Hurd at 8:04 P. M. Williams 75.00 Ordinance No. 413 and Dog Problems _ Mr. J. J. Dypwick, 3645 Huntington Avenue appeared. Said he was opposed to the new Dog Ordinance. Said it was passed without a notice to the people. Asked why it was passed and why it was not advertised. Asked how it happens that we didn't know about this thing. Next it will be children. Feels that St. Louis Park is democratic. It will be hard to take pare of dogs in this manner. Dog haters must have forced this ordinance t_ hru. Mayor Hurd said that leashing children is not in this issue. Mr. J. J. Pesek, 7800 Cambridge Street appeared. Said he was in favor of this ordinance. Likes to have a clean yard and garden during the Summer; Also said dog trouble in school yards is a nuisance. Had a dog of his own and gave it away because he was causing trouble. John Daniels, 3120 Texas Avenue said. he was a dog lover, and suggested that we get-rid of dogs that are causing the . trouble. Mr. Westberg, 3831 Inglewood Avenue asked ''why are we buying dog Licenses? Done we do so to pay for the care. of dogs? If not, why not?tl Mr. Hunter, 3818 Glenhurst Avenue said we have a democrat government. Why didn't we receive a notice of this? It is a very important matter to us. Mayor Hurd said we have found two schools of thought regarding dogs. We tried to handle this matter by hiring.a good dog catcher who has already picked. up 120 dogs so far this year. We ,still have,school yard troubles, scavengering by dogs in yards, garbage cans knocked over, wetting of newspapers and complaints by Garden Club folks. Dog,lovers say dogs must be taken care of and not allowed to run at large. Seeing-eye dogs are.confined and on leash, and are good dogs. Many mentions of dogs and dog trouble have been made at various Council meetings and this ordinance was not drummed up overnight. If the Press who are present at all meetings ,did not mention it in the paper, it is not our fault, as we have no control. Mayor Hurd read letter from Letter Carrier. Mr. Hunter said he feels that this matter should be put before the people for a,referendum, so that they.could tell us whether or not this ordinance is wanted. Mr. Dypwick said he feels that our present ordinance properly enforced would take care of our dog problem. He criticised the Letter Carrier who wrote the 1Qtter Mayor Hurd read. , Mayor Hurd said that unless you can give us some constructive way of handling this dog problem, we feel that the new ordinance should be given a trial. I like dogs, and don't like to complain about dogs. Dogs have made a nuisance of themselves in my yard, but I don't know whose dogs they are, so I can't report it to the Dog Catcher. Is there any way that these dogs at the school yards can be picked up? , This seems to be one of our major problems. Mr. Dypwick said if you can't enforce the present ordinance with one lousey dog catcher, how can you enforce the new ordinance? Mayor Hurd said if you are March 23, 1953 2®9 Ordinance No. 413 and Dog Problems. Cont'd. sure that we can't enforce this ordinance, you have nothing to be concerned about. I don't feel that we can enforce this ordinance 100%, maybe not 50p, but we hope to aleviate as much as possible, the nuisances. Volunteer Firemen On motion of Trustee Jorvig, seconded by Trustee Middleton, the Council accepted the suggestion of the St. Louis Park Volunteer Fire Department to add 8 Village water and sewer department employees to the Volunteer Fire Department, by unanimous vote of all Members of the Council. Letter - Two Certifications for Fire Department Letter from St. Louis Park Fire Civil Service Commission, dated March 19, 1953, certifying Peter J. Mueller, 5701 39th Avenue South, Minneapolis, Minnesota, and Gerald Haines, 4344 Yosemite Avenue, St. Louis Park as eligible for appointment to the St. Louis Park Fire Department, was read. New Firemen Appointed On motion of Trustee Jorvig, seconded by Trustee Middleton, the appointment of Peter J. Mueller, 5701 39th Avenue South, Minneapolis, Minnesota, and Gerald Haines, 4344 Yosemite Avenue, St. Louis Park to the positions of firemen, was approved, effective April 15, 1953, at a starting wage of X6323.30, by unanimous vote of all Members of the Council. Storm Water - 28th & 29th and Princeton A group appeared from the vicinity of 28th and 29th and Princeton Avenue regarding the storm water problem they have. Said there was no drainage east from Monterey Place between 28th and 29th Streets. Village Engineer, Phil W. Smith was asked to prepare plans