A regular meeting of the Village Council was called to order by Mayor
C. L. Hurd at 8:16 P. M.

On motion of Trustee Middleton, seconded by Trustee Bolmgren, the above bids
were referred to the Village Engineer and Chairman of the Street Department Com-
mittee for tabulation and recommendation, by unanimous vote of all Members of the
Council present.
Bids for Two (2) Four-Door Sedans for Police Department
As advertised in the St. Louis Park Dispatch, July 16, 1953, sealed bids were
received from the following bidders for the furnishing of Two (2) 1953 Four-Door
Sedans according to specifications therefore on file with the Village Clerk, and
taking into consideration the trade-in of One (1) 1950 Custom Tudor Coach, and One
(1) 1951 DeLuxe Tudor Coach:

On motion of Trustee Bolmgren, seconded by Trustee Middleton, the above bids
were referred to the Police Chief and Chairman of the Police Department Committee
for tabulation and recommendation, by unanimous vote of all Members of the Council
present.
Hearing on Application for Rezoning - M. Grossman
Pursuant to notice published in the St. Louis Park Dispatch, a public hearing
was had on the application of Max Grossman for rezoning of Lots 5, 6, and 7, Block
5, Minikanda Vista Second Addition; -and application of H. J. Aretz for the rezoning
of Lot 11, Block 4, Minikanda Vista Second Addition from Residential Use to Com-
mercial Use. A petition signed by Mr. and Mrs. Robert Arter, 3801 Princeton Avenue
and others which reads as follows was presented and read:
"The Lots 5, 6, and 7. Block 5, and Lot 11, Block 4,
_Minikanda Vista Second Addition were zoned residential
when we built and purchased our property. We and our
children expect to be protected by these zoning laws.
We do not want our property to be devaluated by the
hoped for profitering of one speculating individual.
We expect fair and just treatment."
Mrs. Ralph Engstrand, 3805 Princeton Avenue said it is not right to make
this change as there is too much business there now. Mrs. Anna Scherbing, 3810
Princeton Avenue said she is opposed to proposed rezoning as same will devalue
their property. John Keeley, 3804 Princeton Avenue said he was opposed to the
rezoning as he doesn't feel that a business should be located there. Mr. W. J.
Dean, 4810 West 38th Street said he objects to any further extension of business
zoning.
On motion of Trustee Bolmgren, seconded by Trustee Middleton, it was agreed
that the Village Council meet on above ground, Saturday, August 1, 1953,-at 2 P.M.
and that Contractor Jerry Holt set stakes for proposed building and show plans
for same, by unanimous vote of all Members of the Council.
Request for Permit to Build• Duplex
Request from J.' D. Corah, 3967 Dakota Avenue, dated July 27, 1953', for a
permit to build a duplex on Lot 15, Block 3, Sunset Gables Second Addition, was
read.
On motion of Trustee Bolmgren, seconded by Trustee Middleton, the above
request was referred to the Planning Commission for checking and recommendation,
by unanimous vote of all-Members of the Council present.
Building Inspector's• Weekly Reports
The Building Inspector's report for weeks ending July 10, 17, and 24, 1953,
showing that 72 building pernLits were issued, totaling $609,640.20, was read and
ordered filed.

Permission to Place Poles
On motion of Trustee Middleton, seconded by Trustee Bolmgren, the
Northern States Power Company was granted permission to place one (1) pole
pn Texas Avenue'south of Minnesonta Boulevard, by unanimous vote of all Members
of the Council. .
Claim for Damages - M. A. Fingerman
Claim of M. A. Fingerman, dated July 24, 1953, for damages to his property
on the North side of Minnetonka Boulevard between Colorado Avenue and Dakota
Avenue, along stores and parking lot, due to change in grade at the time of
paving Minnetonka Boulevard, in the amount of $203.00, was read.
On motion of Trustee Bolmgren, seconded by Trustee Middleton, the above
mentioned claim for damages in the amount of $203.00 was approved, and the Mayor
and Clerk were authorized to issue warrant for same, by unanimous vote of all
Members of the Council present.
1953 Licenses
On motion of Trustee Middleton, seconded by Trustee Jorvig, the following
applications for 1953 licenses were approved, and the Mayor and Clerk were authori-
zed to issue licenses to expire December 31, 1953, by unanimous vote of all Members
of the Council present.

