A regular meeting of the Village Council was called to order by Mayor
C. L. Hurd at 8:00 P. M.
The following Council Members were present at roll call: Trustee Bolmgren,
Trustee Jorvig, Trustee Middleton, Clerk Justad, and Mayor Hurd.

On motion of Trustee Middleton, seconded by Trustee Jorvig, the foregoing
bids were referred to the Village Engineer and Chairman of the Engineering Depart-
ment for tabulation and recommendation, by unanimous vote of all Members of the
Council.
Bids for Two-Door Sedan (Water Department)
As advertised in the St. Louis Park Dispatch April 2, 1953, sealed bids were

On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the above bids
were referred to the Village Engineer and Chairman of the Water Department Committee
for tabulation and recommendation, by unanimous vote of all Members of the Council
present.
Hearing on Proposed Street Grading and Graveling
Pursuant to notices published in the St. Louis Park Dispatch April 2 and 9,
1953, a public hearing was had on each of the following proposed street grading
and graveling improvements. The following persons appeared: Homer S. Nelson,
owner of Lots 1, 2, 3, and 4, Block 10', J: F. Lyons Fourth Addition; Mr. Forfar,
owner of Lot 1, Block 9; Mr. Nordby, owner of Lots 2 and 3, Block 9, J. F. Lyons
Fourth Addition appeared in opposition for Hillsboro from Minnetonka Boulevard to
32nd Street (Improvement 53-39). _ Mr. Samways said Hillsboro Avenue from Minnetonka
Boulevard to Jessie Avenue is 'on his property, and he would like same cleared up.
No one appeared with regard to Improvements 53-40, 41, 42, 43, 44, 45, 46, 47, 48,
49, and 50. No action taken. Hearing was reset for May 11, 1953 to include
"Adjacent property to be assessed".

The following persons appeared: William T,-J Mghn, 4531.West, 362:Street
presented a petition-opposing the improvements . He owns Lots 30 and 31. Has
200 ft. frontage. Folks on Kipling said they need this sewer badly as their
cesspools need pumping frequently. Walter Sager said he doesntt want sewer on
Kipling between 36th and 362 as he hast cesspools for each home.
On motion of Trustee Bolmgren, seconded by Trustee Middleton, action was
deferred on above proposed sanitary sewer and lift station until meeting of April
27, 1953 to give the Committee of the Whole an opportunity to check all sides,
by unanimous vote of all Members of the Council.

petition against Water Main Improvement No. 53-1. R. L. Shackle, 2206 Jersey

Thompson, 3048 Boone Avenue presented a petition against Water Main Improvement
No. 53-3. No persons appeared regarding Improvement Numbers 53-4, 5, and 6.
Mr. Shackle asked why and handed in a petition-against Improvement Number 53-7.
No persons appeared regarding Improvements 53-8, 9, and 10. Mr. Slice, 3517
Pennsylvania Avenue asked that no action be taken on Improvement Number 53-11.
No persons appeared regarding Improvement Numbers 53-12, 132 14, 15, 16, 17.
On motion of Trustee Bolmgren, seconded by Trustee Middleton, action on
foregoing hearing was deferred to April- 27, 1953 to give further time to check
the opposition, etc., by unanimous vote of all Members of the Council. Mayor
Hurd stated that if it is decided to do any of the ,jobs petitioned against, the
petitioners will be notified.
Petition to Remove Sewer Jobs from Contract
A petition asking that sewer be taken out of contract, Oregon Avenue from
28th Street to 29th Street, and Oregon Avenue from 29th Street to Minnetonka
Boulevard, signed by D. L. Johnson, 2916 Oregon Avenue and others, was read. Those
present say that they knew nothing about this sewer until today. They were told
that the contract was awarded after a hearing last Fall. No action taken at this
time.
Tax Statement - L. J. La Mere
L. J. La Mere, 2724 Xenwood Avenue appeared with his tax statement for
that part of Lot 10 lying south of the Plat of La Meres Addition (Aud. Subdivision
No. 350). Doesn't feel that he should be assessed as long as the Village is using
the property. On motion of Trustee Middleton, seconded by Trustee Jorvig, the
above mentioned tax statement was referred to the Village Assessor for checking
and recommendation, by unanimous vote of all Members of the Council.
Street Light for Alabama Avenue and Meadowbrook Boulevard
On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the Mayor and
Clerk were authorized to execute agreement for the Village with Richard Bates and
Charles Michaud for the payment of $150.00, the excess cost to Northern States
Power Company for laying underground street light wires to service street light
on Alabama Avenue and Meadowbrook Boulevard, by unanimous vote of all Members of
the Council.
Agreement for Street Light
On motion of Trustee Middleton, seconded by Trustee Bolmgren, The Mayor
was authorized to sign agreement with Northern States Power Company for the
installation of approximately 270 feet of underground street lighting supply
along Alabama Avenue to a new 2,500 lumen overhead street light to be installed
at the intersection of Alabama Avenue and Meadowbrook Boulevard; said installation
to be made because of objection to overhead wires by property owners in the area,
and the Village agreeing to pay the Company the difference in cost between under-
ground and overhead installation. Motion was passed by unanimous vote of all
Members of the Village Council.
Licenses Approved !
On motion of Trustee Middleton,, seconded by Trustee Jorvig, the following
applications for 1953 licenses were approved, and the Mayor and Clerk were
authorized to issue licenses to -expire December 31, 1953, by unanimous vote of
all Members of the Council.

