REGULAR MEETING SEPTEMBER 22, 1952
_A regular meeting of the Village -Council was called to order by Trustee
Jorvig in the absence of Mayor Hurd., -at -8:60-P. M.
Reverend Paul F. Obenauf, Pastor of Wooddale Luthern Church gave invocation.

As advertised in the St. Louis Park Dispatch September 18, 1952, sealed
bids were received and publicly opened and read from the following bidders for
the furnishing of ONE (1) 3/8 CUBIC YARD HEAVY DUTY DIGGING AND GENERAL PURPOSE

On motion of Trustee Middleton, seconded by Trustee Bolmgren, the above bids
were referred to the Village Engineer and'Chairman of the Street Department
Committee for tabulation -and recommendation, by unanimous vote of all members of
the Council present.
Hearing on Application for Rezoning - Deferred -
On motion of Trustee Bolmgren, seconded by Trustee Middleton, public hearing
on the application of Carl W. Sherer-for the rezoning of Lots 15, 16, and 17,
Block 3, Latham's Minnetonka Boulevard -Tract from multiple dwelling use to com-
mercial use was deferred to October 6th, -due to the death of Mr. Sherer's son,
today, by unanimous vote of all members of the Council present.
Hearing on Petition for Vacating Allen
A hearing was had on petition of Harry Millberg and Gerald La Sere for
vacating of alley in part of Block Two (2), rearrangement -of St. Louis Park ad-
jacent to Lots One (1); Two (2), Three (3) -and -part of Lot Four (4) and Lot
Thirty-three (33), Block Two (2), Rearrangement of St. Louis Park. No one appeared.
Resolution
On motion of Trustee Bolmgren, seconded by Trustee Middleton, the following
resolution was adopted by the unanimous vote of all members of the Council present:
RESOLUTION VACATING PORTION OF ALLEY
WHEREAS, the Village Council has met at the time and place specified in a
notice published in the St. Louis -Park Dispatch September 5 and 12, 1952 and duly
posted in said Village relating to petition of Harry Millberg and Gerald La Sere
for vacating alley in part of Block Tw6-(2) Rearrangement of St. Louis Park
adjacent to Lots One (1), Two (2), Three -(3) -and part of Lot Four (4), and Lot
Thirty-three (33), Block Two (2), Rearrangement of St. Louis Park, and the Council
has heard all interested persons appearing at said meeting in regard thereto,
said petitioners being owners of the majority of the property abutting on said
portion of alley to be vacated, and
WHEREAS, it appears this alley is a traffic hazard and does not serve the
purposes for which it is laid out as it is duplicated by the main alley and it
is in the interest of the public to vacate the same, now therefore,
BE IT RESOLVED by the Village Council of the Village of St. Louis Park that
the portion of alley as heretofore dedicated and laid out in part of Block Two
(2), Rearrangement of St. Louis Park adjacent to Lots One (1), Two (2), Three (3)
and part of Lot Four (4), and Lot Thirty-three (3), Block Two (2), Rearrangement
of St. Louis Park according to the plat thereof on file and of record in the
office of the Register of Deeds of Hennepin County be hereby vacated.
Hearing on Petition to Vacate Street - Denied
Pursuant to notices published in the St. Louis Park Dispatch September 4
and 11, 1952, a public hearing was had on the petition of Haws Realty Company and
Pockrandt Lumber and Fuel Company to -Vacate Colorado Avenue south of 36th Street
and north of the Minneapolis & St. Louis Railway Company R/W. The following
person appeared ----- George M. Stephenson, General Attorney for Minneapolis &
St. Louis Railway Company appeared in opposition as per his letter dated Sep-
tember -4th. The Planning Commission's report and recommendation dated Sept-
ember 211•1952, recommending the denial of petition was read.
On motion of Trustee Middleton, seconded by Trustee Bolmgren, the above
petition for vacating Colorado Avenue south of 36th Street and north of Minneapolis
& St. Louis Railway R/W was renied by unanimous vote of all Members of the Council
present.
Building Inspector's Weekly Report
The Building Inspector's report for week ending September 19, 1952, showing
that 37 building permits were issued, totaling $350,950, was read and ordered
filed.

