REGULAR MEETING AUGUST 24, 1953
A regular meeting of the Village Council was called to order by Mayor
C. L. Hurd at 8:01 P. M.
Invocation was given by Reverend Robinson of Union Congregational Church.
The following Council Members were present at roll call:

Street Railway R/W
Mr. Bren of Twin City RapidnTransit Company appeared. Spoke with regard to
Street Railway Right-of-Way from Hopkins to France Avenue at 44th Street. Hopkins
has an option to purchase the R/W from Hopkins to Brookside Avenue for $75,000.00.
Edina and Hopkins now are very much interested in having this R/W converted into
a THRU WAY for cars.

Street Railway R/W. Continued. �f
The balance from Brookside to France.Avenue now available - Morningside
has been contacted, and St. Louis Park is the last to be contacted. Morningside
admits now is the time to acquire this Right-of-Way. The balance of the R/W
from Brookside Avenue to France Avenue has-been appraised at X75,000.00.
Mr. Bren was asked what will be used for transportation after the street
cars are out. He answered Bus Service, that goes all the way downtown. It is
planned to use the THRU WAY for passenger cars only.
Trustee Bolmgren said that we are studying to see if the Village has the
right to take part in this purchase, and asked if the money could be taken out of
the General Fund. Village Attorney, E. T. Montgomery said he was not sure but
would look into this manner of financing, .Trustee Bolmgren asked Mr. Bren if'
they had made any headway with the City of_Minneapolis. He said no, but it is
not practical as the R/W in Minneapolis is, narrow - only 33 feet between 31st
and 36th Street. He said the County is very enthusiastic about this project.
Also said that it would be a fine thing if, St. Louis Park would go in on it.
This is an opportunity to take now, and should not- be passed up, as the Twin City
Rapid Transit Company are getting requests for this R/W for private use.
Bids for Sanitary Sewer_
As advertised in the St. Louis Park Dispatch August 13, 1953s sealed bids
were received from the following bidders for construction of the following
sanitary sewer extensions:
53-93 Vernon Avenue from West 26th Street to West 252 Street
94 Webster Avenue from West 26th Street to West 25J Street
95 Xenwood Avenue from West 26th Street to West 252 Street
96 West 252 Street from Xenwood Avenue to Vermont Avenue
99 Limn Avenue from North Service Drive of Highway No. 7 to
Minnetonka Boulevard, and Service Drive of Highway No. 7
from Monterey to Lynn Avenue.:

As advertised in the St. Louis Park Dispatch August 13, 1953, sealed bids
were received from the following bidders for grading and graveling of Monitor
Street from Lake Street to the North line of Lot 6,, Block 51, Rearrangement of
St. Louis Park:

On motion of Trustee Bolmgren, seconded by Trustee Middleton, the foregoing

As advertised in the St. Louis Park Dispatch August `13, 1953, sealed bids
were received from the following bidders for,grading of West 25th Street from

