REGULAR MEETING SEPTEMBER 8. 1952
A regular meeting of the Village Council was called to order by Mayor C. L.
Hurd at 8:08 P. M. The following Council Members were present at roll -call

On motion of Trustee Bo]mgren, seconded by Trustee Middleton, the above bids
were referred to the Village Engineer and Chairman of the Sewer Department Com-
mittee for tabulation and recommendation, by unanimous vote of all members of the
Council.

Hearing on Proposed Construction of Storm Sewe'r'- 52-405
Pursuant to notices published in the St. Louis Park Dispatch August
21 and 28, 1952, a public hearing was had on proposed Storm Sewer Improvement
No. 52-405 to be constructed along the south Ten (101) feet of the North
Fifty (501j feet of Lot 37, Block 1, Highwood Tract, Lake Forest Addition.
No persons appeared. -
On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the above
matter was referred to the Committee of the.Whole for a report on Monday,
September 15, 1952, by unanimous vote of all Members of the Council.
Hearing on Proposed Storm Sewer Construction - 51-140
A hearing was had on Storm Sewer Improvement No. 51-140. No one appeared.
Resolution Ordering Storm Sewer
On motion of Trustee Middleton, seconded by Trustee Jorvig, the following
resolution was adopted by unanimous vote of all members of the Council:;

T&EREAS the Village Council has met at the time and place specified in a
notice relating to Storm Sewer Improvement No. 51-140 published in the St. Louis
Park.Dispatch August 21st and 28th, 1952, and has heard all interested persons
appearing at said meeting and determined the necessity for said improvement,
therefore,
BE IT RESOLVED by the Village Council.of the Village of St. Louis Park
that.Storm Sewer Improvement No. 51-140 be hereby ordered constructed in Alley
in Block 3, Lenox, in accordance with plans.and specifications which have been
prepared by the Village Engineer and which are hereby approved. The Clerk is
directed to advertise for bids to be opened.by the Council at its meeting

Hearing on Proposed Water Main Improvement No, 52-231A
A hearing was had on Water Main Improvement No. 52-231A. No one appeared.
Resolution Ordering Water Main
On motion of Trustee Bolmgren, seconded by Trustee Middleton, the follow-
ing resolution was adopted by unanimous vote ofjall members of the Council:

IMPROVEMENT NO. 52-231A
WHEREAS the Village Council has met at the time and place specified in a
notice relating to Water Main Improvement No. 52-231A published in the.St. Louis
Park Dispatch August 21, 1952, and August 28, 1952, and has heard all interested
persons appearing at said meeting and determined the necessity for said improve-
ment) therefore
BE IT RESOLVED by the Village Council.of the Village -of St. Louis Park
that -Water Main Improvement No. 52-231A be hereby ordered in Minnetonka Boulevard
from Aquila Avenue to 8340 Minnetonka Boulevard in accordance with plans and
specifications which have been prepared by the Village Engineer and which are
hereby approved. The Clerk is directed to advertise for bids to be opened by
the Council at its meeting September 22nd, 1952.
Petition ftDosing Operations of _Black Top Service Com
Petition received this date, signed by Mr. and Mrs. James Fitzgerald,
3340 Brownlow and others, describing the unhealthful and unpleasant condition
arising out of the maintenance and operation of the Black Top Service Company at
3600 Republic Avenue, and requesting abatement of same, was read.
On motion of Trustee Jorvig, seconded by Trustee Middleton, the Village
Attorney was instructed to take such action as he may deem necessary to abate -
nuisance as requested in above mentioned petition, by unanimous vote of all -
Members of the Council.
Petition for Stop Sign -- 36th & Xenwood
Petition signed by Arthur Scheuble, 5709 West 36th Street and others, dated
September 8, 1952, explaining the need for a STOP sign at the intersection of
36th Street and Xenwood Avenue, bringing to a stop, cars going east or west on
36th Street in order to promote a safe condition for children, was read.
On motion of Trustee Middleton, seconded by Trustee Jorvig, as requested
in above mentioned petition, the Street Commissioner was ordered to place a
STOP sign on 36th Street at Xenwood Avenue to stop East and West traffic on 36th
Street, by unanimous vote of all Members of the Council.

