payable in 1954. Gas Main Extensions On motion of Trustee Bolmgren, seconded by Trustee Middleton, the following gas main extension was approved by unanimous vote of all Members of the Council present: #314 In Sunset Boulevard and Glenhurst Avenue from 134' W W line France Avenue South to 218' S S line of West 28th Street. Permission to Place Poles On motion of Trustee Bolmgren, seconded by Trustee Middleton, the Northern States Power Company were granted permission to place poles at the f6llowing loca- tion within the Village, by unanimous vote of all Members of the council present: One (1) pole at West 31st Street and Oregon Avenue. One (1) Pole on Yosemite Avenue and West 27th Street. Proposed Plat - Louis Larson's Farm Addition On motion of Trustee Bolmgren, seconded by Trustee Middleton, the`proposed plat of Louis Larson's Farm Addition was referred back to the Platter to re- arrange the lots on the NE and-NW corners so as to have 50 foot frontages and maximum number of parallel lot lines, by unanimous vote of all Members of the Coun- cil present. Petition for Vacating Alley On motion of Trustee Bolmgren, seconded by Trustee Middleton, petition signed by Adolph Fine, Incorporated by H. W. Planning Commission's Report on Request for Permit to Erect Advertising Sign - Western Outdoor Advertising Co. Planning Commission's report dated July 27, 1953, on the request of Western Outdoor Advertising Company for a permit to erect an advertising sign on build- ing at 2100 South Belt Line Highway, was read. On motion of Trustee Middleton, seconded by Trustee Bolmgren, on the recom- mendation of the Planning Commission, the request of Western Outdoor Advertising Company for a permit to erect an advertising sign on face of building at 2100 South Belt Line Highway, 2 ft. vertical and 25 ft. horizontal, was approved by unanimous vote of all Members of the Council present. August 3, 1953 407 Bond ® a'- Bond Approved On motion of Trustee Bolmgren, seconded by Trustee Middleton, the follow- ing bond was approved by unanimous vote of all Members of the Council present; CONTRACTORS BOND with Fine Realty, Incorporated as principal, and American Automobile Insurance Company as surety, dated July 17, 1953, in the amount of $ 6,000.00 covering contract for grading and graveling streets with one and one-half inches of gravel in West r= Texa-Tonka Hills Addition to St. Louis Park, Minnesota. Claim for Damages Approved - H. E. Beardsley On recommendation of the Village Attorney E: --T-: Montgomery, it was moved by Trustee Middleton, seconded by Trustee Bolmgren, that the claim in settlement for damages to premises at 2701 Edgewood Avenue resulting from grading of alley to the rear of said premises by the Village of St. Louis Park in the amount of $470.00 was approved, and the Mayor and Clerk were authorized to issue warrant in payment of same, by unanimous vote of all Members of the Council present. Letter Re: Sub-Station - Northern States Power Co. Letter from Northern States Power Company dated July 24, 1953, concerning a contemplated erection of electric sub-station to be located on the N. 195.75 deet of the South 515 feet of the S2 of the SWC of the SEy, Section 31-29-24, which is a tract of land on the West Side of Joppa Avenue-at approximately the intersection with Sunset Boulevard, was read. On motion of Trustee Bolmgren, seconded by Trustee Middleton, the above request was referred to the Planning Commission for checking and recommendation, by unanimous vote of all Members of the Council present. On motion of Trustee Bolmgren, seconded by Trustee Middleton, the foregoing claim for damages by Almina Westergaard was referred to the Village Attorney for checking and recommendation, by unanimous vote of all Members of the Council present. Bid Award for Two 1953 Four-Door Sedans for Police Department On motion of Trustee Middleton, seconded by Trustee Bolmgren, the bid of The Woodhead Company, Incorporated, received July 27, 1953, for the furnishing of Two (2) 1953 Four-Door Ford Sedans with trade-in of One (1) 1950 Custom Tudor Ford Coach, and 0 e (1) 1951 Deluxe Tudor Ford Coach, was determined to be the lowest bid of a responsible bidder, and the Clerk was authorized to issue a purchase order for same in the amount bid of $1,740.00, by unanimous vote° of all Members of the Council present. Petition for Street Improvement On motion of Trustee