On motion of Trustee Jorvig, seconded by Trustee Bolmgren, the above bids

On motion of Trustee Middleton, seconded by Trustee Jorvig, the foregoing
bids were referred to the Village Engineer and Chairman of'the Water-Department
Committee for tabulation and recommendation, by unanimous vote of all Members of
the Council.
Hearing on Proposed Water Main Extensions
A hearing was had on proposed water main extension Improvement No. 53-110.
No persons appeared.
Resolution
On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the following
resolution was adopted by unanimous vote of all Members of the Council:
' RESOLUTION ORDERING WATER MAIN EXTENSION
WHEREAS, the Village Council has met at the time and place specified in the
notice published in the St. Louis Park Dispatch August 13 and 20, 1953, relating
to the improvement hereinafter described, and has heard all interested persons
appearing in relation thereto, therefore
BE IT RESOLVED by the Village Council of the Village of St. Louis Park
that water main extension No. 53-110 in West 35th Street from Texas Avenue to
Yukon Avenue be hereby ordered, in accordance with plans and specifications which
have been prepared by the Village Engineer and which are hereby approved. The
Clerk is directed to advertise for bids to be opened September 14, 1953•
Request for Permit for Advertising Sign Nordquist Sign Company
Request of Nordquist Sign Company, dated August 24, 1953, for a permit to
erect a tempbrary sign on the SW Corner of Louisiana Avenue and Wayzata Boulevard,
was read.
On motion of Trustee Jorvig, seconded by Trustee Bolmgren, permission was
granted for the above sign, subject to approval of the Planning Commission on
September 2, 1953, by unanimous vote of all Members of the Council.
Request for Permit to Change Location of Advertising Sign Meyers Outdoor
On motion of Trustee Bo]mgren, seconded by Trustee Jorvig, the request of
Meyers Outdoor Advertising, Incorporated to change location of advertising signs
(Permits 10 and 14) to Lots 1 and 2, Block 323, Rearrangement of St. Louis Park,
was approved by unanimous vote of all Members of the Council.
Request for Rezoning to Multiple Dwelling L. J. Holland
Request of Lawrence J. Holland, 2934 Natchez Avenue, dated August 24, 1953,
for the rezoning of his home property so that same may be used for two families,
was read. , '
On motion of Trustee Middleton, seconded by Trustee Bolmgren, the above
request was referred to the Planning Commission for checking and recommendation,
by unanimous vote of all Members 'of the Council.
Building Inspector's Weekly Report
The Building Inspector's report for week ending August 21, 1953, showing
that 25 building permits were issued, totaling $191,150.00, was read and ordered
filed.

Bid Award for Construction of Sanitary Sewers 53-93, 94, 95, 96, 99
The Village Engineer's tabulation of bids received earlier this meeting
for the construction of Sanitary Sewers 53-93, 949 952 96, and 99, and his
recommendation,for award of contract was read.
On motion of Trustee Bolmgren, seconded by Trustee Middletdn, the bid
of William V. Terry Excavating Company received this date for the construction
of Sanitary Sewers 53-93, 94, 95, 96, and 99 was determined to be the lowest
bid of a responsible bidder, and the Mayor and Clerk were authorized to exem to
contract with the bidder for the work at price bid of $17,240.25, by unanimous
vote of all Members of the Council.
Street Lights Ordered
On motion of Trustee Bolmgren,, seconded by Trustee Jorvig, the Northern
States Power Company was ordered to place street lights on Corners of 36th and
Virginia and 35th and Virginia, by unanimous vote of all Members of the Council.
Petitions for and Against Street Improvements
On motion of Trustee Middleton, seconded by Trustee Bolmgren, the follow-
ing petitions were referred to the Village Engineer, Chairman of the Street
Department Committee, and Special Assessment Department, for checking and recom-
mendation, by unanimous vote 'of all Members of the Council present:

On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the following
bond was approved by unanimous vote of all Members of the Council: '

Swedlund Construction Company as principal, and
American Automobile Insurance Company as surety,

On motion of Trustee Jorvig, seconded by Trustee Bolmgren, the following
partial payment on contract work in progress, presented by Village Engineer, Phil
W. Smith, was approved, and the Mayor and Clerk were authorized to issue warrant
covering same, by unanimous vote of all Members -of the Council present:

tember 14, 1953, the legal"description of which follows:
"All that part of Zarthan Avenue and that part of the Alley

