REGULAR MEETING JULY 13, -1953
A regular meeting of the Village Council was called to order by Mayor C. L.
Hurd at 8:00 P. M.

Petition Opposing Construction of Store Building
,it Quentin Avenue and Excelsior Boulevard
Mr. C. L. Stone, 4015 Quentin Avenue presented a petition signed by himself
and 264 others in the area, opposing the construction of a store building for the
National Tea Company at 4951 Excelsior Boulevard (Corner of Quentin Avenue and
Excelsior Boulevard). Petition was read. He said the establishment of a grocery
store at this location would create new traffic hazards in an area already the
worst in the Park, and will jeopardize the lives of both adults and children
living on adjoining streets.
Mr. Robert Erstad, Attorney for the group reviewed the procedure used in
the granting of the permit for the building. Mr. John Pomeroy, 3965 Quentin Ave-
nue, and about fifty other residents from the area appeared in opposition to this
building. Mayor Hurd outlined the procedure one follows in securing a permit
for a commercial building, stating that the applicant must comply, and then the
Village Council has no alternative but to issue same when property is properly
zoned.
Mr. Stone stated that Quentin Avenue is too narrow, and trucks will have
a hard time to make the turn to get in. They do not want the street widened.
Said restriction of trucks only would not be sufficient. Mr. Clyde Russ, 4900
Vallacher said they were opposed to the using of residential property for parking
back of the store building. Also that the residents on Vallacher Avenue were
opposed to the extension of Vallacher Avenue from Quentin to Wooddale. Mayor
Hurd said that Vallacher Avenue will not be'extended.
On motion of Trustee Bolmgren, seconded by Trustee Jorvig, it was agreed
that Mr. Stone would be notified when the plans for the proposed building, and
plot plans showing the location of the building, screening, etc. are ready for
the_Council's approval, prior to issuing the permit; also that he will be notified
of any petitions for rezoning of the property nearby which will affect the use
of said building, by unanimous vote of all Members of the Council ,present.
Licenses
On motion of Trustee Jorvig, seconded by Trustee Middleton, the following
applications for-1953 licenses were approved, and the Mayor and Clerk were author-
ized to issue licenses to expire December 31, 19532 by unanimous vote of all
Members of the Council present:

Bonds
On motion of Trustee Jorvig, seconded by Trustee Bolmgren, the following
bonds were approved by unanimous vote of all Members of the Council present:
' GAS INSTALLATION BOND with Roy Dahl, DBA Dahl's
Gas Heating as principal, and United States Fidelity
and Guaranty Company as surety, effective June 291th,
1953 to expire December 31st, 1953, in the amount of
$1,000.00.
HEATING LICENSE BOND with Walter Olek and Jake Takato
as principals, and Fireman's Fund Indemnity Company
as surety, effective July 6, 1953 to expire December

GAS INSTALLATION BOND with Walter Olek and Jake Takato
as principals, and Fireman's Fund Indemnity Company as
surety, effective July 6, 1953, to expire Deeember 31,
1953, in the amount of $1,000.00.
CONTRACTORS BOND with Phelps-Drake Company, Incorporated
as principal, and Fire Association of Philadelphia as
surety, effective June 24, 1953, in the amount of _
$28,904.90, covering construction contract for sanitary
sewer improvements Nos. 53-51 thru 53-55 inclusive in the
Village of St. Louis Park.
Application for License to Drive Taxicab
On motion of Trustee Middleton, seconded by Trustee Bolmgren, the application
of Harold Oszman, 7821 Lyndale Avenue South, Minneapolis, for a license to drive a
taxicab for St. Louis Park Radio Cab Company, in the Village, was approved by un-
animous vote of all Members of the Council present.
Partial Payment on Contract Work
On motion of Trustee Holmgren, seconded by Trustee Middleton, the following
partial payment on contract work in progress, presented by Village Engineer, Phil
W. Smith, was approved, and the Mayor and Clerk were authorized to issue warrant
covering same, by unanimous vote of all Members of the Council present:

On motion of Trustee Jorvig, seconded by Trustee Bolmgren, the following
resolution was adopted by unanimous vote of all Members of the Council present:

RESOLVED by the Village Council that the foregoing list of Improvement
Projects ordered by the Village Council in previous years which have not as yet
been undertaken be hereby canceled.

Report of activities for June, 1953, of Rural Hennepin Public Health Nursing
District, was read and ordered filed.

