REGULAR MEETING SEPTEMBER 2, 1952
A regular meeting of the Village Council was called to order by Acting
Mayor, Torval Jorvig at 8:00 P. M.
The following Council Members were present at roll call as follows:

Reauest for Permit to Build Industrial-Buildi
Allan Garrison appeared and requested a building permit for an industrial
building on Lots 12, 13, and 14, Block 67, Rearrangement of St. Louis Park.
On motion of Clerk Justad, seconded by Trustee Bo]mgren, the above request
was referred to the Planning Commission for checking and recommendation, by
unanimous vote of all Members of the Council present.

Request for Permit to Build Gas Station
A representative of Continental Oil Company appeared and requested a permit
to build a gas station on the NW Corner of Brunswick and Excelsior Boulevard.
On motion of Clerk Justad, Seconded by Trustee Bolmgren, the above request
was referred to the Planning Commission for checking and recommendation, by unani-
mous vote of all Members of the Council present.
Commercial Driveway Opening
Attorney Watson appeared for Midwest Oil Company, Minnetonka Boulevard and
Lake Street with regard to break in curb line for entrance of gas station. He
said that the opening should be more than 22 feet.
On motion of Trustee Bolmgren, seconded by Clerk Justad, the above matter
was referred to the Village Engineer for further checking and recommendation,
by unanimous vote of all Members of the Council present.

Trustee Middleton arrived -at the meeting at this time - 10:42 P. M.

On motion of Trustee Bolmgren, seconded by Trustee Middleton, the follow-
ing petitions were referred to the Village Engineer and Chairman of the Sewer
Department Committee for checking and recommendation, by unanimous vote of all
Members of the Council present:

Application for 3.2 On -Sale Beer License Denied
The application of Mrs. Dorothy Mc Donald, owner of Old Dutch Grill,
7121 Wayzata Boulevard for an on -sale 3.2 beer license to be used at same address,
which was presented to the Village Council at the August 25th meeting and deferred
to this meeting, was read.
On motion of Trustee Bolmgren, seconded by Clerk Justad, the above applica-
tion of Mrs. Dorothy Mc Donald for a license to sell 3.2 Beer On -Sale at the Old
Dutch Grill, 7121 Wayzata Boulevard was denied by following roll call vote:

Letter Opposing License for 3.2 Beer On -Sale
Letter from R. E. Gilbertson, President of the congregation, Westwood
Luthern Church, dated August 27, 1952, opposing the issuance of a 3.2 beer
license to the Old Dutch Grill located at Louisiana Avenue and Wayzata Boulevard,
was read and ordered filed.

On motion of Trustee Middleton, seconded by Trustee Bolmgren, the following
applications for 1952 licenses were approved, and the Mayor and Clerk were
authorized to issue licenses to expire December 31, 1952, by unanimous vote of
all Council Members present:

On motion of Trustee Middleton, seconded by Trustee Bo]mgren, petition
signed by Wm. Lundin, dated September 2, 1952, for the vacation of 27TH STREET
FROM BLACKSTONE AVENUE TO MINNEAPOLIS, NORTHFIELD AND SOUTHERN RAILROAD TRACKS
(adjacent to Lot 1, Block 3, Park Manor Addition) was referred to the Planning
Commission for checking and recommendation, by unanimous vote of all Members
of the Council present.
Letter Re: Use of Property for Nursing Home
Letter from Louise Pache, 5124 Minnetonka Boulevard, dated August 29,
1952, requesting the Council's approval to use property at 3047 Toledo Avenue
for a nursing home, was read. No action taken.
Clam Shell Bucket
Inter Office Memo from Street Commissioner, K. -"Johnson, dated September
2, 1952, explaining the need for a clam shell bucket to use for water main breaks
or to move hydrants, at an estimated cost of $1000.00, was read.
On motion of Trustee Bolmgren, seconded by Trustee Middleton, the Clerk
was instructed to advertise for bids for clam shell bucket, to be opened on
September 22, 19522 by unanimous vote of all Members of the Council present.

Letter Re: Tax Equalization
Letter from E. L. Conover, President, Hennepin County League of Towns
and Municipalities, dated August 22, 1952, with regard to recent action of the
Hennepin County Tax Equalization Board, was read. By agreement -this matter was
laid over until meeting of September 8th for further discussion.
Building Inspector's Weekly Report
The Building Inspector's report for week ending August 29, 1952, showing
that 28 building permits were issued, totaling $132,780.00, was read and ordered
filed.

