A regular meeting of the Village Council was called to order by Mayor
C. L. Hurd at 8:15 P. M.

As advertised in the St. Louis Park-Dispatch November 26, 1953, sealed bids
were received from the following bidders for furnishing two 1953 model, four-door
sedans, according to specifications described therein, with trade-in of One (1)
1951 Ford Custom two-door coach, and One 1952 Ford Customline two-door coach:

On motion of Trustee Bolmgren, seconded by Trustee Middleton, the above bids
were referred to the Finance Committee, and Chairman of the Police Department Com-
mittee for tabulation and recommendation, by unanimous vote of all Members of the
Council present.
Hearing on Petition to Vacate Portion of Streets Paul Strom Et Al
Pursuant to notice published in the St. Louis Park Dispatch November 19 and
263 1953, a public hearing was had on the petition of Paul Strom and others to
vacate that portion of Dakota Avenue from Cambridge Avenue northerly to the
Minneapolis, Northfield.-and Southern Railway Right-of-Way, and that part of Good-
rich Avenue from Edgewood Avenue easterly to the-Minneapolis, Northfield and
Southern Railway Right-of-Way. Paul Strom appeared in favor of his petition.
Resolution
On motion of Trustee Bolmgren, seconded by Trustee Middleton, the following
resolution was adopted by unanimous vote- of all Members of the Council present:
RESOLUTION VACATING PORTION OF STREETS
WHEREAS, there has been filed with the-Village Clerk a petition signed by
all owners bf real property-adjacent to the portions of streets hereinafter vacated,
and
WHEREAS, the Village Council has met at the time and place specified in notice
published in the St. Louis Park Dispatch November 19 and 26, 1953 relating to
vacation of the portions of streets hereinafter described, and has heard all persons
appearing at said meeting and determined that it is in the interest of the public
to vacate said portions of streets, and-
WHEREAS, the petitioner Paul Strom has this"day paid the Village the sum of
$1,500.00 in consideration of said vacation and in payment for damages for previous
trespass on the portions of the streets herein vacated, therefore
BE IT RESOLVED by the Village Council of the Villag6 of'St. Louis Park that
the following portions of public streets as now layed out and dedicated within the
corporate limits of said Village be hereby vacated:
That portion of Dakota Avenue from Cambridge Avenue
northerly to the Minneapolis, Northfield & Southern
Railway Right-of-Way, and that portion of Goodrich Avenue
from Edgewood Avenue easterly to the Minneapolis, North-

Letter Requesting Special Permit to Build Double Bungalow �d
Letter from Carlyle D. Jacobson, 4164 Browndale Avenue, dated December
7, 1953, requesting a special permit to build a double bungalow on Lot 8, Block
4, Boulevard Heights Addition' to St. Louis Park (next to corner of Pennsylvania
Avenue and Minnetonka Boulevard), was read."
On motion of Trustee Bolmgren, seconded by Trustee Middleton, the above,
request was referred to the Planning Commission for checking and recommendation,
by unanimous vote of all,Members of the Council present.
Re: Sign on Residential Property
Richard E. Wyman, 7734 13th Lane appeared regarding the Shell Oil Company's
advertising sign on Wayzata Boulevard, east of Texas Avenue. Feels that -phis
sign is on Residential Use property, and should be taken down. Mayor Hurd said
that he would like to discuss this matter with General Outdoor Advertising Co.
to see what could be done.
Damage to Lot Due to Grading - Emily Heise
Emily Heise, 7400 Minnetonka Boulevard appeared. Complained of the damage
to her lot due to the grading of Nevada Avenue -- cut up to 42 to 5 feet. She
said she would be satisfied with a sloping job. The matter was referred to
Trustee Middleton, and Village Engineer, Phil W. Smith for checking and report.
Change in Course of Minnehaha Creek , - G. A. Morse
G.. A. Morse of Hopkins Terminal, Incorporated spoke regarding changing- of
the course of Minnehaha Creek adjacent to their property north of Excelsior
Boulevard and East of the West Village Limits. He showed the Council the pro-
posed new course for the Creek, and he was asked to show same to the Village
Engineer, Phil W. Smith so that he would be informed as to what was being proposed.
Application for 1953 License
On motion of Trustee Bolmgren, seconded by Trustee Middleton the following
application for 1953 license was approved, and the Mayor and Clerk were authorized
to issue license to expire December 31, 1953, subject to approval of the Building
Inspector, by unanimous vote of all Members of the Council present:

Letter from Adolph Fine, Incorporated, dated December 5, 1953, requesting
a permit to erect a double bungalow approximately 30' x 50' fronting on Colorado
Avenue on Lot 16, Block 2, #dolph Fine Addition to St. Louis Park, was read.
On motion 6f Trustee Bolmgren, seconded by Trustee Middleton, the foregoing
request was referred to the Planning Commission for checking and recommendation,
by unanimous vote of all Members of the Council present.
Request for Street Light
Letter from Sam G. Segal, dated December 1, 1953, requesting that a street
be placed at the corner of Nevada Avenue and .8th Street, was read.
Street Light Ordered
On 'motion of Trustee Middleton, seconded by Trustee Bolmgren, the Northern
States Power Company was ordered to install a street light at the corner of
Nevada Avenue and 18th Street, by unanimous vote of all Members of the Council
present.
Re: Proper Lighting at Wooddale & Excelsior Blvd.
0 motion of Trustee Bolmgren, seconded by Trustee Middleton, Police Chief,
Andy Nelson, and Village Engineer, Phil W. Smith were authorized to negotiate
with the Northern States Power Company for proper lighting of Wooddale Avenue and
Excelsior Boulevard, by unanimous vote of all Members of the Council present.
Report on Plans for Sewer Extensions & Lift Station - Minn. Dept. of Health
Report of Minnesota Department of Health, Section of Water Pollution Control,
dated November 9, 1953, on examination of plans for sewer extensions and lift
Station in the Village was read and referred to the Village Engineer.
Name Added to Off-Sale Liquor License = Kaplan
Letter from Liquor Control Commissioner, Dudley C. Ericson, dated December
31 1953, regarding the addition of Marion Kaplan's name to the off-sale liquor
license of Harold Kaplan, was read.
On motion of Trustee Middleton, seconded by Trustee Bolmgren, the Village
Council approved the 1954 off-sale liquor license for Harold Kaplan and Marion
Kaplan, dba Tonka Liquor Store at 8112 Minnetonka Boulevard, and the Liquor Control
Commissioner was authorized to change the license to show Marion Kaplan as a
partner. Motion was passed by all Members of the Council present.

On motion of Trusi 4
Trustee Bolmgren, seconded by Trustee Middleton, the following
resolution was adopted by unanimous vote of all Members of the council present:
R E S O L U T I O N
WHEREAS, it appears to the Village Council that there is a sufficient sum
of monies in the Water Department Fund to pay the principal and interest on the
January 15, 1953 Series Water Tank Bonds maturing in the year 1954, therefore

BE IT RESOLVED that the levy for payment of said principal and interest
contained in resolution adopted December 15, 1952 is he canceled in the sum
of $28,871.00, and the Village Clerk is hereby instructed to send a copy of this
resolution to the County Auditor of Hennepin County, Minnesota, and. further the
Village Treasurer be authorized to transfer to the Sinking Fund Account for said
January 15, 1953 Series Water Tank Bonds the amount of $28,87f.00 from the Water
Department Fund and deposit same in the- Citizens State Bank.

Street Light Ordered - Wooddale at Rear of 'Miracle Mile
On motion of Trustee Bolmgren, seconded by Trustee Middleton, the Northern
States Power` Company was ordered to place a 6,000 lumin street light on Wooddale
Avenue at the rear of Miracle Mile Shopping Center, by unanimous vote of all
Members of the Council present.
Five Year Service Contract and Guarantee
for Todd Check Protector
On motion of Trustee Middleton, seconded by Trustee Bolmgren, the Clerk was
authorized to execute contract for the Village with The Todd Company, Incorporated
for a five year service contract and guarantee for Todd Check Protector No.
R-747 R 9137 at $14.50 per year, by unanimous vote of all Members of the Council
present.
Check Ordered Canceled
On motion'-of Clerk Justad, seconded by Trustee Middleton, Village Check
No. 4142, dated April 27, 1953, in the amount 'of 05.00, payable to Freeland W.
Harlow and Victorine Harlow was ordered canceled due to settlement made by Council
action October 26, 19532 by unanimous vote of all Members of the Council present.
Partial Payments on Contract Work
On motion of Trustee Middleton, seconded by Trustee Bolmgren, the following
partial payments on contract work in progress, presented by Village Engineer, Phil
W. Smith were approved, and the Mayor and Clerk were authorized to issue warrants

New Patrolman Appointed
On motion of Trustee Middleton, seconded by Trustee Bolmgren, Robert Smetak,
2945 Brunswick Avenue, having qualified by examination held by the St. Louis Park
Police Civil Service Commission on June 17, 1953, was appointed as' Village
Patrolman, effective 1?115=53 at a starting salary of $323.30, by unanimous vote
of all Members of the Council present.
Regional Hearings of Highway Study Commission
On motion of Trustee Middleton, seconded by Trustee Bolmgren, Donald
Sorensen was authorized to attend hearing of Highway Study Commission to be held
at Mankato, December 8,1953, with necessary expenses paid, by unanimous vote of
All Members of the Council present.
Letter Re: Blacktop Mixing Plant - M. G. Astleford Company
Letter from M. G. Astleford, dated December 1, 1953, concerning complaints
about their Blacktop Mixing Plant located at the Republic Creosoting Company on
Walker Street, and their plan for remedying same, was read.
Resolution
On motion of Trustee Bolmgren, seconded by Trustee Middleton the following
resolution was adopted by unanimous vote of all Members of the Council present:
RESOLUTION GRANTING PERMIT -UNDER ZONING ORDINANCE
14HEREAS application has been received from M. G. Astleford to use the E2 of
the NWS. of Section 20, Township 117, Range 21 for location and operation of Black
Top Mixing Plant with water spray device for removal of smoke and dust for a
period of not more than three years, and it appears to the Council that the pro-
posed use is in harmony with the uses authorized in the Light Industrial District
in which said property is located, therefore
BE IT RESOLVED that M. G. Astleford Company be granted permit for use of
the E2 of the NWy of Section 20, Township 117, Range 21 for the operation of a
Blacktop Plant for the processing of bituminous road material on condition that
said plant be equipped with a water spraying device for removal of dust and smoke
approved by the Village Engineer, and that said plant shall not be so operated
as to become a nuisance to occupants of adjacent property.