Planning Commission's Report on Request for Permit to Build Industrial Building
The Planning Commissionts report dated September 5, 1952, on the request of
Allan Garrison for a permit to build an industrial building on Lots 12, 13, and
14, Block 67, Rearrangement of St. Louis ,Park was read.
Building Permit Authorized for Industrial Building
On the recommendation of the Planning Commission, it was moved by Trustee
Middleton, seconded by Trustee Jorvig, that the Building Inspector was authorized
to issue a building permit to Allan Garrison for the construction of an industrial
building on Lots 12, 13, and 14, Block 67, Rearrangement of St. Louis Park with
the understanding that the 20 foot setback be observed; that parking space be
provided for every 1000 ft. gross floor area as required by Section 14.5 Sub-
division 5 of the Zoning Ordinance, and that the front of the building is finished
with brick and stucco, and that the working plans be approved by the Building
Inspector. Motion was passed by unanimous vote of all Members of the Council.
Planning Commissionts Report on Request for Rezoning - Joe Billman
The Planning Commission's report dated September 5, 1952, on the request of
Joe,Billman for rezoning the balance of their property at Excelsior Boulevard and
5dooddale Avenue for Commercial Use was read.
Hearing Date Set for Rezonin
On motion of Trustee Bolmgren, seconded by Trustee Jorvig, October 6, 1952
was set as hearing date on the request of Joe Billman for rezoning of his property
located at Excelsior Boulevard and Wooddale Avenue for Commercial Use -- the
legal description of which is as follows:
"Commencing at a point which is S 34 degrees 12 minutes
E 279 62/100 feet from a point 6 6/100 chains E of SW
Corner of NW4 of NW4 thence N 34 degrees 12 minutes W
120 3/10 feet; thence S 67 degrees W 191 feet; thence S
34 degrees 12 minutes E to a point which bears S 55
degrees 48 minutes W from point of beginning; thence NEly
to beginning except roads."
Planning Commission's Report on Petition for Vacating Street
The Planning Commission's report on the petition of Wm. Lundin, dated
September 4, 1952, for the vacation of 27th Street from Blackstone Avenue to the
Minneapolis and Northfield and Southern Railroad Tracks (adjacent to Lot 1,
Block 3, Park Manor, was read.
Petition for Vacating Street Denied
As recommended by the Planning Commission, it was moved by Trustee Middleton,
seconded by Trustee Bo]mgren, the petition of Wm. Lundin and others, for the
vacation of 27th Street from Blackstone Avenue to the Minneapolis, Northfield and
Southern Railroad Tracks (adjacent to Lot 1, Block 3, Park Manor Addition) was
denied on the basis that 27th Street borders on a heavy traffic district and some
time in the future it may be necessary to cut through a road in order to gain
access in and out of the heavy traffic district. Motion was passed by unanimous
vote of all Members of the Council present.
Bingo - Holy Family Catholic Church
Letter from Ernest W. Andresen, Bingo Chairman for Second Annual Bazaar,
Holy Family Catholic Church, dated September 3, 1952, requesting permission to
play Bingo Saturday and Sunday, November 8th and 9th, 1952, was read. No action
taken.
1952 Licenses
On motion of Trustee Jorvig, seconded by Trustee Middleton, the following
applications for 1952 licenses were approved, and the Mayor and Clerk were authorized
to issue licenses to expire December 31, 1952, by unanimous vote of all Members of
the Council:

On motion of Trustee Middleton, 'seconded by Trustee Bolmgren, the following
resolution was adopted by unanimous vote of all Members of the Council:
RESOLUTION REFUNDING GARBAGE COLLECTION ASSESSMENT
WHEREAS it appears that by resolution of the Village Council levying assess-
ments for garbage collection, the following lot was inadvertantly assessed,
whereas this lot is vacant and therefore not serviced by garbage collection;
therefore,

BE IT RESOLVED that the 1952 installment of such assessment heretofore
paid in,the respective amount hereinafter set forth be refunded to the respective
property owner, and that, upon receipt of a signed verified claim and a paid
tax statement, that the Mayor and the Clerk be hereby authorized to issue a
warrant in payment of such refund to the respective property owner.

