L. Hurd at 8:09 P. M. Invocation was given by Reverend Paul Obenauf of Wooddale Luthern Church. A hearing was had on the petition of" Carlson Brothers Company and Republic Creosoting Company for vacating Gorham-Avenue as originally platted from 2nd j Street NW to 3rd Street NW. No persons appeared. Resolution On motion of Trustee Middleton, seconded by Trustee Jorvig, the following resolution was adopted by unanimous vote of all Members of the Council: RESOLUTION VACATING PORTION OF STREET WHEREAS, the Village Council has met" at the time and place specified in i notice published in the St. Louis Park Dispatch January 29, 1953, and duly posted in three public places in said Village, relating to hearing on the petition of j Carlson Brothers Company and Republic Creosoting Company who are a majority of owners of property adjacent to the following street, for vacating Gorham Avenue from 2nd Street NW to 3rd Street NW, and aYl interested persons appearing at said j time having been duly heard, it having been determined by the Council that said February 9, 1953 171, 1 Resolution Vacating Portion of Street, Cont'd. street as originally platted no longer serves any public purpose, and an alternate for said street having been dedicated diagonally across Lot 204, Rearrangement of St. Louis Park, and it being in the public interest that said street be vacated as petitioned, therefore BE IT RESOLVED by the Village Council of the Village of St. Louis Park that that portion of Gorham Avenue, a public street in said Village (originally dedi- cated in the plat of the arrangement of St. Louis Park as St. Louis Avenue), from the northwesterly line of 2nd Street NW to the southeasterly line of 3rd Street NW, and adjacent to the southwesterly lot lines of Lots 21 to 40, Block 204, Rearrangement of St. Louis Park, be hereby vacated. Hearing on Application for Rezoning - M. P. Johnson i Pursuant to notice published in the SLP Dispatch January 29, 1953, a public hearing was had on the application of M. P. Johnson for rezoning that part of the West 165 feet of the S2 of the SW-4' of the SW4 of Section 8, Township 117-N, Range 21, lying north of the South 333 feet thereof, from Residence Use District to Multiple Dwelling-Use District. The following persons appeared: Mr. Albee, 2856 Texas Avenue asked what multiple dwelling means. H. W. Perkins explained that the owner of the property wants to build double bungalows. On motion of Trustee Bolmgren, seconded by Trustee Middleton, the Village Attorney was instructed to prepare an ordinance covering this matter for Council Action on February-16; 1953, by unanimous vote of all Members of the Council present. � Hearing on Application for Rezoning - Cusack & Carlson, Inc. Pursuant to notice published in the St. Louis Park Dispatch January 29, 1953, a public hearing was had on the application of Cusack & Carlson, Incorporated, for the rezoning of Lots 44, 45, 46, and 47, Block 3, Browndale Addition from Residential Use District to Commercial Use District. The following persons appeared: A. M. Moliter, 4020 Utica Avenue spoke in opposition to the rezoning. Feels that if this rezoning is done that the two lots g and 9. Block 3, Browndale now vacant will soon follow, to be zoned commercial. Mr. Cusack presented a petition dated January 26, 1953,,-signed by residents in the area, in favor of the rezoning. Ed Owen, 4026 Utica Avenue feels this is a desirable improvement and will welcome same. On motion of Trustee Middleton, seconded by Trustee Bolmgren, action was deferred to meeting of February 16, 1953 to allow the ordinance to be written to contain the necessary type of screening that will meet the requirements of the Planning Commission and Council, by unanimous vote of all Members of the Council. 1953 Licenses On motion of Trustee Middleton, seconded by Trustee Bo1mgren, the following applications for 1953 licenses were approved, and the Mayor and Clerk were author- ized to issue licenses to expire December 31, 1953, by unanimous vote of all Members of the Council: Sachs & Company Gas Connections NW Sheet Metal Heating C. 0. Penny Plumbing as principal, and United States Fidelity and Guaranty Company as surety, dated January 26, 1953, in the amount of $4,000. 172 February 9, 1953 Bonds, Continued GAS INSTALLATION BOND with Abram Sachs and H. C. Olson, DBA Sachs & Company as principal, and Royal Indemnity Company as surety, dated February 2, 1953, in the amount of $1,000. PLUMBING LICENSE BOND with Abram Sachs & H. C. Olson, DBA Sachs & Company as principal, and Royal Indemnity Company as surety,, dated January 14, 1953, in the amount of $4,000. CONTINUATION CERTIFICATE FOR HEATING LICENSE BOND with Gust Hoglund as principal, and Commercial s Casualty Company as surety, dated December 15, 1952, in the amount of $1,000.00. Petitions for Street Improvements On motion of Trustee Bolmgren, seconded by Trustee Middleton, the following petitions were referred to the Village Engineer, Chairman of the Street Department Committee and Special Assessment Department for checking and recommendation, by unanimous vote of all Members of the Council. P-1255 PETITION FOR CURB AND GUTTER, signed by Leroy Carter, 3935 Ottawa Avenue and others, dated December 31, 1952, for the construction of curb and gutter on the EAST SIDE OF OTTAWA AVENUE FROM VALLACHER AVENUE TO WEST 40TH STREET. P-1256 PETITION FOR CURB AND GUTTER signed by Laura