L. Hurd at 8:09 P. M. Reverend Lloyd Mordstrom of Park Baptist Church gave invocation. Hearing on Petition for Vacating Street - Zimmerman & Swanson Pursuant to notice published in the St. Louis Park Dispatch December 3, and 10, 1953, a public hearing was had on the petition of Earl P. Zimmerman and Emma M. .Swanson for the vacating of West 25th Street from Lynn Avenue to Monterey Avenue. No one appeared. On motion of Trustee Bolmgren, seconded by Trustee Middleton, action above hearing was deferred to December 28, 1953 in order to give the Village Attorney an opportunity to check titles of lots 1 to 44, Block 8, Thdrpe„Brothers Cedar' Lake Heights Addition, by unanimous vote of all Members of the Council present. Hearing on Petition to Vacate Alley - Cedar Engineering Company Pursuant to notice published. in the St. Louis Park Dispatch December 3 and 10) 1953, a public hearing was had on the petition of Cedar Engineering Company to vacate Alley in Block 29, Rearrangement.of St. Louis Park. Mr. H. Danz, 5818 West 36th Street appeared. Said he was not opposed to the vacation of alley, but was just seeking information. Resolution On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the following resolution was adopted by unanimous vote of all Members of the Council present: RESOLUTION ORDERING VACATION OF ALLEY WHEREAS, the Village Council has met.at the time and place specified in the notice published in the St. Louis Park, Dispatch on December 3 and 10, 19532 relating to the petition of Cedar Engineering, Incorporated to vacate a portion of alley in Block 29, Rearrangement of St..Louis Park, the Council having con- ducted a public hearing on said petition and heard all interested persons, and determined that it is in the interest of the public.to vacate said alley, and WHEREAS, said petition is a sufficient petition, signed by the owner of all the property fronting upon said alley to be vacated, therefore BE IT RESOLVED by the Village Council of the Village of St. Louis Park that that part of alley in Block 29, Rearrangement of St. Louis Park lying east of the west line of Lot 19, said block, according to the plat thereof on file and of record in the office of the Register of Deeds of Hennepin County, as the same is now dedicated and laid out in said Village as a public alley, be hereby vacated. Resolution On motion- of Trustee Bolmgren, seconded by Trustee Middleton, the following resolution was adopted by unanimous vote of all Members of the Council, present: R E S O L U T I O N RESOLVED that the Village will accept conveyance from Salkin and Linoff to a 50 foot strip immediately adjacent to the south meandered edge of Minnehaha Creek as the bed of the creek is now proposed to be modified over the northerly portion of Salkin and Linoff property, in fulfillment of condition of Ordinance No. 342, such deed to be accepted on condition that the Village accept no obligation, to maintain any dikes constructed upon the 50 foot strip. Bid Award - Sanitary Sewer No. 53-127 On motion of Trustee Middleton, seconded by Trustee Bolmgren, .the bid of William V. Terry Company received earlier this meeting for the construction of sanitary sewer in the north side of Excelsior Boulevard from the West Village limits to 1100' East was determined to be.the lowest bid of a responsible bidder.; and the Mayor and Clerk were authorized to execute contract for the Village with the bidder for the work at price bid of $7,320.00, by unanimous vote of all Members of the Council present. December 21, 1953 Deferred Action on Proposed Comprehensive Rezoning Action on hearing held December 14, 1953, on proposal submitted to the Village Council by the Planning Commission to rezone property described in adver- tisement for said hearing, published in the St. Louis Park Dispatch, November 12 19 and 26, 1953, was again deferred to meeting of December 28, 1953, by unanimous vote of all Members of the Council present. Hearing Date Set for Alley Vacation On motion of Trustee Bolmgren, seconded by Trustee Jorvig, January 18, 1953 was set as hearing date for the vacation of alley adjacent to Lots 1 and 2. Block 2, Calhoun Addition, by unanimous vote of all Members of the Council present. Deed for Alley Purposes On motion of Trustee Jorvig, seconded by Trustee Middleton, the Clerk was instructed to advise the St. Louis Park Theatre Company that the Village will accept their deed for alley °purposes, a strip of land 7 feet in width lying westerly to the alley dedicated on the plat of Block 1, Calhoun