On motion of Trustee Holmgren, seconded by Trustee Middleton, the following
partial payment on contract work in progress, presented by the Village Engineer,
Phil W. Smith, was approved, and the Mayor and Clerk were authorized to issue
warrants covering same, by unanimous vote of all Members of the Council present:

On motion of Trustee Bolmgren, seconded by Trustee Middleton, the approval
of plat of WEST TEXA-TONKA HILLS ADDITION, presented by Adolph Fine, Incorporated
was deferred until the conclusion of the negotiation for establishment of grade
of Cedar Lake Road at this location, by unanimous vote of all Members of the
Council present.
Reguestlto UselProperty for Auction Sale Ross & Ross
Letter from Ross & Ross, dated July 21, 1953, requesting permission to
conduct an auction sale adjacent to the VFW property on 36th Street and Highway
No. 100, and including Village owned property on 37th Street, including the most
Easterly building in the Veterans Housing Area, was read.
On motion of Trustee Middleton, seconded by Trustee Jorvig, the above request
was granted, and the Village Attorney was instructed to work out the details of
agreement needed, by unanimous vote of all Members of the Council present.
Temporary Inspector for Engineering Department - Richard Boorsma
On the recommendation of Phil W. Smith, Village Engineer, it was moved by
Trustee Middleton, seconded by Trustee Bolmgren, that RICHARD BOORSIVIA be placed on
the Engineering payroll on a temporary basis at $1.722 per hour, effective August
32 19532 by unanimous vote of all Members of the Council.
Temporary Inspector for Engineering Department - E. N, Gutch
On the recommendation of Phil W. Smith, Village Engineer, it was moved by
Trustee Middleton, seconded by Trustee Bolmgren, that E. N. GLITCH be placed on the
Engineering payroll on a temporary basis at $1.722 per hour, effective July 27,
1953, by unanimous vote of all Members of the Council.
Temporary Inspector for Engineering Department - Earl M. Morgan
On the recommendation of Phil W. Smith, Village Engineer, it was moved by
Trustee Middleton, seconded by Trustee Bolmgren, that EARL M. MORGAN be placed
on the Engineering Payroll on a temporary basis at $1.722 per hour, effective July
27, 19532 by unanimous vote of all Members of the Council present.

