Pfeiffer Construction Co. 33,150.85 On motion of Trustee Middleton, seconded by Trustee Bo]mgren, the above bids were referred to the Village Engineer and Chairman of the Street Department Committee for immediate tabulation and recommendation, by unanimous vote of all Members of the Council present. Hearing on Proposed Sewer Extensions - #53-93 to 53-96 and 53-99 Separate hearings were had on proposed sewer extensions No. 53-93 to 53-96 and 53-99. No one appeared. Resolution On motion of Trustee Bolmgren, seconded by Trustee Middleton, the following resolution was adopted by unanimous vote of all Members of the Council present: RESOLUTION ORDERING SEWER EXTENSIONS WHEREAS, the Village Council has met at the time and place specified in Notice of Hearing published in the St. Louis Park Dispatch July 9 and 16, 1953, relating to sanitary sewer extensions hereinafter described and has heard all interested persons appearing at said meeting, therefore BE IT RESOLVED, by the Village Council of the Village of St. Louis Park that Village Sanitary Sewers be hereby ordered extended at-the following locations in the Village in accordance with plans and specifications which have been pre- pared by the Village Engineer and which are hereby approved. The Clerk is author- ized to advertise for bids for said sewers'to be opened by the Village Council at its meeting August 10, 1953• The Notice above referred to together with estimated costs and area proposed to be assessed as stated therein are hereby approved. The sewer extensions above referred to are described as follows: Improvement Number Location 53-93 Vernon Avenue from West 26th Street to West 252 Street 53-94 Webster Avenue from West 26th Street to West 251 Street 53-95 Xenwood Avenue from West 26th Street to West 25-2L Street 53-96 West 251 Street from Xenwood Avenue to Vernon Avenue 53-99 Lynn Avenue from North Service Drive of Highway No. 7 to Minnetonka Boulevard and Service Drive of Highway No. 7 from Monterey Avenue to Lynn Avenue. July 20, 1953 379 Licenses On motion of Trustee Middleton, seconded by Trustee Bolmgren, the follow— ing applications for 1953 licenses were approved, and the Mayor and Clerk were authorized to issue licenses to expire December 31, 19532 by unanimous vote of all Members of the Council present: R. J. Mangan Company Plumbing Sheppeard's Rotary Sewer Service Scavenger Minnesota•Gas Service Gas Connections. Bonds On motion of Trustee Jorvig, seconded by Trustee Middleton, the following bonds were approved by unanimous vote of all Members of the Council present: GAS INSTALLATION BOND with George Zubick as principal, and United States Fidelity and Guaranty Company as surety, effective July 14, 1953 to expire December 31, 1953, in the amount of $1,000. HEATING LICENSE BOND with Albert Ostrin, dba Ostrin Heating Company as principal, and United States Fidelity and Guaranty Company as surety, effective March 4, 1953 to expire December 31, 1953, in the amount of $1,000. GAS INSTALLATION BOND with Albert Ostrin, dba Ostrin Heating Company as principal, and United States Fidelity and Guaranty Company as surety, effective March 4, 1953 to expire December 31, 19532 in the amount of $1,000. PLUMBING LICENSE BOND with Gust Hoglund as principal, and Commercial Insurance Company as surety, effective January 1, 1953 to expire December 31, 1953, in the amount of $4;000. Permission to Place Poles On motion of Trustee Jorvig, seconded by Trustee Bolmgren, the Northern States Power Company was granted permission to place poles at the following loca— tions within the Village, by unanimous vote of all Members of the Council present: Two (2) Poles at Cedar Lake Road and Blackstone Avenue. Permission to Place Buried Cable, Poles, Anchors, Etc. On motion of Trustee Jorvig, seconded by Trustee Middleton, the Northwestern Bell Telephone Company was granted permission to set three poles and one anchor on Hampshire Avenue between West Lake Street and the National Lead Company, and to make two dig—ups, one at the intersection of West Lake Street and Hampshire Avenue and one on Hampshire Avenue just in front of the National Lead Company as shown