COUNCIL MEETING SEPTEMBER 15, 1952
A regular meeting of the Village Council was called to order by Mayor
Hurd at 8:05 P. M.

Assessment Hearings
Separate hearings were had on proposed -assessments for improvements listed
in the following resolution. No one appeared. Mayor Hurd staged that the
Minnetonka Boulevard assessment hearing will be deferred to September 22, 1952•
Resolution
On motion of Trustee Bolmgiien, seconded -by Trustee Middleton, the following
resolution wwLs adopted by the unanimous vote of all Members of the Council
present: '
ASSESSMENT•RESOLUTION
WHEREAS the Village Council has -met at the time'and place specified in
a notice published in the St. Louis Park_Dispatch"August 14, 1952, relating to
the following described -assessments and has conducted public hearing on each of
said proposed assessments, therefore 1
BE IT RESOLVED by the Village Council•of the Village of St. Louis Park
that the proposed assessments on file in -the office of•the Village Clerk cover -
the cost of the following described public Improvements heretofore ordered
�#d completed in this Village be hereby approved and there be hereby levied and
assessed against each and every tract and parcel of land described therein a
special assessment -in the sums therein respectively set forth, said assessments
to•be payable in equal annual instalments, the first of which shall be payable
concurrently with taxes levied in the year -I952 and payable in the year 1953
and during the number of years respectively'as follows:

each for a period of 5 years.

It is hereby determined that -each and every tract -and parcel of land des-

Deferred instalments of said assessments shall bear interest at the rate of 4%
per annum from the date of this resolution until August 15th of each year in
which instalments are payable.

On motion of Trustee Bolmgren, seconded by Trustee Middleton, the following
petition was referred to the Village Engineer and Chairman of the Water Depart-
ment Committee for checking and recommendation, by unanimous vote of all Members
of the Council:

Hearina Date Set for Sanitary Sewer and Water Main
On motion of Trustee'Bolmgren, seconded by Trustee Jorvig, October 13, 1952
was set as date for hearing on the construction of sanitary sewer in 342 Street
from Texas Avenue to existing trunk line East of Virginia Avenue; and on the cons-
truction of -water main in 34th Street from Texas Avenue to Wyoming Avenue, by
unanimous vote of all Members of the Council.
Water Hole -34th and Zarthan
Mr. Oas spoke regarding a low spot on the East Side of Zarthan Avenue north
of 34th Street. Says water is 4 to 5 feet deep. The Village Attorney was
instructed to contact the owner with the view of having him take care of the

hazard on this property. Mr. Oas says he wants some definite action to this
end and will continue to push this matter until it is taken care of properly.
Driveway Openings
Mayor Hurd asked for spoksman. Attorney Watson representing a Committee
of five spoke first. He said that serious thought should be given this matter
before an ordinance is passed. Told of State Highway work done on this proposi-
tion -- not completed, and so not approved by M. J. Hoffman. Mr. Watson feels
this matter is so large that it should be given further study and he offered to
present figures and facts. He asked that the proposed ordinance be made
available to all interested parties, and suggested that same be tabled until
they have ample time to study it and present facts to the Village Engineer, etc.
Mr. Maurer of Phillips Petroleum spoke on the matter from facts and figures
he received from his Company. His question was "What is the reason for setting
22 foot openings as being correct?"
On motion of Trustee Bolmgren, seconded by Trustee Middleton, action on
the matter of 22 foot driveway openings was -deferred to meeting of September 22,
1952, with a meeting -to discuss same to be -held on Saturday, September 20th at
2 P. M. at the -Village Hall. Motion was passed by unanimous vote of all Members
of the Council.
Licenses
On motion of Trustee Jorvig, seconded by Trustee Bolmgren, the following
applications for 1952 licenses were approved, and the Mayor and Clerk were
authorized to issue licenses to expire December 31, 1952, by unanimous vote of
all Members of the Council:

Proposal for Payment on Back Rent - Veterans Housing (Duane Hyland)
Letter from Mr. and Mrs. Duane Hyland, 5640 West 37th Street, Apartment "A",
Veterans Housing Area, dated September 13, 1952, in which they stated that they
will pay $70.00 per month on their rent until the total arrearage of $455.00 is

Control, dated August 14, 1952, on plans for sewer extension, Hopkins, Minnesota;

Park Valley Development from existing lift -station near intersection of 6th Ave.

