Invocation was given by Reverend Paul Obenauf of Wooddale Luthern Church. Bids for Curb and Gutter As advertised in the St. Louis Park Dispatch June 4, 1953, sealed bids were received and publicly read for the furnishing of labor and materials for curb and gutter, Improvements 51-115, 51-116, 52-406 to 52-408, 52-410, 52-411, 52-430 to 52-437 inclusive and 52-4, from the following bidders: 1. Hearing on Proposed Street Improvement A hearinglwas had on proposed improvement of Ottawa Avenue from 38th Street north 293 feet by application of tar mat. No persons appeared. Resolution On motion of Trustee Middleton, seconded by Trustee Bolmgren, the follow- ing resolution was adopted by the unanimous vote of all Members of the Council present: RESOLUTION ORDERING STREET IMPROVEMENT June 15, 1953 Resolution Ordering Street Improvement, Cont'd. WHEREAS, the Village Council has met at the time and place specified in the notice published in the St. Louis Park Dispatch June 4 and 11, 1953, relating to the street improvement hereinafter described, has heard all interested persons appearing at said meeting and determined the necessity for said improvement, and the Village Engineer has filed his approval of the project and estimated cost in the sum of $350.00, therefore BE IT RESOLVED by the Village Council of the Village of St. Louis Park that improvement of Ottawa Avenue from 38th Street north 293 feet by application of tar mat, in accordance with the plans and specifications which have been prepared by the Village Engineer and which are hereby approved, is hereby ordered, the work to be done by the Street Commissioner. BE IT FURTHER RESOLVED that this proceeding is under authority of Chapter 398, Laws of 1953• Petition Protesting Activities of Automobile Agency Victor E. Broden, 3730 Joppa Avenue presented the following petition dated June 15, 1953: TO THE HONORABLE VILLAGE COUNCIL OF THE VILLAGE- OF ST. LOUIS PARK: Gentlemen: We, the undersigned, do hereby protest to the following activities on Joppa Avenue from 3700 South, of the Archie Walker, Jr., Imported Automobile Agency located at 4317 Excelsior Boulevard: 1. Showing cars for the purpose of sale, at the curb in front of our homes. 2. Parking cars on Joppa Avenue for hours at a time (some have stood from Friday evenings until Monday mornings). 3. Unloading of auto carriers on Joppa Avenue 4. Excessive speeding and racing of engines when road testing and demonstrating cars on Joppa Avenue. 5. Excessive roaring of engines caused by so—called "straight pipes" when testing cars in rear of Agency and when driving on the street. These activities are very different to contend with in our everyday living, they are a hazard to our children that must cross our street and also ride bicycles to and from school and the markets; they are also causing a great devaluation of our property. We hereby petition your honorable body to help us to improve our living conditions, protect our families and our investments in our homes. (Above petition signed by R. J. Gjerde; 3741 Joppa Avenue and sixteen (16) others) Mrs. V. E. Broden said they tried to contact Archie Walker, Jr. to discuss this matter, but have been unable to do so. The Police claim they can do nothing. They unloaded a car carrier Sunday afternoon, June 14, 1953 at 3 in the afternoon. They are making a race tract out of our residential -streets. Acting Mayor Jorvig asked if the Police Department could enforce traffic tickets given for violation of residential parking only. Village Attorney, E. T. Montgomery said yes, of the -Council orders this restriction. Mr. Broden asked if the Clerk or Council knows what business goes in and if they gave permits or licenses for same. The Village Attorney stated that licenses or permits are not required of Car Dealers. On motion of Trustee Bolmgren, seconded by Trustee Middleton, this matter was referred to the Village Attorney to see what can be done to help take care of these complaints, and take the necessary action to do. so, by unanimous vote of all Members of the Council present. Building Inspector's Weekly Report The Building Inspector's report for week ending June 12, 1953 showing that 34 building permits were issued totaling $219,455.00, was read and ordered filed. 