Hurd at 8:00 P. M. Invocation was given by Reverend Lundwuist of Prince of Peace Luthern Church. Anderson, 2656 Alabama Avenue said he would like a culvert to run the water off from his property. Said he has water in his basement. This has been going on for the past two years and he feels that it is due to water being dumped at 28th Street and Xenwood. Mr. La Mere, 2724 Xenwood represented by Mr. Casey spoke about the water dumped on his property north of 28th Street, west of Xenwood. Mr. Schmitz said he owns 10 acres between 26th Street and the Great Northern Tracks and Alabama Avenue and Georgia Avenue and they are all flooded this year. Asked what the solution was. He was told that an extension of storm sewer to Cedar Lake, but the cost is so high that it has appeared impossible to do. Mayor Hurd said that this extension is the only solution and an assessment to the area must be set up to pay for same. This matter was referred to the Village Engineer to prepare an assessment area to cover the cost of this extension. March 30, 1953 215 Dog Ordinance #413 Meeting Adjourns to Union Cong'l. Church Due to -the largeness of the group who appeared regarding the recently adopted Doi Ordinance, the meeting adjourned to the Union Congregational Church at 8:30 P.-M. Mayor Hurd acknowledged receipt of letters from Andres Hunter, Arthur Weisberg and Otis Dypwick, dated March 30, 1953, opposing Ordinance No. 413, were read. Mrs. Beehler presented a group of petitions in favor of the Ordinance, saying that there was many more due to be received thru the mails. Mayor Hurd said that no action would be taken until all material received can be evaluated, and that no enforcement would be made until he had a chance to hear all sides. Mr. Dypwick, 3645 Huntington Avenue spoke in favor of recinding Ordinance No. 413. He feels that Ordinance No. 298 properly enforced would take care of the Park dog problem. Said leashing dogs would make them vicious. He read a letter and turned in a petition signed by 571 persons for the repeal of Ordinance 413. A. 0. Worthing, 2851 Joppa Avenue asked "Do I understand that Ordinance No. 413 will not be enfroced until all sides of this matter has been hear?" Mayor Hurd said leashing of dogs has been overemphasized and that there were other ways of controlling dogs. Arthur Weisberg, 3651 Huntington Avenue said he could not add anything to Mr. Dypwick's talk. He feels that the problem is everybodys, and before anything is done to enforce Ordinance No. 413, that we have another large meeting. Howard Hawkins said he cleaned up 200 droppings in his yard last Sunday. Says he does not like to do this but would rather continue than to call the Police Department about his neighbors dogs. Herbert Bjorke, 3651 Huntington spoke of a dog that bit the mailman. Mentioned Dypwick's dog and chickens, etc. Mr. Dypwick answered that he took in a dog for his brother. John Shafer, 5900 Goodrich Avenue told about the trouble he had with the mailman's dog. Says that a handful of gravel thrown at a dog will keep him away. He told how to train a dog and control dogs' by feeding them properly, etc. Mr. Dipwick said this meeting is good. Has real spirit. Dwight Hokanson, 2621 Toledo Avenue showed a jacket his niece wore when attached by a dog (torn to shreds). Said he hopes the Council will enforce Ordinance No. 413. Carol Griffin, 2964 Virginia said she was speaking for Mothers in her area. Said they had much trouble keeping dogs away from their property. Mrs. Brokke, 2738 Jersey Ave. said they have called about dogs that were being abused. Mayor Hurd pointed out that provision is made on Ordinance No. 298 controlling this point. Edward Smith, 5911 Oxford Street aswered John Shafer - said he has stoned the Shafer dog, spoke to him about his dog, and talked about the garbage cans tipped over by Shafer's dog, and other havoc wrought. Mr. Smith also said that he finally had to build a fence to keep the dog off his property. Mayor Hurd said he did not like the turn the meeting had taken. Feels that personal attidutes should be left out. Carl Moline, 3820 Woodlane Drive spoke in favor of Ordinance Mo; 413. Too ipany dogs in his yard. Sees it all from his breakfast window. Has no dog, but feels that dogs should be controlled. Clifford Dahl, 2912 Webster Avenue said he was opposed to leashing. Has leashed dogs and it made them vicious. He takes care of Webster Park, and the dogs bother the program considerably. W. S. Meyers, 4221 Toledo Avenue spoke in opposition to the new ordinance. Said dogs are vicious, so are people. Will not leash his dog (his daughters pet). R. A. Alcott, 7719 Minnetonka Boulevard feels that Ordinance No. 413 is placing the responsibility of controlling dogs on their owners. Arthur Weisberg read aloud, Section 8 of Ordinance No. 298. Criticised people who had dog experiences who have not used enforcement already in the Ordinance. Walter