Proposed Plat of Cedarwood Second Addition `
B. F. Kirschbaum, 2520 Inglewood Avenue spoke regarding proposed plat of
Cedarwood Second Addition. He asked that the approval of same be deferred until
August 3, 1953, until his neighbors have an opportunity to be heard.
The Planning Commission's report dated July 27, 1953, on the proposed plat
of Cedarwood Second Addition was read.
On motion of Trustee Jorvig, seconded by Trustee Bolmgren, the proposed
plat of Cedarwood Second Addition as presented by Richard B. Thomson was received,
and the Mayor and Clerk were authorized to execute Village approval of the
recordable plat, upon compliance with the following conditions by the Applicant:
1. Approval of title and form of execution by the Village Attorney.
2. Approval of street grades and form of the plat by the Village Engineer.
3. The Applicant will execute and deliver to the Village a contract in
form approved by the Village Attorney for grading of all streets dedi—
cated in said plat to grade approved by the Village Engineer, provided
that such contract and bond to secure the same will not be required
if the streets of said subdivision are graded and stabilized as approved
by the Village Engineer prior to presentation of the recordable plat.
4. The Applicant will furnish a public contractors performance bond
guaranteeing performance of the contract in a sum to be determined by
the Village Engineer upon the basis of his estimated cost of grading,
such bond to be executed by a corporate surety approved by the Village
Council and the form of which is to be determined by the Village
Attorney.
5. The Applicant will deliver to the Village an option, approved by the
Village Attorney, whereby the Village shall have the exclusive right
to purchase Lots 1 through 6 inclusive, Block 6, said Subdivision
for the sum of $25,000 plus any unpaid special assessment on or before
July 27, 1954 without prejudice to the right of the Village to acquire
the property by condemnation proceedings at price determined-therein.
6. The Applicant will deliver an executed conveyance to the Village
without prepayment, Reserved Lots A and B of said Subdivision to use
as a public park.
Motion was passed by unanimous vote of all Members of the Council.
Re: Division of Lots in La Petite Ferme Addition
A resident from the area asked whether the Council could deny the issuance
of permits in La Petite Ferme Addition for building on 53 foot lots. He was told
that the Zoning Ordinance says that 50 foot lots are the minimum size lots can be
cut to and the Council had no right to hold up permits on lots of 50 feet or larger.
Hearing on Proposed Storm Drain '
A hearing was had on proposed construction of storm drain under and across
West 34th Street between.Xylon Avenue and Yukon Avenue. J. G. Hammes, 3300 Yukon
Avenue and J. E. Hanson, 3341 Xylon Avenue appeared in favor of same.
Resolution
On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the following
resolution was adopted by 'unanimous vote of all Members of the Council present:
RESOLUTION ORDERING STORM DRAIN
WHEREAS, the Village Council has met at the time and place specified in a
notice published in the St. Louis Park Dispatch on July 16 and 23, 1953, relating
to the storm drain improvement hereinafter described, and has heard all interested
persons appearing at said meeting, therefore
BE IT RESOLVED by the Village Council of the Village of St. Louis Park that
construction of a storm drain across West 34th Street at a point approximately mid—
way between Xylon Avenue and Yukon Avenue, in accordance with plans and specifica—
tions which have been prepared by the Village Engineer, be hereby ordered, and it
appearing that the estimated cost of said project is $515.00 the work is hereby
ordered to be done by the Street Commissioner under the direction of the Village
Engineer.

Bids on Sale of on Sale of Improvement Bonds
Sealed bids for purchase of Improvement Bonds to be issued under date of
August 15, 1953 in the aggregate amount of $475,000.00 were opened and read,
as set forth in the following resolution:

On motion of Trustee Middleton, seconded by Trustee Jorvig, the following
resolution was adopted by unanimous vote'of all Members of the Council present:
RESOLUTION PROVIDING FOR THE ISSUANCE AND SALE OF
IMPROVEMENT BONDS
WHEREAS, pursuant to Resolution adopted by the Village Council on July
16, 1953, authorizing advertisement for bids for Improvement Bonds in the
aggregate amount of $$475,000.00 to be issued under date of August 15, 1953, the
Clerk has advertised for bids for purchase of said bonds in the St. Louis Park
Dispatch July 9, 1953 and in Commercial West July 11, 1953 and in response to
said advertisement the following sealed bids have been received by the Village
Clerk and opened and publicly read at this meeting:

determined to be the highest and best bid and the Mayor and Clerk are hereby
authorized to execute an agreement for purchase submitted by the successful
bidders.
2. Improvement Bond6- 611all be issued by the Village of St. Louis Park in
the total amount of $475,000.00, ,said bonds to be numbered from 1 to 475 both
inclusive in denominations of $13,000.00, dated August 15, 1953, arid _shall. bear
interest at the rate of 3.4 per sent per annum, payable August 15, 1954 and semi-
annually thereafter on the 15th day of February and the 15th day of August in each
year, and shall mature serially_ on February 15th in the years and amounts as-