The Street Department's report for period beginning July 21, 1952 thru
August 29, 1952 was read and ordered filed.
Hearing on Proposed Construction of Sanitary Sewer and Lift Station
A hearing was had on proposed construction of Sanitary Sewer Lift Station
at Highway No. 7 Service Road and Webster Avenue and also for construction of
Sanitary Sewers in the locations described in the following resolution. The
following persons appeared: Mr. Terrell and others appeared in favor of the
sewer construction in Webster Avenue.
Resolution
On motion of Trustee Middleton, seconded by Trustee Bolmgren, the following
resolution was adopted by unanimous vote of all Members of the Council present:
RESOLUTION ORDERING CONSTRUCTION
OF SANITARY SEWER AND LIFT STATION
WHEREAS, the Village Council has met at the time and place specified in
a notice relating to Sanitary Sewer Lift Station and Sanitary Sewer Construction
hereinafter described, published in the St. Louis Park Dispatch August 14th and
21st, 1952, and has heard all interested persons appearing at said meeting and
determined the necessity for said improvements, therefore
BE IT RESOLVED by the Village Council of the Village of St. Louis Park
that construction of Sanitary Sewer,Lift Station at Highway No. 7 Service Road
and Webster Avenue and construction of Sanitary Sewers in Lake Street from
Yosemite Avenue to Minnetonka Boulevard and in Webster Avenue from Lake Street
to Service Drive, Highway No. 7, be hereby ordered as Improvement No. 52-429,
in accordance with plans and specifications prepared by the Village Engineer
which are hereby approved, and the Clerk is authorized to advertise for bids to
be opened at the Council meeting September 22, 1952•

Separate hearings were had on Sanitary Sewer Improvements 52-301 to
52-308. The following persons appeared:

3029 Oregon Avenue appeared in opposition to sewer construction in Oregon Avenue
from Minnetonka Boulevard to 31st. George Jones, 3032 Nevada, H. Mostrom,
3026 Nevada Avenue and L. J. Schafer, 3040 Nevada Avenue appeared in opposition
to sewer construction in Nevada Avenue from 31st Street to Minnetonka Boulevard.

A group appeared from Wyoming, Virginia and Xylon Avenues from 33rd Street-
to 34th Street - said need for sewer was urgent. Mrs. Paul Hoffert, 3365 Texas
Avenue said sewer was urgently needed on Texas from 33rd Street to 34th Street.
Clif Sprain, 3321 Aquila Avenue said sewer was urgently needed on Aquila from
33rd Street to 34th Street.
Charles Grayburn asked -how come sewer is proposed for Xylon Avenue between
35th and 36th when the street has not been graded. Was advised to see the
Village Engineer about this.
John Erickson, 3340 Wyoming, B. A. Benjamin, 3354 Wyoming, Dean Nelson, 3350
Wyoming and C. J. Marshall, 3345 Wyoming Avenue appeared in favor of sewer in
Wyoming from 33rd Street to 34th Street.
H. F. Rudd, 3425 Aquila, Mr. Munson, 3440 Aquila and H. Jorvig, 3419 Aquila
appeared in opposition to sewer in Aquila from 34th to 35th. Art. Ruedlinger
said Boone Avenue was only 1/2 street between 34th and 35th and he was opposed
to the sewer going in there. Bob Nelson, 8115 West 35th Street, also
Bruce Duemke and T. Johnson of West 35th Street said they were opposed to the
sewer going in on their street - they have trunk sewer on 36th Street. Charles
Grayburn 8311 West 35th Street said he was opposed to sewer going in from
Xylon to Texas Avenues.
Resolution
On motion of Trustee Bolmgren, seconded by Trustee Middleton, the following
resolution was adopted by unanimous vote of all Members of the Council present;
RESOLUTION ORDERING SANITARY SEWER
CONSTRUCTION
WHEREAS, the Village Council has met at the time and
place specified in
notice relating to proposed Sanitary Sewer extensions 52-301 to 52-308, published
in the St. Louis Park Dispatch
August 14th and 21st, 1952,
and has heard all
interested persons appearing at
said meeting and determined the necessity for
said improvements, therefore,
BE IT RESOLVED by the Village Council of the Village
of St. Louis Park
that the following Sanitary Sewer extensions be hereby ordered in accordance
with plans and specifications which have been prepared by the Village Engineer
and which are hereby approved,
and that the Clerk be authorized to advertise
for bids to be opened at the Council meeting September 22,

Letter Re: Land Lease for Garbage & Refuse Disposal
Letter from Landers-Norblom-Christenson Company, dated August 27, 1952,
with regard to extending their agreement for lease of land for burial of garbage
and refuse for an additional sixty days, was read.
On motion of Trustee Bolmgren, seconded by Trustee Middleton, the permission
granted by Landers-Norblom-Christenson Company in their letter of August 27, 1952,
for the Suburban Sanitary Drayage Company to continue their burial of garbage
and refuse at approximately Virginia Avenue from 31st Street to 32nd Street for
the months of September and October, subject to the terms and conditions of lease
agreement now on file, dated September 15, 1950, was approved and accepted, by
unanimous vote of all Members of the Council present.
Letter Re: Proposal to Abolish Taxation of Household Goods, Etc.
Letter from League of Minnesota Municipalities, dated August, 1952, with
regard to Legislative Commitment for 1953 Session on Property Tax Administration,
including Immediate Abolition of Household Goods Taxation, was read, and the
Clerk was instructed to reply to same, stating that they concurred with the
proposed legislation, except for Item #1, if construed as favoring a County
Assessor, they would go on record as not being in favor of that.

League of Minnesota Municipalities
Letter from League of Minnesota Municipalities, dated August 31, 1951,
enclosing a schedule of regional meetings -for Fall 1952, was read.
Meeting Adjourned
On motion of Trustee Bolmgren, seconded by Trustee Middleton, the meeting
was adjourned at 12:14 A. M., September 3., 1952, by unanimous vote of all Members
of'the Council present.