Assessment Hearings
Separate hearings were had on proposed assessments for improvements
listed in the following resolution. No one appeared.
Resolution
On motion of Trustee Bolmgren, seconded by Trustee Middleton, the follow-
ing resolution was adopted by unanimous vote of all members of the Council
present:
ASSESSMENT RESOLUTION
WHEREAS the Village Counoil•has met at the time -and place specified in
the notice published -in the St. Louis -Park Dispatch August 28, 1952, relating
to the following described assessments -arid -has conducted a separate public
hearing on each of said proposed assessments, therefore
BE IT RESOLVED by the Village Council of the Village of St. Louis Park
that the proposed assessments on file in•the-office of the Village Clerk cover-
ing the cost of the following described public improvements heretofore ordered
and completed in this Village -be hereby approved and there be hereby levied and
assessed against each and every -tract and'parcelfof land -described therein a
special assessment in the sums therein respectively set forth, said assessments
to be payable in ten (10) equal annual instalments, the first of which shall be
payable concurrently with taxes levied in the year 1952 and payable in the year
1953.

Deferred installments of -said assessments shall bear interest at the rate of 4%
per annum from the date -of this resolution until August 15 of each year in which
installments are payable.
Salary Change for Building Department Employee -
Inter Office Memo from Building Inspector, Peter Stienstra, dated September
172 1952, requesting that -since Wm. -M. Pascoe is incapacitated and will not be
able to return to -work for some time; that Mrs. George Reed who has been doing his
work be paid the standard pay for the job,
On motion of Trustee'Middletonl, seconded by Trustee Bolmgren, Mrs, George
Reed was employed to take over Wm. -M. Pascoe's position until his return at a
monthly salary of $203.00, with regular office hours of 8 AM to 5 PM, and the
regular employees benefits such as sick leave and -vacation, effective October 1,
1952, by unanimous.vote of all Members of the Council present.

Minnetonka Boulevard Sidewalk Assessment
A group of property owners appeared regarding the assessment for sidewalk
on Minnetonka Boulevard west from Glenhurst Avenue to Edgewood Avenue. N. W.
Joubert asked how much the assessment will be.- He was told that it would be
$5.60 per front foot. He voiced his -objection to the assessment for sidewalk,
curb and gutter against the abutting property. Said that he and others
objected to the sidewalk on Minnetonka Boulevard at the hearing held June 2nd,
and feels that it is being forced on them.- Said that sidewalk should be
assessed back two or three blocks on either side.- Called attention to the fact
that the State is going to -pay 75% for curb and gutter on Excelsior Boulevard.
He feels that the paving job has devaluated -his property. Said that sidewalk
is not needed on Minnetonka Boulevard west of Lake Street. He said the Village
Council is putting in the sidewalk to beautify the street -and take it out of
the horse and buggy days. He feels that the sidewalk does not benefit the
abutting property and it is not fair. Said that they should not be assessed
for the whole bill but that it should be shared.
F. W. Harlow, 6019 Minnetonka Boulevard said -he did not want to repeat
Mr. Joubert's remarks, but feels that government by the people and for the
people is not being followed. Ralph -Anderson, 2952 Xenwood Avenue said he
does not believe he should have to pay for the good sidewalk that was already
in before the widening of Minnetonka Boulevard. W: L. Emerson, 6012 Minnetonka
Boulevard said he doesn't feel that he should be asked to replace a sidewalk
that was in good condition. D. J. Suride, 5530 Minnetonka -Boulevard said it
is now a disgrace - taking all the trees down. -Worries about the splashing
of snow and water on them while they are standing on his lawn. He didn't want
the shade trees -taken out; they could have -moved the street over. He said
he will shovel the snow'off-his-sidewalk into the street, and if same is
thrown back he will throw it back.
Mrs. E. A. Freude, 6104 Minnetonka Boulevard said their bank has been
cut so that they are way up on a hill now, and it will be difficult to -keep
grass on the bank. Said -that although she is for improvements; her yard has
been ruined. Trustee Jorvig explained that the construction of sidewalk on
side streets leading up to Minnetonka Boulevard are paid for by abutting property
owners. R. W. -Mosher, 5917 Minnetonka'Boulevard asked if side streets are
so anxious for sidewalk on Minnetonka Boulevard, why \ shouldn't they pay for it?
Ralph Anderson, 2952 Xenwood Avenue said his sidewalk was broken. It was
looked at by Phil Smith and some Councilmen. Felt that he should have credit
for same.
Mr. Joubert called attention to the -28th Street sidewalk between Joppa
Avenue and the Belt Line that came up last year. Said that was considered for
general good -of all -people and assessed to streets back of 28th Street, and
he feels that this proposition should be handled -in the same way. Jerry C.
Whelan, 5621 Minnetonka Boulevard said sidewalk was needed before his service
was installed, but now not used. Mrs. Myrtle'Clark, 2929 Salem Avenue said
she just paid for her sidewalk and does not feel that she should pay for anybody
elses. Mr. Sunde said that he paid for his five foot sidewalk and does not
feel that he should pay for another one.
Trustee Bolmgren said that we should defer action on this assessment for
a week for further study.
On motion of Trustee Bolmgren, seconded by Trustee Middleton, action on
the above matter was deferred -to meeting of September 29th to allow time for
further study, by unanimous vote of all Members of the Council present.
Opposition to Milk Vending Machines
Jim Farrell, 3032 Kentucky Avenue appeared regarding milk vending machines
now operating in St. Louis Park. The milk drivers living in St. Louis Park
feel that it will cut into their business and that the grocers are concerned
also. He doesn't feel that they will -meet health -rules and regulations. Said
Mr. Stienstra hasn't given out building permits yet. Said that paper bottles
leak and make a mess and are not good to look at. Trustee Middleton asked if
we had an ordinance specifying that milk be changed daily. Mr. Farrell said
we work on 2 day changes under Milk Regulations. Minneapolis has no machines.
George Nelson, 3720 Pennsylvania Avenue said that the gas -station men make the
changes and reload machines, and he would suggest that Dr. Darby make a close
check on these two machines.
On motion of Trustee Middleton, seconded by Trustee Bolmgren, the above
matter was referred to Health Officer, Dr. H. W. Darby, M. D. to see that Health
Ordinance is complied with and that the -same changes are made as the stores make;
also that Dr. Darby check the machine now -installed in Bloomington and report on
same at September 29th meeting, and to the Village Attorney for checking and study,
by unanimous vote of all Members of the Council present.

