Hurd at 8:10 P. M. Invocation was given by Reverend Roger Schmuck of St. George's Episcopal Church. The following Council Members were present at roll call: Trustee Bolmgren Trustee Jorvig Trustee Middleton Clerk Justad Mayor Hurd Bids for Municipal Incinerator and Appurtenances As advertised in the St. Louis Park Dispatch January 29, 1953, sealed bids were received and publicly opened and read from the following bidders for furnish- ing of labor, materials and equipment for a 150 ton, 24 hour municipal incinerator installation in accordance with plans and specifications prepared by the G. M. Orr Engineering Company, Consulting Engineers, 1004 Marquette Avenue, Minneapolis 3, Minnesota: 1. Pittsburgh-Desmoines Steel Co. $102,950.00 2. American Incinerator Co. 77,•000.00 3. Nichols Engineering 116,440.00 4. George T. Cook Company 77,755.00 5. Evans Incinerator Co. 123,875.00 On motion of Trustee Bolmgren, seconded by Trustee Middleton, the above bids were referred to the Village Engineer, Chairman of the Garbage Disposal Com- mittee and G. M. Orr Engineering Company for tabulation and recommendation, by unanimous vote of all Members of the Council. Hearing on Application for Rezoning - M. P. Johnson Pursuant to notice published in the St. Louis Park Dispatch February 5, 1953, a public hearing was had on the application of M. P. Johnson for rezoning that part of the North 150 feet of the South 333 feet of the West 165 feet of the S2 of the SWC of the SW4, Section 8, Township 117, Range 21 lying North of the South 163 feet thereof, from Residential Use to Commercial Use.. No persons appeared. Ordinance No. 410 On motion of Trustee Bolmgren, seconded by Trustee Middleton, the following ordinance was adopted by unanimous vote of all Members of the Council.: ORDINANCE NO. 410 AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE VILLAGE OF ST. LOUIS PARK The Village Council of the Village of St. Louis Park ordains: Section 1, The Zoning Ordinance of the Village of St. Louis Park adopted January 20, 1932, as heretofore amended, is hereby further amended by reclassifi- cation of the area of the respective use districts as defined in Section 2.2 of said ordinance and the use district maps therein referred to, as follows: That part of the North 100 feet of the South 283 feet of the West 165 feet of the S2 of the SW41 of SW-, Section 8, Township 117, Range 21 now classified within the Residence Use District shall be deleted from said Residence Use District and included in the Commercial Use District and shall be subject to all of the regulations of said ordinance relating to Commercial Use District. Section 2. Section 2.2 of said ordinance and the use district maps therein referred to are hereby further amended as follows: That part of the West 165 feet of the Si of SWC of SIT*, Section 8, Township 117-N, Range 21, lying North of the South 283 feet thereof, 176 February 16, 1953 - Ordinance 953 -Ordinance No. 410, Continued now classified within the Residence Use District shall be deleted from said Residence Use District and included in the Multiple Dwelling Use District and shall be subject to all of the regulations of said ordinance relating to Multiple Dwelling Use District, provided that use of said premises shall be restricted to double bungalows. Section 3. This ordinance shall take effect from and after its publi- cation. _Deferred Action on Rezoning - Cusack & Carlson, Inc. Action on hearing had on February 9, 1953 on the application of Cusack & Carlson, Incorporated for rezoning of Lots 44, 45, 46, 47, Block 3, Browndale Addition, from Residential Use to Commercial Use, was deferred to this meeting. Ordinance No. 411 On motion of Trustee Jorvig, seconded by Trustee Bolmgren, the following ordinance was adopted by unanimous vote of all Members of the Council: ORDINANCE NO. 411 AN ORDINANCE AMENDING THE ODNING ORDINANCE OF THE VILLAGE OF ST. LOUIS PARK The Village Council of the Village of St. Louis Park ordains: Section 1. The Zoning Ordinance of the Village of St. Louis Park adopted January 20, 1932, as heretofore amended, is hereby further amended by reclassifi- cation of the area of the respective use districts as defined in Section 2.2 of said ordinance and the use district maps therein referred to, as• follows: Lots 44, 452 46 and 47, Block 3, Browndale Addition shall be deleted from the Residence Use District and included in the Commercial Use District and shall be subject, to all of the regulations of said ordinance relating to said Commercial Use District, said rezoning to be on condition, however, that the ovmers of the premises execute agreement with the Village, approved by the Village Attorney,, providing for planting before October 1, 1953, and maintenance of a planting screen of assorted evergreen trees, shrubs and buckthorne hedge on the southerly and easterly boundary of the premises rezoned. Section 2. This ordinance shall take effect from and after its publication. Petition for Vacating Portion of Street - C. K. Bros. , Inc. Petition of Clarence K. Bros, Incorporated, dated February 16, 1953, for the vacation of a part of Gorham Avenue between 1st Street NW and 2nd Street NW, was read. On motion of Trustee Bolmgren, seconded by Trustee Middleton, the above petition was referred to the Planning Commission for checking and recommendation, by unanimous vote of all Members of the Council. Claim for Damages to Refrigerator - Lachlan M. Noren Mr. Lachlan M. Noren, 5620 West 37th Street (Veterans Housing Area) appeared regarding damage to his refrigerator alledgedly done by Plumbing Inspector,.Edwin Gilbert on August 22nd, 1952 when he came to repair their stopped-up sink. He brought in a clock, a tray, and metal glass as evidence showing damage to these three pieces, stating that the refrigerator was also damaged. Said he did not have an estimate of the damage due to the fact that the man who could give him this figure is in St. Paul and so far has not been over to see the refrigerator. Mrs. Cihoski was also present. Said she was caring for