on accompanying sketches, by unanimous vote of all Members of the Council present. Gas Main Extension On motion of Trustee Jorvig, seconded by Trustee Middleton, the following gas main extension was approved by unanimous vote of all Members of the Council present: #278 In West 36th Street from Highway #100 to 26, W of W Line of Webster Avenue. In Webster Avenue from West 36th Street to St. Louis Avenue; and in St. Louis Avenue from Webster Avenue to West Line Webster Avenue. Proposed Plat — Murray Lane Addition On motion of Trustee Bolmgren, seconded by Trustee Middleton, the proposed plat of Murray Lane West Addition was referred to the Planning Commission for checking and recommendation, by unanimous vote of all Members of the Council present. Proposed Plat — Cedarwood Second Addition On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the proposed plat of Cedarwood Second Addition, presented by Douglas Rees Associates, was re— ferred to the Planning Commission for checking and recommendation, by unanimous vote of all Members of the Council present. 380 July 20, 1953 � Resolution On motion of Trustee Middleton, seconded by Trustee Bolmgren, the follow- ing resolution was adopted by unanimous vote of all Members of the Council present: RESOLUTION CANCELING 52-209 SANITARY SEWER #499 ASSESSMENT WHEREAS it appears that by resolution of the Village Council adopted September 152 1952, levying assessments for 52-209 Sanitary Sewer #499, the following corner lot was assessed on both Colorado Avenue and on Oxford Street; and whereas said property faces on Colorado Avenue, therefore BE IT RESOLVED by the Village Council of the Village of St. Louis Park that the 1953 installment of such assessment heretofore paid in the respective amount set forth below be refunded to the respective property owner, and, upon receipt of a signed verified claim and a paid tax statement, that the Mayor and Clerk be hereby authorized to issue a warrant in payment of such refund to the respective property owner. BE IT FURTHER RESOLVED that the assessment for years 1954 thru 1962 here- tofore levied against the following property be canceled, and that the Auditor and the Treasurer of Hennepin County be hereby authorized to cancel the same upon their respective records. Improvements On motion of Trustee Bolmgren, seconded by Trustee Middleton, the following petitions were referred to the Village Engineer, Chairman of the Sewer,, Depart- ment Committee, and Special Assessment Department, for checking and recommenda- tion, by unanimous vote of all Members of the Council present: P-1321 PETITION FOR SANITARY SEWER, signed by Harold Holland, 2845 Louisiana Avenue and others, dated July 20, 1953, for the construction of sanitary sewer in LOUISIANA AVENUE FROM MINNETONKA BOULEVARD TO 28TH STREET. Petition for Street Improvement On motion of Trustee Middleton, seconded by Trustee Bolmgren, the following petition was referred to the Village Engineer, Chairman of the Street Department Committee, and Special Assessment Department, for checking and recommendation, by unanimous vote of all Members of the Council present: i P-1322 PETITION FOR CURB AND GUTTER, signed by Merton R. Ellenberg, 3044 Oregon Avenue and others, dated July 20, 1953, for the construction of curb and gutter on the WEST SIDE OF OREGON AVENUE FROM MINNETONKA BOULEVARD TO 31ST STREET. Report on House -Inspection Report signed by Building Inspector, P. Stienstra, and Health Officer, Dr. H. W. Darby, M. D., dated July 16, 1953, on inspection made of house at 3625 Sumter Avenue, stating that same may not be occupied until necessary repairs and remodeling has been done, was read and referred back to the signers for further information. Bid Award - Street Grading On motion of Trustee Bo]mgren, seconded by Trustee Jorvig, the bid of Western Underground Construction Company received earlier this meeting was de- termined to be the best and lowest bid of a responsible bidder, for the grading of LOUISIANA AVENUE FROM WEST 27TH STREET TO CEDAR LAKE ROAD, INCLUDING THE GRADING OF APPROACHES TO BRIDGE UNDER CONSTRUCTION OVER THE GREAT NORTHERN RAIL- WAY RIGHT-OF-WAY, and