Action Granting Gas Station Permit Recinded
Several persons appeared with regard to proposed construction of gas
station on the NW Corner of Brunswick Avenue and Excelsior Boulevard. L. J.
Ulrich, 6121 Excelsior Boulevard asked that the -permit be canceled. Said he
knew that the corner was commercially zoned, -but feels -that same will injure
the values of homes nearby.- Another person suggested that the property be
rezoned to Multiple Dwelling Use. The following petition signed by more than
sixty home owners from the area was presented and read:
"We the undersigned home owners do petition for the
denial of a permit to build a filling station on -
the NW -corner of Excelsior Ave. and Brunswick Ave.
and request its rezoning to multiple -dwelling
because remaining -corners have multiple dwellings
and beyond said corner in same block is zoned resi-
dential."
On motion of Trustee Bolmgren, seconded by Clerk Justad, the motion passed
by the Village Council September 8, 1952 authorizing the Building Inspector to
issue a building permit to construct a gasoline station on Lot A, Block 3, Brook -
lawns is hereby recinded and canceled on the grounds that the use of said premises,
which are within 100 -feet of a residence district, for gasoline filling station
purposes will be detrimental to the safety and welfare of occupants of nearby
residential property, and, because of the nature of nearby residential property,
there will be a substantial detriment to such property values if said premises
are used for gasoline filling station purposes, and in coming to such conclusion
the Council takes into account the fact th&t-this-property is at the western
limit of the Commercial District on that portion of Excelsior Boulevard; the
effect observed as to deterioration of -residence property values near Excelsior
Boulevard where gasoline filling stations in the vicinity of Excelsior Boulevard
have been constructed and operated; public water supply -and pressure at this
point is often low because of nearness to the terminus -of the Excelsior Boule-
vard water main, and fire hazard to the area from pressure of gasoline station
is therefore critical; and'upon the basis of the -said reasons for recision and
cancelation of the authorization -for said permit, the said permit application is
hereby denied by following roll call -vote: Trustee Bolmgren, yea; Trustee
Middleton, yea; Clerk Justad, yea; Acting Mayor Jorvig, yea.
Resolution
On -motion of'Trustee Bolmgren', seconded by Clerk Justad, the following
resolution was adopted by unanimous vote of all Members of the Council present:
R E S O L U T I O N
WHEREAS, it appears to -the Village Council that a sufficient sum has been
paid into the Permanent -Improvement Revolving Fund from assessments levied for
improvements financed out of -the fund to pay principal and interest on Permanent
Improvement Revolving Fund Bonds, October 1, 1948 Series, maturing in the year
1953 in full. Now therefore,
BE IT RESOLVED that the levy for payment of said principal and interest
contained in resolution adopted October 8; 1951 is hereby cancelled in the sum
of $45,433.50, and the Village Clerk is -hereby instructed to send a copy of this
resolution to the County Auditor of Hennepin County, Minnesota.
Plans & Specifications for Addition'to Fire -Station Ordered
On motion'of Clerk Justad, seconded by Trustee Bolmgren, the Fire Chief
was instructed to employ E. R. Ludwig to draw up plans and specifications at
regular Architects -fees for-anaddition to the Fire Station and room for Civilian
Defense, by unanimous vote of all Members of the Council present.
Special Permit to Connect to Sewer
On motion of Trustee Bolmgren, seconded by Trustee Middleton, C. Ed.
Christy was granted a special permit to connect a nine -inch sewer line to the
manhole on --Hamilton Street 200 feet east of the center line of Dakota Avenue;
this nine inch sewer main to be constructed within an easement of 15 feet
furnished to the Village of St. Louis Park for the purpose of maintenance and
repair. Said sewer to go north 1221 from the center line of Hamilton Street
to a manhole; the total cost of said sewer line shall be paid by the owner and
all work shall be done under the -direction and supervision of the Village
Engineer. Motion was passed byl-unanimous vote of all Members of the Council
present.