and easements to correct this trouble and to make a report by March 30th. Gas Main Extensions On motion of Trustee Jorvig, seconded by Trustee Middleton, the following gas main extensions were approved by unanimous vote of all Members of the Council: In Yosemite Avenue from West 37th Street to cover south 15 feet of Lot 1, Block 44. s In Randall Avenue from Huntington Avenue to cover Lot 15, Block 1, Minikanda Oaks Addition. Storm Sewer Assessment - E. L. Ehlen Mr. E. L. Ehlen, 3413 Brunswick Avenue appeared to discuss the Storni Sewer Assessment which he claims has been placed against his property, and which he said does not serve him. Village Engineer, Phil W. Smith was asked to check further on this matter and see where the error comes in, and to get in touch with Mr. Ehlen when he has don so. Licenses On motion of Trustee Middleton, seconded by Trustee Bolmgren, the following applications for 1953 licenses were approved, and the Mayor and Clerk were authorized to issue licenses to expire December 31, 1953, by unanimous vote of all Members of the Council: A. and A. Restaurant Mac's Snack Drive-in " Bonds On motion of Trustee Bo]mgren, seconded by Trustee Middleton, the following bonds were approved by unanimous vote of all Members of the Council: PLUMBING LICENSE BOND with Ralph Hultgren, DBA Ralph Hultgren Plumbing Company as principal, and Commercial Insurance Company, dated March 13, 1953 to expire December 31, 1953, in the amount of $42000.00. PLUMBING LICENSE BOND with Jerome M. Goldberg, DBA Bellaire Plumbing as principal, and Standard Accident Insurance Company as surety, dated March 20, 19532 to expire December 31, 1953, in the amount of $642000.00. 210, March 23, 1953 Bonds, Continued GAS INSTALLATION BOND with T. D. Gustafson Company as principal, and United States Fidelity and Guaranty Company as surety, dated March 13, 1953, to expire December 31, 1953, in the amount of $1,000.00. GAS INSTALLATION BOND with Jerome M. Goldberg, DBA Bellaire Plumbing as principal, and Standard Acciddnt Insurance Company as surety, dated March 20, 1953, to expire December 31, 1953, in the amount of $1,000.00. SIGNS AND BILLBOARDS BOND with Naegele Advertising Company, Incorporated as principal, and St. Paul- Mercury Indemnity Company as surety, dated March 17, 1953, to expire December 31, 1953, in the amount of $1,000.00. Improvements for South Westwood Hills A group appeared from South Westwood Hills Addition. Said they were led to believe that the Village would put in trees and blacktop streets, etc. Mayor Hurd explained the.FHA requirements for South Westwood Hills. Some of the group said they would like to have the park fixed up.and leave the trees go for the present. Kim Cole said to leave the park out of this at this time and so some- thing about the streets. He feels that the Village Council should go after the developers to fulfill their agreement, for the people. He said the developer promised them tarred streets, trees, etc. J. P. Lilja, 2501 Quebec Avenue said the developer told him that the Village had been given the money to complete tar and tree projects. No action taken. 26th Street Extension and Bus Service Mrs. Walter Davidson, 2600 Lynn Avenue appeared. Asked why 26th street is being extended. Mayor Hurd replied that it was to serve folks from Highway No. 100 to France Avenue. She said that with 28th Street cut through, 26th Street is not necessary. Mayor Hurd said it is necessary for use of Fire Department in case of fire. Mrs. Davidson asked about bus service. Said they will have to widen 26th Street. She mentioned the brick wall at 26th and France belonging to Mr. Harris which is on Village property. Asked who appeared at the hearing for the 4 extension of 26th Street. The Clerk said about 12 persons appeared. Mr. Hoffman spoke, according to the minutes. She said that they would not have purchased their property if they knew 26th Street was going thru to the Belt Line. Also said there will be a lot of big trucks going by. Mayor Hurd said he did not think so. Letters Regarding Dogs . A number of letters in favor of the new Dog Ordinance were read and ordered filed. Request for Rezoning Letter from T. C. Johnson Agency, 311 Portland Avenue, Minneapolis, Minnesota, dated March 13, 1953, requesting the rezoning of property located on Highway #7 and Pennsylvania Avenue from Commercial Use to Light Industrial Use, was read. On motion of Trustee Jorvig, seconded by Trustee Bolmgren, the above request was referred to the Planning Commission for checking and