the Mayor and Clerk were authorized to execute contract for the Village with the Bidder for the work at price bid of $24,940.50, by unanimous vote of all Members of the Council present. July 20, 1953 381 Partial Payments On motion of Trustee Bolmgren, seconded by Trustee Middleton, the following partial payments on contract work in progress, presented by Village Engineer, Phil W. Advertising Suns Approved - Meyers On motion of Trustee Bolmgren, seconded by Trustee Middleton, the reappli- cation of Meyers Outdoor Advertising Company, dated July 132 1953, for permits to erect two advertising signs 10' x 401, at the SW Corner of St. Louis Park Theatre Company's 6.17 acres property on Highway No. 7 (original application for same was denied by Village Council on June 8, 1953), was approved by unanimous vote of all Members of the Council present. Request of Engineering Department to Advertise for Bids for Retaining Wall Village Engineer, Phil W. Smith requested authorization to advertise for bids for construction of retaining wall at 3048 Nevada Avenue and adjacent property, the estimated cost of same being approximately $ 800.00. Cash Settlement Offered in Lieu of Retaining Wall On motion of Trustee Bolmgren, seconded by Trustee Middleton, the Village Engineer was authorized to offer a cash settlement of $ 250.00 (not to exceed $300.00) in lieu of retaining wall at 3048 Nevada Avenue and adjacent property, by unanimous vote of all Members of the Council present. Letter Re: Filling Lot on SW Corner Quebec & Minnetonka Boulevard - A. Fine Letter from Adolph Fine, Incorporated, dated July 17, 1953, stating that he has filled in the lot on the SW Corner of Quebec Avenue and Minnetonka Boulevard which was used as drainage basin by the Village, Etc., was read and ordered filed. Letter Re: Water Hole in Street - J. Flie�al Letter from Joe Fliegel, 4120 Sunset Boulevard, dated July 13, 1953, regard- ing "a deplorable condition existing in the street in front of his home. Water stands there all the year round from either rain, snow or watering of lawns up on Inglewood Avenue, or Sunset Boulevard", was read. On motion of Trustee Jorvig, seconded by Trustee Bolmgren, the above matter was referred to the VE for inspection and recommendation, by unanimous vote of all Members of the Council present. Hearing Date Set for Stabilized Oil Base 0 On motion of Trustee Middleton, seconded by Trustee Jorvig, August 10, 1953 was set as date for hearing on the application of stabilized oil base to Blackstone Avenue from Cedar Lake Road to West 16th Street, by unanimous vote of all Members of the Council present. 382 July 20, 1953 Resolution On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the follow- ing resolution was adopted by unanimous vote of all Members of the Council present: RESOLUTION SETTING HEARING ON PROPOSED ACQUISITION AND EXTENSION OF STREETS BE IT RESOLVED by the Village Council that the Clerk be directed to publish Notice of Hearing of the Council Meeting to be held August 3rd, 1953 on the proposed extension and acquisition of West 29th Street from Texas Avenue to Pennsylvania Avenue and Pennsylvania Avenue to West 28th Street. The Engineer's estimate of the cost of said acquisition is $100.00 ,and the proposed area to be assessed is the tracts of land adjacent'to said streets to be acquired is hereby approved. Resolution On motion of Trustee Jorvig, seconded by Trustee Holmgren, the following resolution was adopted by unanimous vote of all Members of the Council present: RESOLUTION ORDERING STORM SEWER CONSTRUCTION WHEREAS, the Village Council met at the time and place specified in the Notice published in the St. Louis Park Dispatch August 21 and 28, 1952 relating to storm sewer No. 52-405 having heard all interested persons regularly referred said consideration of said proposed storm sewer to a Committee of the Whole, and the report of the Committee of the Whole having been received by the Council recommending said improvement, therefore BE IT RESOLVED by the Village Council that Storm Sewer No. 52-405 be hereby ordered to be constructed along the South 10 feet of the North 50 feet