Street Light Ordered
On motion of Trustee Jorvig, seconded by Trustee Bolmgren, the Northern
States Power Company was instructed to place a street light at the Corner of
Princeton Avenue and 38th Street, by unanimous vote of all Members of the Council.
Quit Claim Deed
On motion of Trustee Bolmgren, seconded by Trustee Middleton the quit claim
deed with Rolph H. Hertsgaard and Phyllis Hertsgaard, husband and wife, and
Wallace T. Bruce and Katherine D. Bruce, husband and wife as parties of the first
part, and the Village of St. Louis Park as party of the second part, conveying
the following described property for sewer and water main purposes, was approved
and accepted, by unanimous vote of all Members of the Council:
An easement for sewer and water main purposes in and over
that part of Lot Twenty-two (22), Block One (1), Brook -
lawns Addition, according to the plat thereof on file and
of record in the office of the Registrar of Titles of
said Hennepin County, lying southerly of a line drawn
parallel to the southerly line of said Lot Twenty-two (22),
and measured seven and 5/10 (7.5) feet at right angles
from said southerly line and northerly thereof.
Said easement is more particularly described as the free
right to forever enter upon said premises at all reasonable
times and excavate the soil and construct and install therein
public sanitary and storm sewers and water mains and to
forever use and maintain said sewers and water mains as a
part of the public utility system of said Village and in-
cluding the right to enter upon the premises at all reason-
able times for the purpose of inspection, repairing and
reconstructing any sewer or water main constructed therein,
provided always that in the event of any excavation of the
soil, the same will be replaced and the surface restored as
nearly as practicable,to the condition it was in at the
time the excavation was made.
Planning Commission's Report on Request for Permit to Build Gas Station
The Planning Commission's report on the request of Continental Oil Company
for a permit to build a gas service station on the NW Corner of Brunswick
Avenue and Excelsior Boulevard, was read.
Building Permit For Gas Station Approved
On the recommendation of the Planning Commission, it was moved by Trustee
Jorvig, seconded by Trustee Bolmgren, that the Building Inspector be authorized
to issue a building permit to Continental Oil Company for the construction of
a gas station on the NW Corner of Brunswick Avenue and Excelsior Boulevard with
the understanding that steel tile facing be used:on the outer walls, proper
setbacks and planting to screen the station from the residence property ad-
joining, and that the working plans be approved by the Building Inspector.
Motion was passed by the following roll call vote -----Trustee Jorvig, yea;
Trustee Bolmgren, yea; Clerk Justad, yea. Mayor Hurd and Trustee Middleton -
voting nay.
Partial Payments on Contract Work
On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the following
partial payments on contract work in progress, presented by Village Engineer,
Phil W. Smith, were approved, and the Mayor and Clerk were authorized to issue

Complaint Re: Bituminous Plant
Mrs..Wm. Wende, 2212 Kentucky Avenue appeared regarding the bituminous
plant on Louisiana Avenue, North of Cedar Lake Road. Said she has heard that
Nighway #12 is to_be blacktopped with material from this pit. Mayor Hurd said
he didn't believe that this will be done.
She also said she heard a rumor that Louisiana Avenue is to be make a
trunk, or truck highway. Said with that, a park west of Louisiana Avenue would
be a hazard.
She said that Kentucky Avenue between Cedar Lake Road and 16th Street
should be oiled. This matter was referred to Trustee Middleton for checking
and action.
Petition for Curb and Gutter
On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the following
petition was referred to the Village Engineer and Chairman of the Street Depart-
ment Committee for checking and recommendation, by unanimous vote of all Members
of the Council:

Johnson, 7924 Minnetonka Boulevard and others, dated
September 8, 1952, for the construction of curb and
gutter on ALL STREETS AND AVENUES IN MINNEHAHA GABLES
ADDITION.
Adding Machine for Building Department
On motion of Trustee Bolmgren, seconded by Trustee Middleton, the Clerk
was authorized to purchase One (1) Victor Electric adding machine for the Build-
ing Department, from Hennepin -Lake Stationery Store at price quoted of $240.00
with a trade-in allowance on old machine of $26.50 (net price $213.50), by un-
animous vote of all Members of the Council.
Proposal for Payment on Back Rent -Veterans Housing -- W. Knutson
Letter from Mrs. Warren Knutson, 3001 Brunswick Avenue, dated September
81 1952, who formerly lived at 5700 West 37th Street, Apartment "A", Veterans
Housing Area, stating that they were now able to pay $5.00 per month on their
old rent account ($140.00), was read.
On motion of Trustee Middleton, seconded by Trustee Bolmgren, the above
proposal was approved, by unanimous vote of all Members of the Council.
Proposal for Payment on back Rent Veterans Housing -- Vance Marfell
Letter from Vance Marfell, 5740 West 37th Street, Apartment "All, Veterans
Housing Area, dated September 8, 1952 was read in which he made the following
proposition with regard to the payment of his back rent:

Proposal for Payment on Back Rent - Vance Marfell, Continued
On motion of Trustee Middleton, seconded by Trustee Bolmgren, the foregoing
proposal was approved and accepted, by unanimous vote of all Members of the Council.
Payment on Back Rent - Chester Sorensen
Letter from Mr. and Mrs. Chester Sorensen, 3340 Yukon Avenue, dated August
302 1952, who formerly lived at 5720 West 37th Street, Apartment B, Veterans
Housing Area, enclosing a check in the amount of $10.00 to apply on their back
rent account of $495.00, was read.
On motion of Trustee Bolmgren, seconded by Trustee Middleton, the Council
agreed to accept the above mentioned check and apply same on the Sorensen back rent
account, by unanimous vote of all Members of the Council.
Letter Re: Condition of Oxford Street
Letter from Edwin W. Oien, 6215 Oxford Street, Dated September 4, 1952,
complaining about the condition of Oxford Street since the installation of sewer,
was read.
On motion of Trustee Jorvig, seconded by Trustee Bolmgren, the above matter
was referred to the Street Commissioner for checking and recommendation, by unani-
mous vote of all Members of the Council.
Letter Re: Train Whistles - M. & St. L. Ry. Co.
Letter from The Minneapolis & St.,Louis Railway Company, dated September
4, 1952, acknowledging receipt of our letter of August 18th with reference to
excessive sounding of train whistles, was read.
Letter Re: Complaint Against Sewer Contractor
Letter from John A. Bodeman, 3301 Utah Avenue and others, dated September
21 1952, with regard to evasive answers made by Sewer Contractor to questions
asked about who is responsible for damages to private property by the workmen,
was read.
On motion of Trustee Bolmgren, seconded by Trustee Middleton, the above
letter was referred to the Village Engineer for checking and report, by unanimous
vote of all Members of the Council.
Midwest Conference of Building Officials and Inspectors
On motion of Trustee Jorvig, seconded by Trustee Bolmgren, the Building
Inspector was authorized to attend the Midwest Conference of Building Officials
and Inspectors to be held in Chicago, Illinois, September 28, 29, and 30, 1952,
with necessary expenses paid, by unanimous vote of all Members of the Council.
Building Inspector's Weekly Report
The Building Inspector's report for week ending September 5, 1952, showing
that 31 building permits were issued, totaling $333,300.00, was read and ordered
filed.
Justice of Peace Report of Fines - Ynizve
Justice of Peace Anton Yngve's report of fines dated September 3, 1952
was read and ordered filed.
Letter, Resolution - Mpls. and County Employees Union
Letter from Minneapolis City and County Employees Union, dated September 2,
1952, enclosing a proposed contract for working agreement for the Employees of
St. Louis Park who are members of Local 224, American Federation of State, County
and Municipal Employees, was read.
On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the above matter
was referred to the Village Attorney for checking and recommendation; also a copy
of above mentioned letter and proposed agreement mailed to each Council Member,
by unanimous vote of all Members of the Council.
Protest Installation of Water Main
Petition signed by E. S. Hinners and others, dated September 2, 1952, protest-
ing the installation of water main in Forest Lane.
On motion of Trustee Bolmgren, seconded by Trustee Middleton, water main
extension in Forest Lane was ordered taken out of contract, by unanimous vote of
all Members of the Council.
Petition for Water Main P-1191
Petition signed by Hubert D. Bissell, 4009 Cedar Lake Road and others, dated
September 8, 1952 for the construction of water mains in Cedar Lake Road beginning
at the boundary line between said Village of St. Louis Park and the City of Minneapolis
and running westerly to a juncture with the water main already proposed to be laid

along Forest Lane; or if it not be practicable -to make such juncture, then '
continuing westerly along Cedar Lake Road to the extent required to give
service to the properties -which lie immediately easterly of the present
right-of-way of the Great Northern Railway, was read.
Hearing Date set for Water Main
On motion of Trustee Bolmgren, seconded by Trustee Middleton, September
29, 1952 was set as date of hearing for the above mentioned water main cons-
truction; the area to be assessed to published in notice of same, by unanimous
vote of all Members of the Council.
Petition for Water Main P-1190
Petition signed by Walter J. Wheeler, 2105 Glenhurst Avenue and others,
dated September 8, 1952, for the construction of water mains in Glenhurst Road
beginning at its intersection with Forest Road and running northerly to the
turn -around at the end of Glenhurst Road; and also along Highwoord Road begin-
ning at its intersection with Glenhurst Road and running westerly to the
turn -around at the end of Highwood Road, was read.
Hearing Date Set for Water Main
On motion of Trustee Bolmgren, seconded by Trustee Middleton, October 6,
1952 was set as date of hearing for the construction of above mentioned water
main; the -area to be assessed to be the adjacent property. Motion was passed
by unanimous vote of all Members of the Council.
Hearing Date Set for Grading, Etc. Yosemite Avenue -27th -4201 North
Village Engineer, Phil W. Smith reported that the Village Council at
their meeting of August 18th referred to him the petition for grading and
acquisition of additional 30 feet East of present R/W of Yosemite Avenue from
West 27th Street to 120 feet north, stating that the Village has not as yet
acquired this portion of Yosemite Avenue.
On motion of Trustee Bolmgren, seconded by Trustee Middleton, a hearing
on the proposed widening by acquisition of an additional 30 feet East of present
R/W and grading of Yosemite Avenue from West 27th Street to 420 feet north -was
set for October 6, 1952; the area proposed to be assessed is property adjacent
on the east side of the street.
Bond Approved
On motion of Trustee Middleton, seconded by Trustee Jorvig, the following
bond was approved by unanimous vote of all Members of the Council:
HEATING LICENSE BOND with Robert G. Olson as
principal'and New Amsterdam Casualty Company
as surety, dated August 25, 1952, in the amount
of $12000.00. -

was adjourned at 12:08 A.M., September 9, 1952, by unanimous vote of all
