Invocation was given by Reverend Bennett Brudevold of Aldersgate Methodist Church. Co.8,036.53 Westinghouse Electric Supply 31.90 it if if it 1,457.75 Wilson -Albrecht Company 18.90 if if If to 1,261.83 Anton Yngve 15.00 Request to Remove Island - Highway LOO at 27th On motion of Trustee Bolmgren, seconded by Trustee Middleton, the request of the Minnesota State Highway Department for closing of island at 27th Street and Belt Line (Highway ¢#100), and the Boulevard entrance from Belt Line strip to Utica Avenue, was referred to the Village Engineer for checking and recommenda- tion, by unanimous vote of all Members of the Council. Paving - France -Cedar Lake Avenue to Lake Street Report of the Village Attorney regarding the paving project on France Avenue between Cedar Lake Avenue and West Lake Street was given. He stated that the Village is authorized to pay for a reasonable share of the paving cost even though part of the work would be on the Minneapolis side of France Avenue. He also said that Charles Howard, who approves Village bonds, and an Assistant Attorney General in informal opinions had approved this opinion. Mr. W. K. Hall spoke about the change of curb line - stating that he represents the majority of people in the area. As to the assessment, he under- stands that the paving would be taken care of by General Levy. He was asked where he got this information, and he replied that he got it from Nor. Hurd (before he became Mayor), and Mr. Justad. He feels that there should be a new hearing as to who should pay for it. As it stands now, the whole group are against the present setup (the moving back of the curb). Mr. Hurd asked what share the group felt the adjacent or abutting property owners should pay. Mr. Hall said he had no idea, but he would gladly pay his prorated share. We have more bus traffic than Minnetonka Boulevard. He said what we are now concerned about is the present proposed moving of the curb line. He said now we have water pipe in front of our homes and the people want to know where the water mains are going. Trustee Bolmgren explained that we want a 12 inch main from Minnetonka Boulevard to Cedal Lake Road to have a loop, and it is going in now due to the proposed paving project. They propose to put the main between the Minneapolis 45 inch main and the curb line on the west side of France Avenue. We hope not to spoil any trees, but may have to tunnel under the side- walk at the corner of Sunset Boulevard and France Avenue. Mr. Hall said "I take it if the curbing comes out now we will have to have new curbing soon - the street is not straight - stakes show water main will go right through the yard at SW Corner of Sunset Boulevard and France Avenue." He also said that our method of notification of hearing is not good and he says he is going to find some way to get it into our ordinance that every person interested will get a mailed notice. The Village Attorney explained that we are working under the Village Code set up by State Law. Trustee Bolmgren said the water main is now in contract and same should go thru now even if paving is not done at the present time. Mr. Hall said he hasn't had time to figure out what damage will be done to the property. Trustee Jorvig asked what the stakes were set in for. The Village Engineer was not present so there was no reply. Mayor Hurd said that when the County, the City of Minneapolis, and the Village of St. Louis Park get together on the paving to determine how it can be done, Mr. Hall will be notified. He said he feels that the Council's setting up the water main was good for the property owners. No assessment area for paving has been set up as yet. The Village probably will pay for nine feet, the City of Minneapolis will pay for nine feet, and the County of Hennepin will pay for.27 feet. We are not ready to state anything definite as to the legal end of this project. Mr. Hall said that two hours notice is not enough. Mr. Hurd said that no contract will be signed by him until he has been assured that same is in accord with all concerned. Mr. Smith asked if they were going to have water and sewer, where will it be laid. Trustee Bolmgren said it would be laid out- side of the present curb. The boulevard will have to be disturbed to construct it, btxt same will be put back in shape. Mr. Smith said that we are still concerned about our trees. Trustee Bolmgren said there are no present plans for sewer in France Avenue. August 4, 1952 Paving -France-Cedar Lake Avenue -Lake Street,_Cont'd. Mr. Hall said that he had not had sufficient notice for the removal of his curb and damage to his boulevard and will object if there is any assess- ment against him for a new curb. He stated that the minutes of July 28, 1952 do not show that 100% of property owners from Cedar Lake Avenue to 29th Street on the west side of France Avenue were opposed to this proposed alteration of France Avenue. Mr. J. D. Shotwell, 28th and France, said everybody bought or built here because they had a boulevard, and if we lose that the buses will be that much closer and it will depreciate their property 20%. Mr. Hall said "I now represent Mr. Silverman, and with the new deal of water and sewer (he knew nothing about this) this matter should be adjourned until tomorrow until I get