Motion was passed by unanimous vote of all Members of the Council.
Village Engineer's Report on Petition for and Against Curb and Gutter
Village Engineer's report dated August 20, 1953, concerning the correct
status of petitions for and against curb and gutter on Alabama Avenue between
Excelsior Boulevard and West 41st, Street, was read.
Hearing Date Set & Advertisement for Bids Ordered = Curb & Gutter
On motion of Trustee Middleton, 'seconded by Trustee Bo]mgren, September 14,
1953 was set as date for hearing'on proposed construction of curb and gutter on
East and West Sides of Alabama Avenue between Excelsior Boulevard and West 41st
Street; *also the Clerk was instructed to advertise for bids on same to be opened
on the same date, by. unanimous vote of all Members of the Council.
Offer to Donate Property for Park Purposes - Alfred M. Elie
The survey of property owned by Alfred M. Elie which he would like to donate
to the Village for park purposes, Iwas discussed.
On motion of Trustee Bolmgren, seconded by Trustee Middleton, the Village
Attorney was instructed to prepare a deed -for property lying between 34th and 35th
Streets and Wyoming and pylon Avenues, as shown upon survey of same, to be donated
by Alfred M. Elie, 8206 West 35th Street to the Village for Park Purposes, by
unanimous vote of all Members of the Council present.
Job 0-132 (Tar Mat) Reinstated
Interoffice Memo from Village Assessor, R. B. Connery, dated August 17, 19532
requesting that Job ##P-132, Tar Mat, Alley Block 3, Brookview Park which was
canceled on July 6, 1953 be reinstated as the work has been completed, was read.
On motion of Trustee Bolmgfen, seconded by Trustee Jorvig, the following resolution
was adopted by unanimous vote of all Members of the Council:

RESOLVED that resolution adopted July 6, 1953 canceling improvements prev-
iously ordered be hereby amended by elimination from the list of improvements
incorporated therein, Tar Mat Improvement No. P-132 - Alley in Block 3, Brookview
Park.
Letter Re: Danger to Grade Levels
-` On motion of Trustee Bolmgren; secoaded by Trustee Middleton, the letter
from Ben Badiner, 4110 West 25th Street, dated August 14, 1953, concerning street
levels affecting his home was read and ordered filed, by unanimous vote of all
Members of the Council.

On motion of Trustee Bolmgren, seconded by Trustee Middleton, the Village
Engineer was instructed to bring in a list of tar mat jobs done which may be sealed
in for discussion at Council Meeting on August 31, 19532 by unanimous vote of all
Members of the Council present.
Bid Award for Cleaning Well #6 Deferred
On motion of Trustee Bolmgren, seconded by Trustee Jorvig, action on the
award of bid for cleaning out Well #6 (bids taken this meeting) was ddferred to
meeting of August 31, 1953, by unanimous vote of all Members of the Council.
Notice of Hearing Re: Re Valuation of Property,
Fixing & Establishing Permanent Fares, Etc.
Ngtice of Hearing, received from Minnesota Railroad and Warehouse Commission,
to be held in their office, 470 State Office Building, St. Paul, Minnesota on
February 16, 1954 at 9:30 AM,, in the-matter of re-valuation of the St. Paul City
Railway Company's and Minneapolis Street Railway's property, and fixing and
establishing permanent fares,was read and orderd referred to the fourth meeting
in January, 1954.
Resolution
On motion of-Trustee Bol.mgren, seconded by Trustee Jorvig, the following
resolution was adopted by unanimous vote of all Members of the Council:

WHEREAS, pursuant, to resolutions heretofore duly adopted by the Village

On motion of Trustee Jorvi.g, seconded by Trustee Bolmgren, the Street
Commissioner was instructed to place a street sign on corner of Wyoming Avenue
and Minnetonka Boulevard, by unanimous vote of all Members of the Council.

STREET IMPROVEMENT ORDER
The Village Treasurer of the Village of St. Louis Park, Hennepin County,
Minnesota is ordered and directed to pay to bearer the sum of One Thousand
Dollars (61,000.00) on the 1st day of September, 1954, and to pay interest
thereon at the rate of 3 4/10 per cent per annum, payable semi-annually on the
first day of March and September each year, interest to maturity being represented
by separate interest coupons hereto attached; both principal and interest are
payable at Northwestern National Bank of Minneapolis, Minneapolis, Minnesota, in
any coin or currency which at the date of payment is legal tender for public and
private debts.
This order is one of an issue of orders of like date and tenor except as
to maturity, issued by the Village of St. 'Louis Park under the provisions of
Sections 434.28 through 434.35, Minnesota Statutes, in the aggregate amount of
the unpaid balance of the cost of Public Improvements on certain streets in said
Village in anticipation of the collection of special assessments heretofore duly
levied on the property benefited thereby to pay the cost of said improvements,
and the full faith and credit and taxing powers of the Village have been and are
irrevocably pledged to the payment of the principal and interest hereof.
IT IS HEREBY CERTIFIED and recited that all acts, proceedings and things
required by the Constitution and Laws of the State of Minnesota to be done and
performed precedent to the full issuance of this order have been done and performed
in the time and manner as required by law, and that -the issuance of this order did
not cause the indebtedness of the Village to exceed any constitutional or
statutory limitation of indebtedness.