E. Gray, 3914 Ottawa Avenue and others, dated December 31, 1952, for the construction of curb and gutter on the West Side of Ottawa Avenue from Vallacher Avenue to West 40th Street. Permission Granted to Place Buried Cable - NW Bell Telephone Co. On motion of Trustee Bolmgren, seconded by Trustee Middleton, the North- western Bell Telephone Company was granted permission to place buried cable ACROSS CEDAR LAKE ROAD BETWEEN LOUISIANA AVENUE AND KENTUCKY LANE, by unanimous vote of all Members of the Council. Re: Comprehensive Rezoning, Etc. Letter from the St. Louis Park Planning Commission, dated January 19, 1953, regarding comprehensive rezoning of our Open Development Districts and changes involving our Heavy Industrial and Light Industrial Districts,' was read. On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the Engineering Department was instructed to take large map and trace or color in present zoning at once, by unanimous vote of all Members of the Council. Municipal Short Courses On motion of Trustee Bolmgren, seconded by Trustee Middleton, the following Village personnel were authorized to attend Municipal Short Courses at the University Center for Continuation Study, sponsored by the League of Minnesota Municipalities, with necessary expenses paid, by unanimous vote of all Members of the Council: Assessor's School - R. On motion of Trustee Middleton, seconded by Trustee Bolmgren, the applica- tion of A. J. Johnson, DBA Grand Plumbing and Heating Company for Heating and plumbing licenses was approved, and the Mayor and Clerk were authorized to issue same to expire December 31, 1953, by unanimous vote of all Members of the Council. Miracle Mile On motion of Trustee Bolmgren, seconded by Trustee Jorvig, authorization was given for the execution of stipulation submitted by Sheldon-Thomas Company which was approved by the Village Attorney as per previous Council discussion; also agreement submitted by Wood-Excel, Incorporated providing for permit for use of premises at the rear of Miracle Mile Extension, and containing conditions of permit was approved, and the Mayor and Clerk were authorized to sign same for the Village by unanimous vote of all Members of the Council. Plat Approved - East Texa-Tonka Addition On motion of Trustee Jorvig, seconded by Trustee Bolmgren, the final plat of East Texa-Tonka Addition, presented by M. P. Johnson was approved, and the Mayor and Clerk were authorized to sign same for the Village after receiving the approval of the Village Engineer and the certification from the Village Attorney that title to the ground is in proper order, and after having received an executed agreement prepared or approved by the Village Attorney from the platter as to the grading and graveling of the streets in the addition, and a performance bond in proper amount to cover this agreement. Motion was passed by unanimous vote of all Members of the Council. Planning Commission's Report on Petition for Rezoning - Clarence K Bros. Planning Commission's report dated February 5, 1953 on the request of Clarence K. Bros for rezoning Lots 1 to 14, Block 36, Rearrangement of St. Louis Park from Residential Use to Light Industrial Use; Lots 53 to 68, Block 174, Rearrangement of St. Louis Park from Residential Use to either Multiple Dwelling of Commercial Use; and Lots 1 to 19, Block 196, Rearrangement of St. Louis Park from Residential Use to either Light Industrial Use or Commercial Use, was read. Hearing Date Set for Rezoning On motion of Trustee Bolmgren, seconded by Trustee Middleton, March 16, 1953 was set as date for hearing on the following rezoning requested by Clarence K. Bros and recommended by the Planning Commissions by unanimous vote of all Members of the Council: 1. Rezone from Residential Use to Light Industrial Use, Lots 1 to 14, inclusive, Block 36, Rearrangement of St. Louis Park; and Lots 1 to 19 inclusive, Block 196, Rearrangement of St. Louis Park. 2. Rezone from Residential Use to Multiple Dwelling Use and from "C" to "D" Density, Lots 53 to 68 cinlusive, Block 174, Rearrangement of St. Louis Park. Building Inspector's Weekly Report The Building Inspector's report for week ending February 6, 1953, showing that 7 building permits were issued, totaling $95,800.00, was read and ordered filed. _Settlement of Accounts On motion of trustee Bolmgren, seconded by Trustee Middleton, the settlement of the following accounts pending in District Court, Hennepin County, Minnesota in the following respective amounts were authorized and approved: S. C. Hempfer and Florence Hempfer his wife vs Village of St. Louis Park $350.00 Leo W. Mc Morrow and Mary F. Mc Morrow his wife vs Village of St. Louis Park $350.00 Eugene Christensen and Mrs. Eugene Christensen his wife vs Village of St. Louis Park $125.00, and the issuance of Village checks for the above amounts is hereby authorized upon the receipt of releases approved by the Village Attorney. Motion was passed by unanimous vote of all Members of the Council. Minutes The minutes of meeting held February 2, 1953 were read. On motion of Trustee Middleton, seconded by Trustee Bolmgren, the minutes of meeting held Feb- ruary 2, 1953 were approved as read, by unanimous vote of all Members of the Council. 174 February 9, 1953 Meeting Adjourned On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the meeting �+ was adjourned at 11:30, by unanimous vote of all Members of the Council.