Nelson, 4027 Yosemite said a dog is one of the hardest things to bring before the law. Said, he could push' over garbage cans and would soon be arrested, but a dog can do it and nothing can be done, etc. Its hard to get enforcement of a dog nuisance. Mayor Hurd said he feels that the Council passed Ordinance No. 413, not against dogs as at least three of the Members have dogs. Explained other items Council works on. Told about the Dispatch article, February 16th regarding the leashing of dogs, and there was no response from the public. He said that there would be no action taken tonight, but all petitions will be studied; also that any change in the ordinance must be drawn up by the Village Attorney. Trustee Bolmgren called attention to paragraph 8 in petition letter re- garding appeasement. Said that this problem has come up each year and we tried to do the best we could for all people. Trustee Middleton said he was the owner of a dog and had no trouble controlling it. Feels that the ordinance is necessary to take care of the dog problem. Hearing was adjourned at 9:50 P. M. and the Council returned to the Village Hall to resume regular business. 216 March 30, 1953 Street Light Midway Between Alabama Avenue-Brunswick-Meadowbrook Letter from Charles Michaud, 4306 Alabama Avenue, dated March 25, 1953, requesting that a street light be placed midway between the foot of Alabama C6 Avenue and the foot of Brunswick and Meadowbrook" was read. Mr. Gallagher from Northern States Power Company spoke about various light plans. The Clerk was instructed to write to Richard Bates, Charles Michaud and Clayton-Hutchins, asking them to meet at the Village Hall, Monday, April 6th at 7:30 P. M. to discuss lighting problem further. Petition Opposing Sanitary Sewer On motion of Trustee Bolmgren, seconded by Trustee Middleton, the following petition was referred to the Village Engineer for checking with Contractor, and report findings at meeting of April 6, 1953, by unanimous vote of all Members of the Council present: PETITION OPPOSING SANITARY SEWER, signed by Phillip Wilson, 2801 Pennsylvania Av&nue and others, dated March 30, 1953, opposing the cons- truction of sanitary sewer in PENNSYLVANIA AVENUE FROM MINNETONKA BOULEVARD TO 28TH STREET. Licenses Approved On motion of Trustee Middleton, seconddd by Trustee Bolmgren, the following applications for 1953 licenses were approved, and the Mayor and Clerk were authori- zed to issue licenses to expire December 31, 1953, by unanimous vote of all Members of the Council present: Dairy Mor ,Drive-In Restaurant Nordquist Sign Company Signs and Billboards Northern States Power Company Electrical Northwest Sign Erectors Signs and Billboards General Outdoor Adv. Snead On motion of Trustee Middleton, seconded by Trustee Bolmgren, the matter of a retaining wall at 3048 Nevada Avenue (Lot 21 and South 30 feet of Lot 22, Block 3, Boulevard Heights) was referred to the Village Engineer and Village Attorney for checking and recommendation, by unanimous vote of all Members of the Council present. Fixing Up Lots Irving Hanson spoke regarding the fixing up of lot"s on the southeast corner of Alabama Avenue and Cambridge Street, now being used for storm basin. On motion of Trustee BolMren, seconded by Trustee Middleton, the foregoing matter was referred to the Park Board for action, by unanimous vote of all Members of the Council present. Permission to Place Poles,, On motion of Trustee $olmgren, seconded by Trustee Middleton, the Northern States Power Company was granted permission to place poles at the following loca- tions within the Village, by unanimous vote of all Members of the Council present: One (1) pole at Hampshire Avenue and West 23rd Street' Two (2) poles on Hampshire Avenue between West 23/24 sts. One '(1) pole at Princeton and Raleigh Avenues Two (2) poles on Webster Avenue between West 33rd Street and Highway No. 7. Gas Main Extensions On motion of Trustee Middleton, seconded by Trustee Bolmgren, the following gas main extensions were approved by unanimous vote of all Members of the Council present: West 29th Street and Aquila from 7' W W Line of Aquila Avenue West 28th Street and Quebec Avenue from 16' W E Line Rhode Island Avenue March 30, 1953 rn�� Petition for Sanitary Sewer On motion of Trustee Bo]mgren, seconded by Trustee Middleton, the follow- ing petition was referred to the Village Engineer, Chairman of the Sewer-Department Committee, and Special Assessment Department for checking and recommendation, by unanimous vote of all Members of the Council present: PETITION FOR SANITARY SEWER, signed by Lloyd R. Golden, 3150 Pennsylvania Avenue and others, dated March 30, 1953, for the construction of sanitary sewer in PENNSYLVANIA AVENUE FROM 31ST STREET TO 32ND STREET. Resolution On motion of Trustee Bolmgren, seconded by Trustee Middleton, the following resolution was adopted by unanimous vote of