Reinhard Brothers Proposed Office and Warehouse Building
Martin J. Ward, Attorney for Reinhard Brothers Company appeared and t
submitted a plot plan showing the location of building, planting screen, parking
lots and turn-around, for proposed office and warehouse building to be cons-
tructed at Joppa Avenue and Highway No. 7 (South Side).
Ordinance No. 424
On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the following
ordinance was adopted by unanimous vote of all Members of the Council present:
ORDINANCE NO. 424
AN ORDINANCE AMENDING THE ZONING ORDINANCE OF
THE VILLAGE OF ST. LOUIS PARK
The Village Council of the Village of St. Louis Park ordains:
Section 1. Section 2 of the Zoning Ordinance of the Village of St. Louis
Park adopted by the Village.Council January 20, 1932 as heretofore amended,
together with the Use District maps referred to therein is hereby amended by
deleting from the Residence Use District the following described property:
Lot 12, Block 2, Manhattan Park First Addition; and that
portion of the area lying west of Joppa Avenue north of the
M. & St. L. Right-of-Way, east of the east lot lines of Lots
71 $, and 9. Fernhill, and south of State Highway No. 7 which
is now zoned Residential and which lies south of a line
drawn parallel with the south line of said Residential zone
and which intersects the west line of the tract above described
at a point 65 feet south of the northwest corner thereof,
and including the same within the Light Industrial Use District; and that portion
of the above area lying north of said line drawn parallel to the south line of
said Residential zone shall be deleted from the Residence Use District and in-
cluded in the Commercial Use District, all on condition and provided, however,
that
(a) No building or other structure shall be erected within 30
feet of the southerly right-of-way line of State Highway No. 7.
(b) No building or other structure shall be erected on said premises
within 20 feet from the westerly line of Joppa Avenue as the same
shall be dedicated upon acceptance of the deed widening said street
hereinafter provided for.
(c) The owner of the tract above described shall execute and deliver
to the Village a sufficient conveyance to the Village for use as a
public street the East 30 feet of the premises above described lying
North of the South line of Lot 11, Block 2, Manhattan Park First
Addition extended west, said conveyance to be for the purpose of dedi-
cating the full 60 feet right`=of-way for Joppa Avenue North of said South
line of Lot 11.
(d) The owners of said premises shall also convey to the Village for
use as a public street to serve as a turn-around at the terminus of
. Joppa Avenue a circular tract of land with a radius of 50 feet centered
on the center line of Joppa Avenue (after dedication of the full 60-
foot width) and which circular tract shall be tangent to the Southwest
corner of said Lot 11, Block 2, Manhattan Park First Addition.
(e) The owners of said premises shall execute an agreement in writing
with the Village of St. Louis Park wherein said owners shall undertake
and agree to plant and maintain for at least twenty-five years such
shrubs and trees on said premises as shall provide a screen between said
premises and the adjacent residential property, and which planting screen
shall extend along the North line of Lot 121, Block 2, Manhattan Park
First Addition, and also shall extend along the westerly line of Joppa
Avenue from a point 30 feet South of Highway No. 7 to the South line of
Lot 11, said Block 2, extended west. Such shrubs and trees to be planted
are as indicated on the plat submitted by the applicants for rezoning and
which is on file with the Village Clerk, and to grade and apply tar mat
surface to Joppa Avenue from Highway No. 7 to the said turn-around. Upon
compliance with the foregoing conditions the above described premises shall
be subject to all the regulations and restrictions of said Light Indus-
trial Use District and Commercial Use District as herein provided.

C. A. Carlson Re: Sidewalk. Curb & Gutter Bids
Mr. C. A. Carlson, Contractor, inquired about the bid award for sidewalk,
curb and gutter, the bids for which were taken June 8th and 15th. Mayor Hurd read
the minutes of meeting held July 6th concerning this matter.
Planning Commission's Report on Request for Rezoning - Mrs. J. Carl Johnson
Planning Commission's report dated July 8, 1953, on the request of Mrs. J.
Carl Johnson, 1332 Zarthan Avenue, to rezone 1.96 acres of land located on the SW
corner of Louisiana Avenue and Wayzata Boulevard (S2 Section 5, Township 117,
Range 21), except that which is not already so zoned, from Residential Use and Open
Development Use, to Commercial Use, was read. No action was taken at this time
as it was agreed that same should be acted upon with other rezoning in that area
at a later date.
On motion of Trustee Middleton, seconded by Trustee Bolmgren, the Planning
Commission was instructed to prepare their recommendation for rezoning the South
Side of Wayzata Boulevard from Dakota Avenue to Pennsylvania Avenue, including a
sketch of same, by unanimous vote of all Members of the Council present.
Hearing Date Set for Surfacing Streets
On motion of Trustee Bolmgren, seconded by Trustee Middleton; August 10,
1953 was set as date for hearing for resurfacing the following streets, by unani-
mous vote of all Members of the Council present:

Petition for Street Light
Petition signed by Walter Kildahl, 1500 Zarthan Avenue and others, dated
July 1, 1953, requesting the installation of a street light at the corner of
Wayzata Boulevard and Zarthan Avenue, was read.
Street Light Ordered
On motion of Trustee Jorvig, seconded by Trustee Bolmgren, the Northern
States Power Company was ordered to place a street light at the corner of Wayzata
Boulevard and Zarthan Avenue, by unanimous vote of all Members of the Council
present.
Dust at Bus Turn-around - 29th & Idaho
Hyman S. Shanfield, 2921 Idaho Avenue and others appeared regarding the
vast amount of dust caused by buses at the turn-around, and asked if a tar mat
could be applied.
On motion of Trustee Bolmgren, seconded by Trustee Middleton, the Village
Engineer was instructed to have a heavy tar mat applied to above area at no cost
to the property owners adjacent to same, by unanimous vote of all Members of the
Council present.
Condition of T Alley
Hyman S. Schan€field, 2921 Idaho Avenue complained about the narrowness of
T Alley between Hampshire and Idaho Avenues and Minnetonka Boulevard and 29th
Street - said it was almost impossible to turn around. Trustee Middleton was
instructed to check this and make a report to the Council on July 20th.
Complaint Re: Speeding Up Engines to Make Turn-Around
Hyman Schanfield, 2921 Idaho Avenue and others, complained about the noise
and fumes caused when' the buses speed up to' make the turn-around at 29th and Idaho.
Onimotion of Trustee Bolmgren, seconded by Trustee Middleton, the Clerk was
instructed to write a letter to the Twin City Lines about this complaint, by un-
6imous vote of all'Members of the Council present.
Minutes
On motion of Trustee Bolmgren, seconded by Wrustee Middleton, the minutes
of meeting held July 6, 1953 were read and approved as read, by unanimous vote of
all Members of the Council present.

Storm Drain - West 34th between Xylon & Yukon
John Hanson, 3341 Xylon Avenue and others appeared regarding storm drain
on West 34th Street between Xylon Avenue and •Yukon Avenue.
Resolution
On motion of Trustee Bo]mgren, seconded by Trustee Jorvig, the following
resolution was adopted by unanimous vote of all Members of the Council present:
RESOLUTION SETTING HEARING FOR PROPOSED STORM DRAIN
BE IT RESOLVED that hearing be set on proposed storm drain under West
34th Street between Xylon Avenue and Yukon Avenue for Council meeting July 27,
1953 and the estimated cost of $515.00 is hereby approved, together with
proposed area to be assessed as follows:
The area proposed to be assessed for said improvement
is Block 2, 3 and 4, Ruth Ldvitch Addition, Blocks 2,
3 and 4, Donnybrook Terrace First Addition and Blocks
1, 2 and 3, Oak Hill Manor.
Storm Water in Street
I. S. Joseph, 2525 France Avenue South, and Mr. B. Rubin, 2425 France
Avenue South appeared r6garding the accumulation of rain water in the street in
the vicinity of 25th and France. Said that since the barricade was put there,
they can't get in or out of his garage, and the cars drive around the barricade
over Mr. Rubin's yard. Mr. Rubin said that a month ago he was promised something
would be done about this. Trustee Middleton reported that he and Village
Engineer, Phil W. Smith checked on this condition, and are recommending that a
storm sewer be put in.
Hearinp, Date Set for Storm Sewer
On motion of Trustee Middleton, seconded by Trustee Jorvig, August 3rd,
1953 was set as date for hearing on proposed construction of storm sewer in the
area of 25th Street and France Avenue South, by unanimous vote of all Members
of the Council present.
Advertise for Bids for Storm Sewer
On motion of Trustee Middleton, seconded by Trustee Jorvig, the Clerk was
instructed to advertise for bids for the construction of storm sewer in the area
of 25th Street and France Avenue, to be opened on meeting of August 3, 1953, by
unanimous vote of all Members of the Council present.
Bailing Sand out of Well #6
Water Superintendent, Ira M. Vraalstad reported that the sand in Well #6
was keeping the water pressure down to 20 pounds, and that same would have.to be
bailed out. He presented two estimates from Well Contractors — one from
Layne-Minnesota Company and one from Max Renner Well Company, Inc., which were
read.
On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the Mayor and
Clerk were authorized to execute contract for the Village with the Max Renner
Well Company for bailing out Well #6 , and making other necessary repairs accord-
ing to the following prices quoted in their letter dated July 13, 1953, by-un-
animous vote of all Members of the council present:
"Setting Up Equipment - $ 12.00 per hour
, Removing pump 12.00
(Bailing out well 12.00
Cement if used cost plus 15%
Pump repairs it if 15%
Shop work 3.50 per hour."

Letter Re: Lots Used for Drainage Basins - Adolph Fine Inc.
Letter from Adolph Yine., Inc., dated July 10, 1953, concerning their two
lots - one located at the-SW Corner of Minnetonka Boulevard and Quebec Avenue, and
one located at the NW Corner of Minnetonka Boulevard and Quebec Avenue, which
are being used by the Village as drainage basins, was read.
On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the Clerk was
authorized to advise Mr. Fine that the Village Council has no objection to his
filling in the lot at the SW Corner of Minnetonka Boulevard and Quebec Avenue but
would like to use the lot at the NW Corner of Minnetonka Boulevard and Quebec
Avenue for drainage until a storm sewer can'be developed for that area, by unani-
mous vote of all Members of the Council present.

Meeting Adjourned
On motion of Trustee Bolmgren, seconded by Trustee Middleton, the meeting
was adjourned at 12:30 A. M., July 14, 1953, by unanimous vote of all Members of