Addition and northerly of the south line of West 31st Street extended west, by unanimous vote of all Members of the Council present. Hearing Date Set for R6zoning On motion of Trustee Bolmgren, seconded by Trustee Jorvig, January 25, 1953 was set as hearing date for rezoning Lots 1 to 11, inclusive, Block 2, Calhoun Addition from Residential Use District to Commercial Use District, by unanimous vote of all Members of the Council present. Planning Commission's Report on Application for Permit to Erect Sign - NW Sign Planning Commission's Report dated December 16, 1953, on the application of NW Sign Erectors for a permit to erect an advertising sign at 2931 Texas Avenue, was read. - On motion of Trustee Middleton, seconded by Trustee Bolmgren, the application of Northwest Sign Erectors for a permit to erect an advertising sign at 2931 Texas Avenue was approved by unanimous vote of all Members of the Council present. Planning Commission's Report on Request for Permit to Build Double Bungalow Fine Planning Commission's report dated December 16, 1953, on the request of Adolph Fine, Inc. for a permit to erect a double bungalow approximately 30' x 50' fronting on Colorado Avenu6 on Lot 16, Block 2, Adolph Fine's Addition, was read. Hearing Date Set for Erection of Double Bungalow Fine Planning Commission's report dated December 16, 1953, on the request for permit to construct a double bungalow on Lot 16, Block 2, Adolph Fine's Addition was considered for hearing, and January 18, 1953 was set as date for same, by unanimous vote of all Members of the Council present. Planning Commission's Report on Application for Permit to Erect Advertising Sign Planning Commission's report dated December 16, 1953, on the application of Naegele Advertising Company for a permit to erect an advertising sign on the property of Minneapolis, Northfield and Southern Railroad Company known as Lot 33, Block 176, Rearrangement of St. Louis Park (West Lake Street East of the RR Crossing), was read. On motion of Trustee Middleton, seconded by Trustee Jorvig, the Clerk was instructed to forward copy of the Planning Commission's report on above application for permit to erect advertising sign? by unanimous vote of all Members of the Council present, to Naegele Advertising Company. Planning Commission's Report_ on Request for Rezoning - Adolph Fine, Inc. Planning Commission's report dated December 16, 1953, on the request of Adolph Fine, Incorporated for rezoning Lots 1, 2, 3, and 4, Block 3, Adolph Fine's Addition from Residential Use to Commercial Use, was read. On motion of Trustee Middleton, seconded by Trustee Bolmgren, the Clerk was instructed to furnish Adolph Fine with a copy of the Planning Commission's report on request for rezoning Lots 1, 2, 3, and 4, Block 3, Adolph Fine's Addition, by unanimous vote of all Members of the Council present. Planning Commission's Report on Request to Build Double Bungalow - C. D. Jacobson Planning Commission's report dated December 16, 1953, on the request of Carlyle D. Jacobson for a special permit to build a double bungalow on Lot 8, Block 4, Boulevard Heights Addition, was read. On motion of Trustee Middleton, seconded by Trustee Bolmgren, the request of Carlyle D. Jacobson for a special permit to build a double bungalow on Lot 8, Block 4, Boulevard Heights Addition was denied by unanimous vote of all Members of the Council present. 94 December 21, 1953 Planning Commission's Report on Request for Rezoning - G. B. Miller Planning Commission's report dated December 16, 1953, on the request of G. B. Miller for rezoning Lots 171 and 172, Richmond Third Addition from Residential Use to Commercial Use for the purpose of building a one-story steel and concrete block building approximately 75' x 801, with space for two stores and professional offices, was read. On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the Village Council concurred in the Planning Commission's recommendation relative to above request for rezoning, and same was denied by unanimous vote of all Members of the Council present. Applications for Licenses On motion of Trustee Jorvig, seconded by Trustee Miller, the following applications for 1954 licenses were approved, and the Mayor -and. Clerk were authorized to issue licenses to expire December 31,' 1954, by unanimous vote of all Members of the Council present. December 210 1953 95 Resolution On motion of Trustee Middleton, seconded by Trustee Bolmgren, the following resolution was adopted by unanimous vote of all Members of the