The said maturities in the judgment of the Village Council are warranted by the

3. Said Improvement Bonds shall be payable at Northwestern National Bank
of Minneapolis, Minnesota, and the reasonable charges of said bank as paying
agent shall be paid by the Village out of said Project Fund.
4. The said Improvement Bonds and said interest coupons thereto attached
shall be in substantially the following form:

to pay to bearer out of Improvement Project No. 501 Fund of the Village the sum of
ONE THOUSAND DOLLARS
on February 15, 1954,.•and to pay interest thereon from the date hereof until the
principal amount is paid at the rate of 3..40 per cent per annum on August 15, 1954
and semi-annually thereafter on the 15th day of February and the 15th day of August
in each year, in accordance with and upon presentation and surrender of the attached
interest coupons as they severally become due. Both principal and interest are
payable at Northwestern National Bank of Minneapolis, Minneapolis, Minnesota, in
any coin or currency of the United States of America which at the time of payment
is legal tender for public and private debts, and to provide money for the prompt
and full payment of said principal and interest as the same become due, the full
faith, credit and taxing powers of the Village have been and are hereby irrevocably
pledged.

S THIS BOND is one of an issue in the total principal amount of $475,
all of like date and tenor except as to maturity, issued by the Village pursuant
to the Constitution and Laws of the State of Minnesota, including M. S. A. 412.401
to 412.481, for the purpose of defraying expenses incurred and to be incurred for
public improvements heretofore contracted or completed by said Village.
IT IS HEREBY. CERTIFIED AND RECITED, that all acts, conditions and things
required by the Constitution and Laws of the State of Minnesota to be done, to
happen, to exist and to be performed precedent to and in the issuance of this bond

7. It is hereby determined that assessments have been or will be levied
against property improved by said public improvements in a sum of not less than
$475,435.84.
8. All assessments collected on account of said improvements shall be paid
into Project No. 501 Fund and shall be made available from time to time as required
for payment of principal and interest of said bonds. The Village Council shall
provide for the payment of principal and interest of any of the bonds issued here-
under out of the funds in the treasury of the Village when the money on hand in
said Project No. 501 Fund is insufficient to meet the payment of maturing
principal and interest. The full faith and credit of the Village of St. Louis-
Park for the payment of the principal and interest of said bonds when the moneys
on hand in said Project Fund No. 501 Fund are not sufficient for the purpose are
hereby pledged.

1. In order to provide money for the construction of sanitation facilities
constituting a garbage disposal plant of the Village there shall be issued, sold
and delivered Garbage Disposal Plant Revenue bonds of the Village in the aggregate
principal amount of Fifty-five Thousand Dollars ($55,000.), said bonds to be 55
in number and numbered from 1 to 55, both inclusive, and in the denomination of
$12000. each, all bearing date August 15, 1953, bearing interest at the rate not
to exceed 5% per annum, payable August 15, 1954, and semi-annually thereafter on
the 15th day of August and 15th day of February in each year, at such rate as
shall be determined upon receipt of bids for the purchase of said bonds and matur-
ing serially in order of serial number, lowest numbers first, $10,000. August 15,
1955 to 19581, both inclusive, and $15,000. August 15, 1959. The said bonds shall
be payable at the main office of the Northwestern National Bank of Minneapolis,
Minneapolis, Minnesota, and the reasonable charges of said bank paying agent shall
be paid as an operating expense of said utility.