Quit Claim Deed
On motion of Trustee Bolrngren, seconded by Trustee Jorvig, the quit claim
deed with Homer E. Magnuson and Evenna M. Magnuson, husband and wife as parties
of the first part, -and the Village of St. Louis Park as party of the second part,
dated September 15, 1952, fpr easement for water -and sewer purposes, was approved
and accepted for the following described"property, and the Village Attorney was
instructed to file same with the office of'Register of Deeds, Hennepin County,
Minnesota, by unanimous vote of all Members of the Council.
"The north 20 feet of -the east -200 feet of Lot 1, Block 1, Belmont
Terrace, according to the plat thereof -on -file and of record in the
office of the Registrar of Titles of Hennepin County, said ease-
ment being more -particularly described"as"the free right to enter
upon said premises and construct -and install therein a public water
main and sanitary and storm sewers and to forever maintain the same
with a sufficient amount of'soil above the same to prevent the
freezing of liquids therein, and to enter upon said premises at all
reasonable times to inspect, -repair and reconstruct said water mains

resolution was adopted by unanimous vote of all members of the Council present:
RESOLUTION REGARDING PERMISSION
TO USE PORTION OF ZARTHAN AVENUE
WHEREAS the owners of Lot 8, Brookside Subdivision No. 3 and of Lot 8,
Block 7, Brookside Addition, have requested permission of ,the Council to use that
portion of Zarthan Avenue (originally platted as Amelia Avenue) which lies ad-
jacent to said lots and southwesterly of the right-of-way of the Minneapolis,
Northfield & Southern Railway, and
WHEREAS it appears that said portion of Zarthan Avenue has never been
opened and used as a public street by reason -of the fact that the said Minneapolis,
Northfield & Southern Railway right-of-way intersects Zarthan Avenue at a point
approximately 120 feet northeasterly from Brookside Avenue and it has never been
deemed necessary that a grade crossing be established at that point, and
WHEREAS it appears unlikely to the Village Council that Zarthan Avenue
will be extended across said right-of=way in the foreseeable future and unlikely
that said portion of Zarthan Avenue southwesterly of the Minneapolis, Northfield
& Southern Railway right-of-way and northeasterly of Brookside Avenue will be
improved and used as -a public street, and that it is for the best interests of
property owners in the vicinity that the right-of-way be improved and used in
connection with the land of the adjacent owners, therefore
BE IT RESOLVED by the Village Council of the Village of St. Louis Park
that permission be hereby granted to make the uses hereinafter specified of said
portion of Zarthan Avenue lying southwesterly of the right-of-way of'the
Minneapolis, Northfield & Southern Railway and northeasterly of the northerly
line of Brookside Avenue as follows:

Building Permit Authorized
On motion of Trustee Middleton; seconded by Trustee Bolmgren, the Building
Inspector was instructed to -issue a -building permit to J. Steele, 3831 Texas
Avenue for extension south of his house for the construction of a garage and
breezeway to be built right up to the south line of his property, by unanimous
vote of all Members of the Council.
Time Extended for Receiving Sewer Bids
On motion -of Trustee Bolmgren,-seconded by Trustee Jorvig, the time set for
receiving and opening bids for construction of sanitary sewer extensions and lift
station (Improvements Nos. 52-301, 52-308 and -52-429) was extended from September
22, 1952 to September 29, 1952, and the Village Engineer was instructed to notify
all prospective bidders to that effect, by unanimous vote of all Members of the
Council.
Maintenance of Fire Station
On motion of Trustee Bo].mgren, seconded -by Trustee Middleton, the mainten-
ance needs of the Fire Station was referred to Chief Williams and Building
Inspector, P. Stienstra for checking and recommendation, by unanimous vote of all
Members of the Council.
Check Means for Diverting Water
On motion of Trustee Bolmgren, seconded by Trustee Middleton, the Village,
Engineer was instructed to -check for means of diverting water from low lands
east of the Minneapolis, Northfield-& Southern Railroad Tracks between 26th
Street and the Great Northern Railroad Tracks; and lower tile at Cedarwood Road
and Parklands so that -water will flow away from Cedar Lake Road. Motion was
passed by unanimous vote of all Members of the Council.

On the recommendation of the Committee of the whole, it was moved by
Trustee Bolmgren, seconded by Trustee Middleton that the applications of St.

Rent Control
'Dr. Earl L. Rice, 2915 Huntington Avenue, owner of a duplex appeared. Said
he feels that there is no sense in controling rents any further. He has'been
allowed $100.00 a month ceiling.- P. D. Zimmerman, 3757 Kipling Avenue, owner
of fiveples appeared. Rent is now $60.95. Allowed by Rent Control $1.50 per
unit due to connection to sewer. Said the increase he received (15%) meets
certain costs, but not present maintenance -cost. Overall is $71.25 on four
upper units and $53.00 on basement units today.
The Clerk was asked to (1) get list -of individual homes registered with the
Rent Control Office, and (2) inquire what effect it would have on these homes if
rent control was discontinued.
On motion of Trustee Middleton, seconded by Trustee Jorvig, the matter of
rent control was tabled for one week, and rediscussed at the September 22nd
meeting, by unanimous vote of all Members of the Council.
