REGULAR MEETING SEPTEMBER 29, 1952
A regular meeting of the Village Council was called to order by Mayor
C. L. Hurd at 8:04 P. M.
Invocation was given by Reverend Gerberding of Church of Christ Luthern
Church.

As -per action taken by -the Village Counbil at meeting of September 15, 1952,
deferring the receipt of bids for construction of sanitary sewer extensions and
lift station (Improvements Nos. 52-301 to 52-308 and 52-429) to this meeting, and
sealed bids were received and publicly opened from the following bidders:

cost per front foot.

On motion of Trustee Middleton, seconded -by Trustee Bolmgren, the above
bids were referred to the Street Commissioner and Chairman of the Street Depart-
ment Committee for tabulation and rdcommendation, by unanimous vote of all
Members of the Council present.
Hearing on Proposed Water Main Extension
A hearing -was had on the proposed water main improvement hereinafter des-
cribed. No persons appeared.
Resolution
On motion of Trustee Bolmgren,`seconded by Trustee Middleton, the following
resolution was adopted by unanimous vote of all members of the Council present:
RESOLUTION ORDERING WATER MAIN CONSTRUCTION
WHEREAS, the Village Council has met at the time and place specified in
the notice relating to extension of Village -water main in Cedar Lake Road from
France Avenue to the east line of Lot 1, Block -3, Forest -Tract, Lake Forest
Addition, published ih the St. Louis -Park -Dispatch on September 11th and 18th,
1952, and has heard all interested persoris-appearing at said meeting and determined
the necessity for said improvement, therefore
BE IT RESOLVED by'the Village Council of the Village of St. Louis Park
that Village 12 inch water main extension be hereby ordered in Cedar Lake Road
from France Avenue to the -east -line of Lot -1, -Block -3, Forest Tract, Lake Forest
Addition. It is the intention that said -main shall -connect mains heretofore
ordered at the respective terminals thereof and is to be constructed in accordance
with plans and specifications prepared by the Village Engineer and which are
hereby approved. The'work"is to be done -under current contract with Phelps -Drake
Company, Incorporated on the basis of unit prices specified therein and as an
approved modification of said contract in place of 12 inch main which was formerly
to be constructed at Forest Lane between France Avenue and Cedar Lake Road and
which is hereby abandoned.
BE IT FURTHER RESOLVED that -the publication of notice of hearing above
referred to and -determination of the area proposed to be -assessed as set forth in
said notice prepared by the Village Clerk be hereby approved and ratified.
Hearing on Proposed Sidewalk Construction
Pursuant to notice published in the St. Louis Park Dispatch September 11,
1952, a public hearing was had on -proposed sidewalk to be constructed -at locations
described therein (Improvements No. 52-421 thru 52-428. The following persons
appeared:
W. L. Schmidt, 3245 Zarthan Avenue -said that neither he nor Mr. C. H.
Mc Neal, 3267 Zarthan Avenue has seen or signed a petition, and are strictly
opposed to the construction of'sidewalk.--Said-it is not needed as there is a
sidewalk across the street that takes -care of this block. Mr. E. H. Gumbel,
3051 Brunswick Avenue, owner of Lot 11, Block 1, Adolph Fine's Addition said that
he does not want the sidewalk either.
Hearing Date Re -Set for Sidewalk Construction
Due to the fact that the above hearing was published only once, hearing
date was re -set for October 20, 1952, -oh proposed -Sidewalk Construction Improve-
ments Nos, 52-421 thru 52-428, by unanimous vote of all Members of the Council
present.