This bond is one of an issue in the aggregate principal amount of $5000.,
all of like date and tenor except as to numbers and maturity dates, all issued for
the purpose of providing money for the construction of sanitation facilities
constituting a garbage disposal plant and is issued pursuant to and in full con-
formity with the Constitution and Laws of the State of Minnesota, and is payable
solely from the net revenue of the garbage disposal plant and system of said
Village, being the gross revenue after deducting therefrom the necessary costs
of operation and maintenance, as more particularly defined in the authorizing
resolution, and said bonds constitute a first and prior lien on said net revenue
and the Village shall be relieved of any duty to levy, collect, use or apply
any moneys received or to be received from taxation for the payment of either
principal or interest thereon, except payment of charges for services rendered
to or benefits received by the Village.
IT IS HEREBY CERTIFIED AND RECITED that in and by the authorizing resolution
the Village Council of the Village of St. Louis Park has covenanted and agreed that
it will continue to operate sanitation facilities constituting a garbage disposal
plant as a public utility free from competition by other like utilities and free
from all other or additional liens thereon except as herein provided; that adequate
insurance on said plant and system and suitable fidelity bonds will be procured
and carried; that proper and adequate books of account will be kept showing
receipts and disbursements; that it has established and will maintain a Garbage
Disposal Revenue Fund and has set up therein an Interebt and Sinking Account into
which it will pay monthly out of the net revenue of said utility a sum sufficient
to meet principal and interest requirements and a separate Reserve Account, all
in accordance with the authorizing resolution; that it will impose and collect
rates and charges for services furnished by the utility adequate to meet the above
payments; that no additional or other obligations will be incurred or permitted
to be incurred except .as provided in said authorizing resolution.
IT IS FURTHER CERTIFIED AND RECITED that all acts, conditions and things
required by the Constitution and Laws of the State of Minnesota, and ordinances
and resolutions of the Village of St. Louis Park, to be done, to exist and to
be performed in order to make this bond a valid and binding special obligation
according to its terms have been done, do exist and have been performed as so
required. This bond is not to be included in determining the net indebtedness
of the Village under any constitutional or standard provisions defining or
limiting such indebtedness.

3. The bonds in the form herein provided shall be prepared under the
direction of the Village Clerk and when so prepared shall be executed on behalf
of the Village by the signature of the Mayor and attested by the Clerk and the
interest coupons shall be executed and authenticated by the printed facsimile
signatures of said officers.
4. There is hereby created a separate fund to be called Garbage Disposal
Revenue Fund which shall be maintained by the Village Treasurer until all of the
bonds issued hereunder have been fully paid. All of the income and receipts
arising from the operation of the sanitation facilities constituting a garbage
disposal plant, including the proceeds of special assessments levied against
property in the Village served by the garbage collection service, shall be paid
into said fund. • In accordance with sound accounting practices there shall be
set up and maintained within said fund the following separate accounts to which
shall be credited and debited the income and disbursements of said fund as follows:
(a) A Capital Expenditure account into which shall be paid all moneys
derived from the sale of these revenue bonds and any general obligation bonds
issued for the purpose of financing the garbage disposal plant, or from the sale
of any property acquired for or used in connection with said utility. Out of
said account shall be paid the cost of all corporate improvements, extensions
and changes to said utility including the construction of a garbage incinerator
plant and appurtenances in connection therewith. If at any time any money in
said account is not needed for such purposes it may be transferred to the Interest
and Sinking Account or any such surplus may be kept in a proper bank account,
held as a cash deposit or temporarily invested in United States Government
securities.
(b) An income Account to which shall be credited all receipts and income
from the operation of the garbage disposal plant. Out of said account there
shall be first paid all but only such items as by sound accounting practices cons-
titute normal, reasonable current costs of operation, including costs of necessary
current repairs and replacements and there shall be retained therein such amount
as may be reasonably required for such purpose. The remaining amount in said
account shall constitute and is hereafter referred to as net revenue. Receipts
and income derived from the garbage and refuse collection system of the Village
for the purpose of covering cost of such collection and delivery to the garbage
disposal plant shall not be credited to said account.
(c) An Interest and Sinking Account. From said net revenue there shall
be credited to said account on the first day of March, July and September of each
year thereafter such net revenues as shall be available in the Income Account
in such amount as shall be required to pay principal and interest on all bonds
issued hereunder on February 15th and August 15th following. Said payments shall
be a first and prior charge on said net revenue. Money in the Interest and
Sinking Account shall be used solely for the purpose of payment of principal and
interest on said bonds.
(d) A Reserve Account into which shall be paid the entire net revenue
after payment to the Interest and Sinking Account until there shall be accumulated
therein a reserve equal to one year's interest requirements. Thereafter said
Reserve Account shall be maintained and used only to make up a deficiency when
and if moneys in the Interest and Sinking Account shall be insufficient to pay
the principal of or interest on any bonds issued hereunder. Whenever the moneys
therein are so used the said reserve shall be restored from the next net revenue
available after satisfying current Interest and Sinking Account requirements.
(e) A Surplus Account. All amounts in the Income Account in excess of
those required as herein above set forth for the Interest and Sinking Account and
Reserve Account shall be transferred from time to time to the Surplus Account.
Funds therein may be transferred to any other account or to the Sinking Fund for
general obligation bonds issued to finance construction of the garbage disposal
plant, or may be paid over to the general fund of the Village and used for any
corporate purpose.
5. Until payment of the bonds herein authorized, no additional bonds or
other obligations shall be issued payable from the net revenue of the garbage
disposal plant except as provided in this paragraph. The Village Council may at
any time issue additional revenue bonds or other obligations payable as to
principal and interest from the net revenue of said plant and on a parity with
but not superior as to lien and charge with respect to the revenue bonds of this
issue, provided, first, such additional obligations shall be issued to provide
money to pay for necessary improvements and changes in said utility plant and,