recommendation, by unani- mous vote of all Members of the Council. Building Inspector's Weeklv Report The Building Inspector's report for week ending March 20, 1953, showing that 11 building permits were issued, totaling $157,100.00, was read and ordered filed. Letter Re: Civil Air Patrol Sign Letter from Donald S. Hagstrom, Captain, St. Louis Park Squadron, Civil Air Patrol, dated March 10, 1953, expressing their appreciation for the sign placed on the rear door of the Council Room, was read and ordered filed. Notice of Assessor's Meeting Notice from the Department of Taxation, State of Minnesota, dated March 16, 1953, of a meeting for the instruction of assessors to be held at the Minneapolis Court House on April 2nd, 1953, was read. On motion of Trustee Middleton, seconded by Trustee Jorvig, Village Assessor, R. B. Connery was instructed to attend aforementioned meeting with necessary expenses paid, by•unanimous vote of all Members of the Council. Trucks for Street Department On motion of Trustee Jorvig, seconded by Trustee Bolmgren, the request of Street Commissioner for four new trucks for the Street Department was referred to Trustee Middleton for checking and recommendation, by unanimous vote of all Members of the Council. March 23, 1953 211 Petitions for Street Improvements On motion of Trustee Middleton, seconded by Trustee Bolmgren, the following petitions were referred to the Village Engineer, Chairman of the Street Department Committee, and Special Assessment Department for checking and recommendation, by unanimous vote of all Members of the Council present: P-1272 ---- PETITION FOR CURB AND GUTTER signed by Carl Mark, 2754 Georgia Avenue and others, dated March 20, 1953,' for the construction of curb and gutter on the WEST SIDE OF GEORGIA AVENUE FROM 27TH STREET TO 28TH STREET. Employee for Building Department On the recommendation of Building Inspector, Peter Stienstra, it was moved by Trustee Middleton, seconded by Trustee Jorvig that Walter Mark be employed to work in the BuildinDepartment at $1.50 per hour, by unanimous vote of all Members of the Council. Effective March 23, 1953)• Resolution On motion of Trustee Jorvig, seconded by Trustee Bolmgren, the following resolution was adopted by unanimous vote of all Members of the Council: RESOLUTION CANCELING P-116 TAR MAT #503 ASSESSMENT WHEREAS it appears that by resolution of the Village Council adopted June 9, 1952, levying assessments for P-116 Tar Mat #503, the following property was inad- vertantly assessed, whereas said property received no benefit from assessment; therefore BE IT RESOLVED by the Village Council of the Village of St. Louis Park that the entire assessment heretofore levied against the following property be canceled, and that the Treasurer and the Auditor of Hennepin County be hereby authorized to cancel the same upon their respective records. M. to discuss the probable purchase of another snow plow on March 30, 1953, by unanimous vote of all Members of the Council present. 212- March 23, 1953 � Resolution On motion of Trustee Middleton, seconded by Trustee Bolmgren, the follow- ing resolution was adopted by unanimous vote of all Members of the Council present: RESOLUTION CANCELLING M-91 WATER MAIN AND 0-91 GRADING #497 ASSESSMENT WHEREAS it appears that by resolution of the Village 'Council adopted October 11, 1948, levying assessments for M-91 Water Main, and adopted May 7, 1951, levying assessments for 0-91 grading #497, the following parcels were assessed; and WHEREAS said parcels have now been taken for street purposes; therefore BE IT RESOLVED by the Village Council of the Village of St. Louis Park that the above assessments for years 1953 thru 1958 and 1953 thru 1954 respectively, heretofore levied against the following parcels be canceled, and that the Treas- urer and the Auditor of Hennepin County be hereby authorized to cancel the same upon their respective rec6rds. Resolution On motion of Trustee Middleton, seconded by Trustee Bolmgren, the following resolution was adopted by unanimous vote of all Members of the Council present: RECLASSIFICATION OF TAX FORFEITED LANDS - WHEREAS, the Village Council of the Village of St. Louis Park, Hennepin County, Minnesota, has received from the County Auditor of Hennepin County, Minnesota, a list of lands in said Village which became the property of the State of Minnesota under the provisions of law declaring the forfeiture of lands to the State for non-payment of taxes, which said list has been designated as List 11362-C", March 17, 1953; and