332 June 15, 1953 0- Petition Petition Ob.iecting to Proposed Used Car Lot Peter Nisser, 3761 Kipling Avenue presented the following petition dated June 15; 1953: "We, the undersigned, do object to having the proposed "Used Car Lot" on the cornerIlof Excelsior Boulevard and Kipling Avenue," signed by Erle W. Benjamin, 3782 Kipling Avenue and 18 others. On motion of Trustee Middleton, seconded by Trustee Bolmgren, the above petition was referred to the Planning Commission in connection with the request now on hand for a permit by Archie Walker Company to gain a permit for a Used Car Lot on the SW Corner of Excelsior Boulevard and Kipling Avenue, by'-unani- mous- vote of all Members of the Council present. Storm Sewer No. 53-78 (Formerly Known as No. 52-404) Mr. Rouse appeared again in regard to Storm Sewer No. 53-78 (formerly known as 52-404. He spoke about an Engineer named Mr. Lund from the University of Minnesota who gave him some further light on this matter. He showed a plan that he had checked with Mr. Lund and feels that this plan would work OK and would be less costly than the plan now on file in the Village Engineer's office. He also said that Mr. Lund told him that unless the Village keeps the streets clean, no matter what size pipe is used, it will always be filled up. He says we need a program to maintain and clean streets. He said his street is no better than a third class street in Minneapolis. Trustee Bolmgren said that our streets are worked on. Mr. Rouse said it should be on a regular schedule. Mr. Rouse leftla plan for Council to study, and suggested that Mr: Lind and Mr. Smith go over same. C. H. Brown asked where_ the two plans coincide. He was told that theyjcoincide from Monterey Parkway or Natchez East. Mr. Brown said if there is some coinciding, lets OK that part at this time and leave the rest go until later Trustee Jorvig told of the various experiences we have had with other storm sewers, where we have conceded to pressure and did less than what was recom- mended by the Village Engineer, etc. Mrs. Smith, 2835 Princeton Avenue said they are most affected and should be heard and do as Mr. Rouse suggested -- compromise nowt They said they are not against the cost. Report on Storm Sewer - Committee of Whole After duelconsideration, the Committee of the Whole reported that they concurred with the recommendation made by the Village Engineer, outlined on map for Storm Sewer Job #52-78 (formerly known as #52-404), except the stub to the Hoffman property. Resolution On motion of Trustee Bolmgren, seconded by Trustee Middleton, the follow- ing resolution was adopted by unanimous vote of all Members of the Council present: RESOLUTION ORDERING PROPOSED STORM SEWER CONSTRUCTION WHEREAS the Village Council has met at the time and place specified in the notices published in the St. Louis Park Dispatch May 14 and 21, 1953, relating to the public improvements hereinafter described and has heard all interested persons appearing at said meeting and determined the necessity for said improvements, and the hearing having been regularly adjourned to this present- meeting; therefore BE IT RESOLVED by the Village Council of the Village of St. Louis Park that the follo 'wing public improvements be hereby ordered constructed in accord- ance with plansI Iand specifications which have been prepared by the Village Engineer and which are hereby approved, the Village Clerk being directed to advertise for bids which vrlll be opened at the meeting of the Council on July 20, 1953: From Princeton Avenue connecting with existing sewer extending across the line between Lots 5 and 6. BE IT FURTHER RESOLVED that the Council proposes to proceed under authority of Chapter 398, Laws of Minnesota, 1953. BE IT FURTHER RESOLVED that an alternate bid be included for construction of the sewer from Ottawa Avenue at the north line of Lot 7, Auditor's Sub-Division No. 318 east to thewestern terminis of the above sewer. BE IT FURTHER RESOLVED that the Village Attorney be authorized to acquire easements for said sewer where construction is required over private property. Plan for Proposed' Storm Sewer #53-78 On motion of Trustee Middleton, seconded by Trustee Bolmgren, the plan made by Mr. Rouse and Mr. Lund regarding Storm Sewer No. 53-78 (formerly known as #52-404) was referred to the Village Engineer for checking and study with the understanding that he contact Mr. Lund, by unanimous vote of all Members of the Council present. Bla.cktopping 36th Street East from Highway No. 100 On motion of Trustee Bolmgren, seconded by Trustee Middleton, the Mayor and Clerk were authorized to enter into a contract for the Village with Hedberg- Freidheim and Company for blacktopping West 36th Street from Highway No. 100 to end of present tar mat in the vicinity of Raleigh Avenue as approved by the Village Attorney, said contract to be accompanied by a performance bond in an amount to be determined by the Village Engineer with completion date set at July 31, 1953; the work to meet specifications of the Village Engineer, by unanimous vote of all Members of the Council present. Licenses On motion of Trustee