Adjourned Hearings on Proposed Assessments
Adjourned hearings on the proposed assessments for improvements listed
in the following resolution were held. The following persons appeared:
Re: Minnetonka Boulevard Sidewalk and Curb and Gutter Assessment.
Mayor Hurd gave the amount of assessment as $5.60 per ft.- He mentioned
the rumor of the assessment being spread over an area other than those -fronting
on Minnetonka Boulevard and -stated that that was not the proposal. He•suggested
that anyone who felt that they had a credit coming due to good sidewalk taken
up can_ take same up with the Village Engineer for -checking and he also said that
if the taxpayer is_ not satisfied with -the Engineer's opinion he may an appeal
to the Village Council. - Trustee Bolmgren said he feels thesameas Mayor
Hurd, and Trustee Middleton and Clerk Justad-said they also feel the same.
Trustee Jorvig said he has no sidewalk now but expects to pay for same when he
gets it. He feels that $5.60 is a reasonable assessment.
F. W. Harlow, 6109 Minnetonka Boulevard agreed that they should pay for
their own sidewalk but still feels that if -the -folks off the -Boulevard want the
sidewalk they should pay their share: Mayor Hurd said -that there has been no
issue that the assessment will be spread back from Minnetonka Boulevard. J. T.
Kain, 3018 Alabama Avenue complimented the Village Council for their action in
this matter. Ned Joubert, 5920 Minnetonka -Boulevard said he came to -the meet-
ing with the thought in -mind that -he would not talk. However, due to our action
taken this evening regarding the sewer, he -feels -if we -can do -it in one -instance,
we could have done so - in - this -case. He says he and others opposed this project
100%. He has had his home appraised -for sale and he stands -to -lose two to
three thousand dollars due to this Minnetonka -Boulevard project. Mayor Hurd
explained the sewer bids were rejected. Mr. D. J. Sunde•said the gentlemen is
on the right track - we never ordered sidewalk and curb and gutter and we can't
pay same. Our economy is such -that -we can not afford to pay for this. Said
it is beyond him, and others, to pay, but still the Council put this on them.
He is losing three to four thousand in property value, and asked who ordered it.
Trustee Bolmgren said the Village Council ordered it. Mr. Sunde said it was
beyond him why it was ordered.
Mayor Hurd called his attention to the fact that all taxpayers in St.
Louis Park have paid for Minnetonka Boulevard -all -these years. Trustee
Bolmgren explained where his -taxes went - schools, etc. Mayor Hurd rapped for
order. Mr. Sunde said he does not feel that he should pay for a race track on
Minnetonka Boulevard.
Resolution
On motion of Trustee Bolmgren, seconded -by Trustee Middleton, the following
resolution was adopted by the following roll call vote --- Trustee Bolmgren,
yea, -Trustee Jorvig, yea; Trustee Middleton, yea; Clerk Justad, yea; and Mayor
Hurd, yea:
ASSESSMENT RESOLUTION
WHEREAS, the Village Council has met at -the -time and place specified in a
notice published -in the St. -Louis Park Dispatch August 14, 1952, relating to the
assessments hereinafter described and other as--sessments and has conducted separate
public hearings on each of the proposed assessments, therefore
BE IT RESOLVED by the Village Council of the Village of St. Louis Park
that the proposed assessments ori file in the office of the Village Clerk cover-
ing the cost of the following described public improvements heretofore ordered
or completed in this Village be hereby approved, and there be hereby levied
and assessed against each and every tract and parcel -of land described therein
a special assessment in the sums therein respectively -set forth, said assessments
to'be payable in equal annual instalments; the first of which shall be payable
concurrently with taxes levied in the year -1952 and payable in the year 1953
and during the number of years respectively as follows:

Assessment Resolution, Cont'd.
It is hereby determined that each and every tract and parcel of land des-
cribed in said proposed assessments is benefited in the sum equal to the assess-
ments hereby levied on account of the improvement for which the assessment is
livied. Deferred instalments of said assessments shall bear interest at the rate
of 4% per annum from the date of this resolution until August 15th of each year
in which instalments are payable.

On motion of Trustee Middleton,,seconded by Clerk Justad, the following
applications for 1952 licenses were approved, and the Mayor and Clerk were
authorized to issue licenses to expire December 31, 1952, by unanimous vote of

On motion -of Trustee Middleton; seconded -by Trustee Bolmgren, the following
petitions were referred to the Village Engineer and -Chairman of the Street
Department Committee for checking and recommendation, by unanimous vote of all
Members of the Council present:

Street Light Ordered
On motion of Trustee Middleton, seconded by Trustee Bolmgren, the Northern
States Power Company was ordered to place a street light on the Corner of 33rd
Street and Yukon Avenue, by unanimous vote of all Members of the Council present.
Bid Award for Four Three -Ton Trucks
On motion of Trustee Middleton, seconded by Trustee Bolmgren, the bid of
Rettinger Motors, Inc. received earlier this meeting was determined to be the
lowest bid of a responsible bidder for the furnishing of Four (4) Three -ton
Trucks, and the Clerk was authorized to issue a purchase order for same at price
bid of $12,706.56, by unanimous vote of all Members of the Council present.
Bid Award for Clamshell Bucket
On motion of Trustee Middleton, seconded by Trustee Bolmgren, the bid of
The Mc Mullen Company received September 22, 1952, for the furnishing of a 3/8
Cubic Yard Clamshell Bucket was determined to be the lowest bid of a responsible
bidder, and the Clerk was authorised to issue purchase order for same in the
amount bid of $860.00 (Kiesler Type N, No. 34 Bucket), by unanimous vote of all
Members of the Council present.
Building Inspector's Weekly Report
The Building Inspector's report for week ending September 26, 1952, showing
that 19 building permits were issued, totaling $125,150.00 was read and ordered
filed.