of Lot 37, Block 1, Highwood Tract, Lake Forest Addition, in accordance with plans and speci- fications prepared by�the Village Engineer which are hereby approved, and it appearing that said project will cost less than $1,000.00, the Street Commissioner ordered to proceed with the work. Resolution On motion of Trustee Middleton, seconded by Trustee Bolmgren, the follow- ing resolution was adopted by unanimous vote of all Members of the Council:present: RESOLUTION SETTING HEARING FOR PROPOSED STORM SEWER AND GRAD PROJECTS S � WHEREAS, it appears to the Village Council upon report from the Village Engineer that it is necessary to grade West 25th Street from Inglewood Avenue to France Avenue, and Huntington Avenue from 26th Street to 25th Street and to construct a storm sewer in France Avenue from 25th Street to a point approximately 60 feet North of 24th Street, therefore BE IT RESOLVED by the Village Council that the Clerk be directed to publish Notice of Hearing on said proposed improvements to be held at the Council Meeting August 3, 1953 and the Engineer's estimate of cost in the sum of $3,800.00 for said grading and $9,000.00 for said storm sewer together with area proposed to be assessed as follows be hereby approved: An area, the boundary of which is as follows: Commencing at the inter- section of the center line of West 24th Street with its intersection with the boundary between the City of Minneapolis and the Village of St. Louis Park; thence South along said boundary to the point of intersection with said boundary of the center line of West 26th Street; thence Westerly along the center line of West 26th Street to the center line of France. Avenue; thence South to the center line of West 26th Street; thence West along said center line of West 26th Street to point of intersection of said line with the rear lot lines of Lots 1 to 5, Block 8, Basswood ex- tended South; thence North along said rear lot lines to the Northwest corner of said Lot 1; thence West along the North line of Lot 10, said Block 8 to the West line of Joppa Avenue; thence North along said West line of said Joppa Avenue and the same extended North along the Westerly line of Lot 8, Block 1, Cedarwood, Lot 1, Block 2, and Lots 22, Block 1, Basswood to the center line of West 24th Street; thence East along the center line of West 24th Street to the point of beginning. Minutes The minutes of meeting held July 13, 1953 were read. On motion of Trustee Bolmgren, seconded by Trustee Middleton, the minutes of meeting held July 13� 1953 were approved as read by unanimous vote of all Members of the Council present. July 20, 1953 383 Special Permit to Extend Garage - M. L. Gordon M. L. Gordon, 2824 Vernon Avenue appeared and requested a permit to extend his present garage 2 feet to make a double garage. This extension will bring the building to within 2 feet of his north property line. The house on the lot north of him is approximately 12 feet north of their south property line, and the ex- tension of his garage two feet in that direction will bring the distance between the garage and said house on the north to 14 feet. On motion of Trustee Jorvig, seconded by Trustee Middleton, a special permit was granted to M. L. Gordon to extend his present garage 2 feet, with the under- standing that a letter from the property owners on the north (signed by both husband and wife) be filed with the Building Inspector to the effect that they are not opposed to this extension, by unanimous vote of all Members of the Council present. Motion Amended Re: Permit to Build Commercial Building - M. Arneson On motion of Trustee Bolmgren, seconded by Trustee Middleton, the motion passed by the Village Council on July 6, 1953 relating to a permit to build a commercial building to Morten Arneson was amended to read as follows to conform to the intent of the Council --- ON MOTION OF TRUSTEE BOLMGREN, SECONDED BY TRUSTEE MIDDLETON, THE ISSUANCE OF A BUILDING PERMIT TO MORTEN ARNESON TO BUILD A COMMERCIAL BUILDING FOR RETAIL PURPOSES ON THAT PORTION OF HIS PROPERTY NOW ZONED WITHIN THE COMMERCIAL USE DISTRICT AT 4951 EXCELSIOR BOULEVARD ADJACENT TO