second, the estimated annual net revenue as herein defined for the period
during which the revenue bonds issued hereunder shall mature, as determined
by the Village Engineer of the Village of St. Louis Park upon the basis of the
established rates imposed by ordinance for garbage disposal service of the
Village and upon his determination of operation costs and expenses chargeable
against gross revenue, shall have been in an amount at least one and one-
quarter times the average of the annual principal and interest requirements for
the remainder of the terms of said revenue bonds on all such bonds and other
obligations at any time outstanding, including those so to be issued, and there-
after to be payable from said net nevenue. In addition to the powers above
granted the village may issue revenue bonds on a parity as to lien for the pur-
pose of extending the maturities of any of tfre bonds of this issue then due
whenever there are no funds available for the payment thereof. Nothing herein
shall prevent the issuance of additional revenue obligations payable out of the
Surplus Account and inferior as to lien on the net revenue of the utility.
6. For the protection of the security of the bonds herein authorized the
Village Council hereby covenants and agrees to and with the holders thereof
from time to time as follows:
(a) It will cause the construction of sanitation facilities constituting
a garbage disposal plant, heretofore referred to, to be completed in accordance
with plans and specifications properly prepared by competent engineers and
approved by the Village Council and will use and apply the proceeds from the
sale of the bonds to be issued hereunder to the payment of the cost thereof and
that it will not create any additional or other liens or charges against the
income of the garbage disposal plant except as herein provided.
(b) It will continue to operate the garbage disposal plant as a revenue
producing utility of the Village free from competition by other like utilities
and free from liens and will cause the same to be maintained in good and efficient
operating condition and will not sell or otherwise dispose of any part thereof
unless the same be replaced with some other part of equal utility.
(c) Until the principal and interest on the bonds shall have been paid,
the Village shall give no free service and the Village Council will charge the
Village reasonable rates and charges for services furnished to the Village and
not less than the existing schedule of rates and charges.
(d) It will cause all income and revenue from the operation of said
garbage disposal plant to be credited to the Garbage Disposal Revenue Fund and
will permit no payments therefrom except as herein provided.
(e) It will cause proper and adequate books of record and account to be
kept in which true and correct entries will be made of all charges imposed for
services by said utility and all collections and receipts therefrom and all
expenditures and disbursements. Said books of account shall be open to ins-
pection and copying by any holders of bonds issued hereunder and the Village
Clerk shall, upon request, furnish certified copies of any portion thereof upon
receipt of a reasonable fee therefor. It will cause said books and records to
be audited at least annually by a ceritfied accountant or firm thereof and will
mail copies of such audit to the purchasers and such holders as shall request
the same.
(f) It will procure and keep in force insurance upon the garbage disposal
plant against loss or damage by fire, tornado, windstorm, flood or other causes
customarily insured against and will procure suitable fidelity bonds covering
all employees having custody of any money, such insurance and bonds to be made
with an insurer or insurers in good standing in such amounts as the Village
Council shall determine will be required to protect the Village and the
holders of the outstanding bonds from loss due to any such casualty or mis-
feasance or malfeasance and in event of any such loss the proceeds shall be used
to make good said loss or to retire outstanding bonds.
7. The bonds issued hereunder shall constitute a first and prior lien and
charge upon the net revenue of the garbage disposal plant except as herein pro-
vided without priority or preference of any of said bonds over any other, provided
that in event any payments of principal or interest shall fall due when there is
not sufficient money in the Interest and Sinking Account or in the Reserve Account
to make full payment thereof, all such moneys shall be applied first, to payment
of accrued interest then due and, second, towards payment of principal upon
matured bonds in order of serial number.