Dust Coat Ordered
On motion of Trustee Middleton, seconded by Trustee Jorvig, the Street
Commissioner was ordered to give a dust coat to Colorado and Zarthan Avenues
from Cedar Lake Road to Wayzata Boulevard, by unanimous vote of all Members
of the Council.
Special Permit to Connect to Water Main
On motion of Trustee Bolmgren, seconded by Trustee Middleton, a special
permit was granted to Iner C. Erickson to connect his place of business at
7102 West Lake Street to the water main 1501 east to Hampshire Havnue and Lake
Street, it being understood that he will pay an assessment of $371.30 at the
time he takes out the regular mermit and that he will be given credit for
this assessment when the water main is constructed past said property, arid!that
the work will be done under the supervision of the Superintendent of the Water
Department. Motion was passed by unanimous vote of all Members of the Council.
Rent Control -- Not Extended
It was moved by Trustee Middleton, seconded by Trustee Jorvig, that rent
control in St. Louis Park be extended to April 30, 1953. Motion was lost by
the following roll call vote:

On motion of Trustee Jorvig, seconded by Trustee Bolmgren, the following

Permission to Place Poles
On motion of Trustee Jorvig, seconded by Trustee Bolmgren, the Northern
States Power Company was granted permission to place two poles on WEST 39TH
STREET BETWEEN GLENHURST AND HUNTINGTON AVENUES, by unanimous vote of all
Members of the council.
Permission to Place Poles
On motion of Trustee Jorvig, seconded by Trustee Bolmgren, the Northern
States Power Company was granted permission to place one pole in ALLEY WEST
OF PENNSYLVANIA AVENUE, and south of 13th Lane, by unanimous vote of all
Members of the Council.
Bids for Sanitary Sewers Rejected
On motion of Trustee Bolmgren, seconded by Trustee Middleton, all bids
received September 81 1952 for the construction of Sanitary Sewer Improvements
Nos. 52-254 thru 52-289 and 52-291 thru 52-300 were rejected by unanimous vote
of all Members of the Council present. -
Plans Ordered for Sanitary Sewer for Residential Area
On motion of Trustee Bolmgren, seconded by Trustee Middleton, the Village
Engineer was ordered to prepare plans and specifications for sanitary sewers for
residential area included in above mentioned bids (Improvements 52-254 thru 52-
289 and 52-291 thru 52-300), due to the rejection of same, by unanimous vote of
all Members of the Council.

Appointment to Fire Civil Service Commission
On motion of Trustee Jorvig, seconded by Trustee Bolmgren, Andrew
Bjornson was appointed as a -Member of the Fire Civil Service Commission for term
expiring September 20, 1955, by unanimous vote of all Members of the Council.
Appointment to Police Civil Service Commission
On motion of Trustee Bolmgren, seconded by Trustee Middleton, Eldon
Rempfer was reappointed -to the Police Civil-Service'Commission for term to expire
October 1, 1955, by unanimous vote of all Members of the Council.
Pronosal for Engineering Services for Incinerator
Letter from G. M. -Orr Engineering Company, dated September 23, 1952,
enclosing in duplicate a proposal for engineering services for the proposed
incinerator for the Village of St. Louis Park, was read.
On motion of Trustee Bolmgren, seconded by Trustee Middleton, the Mayor
and Clerk were authorized to sign for the Village, agreement in form approved
by the Village Attorney, with G. M. Orr Engineering Company for engineering
services for designing and supervising construction of garbage incinerator in
accordance with the proposal of that Company dated September 23, 1952, by unanimous
vote of all Members of the Council.
Hearing Date Set for Blacktop
On motion of Trustee Bolmgren,-seconded by Trustee Middleton, October
27, 1952 was set as date for -hearing on petition signed by Charles Von B. Geise,
2716 Raleigh Avenue and others, dated May 16, 1952,'for the application of
black top to ALLEY, BLOCK 4, OAK LAWN ADDITION, by unanimous vote of all Members
of the Council present.
_Letter Re: Traffic Signals for T. H. #169 at -France and Joppa
Letter from J. E. P. Darrell, Traffic Engineer for Minnesota State High-
way Department, dated September 24, 1952, in -reply to our letter of September
19th with regard to our -request for traffic signals -on Trunk Highway No. 169 at
France and Joppa Avenues, stating that a review of the locations will be made
and a report made later, was read and ordered filed with other material on traffic
signals.
Letter Re: Dogs
Letter signed by Mr. and Mrs. Clarke W. Daniel and others, dated Sept.
25, 1952, asking that something be done about the dogs in the area of Kentucky
Avenue between Minnetonka Boulevard and 29th-Stre-et, was read. They claim that
there is a continual marauding of dogs on their garbage cans, and that the
situation is detrimental to health -- was read and referred to the Dog Catcher,
for checking.