Middleton, seconded by Trustee Bolmgren, the following applications for 1953 licenses were approved, and the Mayor and Clerk were author- ized to issue licenses to expire December 31, 1953, by unanimous vote of all Members of the Council present: Caron's Standard Station Cigarette St. Louis Park Driving Tee Soft Drink " if " it if Miniature Golf Part Putt Miniature Golf " 11 Minneapolis Gas Company Plumbing It n it Heating Lake Street Plumbing Company Plumbing. Lowe Plumbing Company " 9onds On motion of Trustee Bolmgren, seconded by Trustee Middleton, the following bonds were approved, by unanimous vote of all Members of the Council present: PLUMBING LICENSE BOND with John Lervoog, dba Lake Street Plumbing Company as principal, and United States Fidelity and Guaranty Company as surety, effective-June 5, 1953, to expire December 31, 1953, in the amount of $4,000.00. PLUMBING LICENSE BOND with George Lowe, dba Lowe Plumbing Company as principal, and Commercial Insurance Company as _ surety, effective June 15, 1953 to expire December 31, 1953, in the amount of $4,000.00. Plat - Eaton's First Division On motion of Trustee Bolmgren, seconded by Trustee Middleton, the Plat of Eaton's First Division was referred to the Village Engineer and Village Attorney for checking and recommendation, by unanimous vote of all Members of the Council present. 'Letter Re: Storm Sewer Drainage Letter from Mr. and Mrs. L. J. La Mere, 2724 Xenwood Avenue, dated June 15, 1953, requesting that drainage of storm sewers on to that part of Lot 10, Auditor's Subdivision No. 350, lying south of La Mere's Addition, be discontinued for sanitary reasons, and because that same is a source of danger to the children in the area, was read. Mr. La Mere who was present was told that the Village is making plans to take care of this situation. Letter Re: Cancelation of Assessments 334 June 1'5, 1953 I � Letter Re: Cancelation of Assessments - La Mere Letter from Mr. and Mrs. L. J. 1a Mere, 2724 Xenwood Avenue, dated June 152 1953, requesting that the special assessments on that part of Lot 10, Auditor's Subdivision No. 350, lying south of La Mere's Addition be canceled because of the fact that the Village is using that land to drain storm sewers onto, causing it to be invaluable to them, was read. The foregoing letter was referred to the Village Attorney with instructions to prepare a proper resolution for canceling assessments pending receipt of release of further claims regarding storm water from the La Mere's, by unanimous vote of all Members of the Councilpresent. Petitions for Street Imprvoements On motion of Trustee Middleton, seconded by Trustee Bolmgren, the follow- ing petitions were referred to the Village Engineer, Chairman of the Street Department Committee and Special Assessment Department for checking and recom- mendation, by unanimous vote of all Members of the Council present: P-1309 PETITION FOR SIDEWALK., Signed by Dr. and Mrs. Jesse J. Barron, 2840 Sumter Avenue and others, dated June 2, 11953, for the construction of sidewalk on the WEST SIDE IOF SUMTER AVENUE FROM 28TH STREET TO 29TH STREET. P-1311 PETITION FOR CURB AND GUTTER, signed by Phillip Mc Ginty, 12810 Virginia Avenue and others, dated June 15, 1953, for the construction of curb and gutter on the WEST SIDE OF VIRGINIA AVENUE SROM 28TH STREET TO VIRGINIA AVENUE. Reguest to Cancel Application for Rezoning - Tom Gould Clerk Justad reported that Tom Gould had 'phoned and requested that his application for rezoning property at 7401 Wayzata Boulevard from Residential Use to Commercial Use, be canceled, and that his check for $25.00 be returned to him. On motion of Trustee Bolmgren, seconded by Trustee Middleton, the Clerk was authorized to refund the $25.00 which accompanied Mr. Gould's application for rezoning upon receipt of a verified claim signed by him, by unanimous vote of all Members of the Council present. Letter Re: Traffic Signals at Inglewood and Lake Letter from Mrs. Betty H. Kates, 2815 Inglewood Avenue describing the traffic hazard existing at the intersection of Inglewood Avenue and West Lake Street, and requesting that traffic signals be placed there, was read. On motion'lof Trustee Bolmgren, seconded by Trustee Middleton, the Police Chief was instructed to take a traffic check and report on same at meeting of the Council to be held June 22, 19532 by unanimous vote of all Members of the Council presentll Bingo - St. Louis Park Soft Ball Club Letter from Jerry Longabaugh, representing the St. Louis Park Soft Ball Club, dated May115, 1953, requesting permission to operate a Bingo game at the Circus to be held June 22 and 23, 1953, for the joint benefit of the Club and the St. Louis