Special Permit to Connect to Water Main
On motion of Trustee Bolmgren, seconded by Trustee Middleton, a special per-
mit was granted to Mr. Christianson, 1835 Dakota Avenue to lay a one-inch copper
service pipe from the water main at the north line of West Franklin Avenue east
to the boulevard between the east curb line and the sidewalk, thence north to the
front of his home; thence east to the basement of his home, placing a stop box
in front of said home -- with the understanding that Mr. Christianson is to pay
an assessment of $340.00 at the time he takes out the regular permit with the
understanding that he will be given credit for this assessment payment when the
water main is constructed past this property; work to be done under the supervision
of the Superintendent of the Water Department. Motion was passed by unanimous
vote of all Members of the Council.

Street Light Ordered
On motion of Trustee Middleton, seconded by Trustee Bolmgren, the Northern
States Power Company were authorized to place a street light on Meadowbrook
Boulevard adjacent to the north line of Lot 9, Block 2, Brookside Addition, by
unanimous vote of all Members of the Council present.
Partial Payment on Contract Work,
On motion of Trustee Bolmgren, seconded by Trustee Middleton, the following
partial payment of contract work in progress, presented by Village Engineer,
Phil W. Smith, was approved, and the Mayor and Clerk were authorized to issue
warrant covering same, by unanimous vote of all Members of the Council present:

On motion of Trustee Bolmgren, seconded by Trustee Middleton, the quit claim
deed with Melvin P. Johnson and Barbara Lee Johnson, husband and wife as parties
of the first part, and the Village of St. Louis Park as party of the second part,
dated April 9, 1953, conveying the following described property to be used for sewer
easements, was approved, and the Village Attorney was instructed to file same with
Office of Register of Deeds, by unanimous vote of all Members of the Village Council.
An easement over the South Ten (10) feet of the North Four
Hundred Forty (440) -feet of the West One Hundred Seventy-two
(172) feet of the South One Half (S2) of the Southwest Quarter
(SM';). of the Southwest Quarter (SW�), Section Eighteen (18),
Township One Hundred Eighteen (118), Range,Twenty-one (21),
for the purpose of entering upon said premises, excavating the
soil and constructing and installing thereon sewer in accordance
with plans and specifications which have been prepared by the
Village Engineer for sewer including the free right to use said
sewer forever for-the drainage of the storm and the right to maintain
sufficient soil above said sewer to prevent freezing of liquids
therein and also the right to enter upon said premises at reasonable
times for the purpose of inspecting, repairing and replacing said
sewer.
Quit Claim Deed for Sewer Easements
On motion of Trustee Bolmgren, seconded by Trustee Middleton, the quit
claim deed with Fine Realty, Incorporated as party of the first part, and Village-
of St. Louis Park as party of the second part, dated April 14, 1953, conveying
the following described property to be used for sewer easements, was approved,
and the Village Attorney was instructed to, file same in the Office of Register of
Deeds of Hennepin County, Minnesota, by unanimous vote of all Members of the
Council:

(4), East Texa Tonka Addition according to the map or plat thereof
on file and of record in the Office of the Registrar of Titles in

Village Engineer, Phil W. Smith presented a statement and signed verified
claim from Kinney Lawn Service in the amount of $374.15 covering the'cost of
building necessary retaining wall on the west line of Lots 11 and 12, Block 20,
Park Manor Addition - a part of Alley Grading Project #7-74 (Brunswick Avenue
from Minnetonka Boulevard to 29th Street, which is in excess of the estimated cost .
of $250.00, and recommended the payment of same.
On motion of Trustee Middleton,- seconded by.Trustee Bolmgren, the above
claim was approved for payment, and the Mayor and Clerk were instructed to issue

Letter from The Pure Oil Company, dated April 16, 1953, requesting a
permit to construct a two-bay masonry service station at the intersection of
Minnetonka Boulevard and Texas Avenue =-- on All of Lot 4 and the westerly