all Members of the Council present: RESOLUTION CANCELING 51-241 SANITARY SEWER #500 ASSESSMENT WHEREAS it appears that by resolution'of the Village Council adopted Sep- tember 15, 1952, levying assessments for 51-241 Sanitary Sewer #500, the following lot was inadvertantly assessed on Jersey Avenue; and WHEREAS the following lot faces on Minnetonka Boulevard and receives no benefit from aforementioned sewer; therefore BE IT RESOLVED by the village council of the Village of St. Louis Park that the entire assessment heretofore levied against the following lot be canceled, and that the Treasurer and the Auditor of Hennepin County be hereby authorized to cancel the same upon their respective records. Shaw 6925 Minnetonka Boulevard 7 6 Lenox TOTAL L9L3 1954 195 1956 1957 320.00 43.20 43.52 42.24 40.96 39.68 PRINCIPAL 1958 1959 1960 1961 1962 32.00 38.40 37.12 35.84 34.56 33.28 Resolution On motion of Trustee Bo1mgren, seconded by Trustee Middleton, the following resolution was adopted by unanimous vote of all Members of the Council present: RESOLUTION AUTHORIZING APPLICATION FOR CONVEYANCE OF TAX FORFEITED LAND ----- WHEREAS, it appears that Lot 17, Block 10, Westmoreland Park has been for- feited to the State of Minnesota for non-payment of taxes, and that the Village of St. Louis Park owns property in the vicinity thereof which it has dedicated to use as a public park, and that it is necessary to acquire Lot 17 in order to com- plete the said park area, therefore BE IT RESOLVED by the Village Council of the Village of St. Louis Park that the Mayor and Clerk of the Village be authorized to execute an application to the County Board and State Tax Commissioner for conveyance of said Lot 17, Block 10, Westmoreland Park, to the Village of St. Louis Park for public park purposes. Employment of Don Glassing for Special Assessment Work Assessor, R. B. Connery requested permission to employ Fireman, Donald Glassing on his days off to work on Special Assessments. On motion of Trustee Bolmgren, seconded by Trustee Middleton, permission was granted to R. B. Connery to employ Donald Glassing on his days off from the Fire Department to work on Special Assdssments at rate of $1.722 per hour, by unanimous vote of all Members of the Council "present. Estimates for Sloping and Sodding Requested On motion of Trustee Bolmgren, seconded by Trustee Middleton, the Village Engineer was instructed to obtain estimates for sloping and sodding all properties affected by the grading of Minnetonka Boulevard, and to negotiate with the property owners for a cash settlement and releases of same, by unanimous vote of all Members of the Council present. 218 March 30, 1953 � Through Street Designated On motion of Trustee Bolmgren, seconded by Trustee Middleton, France Avenue from Minnetonka Boulevard to Cedar Lake Avenue was designated as a THROUGH STREET, by unanimous vote of all Members of the Council present. Meeting Date Set to Discuss Future Use of Community Fund Monies On motion of Trustee Bolmgren, seconded by Trustee Middleton, April 25, 1953, at 2 PM, As the Village Hall was set as date for a meeting of the Village Council with members of the St. Louis Park Community Fund; Board of Education, Park Board, Chamber of Commerce, Recreation Planning Commission, and Minister of a Church, for the purpose of discussing future Community Fund monies, and recreational plan- ning, by unanimous vote of all Members of the Council present. Advertise for Bids for Four (4) Three-ton 'rucks On motion of Trustee Bolmgren, seconded by Trustee Middleton, the Clerk was authorized to advertise for bids for the purchase of four (4) three-ton trucks for the Street Department, according to specifications therefor on file with the Village Clerk; bids to be opened April 13, 19533 by unanimous vote of all Members 6f the Council present. Resolution On motion of Trustee Bolmgren, seconded by Trustee Middleton, the following resolution was adopted by unanimous vote of all Members of the Council present: RESOLUTION CANCELING 51-6 ALLEY GRADING #497 ASSESSMENT WHEREAS'it appears that by resolution of the Village Council adopted Sep- tember 24, 1951, levying assessments for 51-6 Alley Grading #497, the following lot was inadvertantly charged for 14 feet, whereas it receives no benefit from said assessment; therefore BE IT RESOLVED that the 1952 installment of such assessment heretofore paid in the respective amounts set forth below be refunded to the respective property owner, and, upon receipt of a signed verified claim and•a paid tax statement, that the Mayor and Clerk be hereby authorized to issue warrants in payment of such refund to the respective property owner. Dog Ordinance #413 Dog Ordinance #413 amending Ordinance #298, relating to licensing and regulat- ing of dogs was discussed at length, and it was the opinion of the entire Council that the ordinance stand as adopted, and be enforced.