Letter from'Ralph Engstrand, 3805 Princeton Avenue, dated September 26th,
referring to petition for blacktop to be -applied to Princeton Avenue from Excelsior
Boulevard to 38th Street, and asking if this work could be done before cold
weather sets in, was read.
Hearing Date Set for Blacktop
On motion of Trustee Bolmgren, seconded by Trustee Middleton, October
27th, 1952 -was set as date for hearing on'petition"for application of blacktop
to Princeton Avenue from Excelsior -Boulevard to 38th Street; area to be
assessed to be adjacent lots and tracts. Motion was passed by unanimous vote
of all Members of the council.
Letter Re: Condition of Road to Gravel Pit
Letter from Elmer Lind, 1670 Lilac -Drive South, dated September 27th,
stating that on the rear of his property is the private road of the Minnesota
Sand and Gravel Company which is used by their trucks and is very dusty, and
asked that same be blacktopped, was read.
On motion of Trustee Bolmgren, seconded by Trustee Middleton, the Clerk
was instructed to write Bury & Carlson to abate dust nuisance by oil treatment of
tar mat, by unanimous vote of all Members of the Council.

Hearing Date Set for Grading, Etc. '
On motion of Trustee Middleton, seconded by Trustee Bolmgren, October 27th,
1952 was set as date for hearing for the -grading, stabilizing, and bituminous
mat on West 36th Street from the Belt Line (Highway #100) to Raleigh Avenue, by
unanimous vote of all Members of the Council.
_Plans and Specifications for Gradin. Etc.
On motion of Trustee Middleton, seconded by Trustee Bolmgren, the Village
Engineer was instructed to prepare plans and -specifications for grading, -stabil-
izing and tar mat on West 36th Street from the Belt Line (Highway #100) to
Raleigh Avenue, same to -be ready for hearing on October 27th, -with extimated
cost of same, by unanimous vote of all Members of the Council.
Report on Claim for Damages - John P. Becker
Village Attorney, E. T. Montgomery reported on his investigation of claim
of John P. Becker and wife -for damage to clothing and curtains by road oil spray
blown from Village equipment applying same -on Toledo Avenue on September 4, 1952
adjacent to premises of Mr. and Mrs. Becker whose address is 3998 Wooddale
Avenue. The Village Attorney found that clothing, diapers and curtains valued
at approximately $75.00 had been sprinkled with fine spots of road oil. $50.00
was recommended for settlement, which sum was accepted as fair by Mr. Becker who
was present.
On motion of Trustee Middleton; seconded by Trustee Bolmgren, settlement
of said claim by payment of $50.00 to John P: Becker and wife was authorized, by
unanimous vote of all Members of the Council.
Ordinance No. 401
On motion of Trustee BoLngren,-seconded by Trustee Jorvig; the following
ordinance was adopted by unanimous vote of all Members of the Council:
ORDINANCE NO. 401
AN ORDINANCE REGULATING PRIVATE DRIVEWAY
INTERSECTIONS WITH PUBLIC STREETS
The Village Council of the Village of St. Louis Park ordains:
Section 1. No person, firm or corporation shall construct or lay out any
driveway providing for access by vehicles from a public street of the Village
onto adjacent property -unless there shall have first been issued a permit by the
Village Engineer for such driveway access to the public street. Such permit
shall by granted by the Village Engineer upon application in writing by the owner
or occupant of the premises accompanied by a plat setting forth the width of
the proposed driveway at the sidewalk line and at the curb line and a statement
describing the materials with which the driveway is to be constructed from the
property line to the curb line.
Section 2. No driveway -from private property crossing a public sidewalk
and entering a public street of -the Village shall be constructed in excess of
22 feet in width at the center of the sidewalk line. -The Village Engineer shall
determine at what angles the driveway may approach the curb line from the side-
walk line in order to provide for safe ingress and egress to the driveway.
Section 3. Wherever it is proposed to construct a private driveway across
a public sidewalk the Engineer shall determine whether the thickness of the
existing walk is sufficient to withstand the use thereof by -vehicles using the
driveway and if itis not so sufficient the Village Engineer may require the
applicant to replace the sidewalk with a sidewalk for the width of the driveway
of at least six inches in thickness and in accordance with Village specifications
for such sidewalks and if there is no concrete sidewalk at the place where the
driveway is to be constructed such driveway shall be constructed at the sidewalk
line of concrete six inches -in thickness in accordance with Village specifica-
tions for sidewalk construction.
Section 4. No -existing curb and -gutter -on Village streets shall be cut
for driveway purposes unless a driveway permit under this Ordinance shall have
been issued by the Village Engineer and if such curb is cut pursuant to such
permit the curb shall be returned from the curb line to the sidewalk line in
accordance with directions given by the Village Engineer and attached to the
permit.
Section 5. Unless the work of constructing such driveway between the
property line and the curb line shall be done by a contractor who shall have
filed a bond with the Village -conditioned to save the'Village harmless from any
and all claims for damage resulting from the contractor's operations and
conditioned further to perform the work in accordance with Village specifications