QUENTIN AVENUE AND EXCELSIOR BOULEVARD, SUBJECT TO COMPLIANCE WITH ZONING AND BUILDING ORDINANCE REGULATIONS AND DEDICATION OF EASTERLY 20 FEET ADJACENT TO QUENTIN AVE. FROM EXCELSIOR BOULEVARD TO WEST 40TH STREET AS A PUBLIC STREET, was passed by unanimous vote of all Members of the Council present., Letter Re: Relief from Sewer Assessment Letter from William T. Mohn, 4531 West 362 Street, dated July 15, 19532 requesting some relief in the payment of assessment for proposed sewer in West 362-1 Street adjacent to his property with 200 ft. frontage, was read. On motion of Trustee Middleton, seconded by Trustee Bolmgren, the above matter was referred to the Village Engineer and-Village Assessor for checking and recommendation at the time of assessment hearing, by unanimous vote of all Members of the council present. Bid-Award - Duplicator On motion of Trustee Bolmgren, seconded by Trustee Middleton, the bid of H. A. Rogers Company received June 8, 1953, for One (1) Model No. 251, Davidson duplicator in the amount of $2,674.00, and equipment for same in the amount of $163.75, was determined to be the best bid of a responsible bidder, and the Clerk was authorized to issue purchase order for same at the amount bid, ($2,837.75 total) by unanimous vote of all Members of the Council present. Letter Terminating Permit to Drain Durface Water - K. S. Child Letter from K. S. Child, dated July 13,•1953, stating that he wishes to terminate his permit with the Village to use Lots 13 and 15, Block 11, Mc Nair Park (located between Drew Avenue and France Avenue, near West 24th Street) to drain surface water, was read. On motion of Trustee Bolrpgren, seconded by Trustee Middleton, the above matter was referred to the Village Attorney and Village Engineer for checking and report, by unanimous vote of all Members of the Council -present. Letter from Building Inspector to T. 0. Wassen Condemning Use of Property Copy of letter from Building Inspector, Peter Stienstra and Health Officer, Dr. H. W. Darby, M. D. to Theodore 0. Wassen, 3463 Alabama Avenue, dated July 17, 1953, on their inspection of premises on the South 301 of Lots 4 and 5, and North 81 of vacated alley, Block 13, St. Louis Park Addition, condemning the building on said property, was read. The Building Inspector was instructed to make a report to the Village Council on August 10, 1953, if the condition of above premises has not been improved to the satisfaction of the Building Department, Village Engineer's Recommendation for New Sidewalk The Village Engineer reported that on June 22nd the Village Council agreed to allow the sidewalk on France Avenue between Randall and West 34th Street moved out from the property line a distance of 41611; and that since this is contrary to our established standards, it was investigated, and it appears that this is not the best solution and will most likely not be satisfactory to all residents. He feels that it is best to install new sidewalk according to established standards. On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the foregoing matter was referred to the Village Attorney and Village Engineer to secure releases from every property owner prior to starting any work, by unanimous vote of all Members of the Council present. 384 July 20, 1953 ' Bid Award - Lift Station at Natchez and 3(z Street & Sanitary Sewer 53-56. 57 P. On motion of Trustee Bo]mgren, seconded by Trustee Middleton, the bid of Phelps-Drake Company, Incorporated received June 15, 1953, for the construction of Sanitary Sewer Jobs 53-56 and 53-57, and Lift Station at Natchez Avenue and 362 Street, was determined to be the lowest bid of a responsible bidder, and the Mayor and Clerk were authorized to execute contract for the Village with Phelps- Drake Company, Inc. for the work at the price bid of $74,606.10, by unanimous vote of all Members of the Council present. Letter Re: Offer of $1,500 for Park Purposes Letter from Attorney Vincent Johnson for Clarence K. Bros, Incorporated, dated July 152 1953, concerning the offer made by the Village in their letter dated July 1, 1953 of $1,500 for certain property located in the area of 33rd