WHEREAS, each parcel of land described in said list has heretofore been classified by the Board of County Commissioners of Hennepin County, Minnesota as non-conservation land and the sale thereof has heretofore been authorized by said Board of County Commissioners; therefore BE IT RESOLVED, by said Village Council, acting pursuant to MinnesotAL Statutes for 1945, Section 282.1, that the said classification by said Board of County Commissioners of each parcel of land described in said list a§ non-con- servation land be and the same is hereby approved and that the sale of each such parcel of land be and the same is hereby approved. Todd Check Signer On motion of Trustee Bolmgren, seconded by Trustee Middleton, the Clerk was authorized to purchase from The Todd Company, Incorporated One (1) Todd Electric Signer at price of $300.00 with a five-year guarantee with maintenance agreement of $18.00 per year was approved by unanimous vote of all Members of the Council. 1=3CoMarch 23, 1953 21-3- Conveyance nveyance of Property to Independent School District of St. Louis Park On the recommendation of the Park Board, it was moved by trustee Bolmgren, seconded by Trustee Jorvig that the Mayor and Clerk be authorized to execute deed on behalf of the Village, for the conveyance of following described land to the Independent School District of St. Louis Park, by unanimous vote of all Members of the Council: All that part of Block 179, Rearrangement of St. Louis Park, according to the plat thereof on file and of record in the office of .the Register of Deeds of Hennepin County, Minnesota, lying south of the southerly line of 33rd Street, excepting-Lot-s-30-to 36 nclusive--of-said-Block. Letter Re: Bill Passed by Legislature-Assement Charges Letter from County Auditor, Robert F. Fitzsimmons, dated March 19, 1953, enclosing a copy of bil passed by the 1953 Legislature TO REQUIRE THE PAYMENT OF CERTAIN FEES TO THE COUNTY AUDITOR BY CITIES, VILLAGES AND TOWNS, AND BOARDS AND DEPARTMENTS THEREOF, FOR THE SPREADING OF SPECIAL ASSESSMENTS FOR LOCAL IMPROVE- MENTS IN COUNTIES NOW OR HEREAFTER HAVING A POPULATION OF 600,000 OR MORE, was read and ordered filed. Bingo Letter from Mrs. M. D. Kelley, 3916 Yosemite Avenue, dated March 23, 1953, requesting .permission to play Bingo at the Park Knoll School Carnival to be held on April 18, 1953, was read. No one appeared in opposition. No action taken. Fireman Reinstated - Don Glassing On motion of Trustee Jorvig, seconded by Trustee Middleton, Donald Glassing was reinstated after leave of absence tq his position of Fireman , effective April 1, 1953 at salary of $319.30 permonth, upon passing a physical examination to be given by Dr. Archie Smith, M. D., ,by unanimous vote of all Members of the Council. Release from Accident Case On motion of Trustee Jorvig, seconded by Trustee Middleton, the Mayor and Clerk were authorized to execute release for the Village of $327.49 in the Frank Moot and Donald Moot accident case of February 23, 1953, and turn same over to Glen Falls Indemnity Company and accept -check in payment of claim, by unanimous vote of all Members of the Council. Letter Re: New Mortuary Building Letter from John 0. Louis, Executive Secretary, St. Louis Park Chamber of Commerce, dated March 23, 1953, stating 'that John Billman is interested in acquiring space and building a new mortuary at 4120 Excelsior Boulevard, and inquiring re- garding a permit to operate from that location, was read. On motion of Trustee Jorvig, seconded by Trustee Bolmgren, the foregoing matter was referred to the Planning Commission for checking and recommendation, by unanimous vote of all Members of the Council present. Street Light - Alabama Avenue & Meadowbrook Boulevard Mr. Gallagher of Northern States Power Company appeared and asked that no action be taken on the matter of installation of street light on Alabama Avenue and Meadowbrook Boulevard uhtil March 30 to give him a chance to make further study of same. On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the matter of installing a street light on Alabama Avenue and Meadowbrook Boulevard was deferred to Meeting of March 30th, by unanimous vote of all Members of the Council. Automobile Insurance Bond On motion of Trustee Bolmgren, seconded by Trustee Middleton, American Automobile Insurance Company No. K-206 7621, effective March 12, 1953 to expire March 12, 1954, covering fleet of Village owned trucks and passenger cars listed thereon, was approved by unanimous vote of all Members of the Council.