something from the rest of the people. Mr. Hurd explainted the use of the streets. This deal was trying to be fair to the Minneapolis people on the east side of the street by putting paving in the center of the street. But if the City of Minneapolis will let us pay and assess any work done in Minneapolis, I will like to go along with you. Disturbing trees and boulevard is almost necessary when improvements are put in, even though we use extreme care. W. 0. Lund, Jr., 2700 France Avenue spoke regarding sewer, water main and pavement. Said Minneapolis homes are set back further on the east side than on the West side and asked if anybody in Minneapolis has asked for wider boule- vards. The Village Attorney said he didn't think so. Asked who pays for the 9 feet of pavement. Trustee Bolmgren said he was not sure at this time. He said that if we pay for the 9 feet, he would rather keep the wide boulevard. Mr. Hurd said that you should pay some attention, that due to this controversy, the County may throw up the whole job and leave the entire cost for half of the maintenance to St. Louis Park. Resolution On motion of Trustee Bolmgren, seconded by Trustee Middleton, the follow- ing resolution was adopted by unanimous vote of all Members of the Council: RESOLUTION REGULATING USE OF VILLAGE WATER WHEREAS, there is an apparent shortage of water due to dryness of the season and lawn sprinkling, therefore, BE IT RESOLVED that lawn sprinkling be restricted as follows: All property owners on the even side of the street be permitted to sprinkle on the even days except between the hours of 4 and 8 P. M.; and all property owners on the odd side of the Street be permitted to sprinkle on odd days except between the hours of 4 and 8 P. M., effective August 4, 1952• Petition for Grading On motion of Trustee Bolmgren, seconded by Trustee Middleton, the petition signed by Mrs. Ralph Carter, 2925 Independence Avenue and others, dated August 43 1952, for the grading of INDEPENDENCE AVENUE FROM MINNETONKA BOULEVARD AND THE GREAT NORTHERN RAILROAD, was referred to the Village Engineer and Chairman of the Street Committee for checking and recommendation, by unanimous vote of all Members of the Council. Road Oil - Louisiana -Cedar Lake Road to Bridge On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the Street Commissioner was instructed to apply a shot of oil to Louisiana Avenue from Cedar Lake Road to the Bridge, by unanimous vote of all Members of the Council. Licenses On motion of Trustee Middleton, seconded by Trustee Bolmgren, the applica- tion of George E. Carlson for a license to sell cigarettes at Betty's Cafeteria, 6505 Walker Street was approved, and the Mayor and Clerk were authorized to issue license for same to expire December 31, 1952, by unanimous vote of all Members of the Council. Grading for Drainage - Boone Avenue Victor Anderson,.3405 Boone Avenue appeared. Said Boone Avenue from 34th Street to 35th Street needs grading for drainage - the situation is unbearable. On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the above matter was referred to the Village Engineer for profiles and contact with residents to see what can be done, by unanimous vote of all Members of the Council. {- 9 August 4, 1952 406 Bonds On motion of Trustee Jorvig, seconded by Trustee Middleton, the following bonds were approved by unanimous vote of all Members of the Council: HEATING LICENSE BOND with Hillman Machinery and Supply, Incorporated as principal, and American Automobile Insurance Company as surety, dated July 29, 1952, in the amount of $1,000. CONTRACTORS BOND with Anderson & Sons, Incorporated as principal, and St. Paul -Mercury Indemnity Co. as surety, dated July 31, 1952, in the amount of $203,220.10, covering contract with the Village for grading, concrete paving and concrete sidewalk and curb - Village Job No. 52-216, 217, 218 - County Project No. 5124 on Minnetonka Boulevard from approximately 172 feet East of Huntington Avenue to approximately 140,feet West of Dakota Avenue - State Aid Road No. 5. Application for 3.2 Beer - Off -Sale and On -Sale Denied On motion of Trustee Jorvig, seconded by Trustee Bolmgren, the application of George G. Harrison for licenses to sell 3.2 beer off -sale and 3.2 beer on - sale, also application for licenses to sell cigarettes and operate a restaurant at Tex& -Tonka Shopping Center (Texas Avenue and Minnetonka Boulevard, was denied, and the Mayor and Clerk were authorized to return fees paid as per receipts #14219 and 14220, dated August 4, 1952, by unanimous vote of all members of the Council. Petition for Vacating Alley On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the petition signed by Harry Millberg and Gerald H. La Sere, dated July 30, 1952, for the vacating of ALLEY IN PART OF BLOCK 2, REARRANGEMENT OF ST. LOUIS PARK, ADJACENT TO LOTS 11 2, 3, and PART OF LOT 4 (approximately 7 feet), and LOT 33, REARRANGE- MENT OF ST. LOUIS PARK, was referred to the Planning Commission for checking and recommendation, by unanimous vote of all Members of the Council. Petition for Vacating Street On motion of Trustee Bolmgren, seconded by Trustee Middleton, the petition signed by Haws Realty Company and Pockrandt Lumber Company, received August 1, 1952, for the vacating of COLORADO AVENUE