Middleton, seconded by Trustee Bolmgren, the follow- ing petition was referred to the Village Engineer, Chairman of the Street Depart- ment Committe, and Special" Assessment Department for checking and recommendation, by uhanimous vote of all Members of the Council present: P-1324 PETITION FOR TAR MAT, signed by Robert J. On motion of Trustee Middleton, seconded by Trustee Bolmgren, the Clerk was instructed to contact Mr. Grossman and request that he be present at the adjourned meeting to be held August 5, 1953, at 9:30 P. Letter Re: Services of League of Minnesota Municipalities Letter from League of Minnesota Municipalities, dated July 31, 1953, re- garding services of the League, was read and ordered filed. August 3, 1953 409 Request for Rezoning - Carlson Bros. Company On motion of Trustee Bolmgren, seconded by Trustee Middleton, the request of Carlson Brothers Company, dated August 3, 1953, for rezoning that part of Block 204 lying Southeasterly of the new Gorham Road which is cut through to Louisiana Avenue, the lots being 8, 91 102 11, 12, 132 143 15, 16, 17, 182 19, and 20, for Light Industrial Use, was referred to the Planning Commission for checking and recommendation, by unanimous vote of all Members of the Council present. Resolution On motion of Trustee Holmgren, seconded by Trustee Middleton, the following resolution was adopted by unanimous vote of all Members of the Council present: RESOLUTION SETTING HEARING FOR STREET ACQUISITION BE IT RESOLVED that the Clerk be directed to publish Notice of Hearing to be held at the Council Meeting August 17, 1953 on proposed opening of extension to Cedar Lake Road from the East line of Section 30 Township 29, Range 24 to the intersection of County Road No. 16 (Cedar Lake Roadj with the Great Northern Railway Right-of-Way, the estimated cost to be specified at $5,000 and the area to be assessed being the tracts of land adjacent to said proposed extension includ- ing all premises lying North thereof and East of said intersection of County Road No. 16 with the Great Northern Railway. Ordinance No. 219, Section'4 - D & E The Village Attorney said that there was some question as to the interpetation of the two sections of the Employees Ordinance which refer to compensation for Employees who fill the position of a higher paid job for part time. He was asked to draw up a suggested amendment that would clarify this rule. Repairs for Well #6 Report from Water Superintendent, Ira Vraalstad regarding the condition of Well #6, and his recommendation for a remedy, was read. This calls for a relining of Well #6 with 16 inch OD steel pipe to eliminate the sand condition that exists. On motion of Trustee Bolmgren, seconded by Trustee Middleton, the Clerk was instructed to advertise for bids in the Construction Bulletin this week for the furnishing and installing of approximately 330 feet of 16 inch OD, 3/8" wall pipe for well #6, bids to be opened August 24th, 1953, by unanimous vote of all Members of the Council pressnt. Note Construction Bulletin being used due to St. Louis Park Dispatch Office being closed this week for vacation, and this work was declared urgent.) Minutes of St. Louis Park Community Fund Board Copy of minutes of regular meeting of the Board of Trustees of the St. Louis Park Community Fund including 1954 budget, held July 7, 1953, was read and ordered filed. Letter Re: R/W France Avenue to Brookside Station Copy of letter from Fred A. Ossanna, President of the Twin City Rapid Transit Company to County Commissioner, S. Earl Ainsworth, concerning the proposed purchase of the R/W of the Minneapolis and St. Paul Suburban Railroad Company from'France Avenue to Brookside Station, was read and ordered filed. Letter Re: Widening & Grading S. M. Mc Namara Letter from S. M. Mc Namara, dated July 28, 1953, relative to widening and grading of 14th Street from Louisiana Avenue to Oregon or Pennsylvania, was read. On motion of Trustee Middleton, seconded by Trustee Bolmgren, the above letter was referred to the Village Engineer and Street Department Chairman for checking and recommendation, by unanimous vote of all Members of the Council present. Letter from Municipal Employees Union Re: Wages Letter from Parker S. Nolan, Business Representative, Municipal Employees Union, dated July 29, 1953, stating that they were negotiating an increase for Village Employees of $25.00 per month, was read.