Park Chamber of Commerce, was read. No action taken. Claim for Damages - H. E. Beardsley Letter from H. E. Beardsley, 2701 Edgewood Avenue, dated May 25, 1953, together.with al,photograph, claiming.damages in the amount of $535.00 to his property due to cutting alley thru and leaving his garage about five feet above the alleylso that the soil underneath has given way back underneath the building, was read. On motion of Trustee Middleton, seconded by Trustee Bolmgren, the above claim was referred to the Village Attorney for checking and recommendation, by unanimous vote of all Members of the Council present. Temporary Employee for Engineering Department On recommendation of Village Engineer, Phil,W. Smith, it was moved by Trustee Middleton, seconded by Trustee Bolmgren, that Richard Uppgaard be placed on the Engineering payroll for approximately three months beginning June 15, 1953, as a Rodman at $ 1.722 per hour, by unanimous vote of all Members of the Council present.) Quarterly Reporti - R. H. Public Health Nursing District Quarterly 'report of Rural Hennepin Public Health Nursing District for period of January 1, 1953 thru May, 1953, was read and ordered filed. I I June 15, 1953 335 Purchase of Typewriter Authorized On motion of Trustee Bolmgren, seconded by Trustee Middleton, the Clerk was authorized to purchase One (1) Model KMG 14, #3987212, 14 inch carriage, color grey, Royal Typewriter with elite type at amount quoted of $165.00; also One (1) KCL Typewriter table with two sidewings, color grey, with brakes at amount quoted of $17.85 --- total $182.85, from Hennepin-Lake Stationers, by unanimous vote of all Members of the Council present. State Fireworks Law With regard to the request of Meadowbrook Manor for permission to have a fireworks display on July 4th, a copy of the State Fireworks Law (Minnesota Statutes Section 616.433 — 616.438, adopted originally as Laws of 1941, Chapter 125, was read, and referred to the Clerk for action. Resolution On motion of Trustee Bolmgren, seconded by Trustee Middleton, the following resolution was adopted by unanimous vote of all Members of the Council present: RESOLUTION AUTHORIZING GRADING CONTRACT ON CONDITIONS WHEREAS the Village Council on June 1, 1953 received bids for proposed grading of Cedar Lake Road from Wyoming Avenue to 150 feet West of Flagg Avenue as follows: Terry Brothers, Incorporated $ 9,870.29 J. A. Danens & Son, Incorporated 8,329.97 William V. Terry 12,971.03 and WHEREAS the Village Council is willing to proceed with said grading on condition that the County of Hennepin undertake to reimburse the Village for one- half the cost thereof, and interested property owners advance to the Village the remaining one-half of the cost as estimated by the Village Engineer, therefore BE IT RESOLVED by the Village Council that the grading of Cedar Lake Road from Wyoming Avenue (Burd Place) to 150 feet West of Flagg Avenue in accordance with plans and specifications prepared by the Highway Engineer of Hennepin County be hereby ordered on condition that the County of Hennepin enter into an agree- ment in writing which has been prepared by the Village Attorney wherein the County will undertake to reimburse the Village for one-half the contract cost, and furnish the engineering cost, and on the further condition that interested property owners advance the Village Treasurer a sum equal to one-half of the re- maining cost of the project as estimated- by the Village Engineer, and upon receipt of the executed contract with the County, and the said cash deposit, the Mayor and the Clerk are authorized to execute contract for such grading with J, A. Danens & Son, Incorporated, which is hereby determined to be the lowest bid of a responsible bidder at said bid price of $8,329.97• BE IT FURTHER RESOLVED that the Village Attorney be authorized to commence condemnation proceedings for necessary right-of-way to be acquired. Resolution On motion of Trustee Bolmgren, seconded by Trustee Middleton, the following resolution was adopted by unanimous vote- of all Members of the Council present: RESOLUTION SETTING HEARING ON GRADING PROJECTS BE IT RESOLVED by the Village Council of the Village of St. Louis Park that a hearing be hereby set- for June 22; 1953 at 8 o'clock PM on proposed grad- ing projects 53-89, Louisiana Avenue from--Cedar Lake Road to Wayzata Boulevard, and 53-90, Pennsylvania Avenue from West' l6th Street to Wayzata Boulevard, the estimated cost of each being respectively $14,992.45 and $10,045.48, and 53-92, the East Side of Yosemite Avenue from 27th Street to 420 feet north at an estimated cost of $708.40; and June 29, 1953 was set as hearing date for said proposed project 53-92.