SOUTH OF 36TH STREET TO THE RAILROAD TRACKS ADJACENT TO LOT 1, BLOCK 40, ST. LOUIS PARK CENTER ADDITION, and LOT 61 BLOCK 411, REARRANGEMENT OF ST. LOUIS PARK ADDITION, was referred to the Planning Commission for checking and recommendation, by unanimous vote of all Members of the Council present. Street Sign Ordered On motion of Trustee Jorvig, seconded by Trustee Middleton, the Street Department was ordered to place a street sign at Corner of Cambridge Street and Wooddale Avenue, by unanimous vote of all Members of the Council. Claim - Wron-- Measurements Tom Notzko presented a bill for $88.00, due he claims to error in giving sewer measurements for D. J. Leahy, 3834 Huntington Avenue. Village Engineer, Phil W. Smith was asked for an answer. He said that the sewer was put in before his time. Mayor Hurd asked what our responsibility is in giving out the informa- tion as to location of sewer connections. Mr. Smith said Minneapolis does.not guarantee measurements, and has a statement to that effect on their permits. Mr. Motzko said he never had a wrong one in Minneapolis bus has in Hopkins, and they have paid for it. Mayor Hurd asked how many errors have we had since Mr. Smith has been here. Mr. Smith said about 4 - all from Tom Motzko Jobs. Mr. Motzko said Village Surveyors were on the job and measured and did not find it correct. Trustee Middleton asked Mr. Smith when he could give us a report. Mr. Smith said tomorrow. On motion of Trustee Middleton, seconded by Trustee Jorvig, Village Engineer, Phil W. Smith was requested to get all evidence needed on this matter and bring same to the August 11th meeting for action, by unanimous vote of all Members of the Council. Request for Certification of New Fireman On motion of Trustee Jorvig,_seconded by Trustee Bolmgren, due to the injury of Don Glassing, Fireman, the Fire Civil Service Commission was requested to certify one man from the eligible list for fireman to start work at once, by unanimous vote of all Members of the Council. 408 August 4, 1952 American Public Works Association Annual Congress On motion of Trustee Middleton, seconded by Trustee Bolmgren, Village Engineer, Phil W. Smith was authorized to attend the 58th Annual Congress of The American Public Works Association to be held in Los Angeles, California, August 24th to 27th, 1952, with all necessary expenses paid, by unanimous vote of all Members of the Council. Move Dead End Street Si On motion of Trustee Middleton, seconded by Trustee Jorvig, the Street Commissioner was ordered to move the "DEAD END street sign at the entrance of Brook Lane so that it will be in plainer view, by unanimous vote of all Members of the Council. Permit Extended for Basement Occupancy On motion of Trustee Middleton, seconded by Trustee Bolmgren, the Building Inspector was authorized to extend the permit for occupancy of basement dwelling at 3113 Alabama Avenue to September 1, 1953, based on the representation of purchaser, Virgel Sizer that he will start construction of the superstructure before that time, by unanimous vote.of,all Members of the Council. Standard Form 1034 - Public Voucher Minn. 21-P-1002 On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the Clerk was authorized to sign for the Village, U. S. Government Form No. 1034 "Public Voucher for Purchases and Services other than Personal", covering the final payment of advance on Project Minn. 21-P-1002 in the amount of $42,272.87. Total approved advance $$561867.87 Less previous payment 9-18-50 14,595.00 Amount due this payment $42,272.87 Motion was passed by unanimous vote of all Members of the Council. Mileajze for Walter J. Mark On the recommendation of Building Inspector, Peter Stienstra, it was moved by Trustee Jorvig, seconded by Trustee Middleton, that Walter J. Mark be authorized to receive 7¢ per mile for the use of his car in the performance of his duties with the Building Department. Motion was passed by unanimous'vote of all Members of the Council. Petition for Curb and Gutter P-1172 On motion of Trustee Bolmgren, seconded by Trustee Middleton, the petition signed by K. J. Davis, 4011 TnWooddale Avenue and others, dated July 21, 1952, for the construction of curb and gutter on the EAST SIDE OF WOODDALE AVENUE BETWEEN 4011 and 4041, was referred to the Village Engineer -and Chairman of the Street Department Committee for checking and recommendation, by unanimous vote of all Members of the Council. Partial Payment of 2% Apportionment Letter from State of Minnesota Insurance Department, dated August 1, 1952, enclosing check for $5,235.59 as a partial payment of our 2% apportionment due for fire department aid and relief as of December 31, 1951, was read. Letter - Re: Salary Increase for Firemen Letter from the St. Louis Park Association of Fire Fighters, Local 993, dated July 25, 1952, requesting a salary increase, effective January 1; 1953, or x$70.00 per month for all Fire Department personnel, was read. On motion of Trustee Middleton, seconded by Trustee Bolmgren, the above letter was referred to Committee on salaries and wages, by unanimous vote of all Members of the Council. Letter - Re: Allowance for Uniforms for Fire Department Letter from the St. Louis Park Association of Fire Fighters, Local 993, dated July 25, 1952, requesting an