J. G. Gaiser, 3072 Boone -Avenue and Mrs. C. W. Thompson, 3048 Boone Avenue
appeared regarding the -paving on Boone Avenue from Minnetonka Boulevard south
to 31st Street. Trustee Jorvig-discussed the paving of Boone and -Aquila Avenues
sometime ago, which has been reported a6a poor job. He said that the folks
feel same should be put in hsape at,no cost to them. Mr. Gaiser said they may
have used the wrong kind of material iri-constructing same. Trustee Bolmgren
asked Trustee Jorvig and Trustee Middleton for a recommendation as they have
seen the streets.
On motion of Trustee Middleton., seconded by Trustee Bolmgren, Aquila and
Boone Avenue from Minnetonka Boulevard to 31st Street were ordered repaired and
put in proper condition at general fund expense; and -that a seal coat be applied
in the Spring of 1953 and assessed, by unanimous vote of all Members of the
Council present.

Trustee Middleton, seconded by Trustee Bo1mgren,-that Odin Quady, Jr. be hired as
rodman for the Engineering Department at $$1.622 per hour, effective September

Request for Permit to Construct Commercial Building
(Highway #7 and Pennsylvania Avenue)
Ted Johnson, -4933 Elliot Avenue, Minneapolis appeared and requested a
permit to build a commercial building on the -NW corner -of Pennsylvania Avenue
and Highway #7. The building will be two stories high - 581 fronting on
Pennsylvania -Avenue, and 1101 on Highway #7 Service Road. The building site is
zoned Commercial. Survey and plans were presented.
The building is to be used for several -endeavors, such as research; some
lathe work, and assembling. There will be no"punch press work, stamping, or
noise. The business will be known as Cedar Engineering, Incorporated, John
Bergen, President. They will -employ about 40 people. Their present business
is located at 7700 Cedar Avenue.
Mr. Johnson said he would like a decision on this as soon as possible as
the building should be ready for occupancy in 90 days.
On motion of Trustee Bolmgren,-seconded by Trustee Middleton, the Building
Inspector was authorized to issue a building permit for the construction of
above described building on the -NW Corner -of Pennsylvania Avenue and Highway #7
Service Road, subject to -proper setbacks; and -an approval -from the Planning Com-
mission, by unanimous vote of all Members of the Council preseftt.