8. The Village Council further covenants to continue to impose and collect
rates and charges for services in accordance with existing rates and that it will
not reduce such rates at any time to a point where the net revenue as herein de-
fined shall be less than one and one-quarter times principal and interest require-
ments for the ensuing year and that it will revise such rates from time to time
whenever, and as often as, it may be necessary to make the net revenue sufficient
for the purposes herein described.
9. The holders of twenty per cent or more in aggregate principal amount
of the revenue bonds herein authorized at any time outstanding may, either at law
or in equity, by suit, action or other proceedings protect and enforce the rights
of all holders of revenue bonds outstanding hereunder or enforce and compel the
performance of any or all covenants and duties herein specified on the part of the
Village or its officials to be� performed, including the fixing and maintaining of
sufficient rates, charges and rentals for services of the garbage disposal plant
and the collection and proper segregation of the revenue and the proper applica-
tion thereof.
10. Each and all of the terms and provisions of this resolution shall be
and constitute a covenant on the part of the Village to and with each and every
holder from time to time of the bonds issued hereunder.
11. The bid above described of J. M. Dain & Company to purchase said revenue
bonds at a price of par and accrued interest plus $19.00 premium at the interest
rate of three and one-eighth per cent (3 1/8%) per annum payable August 15, 1954,
and semi=annually thereafter, is hereby determined to be the highest and best bid
and the Mayor and Clerk are hereby authorized and directed to deliver to said
purchaser, upon payment of said purchase price, said bonds in form, with maturities
and in the denominations as hereinbefore specified.
12. The Mayor and Clerk are hereby authorized to execute purchase agreement
submitted by the purchaser.

required by the Constitution and Laws of the State of Minnesota to be done, to
happen, to exist and to be performed precedent to and in the issuance of this bond
have happened, do exist and have been performed in regular and due form, time and
manner as so required; that prior to the issuance hereof a direct annual irre-
pealable ad valorem tax has been duly levied upon all of the taxable property in
said Village for the years and in amounts as required by law, and additional taxes

heretofore agreed upon and the purchaser shall not be obligated to see to the
proper application thereof.
5. There is hereby created a separate sinking fund for said bonds, which
shall be held by the Village Treasurer and used for no other purpose than to
pay principal of and interest on said bonds; provided that if any payment of
principal or interest shall become due when there is not sufficient money in
said fund to pay the same, the Treasurer shall pay such principal or interest
from the general fund of the Village, and said general fund shall be reimbursed
for such advances out of the proceeds of taxes levied pursuant hereto or other
moneys appropriated by the Village Council for such purpose. Into said sinking
fund shall be paid all proceeds of the taxes levied pursuant to this resolution
and such other moneys as may be received by the Village for the purpose of or
appropriated to the payment of said bonds and interest.