and in such amount as the Village -Council -shall have'approved,_the Village
Engineer may require as a condition to the issuance of the permit that the
owner of adjacent property file'a like bond with the Village Council in a
penal sum of at least $1,000.00.
Report on Milk Vending Machines
As ordered by the Village-Counoil at meeting'of September 22nd, Dr. Darby,
M. D., Village Health Officer made an investigation, and reported that sanitation
is alright if serviced currently, and he understands that the Company services
the machine every other day. -Applicant-for the licenses to install machines
at 7001 West Lake and 5600 West Lake (Roger Jacobs) wa.s present: He said all
milk cartons were dated, -and inaximum'storage'was 48 hours. The -Service Station
attendant fills the belts when necessary:- If a leaking carton comes out he
can get into the cabinet and -give the customer a good carton. He also refills
the belts when they are empty.
It was moved by Trustee Middletori, seconded by -Trustee Jo"rvig, that the
Village Attorney be requested to prepare an amendment to the Milk Ordinance
to prohibit gas station attendants-from'servi.cing milk vending machines. Motion
was lost by the following roll call vote:

Hearing Date Set for Sanitary Sewer ' P-1180
On motion of Trustee Middleton, seconded by Trustee Bolmgren, October 27,
1952 was set as date for hearing on construction of sanitary sewer in WEST 39TH
STREET FROM HUNTINGTON AVENUE TO 225 FEET EAST, by unanimous vote of all Members
of the Council.

On motion of Trustee Jorvig, seconded by Trustee Bolmgren, the following
resolution was adopted by unanimous vote of all members of the Council present:

Village Engineer, Phil -W. Smith reported -on the request of -Adolph Fine,
owner of Lots 1, 2, 3, and 4; and -Lot 161,,Bl6ck 2, Adolph Fine's Addition
special size driveway openings from Minnetonka -Boulevard to his property. Mr.
Smith said he visited the site with Mr. Fine and --told him it would be impractical
to provide driveway entrances at this time, and recommended that a straight curb
be run along this property and when buildings are constructed, the driveways
can be cut in at the proper locations.
On motion of Trustee Trustee Bolmgren, seconded by Trustee Jorvig, the
Village Engineer's recommendation as heretofore stated was accepted and approved
by unanimous vote of all Members of the Council.
Report on Tax -Hearing
• Report on Tax Hearing received from Earl H. Maffett, Chairman of Committee
appointed by Hennepin County League of Towns and Municipalities, dated September
19, 1952, on their activities in -gathering and correlating information concern-
ing increased valuation of property in Hennepin County was read and ordered
filed.
Meeting Adjourned
On motion of Trustee Boluigren, seconded by Clerk Justad, the meeting was
adjourned at 1:10 AM, by unanimous vote of,all Members of the Council.