the Noren children at the time Mr. Gilbert came to repair the sink and explained what he did Having no success, Mr. Gilbert secured two cans of lye and used same in the sink and it splashed onto the refrigerator. Mrs. Noren said she called the Village Hall regarding the damage and Mr. Gilbert came over and said it was not his fault. He hollared at her and made her feel badly. Mrs. Renner came up and at her visit said she felt that the Village was responsible, but evidently her report to the Council was changed. Mayor Hurd said he will see that something is done about it. It was moved by Trustee Bolmgren, seconded by Trustee Jorvig that the Clerk communicate with Mr. Noren and tell him the Village Council is disposed to meet his claim, and for him to furnish an estimate of the cost of repairs, by unanimous vote of all Members of the Council. February 16, 1953 177 Surety Bond Canceled - Vernice E. Larson Because Vernice E. Larson is no longer employed in the office of Water Registrar, it was moved by Trustee Middleton, seconded by Trustee Bo1mgren, Surety Bond No. 23-490-049 with Vernice E. Petitions for Street Improvements On motion of Trustee Middleton, seconded by Trustee Bolmgren, the following petitions were referred to the Village Engineer, Chairman of the Street Department Committee, and Special Assessment Department for checking and recommendation, by unanimous vote of all Members of-the Council. Street Sign Ordered On motion of Trustee Jorvig, seconded by Trustee Bo1mgren, the Street Com- missioner was instructed to place a street sign at the corner of Raleigh and Princeton Avenues, by unanimous vote of all Members of the Council. Bid Award - Grading and Graveling - Job No. 52-450 On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the bid of Terry Brothers, Incorporated received January 26, 1953, for grading and graveling of WEST 26TH STREET FROM HIGHWAY NO. 100 TO MONTEREY AVENUE was determined to be the lowest bid of a responsible bidder, and the Mayor and Clerk were authorized to execute contract for the Village with the bidder for the work at price bid of $14,665.002 by unanimous vote of all Members of the Council present. Building Inspector's Weekly Report The Building Inspector's report for week ending February 13, 1953, showing that 8 building permits were issued, totaling $77,500.00, was read and ordered filed. Minutes The minutes of meeting held February 9, 1953 were read. On motion of Trustee Middleton, seconded by Trustee Bolmgren, the minutes of meeting held February 9, 1953 were approved as read, by unanimous vote of all Members of the Council. Report of Liquor and Cigarette Tax The Clerk reported the receipt of $12,227.76 for Liquor tax and $11,774.55 for Cigarette tax as the Village's share for the first half of 1953• Request to Use Vacant Veterans Housing Unit for Storage Purposes On motion of Trustee, Bolmgren, seconded by Trustee Middleton, the request of Water Superintendent, Ira M. Vraalstad to use Veterans Housing Unit (now vacant) at 5710 West 37th Street for storing of meters, meter horns, corporation stops, split repair sleeves, valves and other supplies; also portable pumps, light plants and other supplies and equipment which cannot be stored outside, was approved by unanimous vote of all Members of the Council. Vacating Veterans Housing Project On motion of Trustee Bolmgren, seconded by Trustee Middleton, the Clerk was instructed to notify all tenants living at the Village Veterans Housing Project that the project will be closed by the Village on July 1st, 1953; and that all tenants should vacate said premises not later than that date. Motion was passed by unanimous vote of all Members of the Council. Resolution On motion of Trustee Jorvig, seconded by Trustee Bo]mgren, the following resolution was adopted by unanimous vote of all Members of the Council: R E S O L U T I O N WHEREAS the Village Council of the Village of St. Louis Park meeting in a joint session with the Fire Civil Service Commission and the Chief of the Fire Department recognize the serious manpower shortage in the Fire Department,- recommend the following resolution for adoption, therefore BE IT RESOLVED that the Volunteer Fire Department be requested to increase the personnel of the Department by the addition of ten (10) Village Employees who have made application for membership in the Volunteer Department, and such other citizens as are available; the Village Employee's to be approved by the Village Council and the Chief of the Fire Department -- the other applicants to be approved in such manner as the Volunteer Department may determine. BE IT FURTHER RESOLVED that such new rules and regulations as may be adopted by the Volunteer Fire Department shall be approved by the Fire Chief and Village Council. Generators for Fire Trucks Approved On motion of Trustee Jorvig, seconded by Trustee Bolmgren, the requisition presented by Fire Chief Williams for 1 Leece-Neville generator for Fire Truck #3 and 1 for Fire Truck #5 was approved, and the Clerk was authorized to issue a purchase order for same to the Fowler Electric Company in the amount of $396.00, to, include installation, by unanimous vote of all Members of the Council. Meeting and Hearings Adjourned to March 2, 1953 On motion of Trustee Jorvig, seconded by Trustee Bolmgren, the meeting of February 16, 1953 lei, Meeting and Hearings Adjourned to March 2, 1953, Continued February 23, 1953 and any hearings set for that date was adjourned until the meeting of March 2, 19532 by unanimous vote of all Members of the Council. Air Packs (Masks) Approved On motion of Trustee Jorvig, seconded by Trustee Middleton, the request of Fire Chief, C. M. Williams to purchase two (2) 1/2 hour Scott aire packs (Masks) from the Minnesota Fire Equipment Company at $139.00 each was approved, and the Clerk was authorized to issue purchase order for same, by unanimous vote- of all Members of the Council, Meeting Adjourned On motion of Trustee Bolmgren, seconded by Trustee Middleton, the meeting was adjourned at 10:48 P.