direct annual ad valorem tax which shall be spread upon the tax rolls and
collected with and as a part of other general taxes -of the Village, which taxes

equal to interest and principal maturing on said bonds in each year, plus 5%
thereof. —
7. The Village Clerk is hereby authorized and directed to file with the
County Auditor of Hennepin County, Minnesota a certified copy of this resolution
together with such other information as the County Auditor may require, and to
obtain from the County Auditor a certificate that such tax has been levied and
the bonds have been entered upon his bond register.
8. The County Auditor of Hennepin County and the officers of the Village
are hereby authorized and directed to prepare and furnish to the purchaser of
said bonds and to the attorneys approving the same, certified copies of all
proceedings and records of the Village relating to said bonds and to the financial
condition and affairs of the Village, and such other certificates, affidavits
and transcripts as may be required to show the facts within their knowledge, or
as shown by the books and records in their custody and control, relating to the
validity and marketability of said bonds, and such instruments, including any
heretofore furnished, shall be deemed representations of the Village as to the
facts stated therein.
9. The Village Clerk is authorized to secure and furnish to the purchasers
of said bonds at the expense of the Village the opinion of Messrs. Faegre & Benson,
of Minneapolis, Minnesota, certifying as to the validity of the bonds and to
furnish the printed bonds, also at the expense of the Village.
10. The bid of Kalman & Company, Incorporated, Paine Webber Jackson & Curtis,
Harold E. Wood & Company, Juran & Moody and E. J. Prescott & Company is hereby
determined to be the highest and best bid received as above recited and said bid
is hereby accepted. The Village Treasurer is directed to retain the good faith
check of the successful bidder pending sale and completion of the said bonds,
and the Village Clerk is directed to return the checks of unsucessful bidders
forthwith. The Mayor and Clerk are authorized to execute the purchase agreement
submitted by the purchaser and to execute and deliver the bonds when prepared on
or after August 15, 1953.

On motion of Trustee Bolmgren, seconded by Trustee Middleton, the meeting
was adjourned at 12:40 A. M., July 28, 1953, to reconvene on August 1, 1953 at 2:00
P. M., by unanimous vote of all Members of the Council present.

The adjourned meeting of the Village Council of July 27, 1953, was called to
order by Mayor C. L. Hurd at 2:35 P. M.

Hearing on Application for Rezoning (Continued from July 27, 1953)-M. Grossman
Hearing on application of Max Grossman for rezoning Lots 5, 6, and 7. Block
5, Minikanda Vista Second Addition from Residential Use to Commercial Use, continued
from meeting of July 27, 1953 to this present meeting, was resumed. The Council
met on the ground with neighbors and discussed above rezoning. They returned to the
Village Hall and after further discussion, agreed that the matter be brought up again
at the August 3rd meeting,
Waive Hearing on Grading
On motion of Trustee Bolmgren, seconded by Trustee Middleton, the deposit of
$2700.00 made by Ecklund & Swedlund to guarantee assessment for grading of Cedar Lake
Road east of Flagg Avenue and letter accompanying said deposit, dated July 29, 1953,
waiving hearing and notice of hearing on the project were accepted; and letter from
Adolph Fine, Incorporated, dated July 30, 1953, likewise waiving hearing and notice
of hearing on said project was accepted, by unanimous vote of all Members of the
Council.
Plat Approved - West Texa-Tonka Hills Addition
On motion of Trustee Bolmgren, seconded by Trustee Middleton, the plat of
West Texa-Tonka Hills Addition was approved and accepted, and the Mayor and Clerk
were authorized to sign same for the Village, subject to approval of the Village
Engineer and Village Attorney, and the filing of a performance bond in the amount
of $61,000. guaranteeing the grading of streets, by unanimous vote of all Members of
the Council.
Licenses
On motion of Trustee Bolmgren, seconded by Trustee Middleton, the following
applications for 1953 licenses were approved, and the Mayor and Clerk were authorized
to issue licenses to expire December 31, 1953, by unanimous vote of all Members of
the Council:

On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the following bonds
were approved by unanimous vote of all Members of the Council:

December 31, 1953, in the amount of $1,000.00.