Street and Kentucky Avenue (Lots 21 to 24, Block 207, Rearrangement of St. Louis Park), was read and referred to the Park Board for checking and recommendation. Letter Re: Primary Elections - Village Attorney, E. T. Montgomery Letter from Village Attorney, E. T. Montgomery, dated July 132 1953, re- garding primary elections in a Village having voting machines, was read and ordered filed. Request to Move Fire Hydrant and Lower Lift Station Richard Moldestad appeared and requested that fire hydrant and lift station at 26th Street and Webster Avenue be lowered. The matter was referred to the Village Engineer who reported that the fire hydrant could be lowered if Mr. Moldestad will assume the entire cost, but that nothing could be done about lowering the lift station. Transfer Cost of Tar Mat to Mtka. Paving Job On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the cost of application of tar mat to West 28th Street from Joppa Avenue to Toledo Avenue was transferred to the Minnetonka Boulevard paving job, by unanimous vote of all Members of the Council present. Telephone Calls on Saturdays, Sundays, Evenings, and Holidays Trustee Jorvig reported that the Fire Department receives many telephone calls on Saturdays, Sundays, Evenings, and Holidays not pertaining to fires, etc. which should go to other Village Departments. The Clerk was instructed to have each Village Department designate someone from their Department to whom these calls can be referred to. Radio Equipped Cars to Report in and Out Trustee Jorvig reported that Village radio equipped cars fail to report when they are on and off the air. The Clerk was instructed to instruct all Departments using radio equipped cars that the drivers of these cars must report when they are on and off the air. Fire Civil Service Examination Ordered On motion of Trustee Jorvig, seconded by Trustee Bolmgren., the Clerk was advised to instruct the Fire Civil Service Commission to hold examination for common fireman and prepare a certified eligible list, by unanimous vote of all Members of the Council present. Barricades On motion of Trustee Bolmgren, seconded by Trustee Middleton, the Village Engineer was instructed to write to all Building, Plumbing, Sewer and Water Contractors concerning the proper placing of barricades and flares while working on Village Streets, By unanimous vote of all Members of the Council,present. Letter Re: Claim for Damages Freeland W. Harlow Letter from Freeland W. Harlow, 6Q19 Minnetonka Boulevard, dated July 15, 1953, with reference to his claim for damages to his property due to the Minne- tonka Boulevard paving, was read and referred to the Village Engineer for check- ing and report. Petition for Grading Alley On motion of Trustee Middleton, seconded by Trustee Bolmgren, the following petition, signed by Mr. and Mrs. Herbert- Dahl and others, dated July 21, 1953, was referred to the Village Engineer and Chairman of the Street Department Committee for checking and recommendation, by unanimous vote of all Members of the Council present: July 20, 1953 385 Petition for Grading Alley, Continued 'We hereby petition the Village Council for appropriate action by the Council in our behalf for the following need: The Health Department recommends the leveling and grading of an Alley in Block 4, Jeffrey James Fine Addition, located be- tween Texas and Sumter Avenues and 29th and 28th Streets because of inadequate drainage, resulting in a contaminated area (flies, mosquitoes and stagnant water). The Contractor Adolph Fine, having been contacted by the Health Department, has done nothing since being contacted in the above matter, and we hereby petition for appropriate action on the part of the Council." Letter Re: Guard Rail at Mtka. & Quebec, Etc. Henn. Co. Highway Dept: Letter from Assistant County Highway Engineer, L. P. Pederson, dated July 103 1953, stating that a guard rail will be placed at Minnetonka Boulevard and Quebec Avenue; also at embankment at Minnetonka Boulevard and Minnehaha Creek, within the next 30 days was read and referred to the Village Engineer to report back to the Council when the work has been completed.