allowance of x$50.00 per year per each fireman for uniforms and upkeep and cleaning of same, was read. On motion of Trustee Middleton, seconded by Trustee Bolmgren, the above matter was referred to the Fire Department Committee for recommendation, by unani- mous vote of all Members of the Council. Letter - Re: Damage to Public Sidewalk Letter from L. J. Clark, dated July 302 1952, explaining the damage to side- walk done by Motzko Plumbing Company while cleaning up debris which they had left in front yard when they connected the sewer to their home, was read. 1 August 4, 1952 Building Inspector's Weekly Report The Building Inspector's report for week ending August 1, 1952, showing that 30 building permits were issued, totaling $184,150.00, was read and ordered filed. Building Inspector's Report for July, 1952 The Building Inspector's report for the month of July, 1952, showing a total of 117 building permits issued, totaling $6779,350.00, was read and ordered filed. Fire Departmentts Report for July The Fire Department's report for the month of July, 1952 was read and ordered filed. Justice of Peace Report of Fines - Linnee Justice of Peace E. A. Linnee's report of fines dated July, 31, 1952, was read and ordered filed. Finstad Settlement On motion of Trustee Bolmgren, seconded by Trustee Middleton, the following resolution was adopted by unanimous vote of all Members of the Council present: R E S O L U T I O N WHEREAS, the Village has heretofore made claim against New York Casualty Company in the sum of Five Thousand Six Hundred Forty-nine and 69100 Dollars ($65,649.69) on account of damages alleged to have been sustained by the Village and John Finstad and Norman Finstad, doing business as John Finstad and Son, which contracts were dated July 25, 1949 and July 19, 1948, for construction of ,sidewalk, the said New York Casualty Company being surety on the Public Contractor fonds, and WHEREAS, the said New York Casualty Company has denied liability under its bonds in said amount, and it appears that determination of the amount of damages ,sustained by the Village involve the question of improper mixtiire of cement and improper workmanship on the part of the Contractors at many locations which resulted in cracking and breaking up of sidewalk and that the cause of such cracked and broken sidewalk may in some instances be open to opinion, and it appears to the best interest of the Village that its claim be compromised and settled by acceptance of Three Thousand Five Hundred and no/100 Dollars ($63,500.00), which sum said New York Casualty Company has offered and agreed to pay, and WHEREAS, the Village has withheld Six Hundred Eighty-five and 51100 Dollars ($685.51) payable to the Contractors on account of said contracts, there- fore BE IT RESOLVED by the Village Council of the Village of St. Louis Park that the offer of New York Casualty Company to compromise and settle the claim of the Village described above by payment of the sum of Three Thousand Five Hundred Dollars ($3,500.00) be hereby approved and the Mayor and the Clerk be authorized to execute release -upon receipt of said sum of Three Thousand Five Hundred Dollars ($63,500.00). Pacific Uniform Building Code Letter from Suburban Building Department Administrators, dated July 14, 1952, presenting for the adoption of the Village Council, the Pacific Uniform Building Code and suggested amendments thereto. On motion of Trustee Middleton, seconded by Trustee Jorvig, Harold Fridlund, 424 Second Avenue South, Minneapolis was engaged to study and make a recom- mendation regarding the adoption of above mentioned code by the Village at rate of $65.00 per hour, not to exceed $500.00, by unanimous vote of the Council. 4 August 4, 1952 Application for Rezoning Held Property At meeting of July 21, 1952, the Council considered the application of J. W. Held and F. J. Swenson for rezoning that portion of the E2 of the NW4 of the SWj., Section 30,•Township 29, Range 24, from open development to com- mercial use. Action was deferred to this meeting. Roger Shandeling asked if anything was coming up this evening. He was told no. The.clerk was instructed to write to Mr. Swenson and Mr. Held, in- forming them that the time for action has elapsed, and that the Village Council would like to hear from them further regarding their proposition. Proposal Re: Payment of Rent (Stanley Johnson) Letter -from Budget Service, Incorporated, dated August 4, 1952, stating that Stanley Johnson, 5730 West 37th Street, Apartment "B" (Veterans Housing) had applied to them for assistance in liquidating his bills totaling some $1,600.00, was read. Mr. Johnson is in arrears for rent in the amount of $420.00. The proposal made by Budget Service, Inc. is that the current rent of $35.00 will be paid at the weekly rate of $8.00, and the past due account will be paid at the rate of $5.00 per week, making a total of $13.00 per week or approximately $56.00 per month. On motion of Trustee Middleton, seconded by Trustee Bolmgren, the above proposal was approved and accepted, by unanimous vote of all Members of the Council. Partial Payments on Contract Work On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the following partial payments on contract work in progress, presented by Village Engineer, Phil W.