Village Engineer's Report on Request for Vacating Portion
of Alley in Block 2. Texa Tonka Addition
The Village Engineer made a verbal report on the request of Adolph Fine,
Inc. for vacating a portion of Alley in Block 2s Texa Tonka Addition.
On motion of Trustee Bolmgren, seconded by Trustee Middleton, the Clerk
was instructed to get a new petition for vacating the entire Alley in Block 2,
Texa Tonka Addition, and refer same to the Planning Commission for checking and
recommendation, by unanimous vote of all Members of the Council.
Request for Rezoning Guilford A. Morse
On motion of Trustee Middleton, seconded by Trustee Bolmgrens the following
requests for rezoning received from Guilford A. Morse, august 25, 1953s were
referred to the flaming Commission for checking and recommendation, by unanimous
vote of all Members of the Council:

Gas Main Extensions
r On motion of Trustee Bolmgren, seconded by Trustee Middleton, the following

Street Pavement Problem
On motion of Trustee Jorvig, seconded by Trustee Bolmgren, Trustee Middleton
was authorized to negotiate a satisfactory solution to the street pavement problem
at Salem Avenue and West ?8th Street, by unanimous vote of all Members of the
Council.
Request to Extend 1011 Gas Main Across New Louisiana Avenue Bridge
Letter from Great Northern Railway Company, dated July 30, 1953, stating
that they received a letter from the Minneapolis Gas Company requesting permission
to construct and maintain a ten—inch diameter gas main extending across the new
bridge which is being constructed over the Great Northern Railway Company's tracks
on Louisiana Avenue, and requesting that the Village Council grant permission for
same, was read.
On the recommendation of Village Engineer, Phil W. Smith, dated August 10,
1953, it was moved by Trustee Bolmgren,, seconded by Trustee Middleton, that the
Minneapolis Gas Company be granted permission to construct a ten—inch (101) gas
main across the new Louisiana Avenue Bridge, with the understanding that same will
be maintained entirely at their expense; by unanimous vote of all Members of the
Council present.
Tentative Plat of Lot 6. Block 3, Cedarcrest Second Addition
On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the tentative
plat of Lot 6, Block 3, Cedarcrest Second Addition, presented by Wallace Bruce was
referred to the Planning Commission and- Village Engineer for checking and recom—
mendation, by unanimous vote of all Members of the Council.
Petition to Acquire Triangular Piece of• Land for Park Purposes
Petition signed by Mr. and Mrs. Frank Fleetham, 3248 Jersey Avenue and others,
dated August 5, 1953, requesting that the Village acquire thru purchase or condem—
nation proceedings, portions of Lots 21- thru 24, Block 207, Rearrangement of St.
Louis Park (triangular piece of land west end of Parkview Park between Kentucky
Avenue and 33rd Street), for park purposes only, was read.
Hearing'Date ,Set for Acquisition of Park Property
On motion of Trustee Bolmgren, seconded by Trustee Jorvig, September 14, 1953
was set as date of hearing on proposed acquisition of above described property to
be used for park purposes only, by unanimous vote of all Members of the Council.
International Association of Fire Chiefs
On motion 'of Trustee Jorvig, seconded by Trustee Middleton, Fire Chief,
C. M. Williams was authorized to attend the Conference of International Association
of Fire Chiefs at Toronto, Canada, September 15 thru 18, 1953 with necessary
expenses paid, by unanimous vote of all Members of the Council.