A communication from the Planning Commission, dated April 15, 1953, in regard

Offer to Buy Village Owned Lot Accepted Lot 4, Block 1, The Bronx
Letter from Ervin E. Rieke, Fairfax, Minnesota, dated April 17, 1953, offering

instructed to prepare deed for conveyance of said lot to Ervin E. Rieke, Fairfax,

On motion of Trustee Bolmgren, seconded by Trustee Middleton, the-follow- ow
ing resolution was adopted by unanimous vote of all Members of the Council:
RESOLUTION CANCELING 2-CB SANITARY SEWER #497 ASSESSMENT
WHEREAS it appears that by resolution of the Village Council adopted
September 4, 1951, the S2 of Lot 25, Block 6, Suburban Homes Company's Addition
(Parcel #4750) was inadvertantly assessed for the above sewer (to which, it was
not connected), and also for 2-K Sanitary Sewer #500 (to which it is connected;
and
WHEREAS the NA of Lot 25, Block 6, Suburban Homes Company's Addition
(Parcel #4725) was inadvertantly omitted from the assessment for 2-CB Sanitary
Sewer #497 (to which it is connected); therefore
BE IT RESOLVED THAT THE L(%" INSTALLMENT of said assessment heretofore
paid (for. Parcel #4750) in the respective amount set forth below be refunded to
the respective property owner, and, upon receipt of a signed verified claim and

On motion' of Trustee Bolmgren, seconded by Trustee Middleton, Certificate
of Insurance for Comprehensive Policy No. XP 145543 #18 with Pioneer Theatre
Corporation, St. Louis Park Theatre Company, Et Al, 4829 Minnetonka Boulevard,
St. Louis Park, Minnesota named as the insured, and Tye Fidelity and Casualty
Company of New York as the insuror, dated January 6, 1953 to expire January 1,
1954, was approved and accepted; by unanimous vote of all Members of the Council.
Bid Award - Road Tar Mix
On the recommendation of Village Engineer, Phil W. Smith, it was moved by
Trustee Middleton, seconded by Trustee Bolmgren, that the bid of Black Top Service
Company received April 13, 1953 be determined to be the lowest bid of a responsible
bidder, and the Mayor and Clerk were authorized to execute contract for the Village
with Black Top Service Company for the furnishing of road tar mix as needed at
price bid of $4.95 per ton, by unanimous vote of all Members of the Council.
Bid Award - Bituminous Plant Mix
On-the recommendation of Village Engineer, Phil W. Smith, it was moved by
Trustee Middleton, seconded by Trustee Bolmgren, that the bids of J. V. Gleason
received April 13, 1953 for the furnishing of asphalt cement mix at $4.80 per
ton; Medium curing cutback asphalt mix at $4.60 per ton, and slow curing asphalt
mix at $4.55 per ton, were determined to be the lowest bids of responsible bidders,
-and the Mayor and Clerk were authorized to execute contract with J. V. Gleason for
the materials at prices bid, by unanimous vote of all Members of the Council.
Bid Award - Road Tar
On the recommendation of Village Engineer, Phil W. Smith, it was moved by
Trustee Jorvig, seconded by Trustee Middleton, that the bid of Republic Creosoting
Company received April 13, 1953, for the furnishing of road tar at $0.16 per
gallon, was determined to be the lowest bid of a responsible bidder, and the Mayor
and Clerk were authorized to execute contract for the Village with Republic Creosote
Company for the material at price bid, by unanimous vote of all Members of the
Council present.
Bid Award for RC Cutback Asphalt
On the recommendation of Village Engineer, Phil W. Smith, it was moved by
Trustee Middleton, seconded, by Trustee Bolmgren, the bid of J. V. Gleason received
April 13, 1953 for the furnishing of RC cutback asphalt at $.1070 per gallon was
determined to be the lowest bid of a responsible bidder, and the Mayor and Clerk
were authorized to execute contract for the Village with J. V. Gleason for the
material at price bid, by unanimous vote of all Members of the Council.
Bid Award - Bituminous Liquids
On the recommendation of Village Engineer, Phil W. Smith, it was moved by
Trustee Middleton, seconded by Trustee Bolmgren, that the bid of Bury and Qarlson
received April 13, 1953, for the furnishing of MC cutback asphalt at $.0967 per
gallon, and SC cutback asphalt At $.0867 per gallon were determined to be the
lowest bids of a responsible bidder, and the Mayor and Clerk were authorized to
execute contract for the Village with Bury & Carlson for the materials at prices
bid, by unanimous vote of all Membdrs of the Council present.
Bid Award - Four Three-ton Trucks
On the recommendation of Village Engineer, Phil W. Smith, it was moved by
Trustee Middleton, seconded by Trustee Bolmgren, that the bid of The Minar Company
received April 13, 1953, for the furnishing of four (4) three-ton trucks was
determined to be the lowest bid of a responsible bidder, and the Clerk was author-
ized to issue a purchase order for same at price bid of $16,780.00 less trade-in
value of old trucks in the amount of $4,265.00 or net amount of $12,515.36, by
unanimous vote of all Members of the Council.
Planning Commissions Report - Request for Permit to Construct Commercial Building
Planning Commission's report dated April 15, 1953, on the request of Viola
C. Mc Dermott for Mr. Vincent A. Ryan, to construct a commercial building for a
Dairy Drive-in on Lots 28 to 36 inclusive, Block 32, Rearrangement of St. Louis
Park, was read.
Building Permit for Commercial Building Approved
On motion of Trustee Jorvig, seconded by Trustee Middleton the Building
Inspector was authorized to issue a building permit to Vincent A. Ryan for the
construction of a commercial building for a Dairy Drive-in on Lots 28 to 36 inclusive,
Block 32, Rearrangement of St. Louis Park as recommended by the Planning commission,
by unanimous vote of all Members of the Council.