Oia motion of Trustee Bolmgren, 'seconded by Trustee Middleton, the Village
Clerk was authorized to advertise for bids for a 3/4 ton pick-up truck with trade-
in of One (1) 1949 Chevrolet pick-up truck; bids to be received and opened on
December 285 1953s by unanimous vote of all Members of the Council present.
Invitation to 'Planning Commission Meeting
Inter Office Memo from the Planning Commission, dated December 5, 1953,
inviting the Village Council to attend their next regular meeting on December 9,
1953 to hear Mr. Law of Morell and Nichols, Planning Engineers present, the
preliminary report on rezoning of the area from Excelsior Boulevard to the
Chicago, Milwaukee, St. Paul and Pacific Railroad tracks, and from Highway No. 100
east to Kipling Avenue and Bass Lake, was read.

On motion of Trustee Middleton, seconded by Trustee Bolmgren, the Mayor and
Clerk were authorized to issue Village Employee's December 31st, 1953 salary checks
on December 23rd, 1953, so that they may be used for Christmas, by unanimous vote

Quit Claim Deeds
On motion of Trustee Bolmgren, seconded by Trustee Middleton, the following
quit claim deeds with Richard B. Thomson and Evelyn V. Thomson, his wife of the
County of Hennepin and State of Minnesota; and K. T. Wiedemann of the County of
Sedgwick, State of Kansas as parties of the first part and the Village of St. Louis
Park, Hennepin County, Minnesota as party of the second part were approved and
accepted, and the Village Attorney was instructed to file same with the Office of
Register of Deeds, by unanimous vote of all Members of the Council present:
Reserve Lot .4 "Cedarwood Second Addition", according to the
map or plat thereof on file or of record in the office of the
Register of Titles in and for Hennepin County, Minnesota -- for
park purposes only.
Reserving unto said grantors, their heirs, executors, adminis-
trators, and assigns, a perpetual easement for roadway purposes,
over, and upon and across a strip of land 25 feet in width,
lying Southerly of and adjacent to the line between Reserve
Lots A and B, said Addition, and same extended so that the

Contractor' s Bond & Agreement
On motion of Trustee Bolmgren, seconded by Trustee Middleton, Contractor's C7
bond with Walter D. Giertsen Company, 900 Glenwood Avenue, Minneapolis, Minne-
sota as principal, and Fire Association of Philadelphia,. 401 Walnut Street,
Philadelphia; Pennsylvania as surety, covering contract for repairs after fire
to pump house at 2500 Louisiana Avenue,, Village of St. Louis Park, dated November
24, 1953, in the amount of $625.78 was approved, also agreement by and between
the Village of St. Louis- Park and Walter D.-Giertsen Company for said repairs
was approved, and the Mayor and Clerk were authorized to execute same for.the Vil-
lage, by unanimous vote of all Members of the Council present.
Contractor's Bond
On motion of Trustee Middleton, seconded by Trustee Bolmgren, Contractor's
Bond with Richard B. Thomson of Minneapolis, Minnesota as principal, and Saint
Paul-Mercury Indemnity Company of Saint Paul and surety, dated November 27, 1953,
in the amount' of $103000.00, covering contract dated October 26, 1953 for the
furnishing of all labor and material necessary for the grading and oil stabili-
zing of all streets in Cedarwood Second Addition as shown and dedicated upon the
plat thereof, was approved by unanimous vote of all Members of the Council
present.
Special Meeting to Canvass Election Returns
The Members of the Village Council present concurred in holding a special
meeting on December 9, 1953, at 8:00 P. M. at the Village Hall to canvass the
vote of the Village Election held on pecember 8, 1953 -&nd to approve the verified
claims of Election Judges for their services at said Election.
Adding Machine for Building Department
On motion of Trustee Middleton, seconded by Trustee Bolmgren, the Clerk
was authorized to purchase One (1) Burrought No, 9-10-53 10 column electric adding,
substractin, cr. bal. machine at a price of $360.4`0/ with a trade-in allowance for
old 8 column Victor of $107.00, (Net $253.40), from Hennepin-Lake Stationers, by
unanimous vote of all Members of the Council present.
Repair of Leak 'in-Water Tank Authorized ►
On motion of Trustee Bo1mgren, seconded by Trustee Middleton, Master Tank
Service was authorized to ,repair the leak on elevated water tank No. 1 at a cost
not to exceed $300.00, by unanimous vote of all Members of the Council present.