Council: RESOLUTION CANCELING 51-142 SANITARY SEWER #500 ASSESSMENT WHEREAS it appears that by resolution of the Village Council adopted September 18, 1952, levying assessments for 51-142 Sanitary Sewer #500, the following property owner was charged for 67 feet of said improvement on Wooddale Avenue. However, since said owner is ,'also assessed for 77 feet of Sanitary Sewer on Hamilton Street it is hereby RESOLVED by the Village Council of the Village of St. Louis Park that the above assessment be reduced to 20 feet, 'and that the 1953 installment of such assessment heretofore overpaid in the respective amount set forth below be refunded to the respective property owner, and, upon receipt of a signed verified claim and a paid tax statement, that the Mayor and the Clerk be hereby authorized to issue a warrant in payment of such refund to the respective property owner. On motion of Trustee Middleton, seconded by Trustee Bolmgren, the above request was approved and the Building Inspector was authorized to issue permit for same, by unanimous vote of all Members of the Council. Request for Civil Defense Supplies On motion of Trustee Jorvig, seconded by Trustee Bolmgren, the requisition presented by Civil Defense Director, Ralph La Hue for 3300 civil defense armbands in the amount of $402.00 was approved, and the Clerk was instructed to issue a purchase order to Wentworth Forman Company, Incorporated for same, charging the cost to the Civil Defense account, by unanimous vote of all Members of the Council present. (Village Requisition No. 426) Request for Civil Defense Equipment On motion of Trustee Jorvig, seconded by Trustee Bolmgren, the requisition presented by 'Civil Defense Director, Ralph La Hue for 36 folding chairs at $4.12 each was approved, and the Clerk was instructed to issue a purchase order for same in the amount of $148.32 to 0. J. Rental and Sales Company, charging the cost to the Civil Defense account, by unanimous vote of all Members of the Council present. (Requisition No. 427). Request for Cabinet, Shelves, Etc. - Civil Defense ,On motion of Trustee Jorvig, seconded by Trustee Bo1mgren, the requisition presented by Civil Defense Director, Ralph La Hue for One steel cabinet, two sets of steel shelves and one steel waste basket in the totalunt of $130.00 was approved and the Clerk was authorized to issue purchase order for same, by unani- mous vote of all Members of the Council present. Permission to Place Poles On motion of-Trustee •Jorvig, -seconded by Trustee Bolmgren, the Northern States Power Company was granted permission to place poles at the following loca- tions, by unanimous vote of all Members of the Council present. Two (2) poles on Quentin Avenue from Vallacher Avenue to Excelsior Boulevard. Letter Re: Parking S.A.R. 5 (Minnetonka Boulevard at Texa-Tonka Shopping Center Letter from Hennepin County Highway Department, dated December 17, 1953, with regard to the traffic hazard existing on the NS Minnetonka Boulevard at the Texa Tonka Shopping Center, was read. The Clerk was instructed to give a copy of said letter to Andy Nelson, Police Chief for checking and recommendation, and to write to L. P. Pederson, Assistant County Engineer of the Hennepin County Highway Department informing him of same. Request for Removal of Limitations of On-Sale Liquor License Letter ffom Frank Theros, Secretary and Treasurer and General Manager of Lilac Lanes Cafe, dated December 21, 1953, requesting that the Village Council remove the limitations on their On-Sale Liquor License, was read. On motion of Trustee Middleton, seconded by Trustee Holmgren, January 11, 1954 was -set as date for public hearing on above request, by unanimous vote of all Members of the Council present. Petition for Curb and Gutter On-motion of Trustee Bolmgren, seconded by Trustee Middleton, the following petitions were referred to the Village Engineer, Chairman of the Street Department Committee, and Special Assessment Department, for checking and recommendation by unanimous vote of all Members of the-Council present: P-1388 PETITION FOR CURB AND GUTTER, signed by Reverend Roger Schmuck, and Frank D. Report on Student Fares - Minn. Railroad & Warehouse Commission Report of Minnesota Railroad and warehouse Commission, dated December 18, 1953, showing that an extension of temporary student rates for street car and bus fares be extended from January 1, 1954 to March 20, 1954, was read and ordered filed. Pa7ment for Architectural Services for Public Safety Building On motion of Trustee