The Planning Commission's report on the request of the Pure Oil Company for
a permit to erect a gas service station on the, NW Corner of Louisiana Avenue and
Cedar Lake Road, was read.

On motion of Trustee Jorvig, seconded by Trustee Middleton, the request of
The Pure Oil Company for a permit to erect a gas service station on the NW Corner
of Louisiana Avenue and Cedar Lake Road was approved, and the Building Inspector
was authorized to issue permit for same on the condition that the pumps conform
to the 20 foot setback requirement from the new line established by the Hennepin
County Highway Department on Cedar Lake Road and the 20 foot setback requirement
on Louisiana Avenue, by unanimous vote of all Members of the Council.

The Planning Commission's report dated April 15, 1953, on the request of
Saint Timothy Luthern Church, 3000 Texas Avenue to erect a Chapel on Lots 1, 2,

On motion of Trustee Middleton, seconded by Trustee Jorvig, Saint Timothy
Luthern Church was granted a permit to erect a Chapel on Lots 1, 2, 3, and 4.

by unanimous vote of all Members of the Council, and the Building Inspector was
authorized to issue permit for same.

Letter Repayment of Advance Money - Project Minn 21-P-1004
Letter from U. S. Housing and Home Finance Agency, dated April 10, 1953,
regarding agreement for advance money to finance the preparation of plans for
Project No. Minn 21-P-1004, an underground concrete reservoir for the Village of
St. Louis Park, and requesting that repayment of $1,765.00 be made on or before
May 10, 1953, was, read.
Repayment of Advance Money Authorized - Project No. Minn 21-P-1004
On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the Mayor and
Clerk were authorized to issue warrant to U. S. Treasurer for repayment of advance
money paid to the Village pursuant to agreement dated June 1, 1950 by the Govern-
ment, and June 211, 1951 by the Village, in the amount of $1,765°00, covering cost
of preparation of plans for Project No. Minn 21-P-1004, by unanimous vote of all
Members of the Council.
Report on Dogs
The Clerk read a report from Harold Enestvedt, Superintendent of the St.
Louis Park Public Schools on the dog problem at the various school grounds, showing
considerable improvement since Ordinance No. 413 was made effective on April 20,
1953. A review was made of Dog Cards 155 thru 180, on dogs picked up.
Police Chief Andy Nelson - Outstanding Citizen of the Year
On motion of Trustee Middleton, seconded by Trustee Bolmgren, the Village
Council went on record to compliment Police Chief, Andy Nelson on his receiving
the°OUTSTANDING CITIZEN OF THE YEAR award.presented to him by the Veterans of
Foreign Wars, Post No. 5632, St. Louis Park, Friday, April 17, 1953, by unanimous
vote of all Members of the Council.
Ass"essment for Grading - Louisiana-Minnetonka-28th
Glenn Mueffelmann, 2817 Louiaiana Avenue spoke regarding assessment made
for grading of Louisiana Avenue from Minnetonka Boulevard to 28th Street. Said
they were promised a call before the work was to be done. Did not receive a call.
Does not deny that the work was done, but does deny any benefits. The 2800
Black had very little work done. Sidewalk was already in so there was no chance
to -change the grade. The 2700 Block had .many loads of fill. They said they
were at the hearing for grading and didnl.t want the job done. Asked what recourse
they have at this time. Mayor Hurd said he was willing to check with the
Village Attorney, Engineer and Assessor, .and have a review made of the assessment
to -see what the benefits as decided by assessment are.
On motion of Trustee Middleton; seconded by Trustee Jorvig, the above
matter was referred to the Village Attorney to determine if any relief from the
assessment for grading of Louisiana Avenue from 27th Street to Minnetonka Boule-
vard may be had, by unanimous vote of all Members of the Council.