Bolmgren, seconded by Trustee Middleton, the claim of Mc Enary and Krafft, Architects for architectural services for construction of proposed building for the Village, in accordance with agreement dated January 31, 1951, in the amount of $500.00 was approved, and the Mayor and Clerk were authorized to issue warrant covering same, by unanimous vote of all Members of the Council present. Letter Re: Grade Change Due to Street Improvement - • R. B. Thomson Letter from Richard B. Thomson, dated November 18, 1953, stating that due to grading of West 25th Street 'and of Huntington Avenue adjacent to Lot 3, Block 3, Cedarwood has materially reduced the value of said lot, and that it will require considerable amount of fill to bring it up to grade, was read. On motion of Trustee Jorvig, seconded by Trustee Middleton, the foregoing matter was referred to the Village Engineer for checking of profiles, and report, by unanimous vote of all Members of the Council. Building Inspector's Weekly Report Report of Building Tnspector, Peter Stienstra for week ending December 18, 1953, showing that 9 building permits were issued, totaling $63,000.00, was read and ordered filed. Report of Nursing Service for November, 1953 Report of Rural Hennepin County Nursing Service for the month of November, 1953, was read and ordered filed. Re-convey Property to State On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the Mayor and Clerk were authorized to re-convey to the State of Minnesota, Lot 18, Norwaldo Addition, and that portion not being used for an alley of Lot 16, described as follows: Commencing at the SE Corner of said Lot 16; thence north along the east line of said Lot 16, a distance of thirty (309 feat; thence Sally a distance of thirty-eight (381) feet to a point in the south line of said Lot 16, twenty- three (23') feet west of the SE corner of said Lot 16; thence east twenty-three (231) feet along the south line of said Lot 16 to the point of'beginning. Motion was passed by unanimous vote of all Members of the Council present. Request to Use Property for Drainage On motion of Trustee Middleton, seconded by Trustee Jorvig, the Mayor and Clerk were instructed to file an application with the State Commissioner of Taxation for permission to use Lots 4 and 5, Block 71, St. Louis Park for drainage purposes, as at present we hold permission to use same for park 'purposes only, by unanimous vote of all Members of the Council present. The following Council Members were present at roll call: Trustee Bolmgren Trustee Jorvig Trustee Middleton Clerk Justad Mayor Hurd Salaries and Wages for 1954 The matter of salaries and wages f6r the year 1954 was discussed at length, and action on same was deferred to the meeting of December 28, 1953 'by common` consent of all Members of the Council present. ' Recommendation for Change in Police Civil Service Rules and Regulations On motion of Trustee Jorvig, seconded by Trustee Bolmgren, the Clerk was instructed to write the Police Civil Service Commission as follows: "That the Village Council has considered their letter of November 19, 1953, and concur in their recommendation that an established line of promotion be adopted. The Village Council requests that the Police Civil Service Commission amend the Rules and Regulations of said Commission with respect tq Section 21, entitled CLASS OF POSITIONS for the purpose of establishing the recommended line of promotion. The Village further concurred in the filling of position of Rank 4, entitled Police Captain, and requests that an examination be given for promotion to this rank as provided in Section 13 in said Rules and Regulations. The Council notes the recommendation for the elevation of Patrolman, F. J. Senander to Captaincy and expresses the hope that as a result of the competitive examination that his efficiency, Character, conduct and seniority in the local department, he may qualify for the favorable consideration of the Com- mission in making that' promotion, and the Council further directs that Section 18 of Rules and Regulations of the Police Civil Service Commission be amended to conform to the Section 5 of Ordinance No. 219 and amendments regarding sick leave and vacation leave with pay, and the Village Council further directs the Commission to provide in said rules for time off on holidays as granted other Village Employees, or com- pensation time off in lieu thereof in accordance with public safety demands and departmental convenience as arranged for by the Chief of Police and his staff."
