REGULAR MEETING JULY 28, 1952
A regular meeting of the Village Council was called to order by Mayor
C. L. Hurd at 8:08 P. M.
Invocation was given by Reverend Norman Nielson of Westwood Luthern
Church.
The following Council Members were present at roll call as follows:

France Avenue Pavement Project from Cedar Lake_ Road to Lake Street C�
Mr. Wm. K. Hall, 2808 France Avenue and others from the area appeared
to discuss the pavement project to be done jointly with the City of Minneapolis,
County of Hennepin and Village of St. Louis Park. Mr. Hall, as spokesman
for the group protested the moving of the curb in toward the property line on
the•West side of France Avenue, and the resulting loss of trees and lawn.
Mayor Hurd told the group that the matter would be given further study
in the light of their objections, and a report would be made at the Council
meeting to be held on August 4, 1952•
Miracle Mile -- Hearing
Curtis Hall, Attorney appeared for Miracle Mile.
1. He has talked with residents south of Miracle Mile, regarding the
placing of a fence, and need for additional parking space so fence should be
placed on property line. Mr. Hall said that some of the property owners would
be satisfied with a fence on the property line, and Miracle Mile to landscape
back sections of lots.
Father Brady has withdrawn his objections to opening onto Wooddale Avenue
back of the stores as his congregation now like to use said space for church
parking. It was suggested that Miracle Mile leave money for fence, etc. in
escrow with the Village so that the job will be cone. It was remarked that
use of space back of stores should be locked up at night so that cars can not
come thru there after hours.-
- Mr. Hall asked for more time to get together with property owners and work
out a deal favorable to them. Mr. Hall said he felt that all but the south
50 feet was commercial. He was corrected -the south 100 feet is not -commercial;
the north 50 feet of the south 100 feet is -used by special permit. Mr. Hall said
it seems a shame that this 50 feet is left vacant and not usable now that same
is needed so badly for additional parking.
Trustee Bolmgren asked - "Do you intend to use the space for public parking
or is it to be used for employee parking and unloading?" Mr. Hall answered
that that would depend on the property owners concerned. Mr. Robertson of
40th Street asked what chance there'is of the Village Council enforcing the
present agreement. The answer was "That 8s why we are holding this hearing."
Mr. -Robertson said that due to what was being done Saturday afternoon by Mr.
Redman regarding parking he withdraws any dealing in the petition with Mr. Hall.
A property owner asked if there had been any rezoning of the south 50 feet.
the answer was no. Mrs. Cassidy said "I°would like to see the Council protect
us as per agreement with Miracle Mile." Trustee Bolmgren asked Village
Att6rney E. T. Montgomery what the next move would be. Mr. Montgomery said that
after this hearing, we can proceed to obtain an injunction against the Miracle
Mile restraining them from using the south•50 feet, and enforce the agreement
made at the time the permit was granted. • Mr. Montgomery asked, "does anyone
have trouble or discomfort due to flood lites?" The answer was yes.
Attorney Edelman said that the Catholic Church would like the use of the
property for church parking. Mr. Robertson said there is plenty of parking
space in front of stores that can be used by the church for parking on Sunday.
It was remarked by someone in the audience that the danger is still there, if
the"Wooddale Avenue opening is used in the rear of the buildings. Mayor Hurd
said that the Council has not sanctioned the restricted use. a qy,
On motion of Trustee Middleton, seconded by Trustee Jorvig, the Village
Attbrney was instructed to proceed to enforce agreement dated�, 1950,
made at the time -the permit for Miracle Mile was granted, by unanimous vote of
all"Members of the Council present.
Resolution
On motion of Trustee Bolmgren, seconded by Trustee Middleton, the following
resolution was adopted by unanimous vote of all Members of the Council:
RESOLUTION REFUNDING MAIN TRUNK SEWER #2 ASSESSMENT
WHEREAS it appears that on July 9, 1952, Town Realty Company paid the
Village of St. Louis Park $50.13, the full assessment for Main Trunk Sewer #2
from 1953 thru 1957 (Receipt#13882), whereas that assessment had already been
paid by White Investment Company on September 6 , 1949, in the amount of $80.00
(Receipt #712); therefore

BE IT RESOLVED that the amount of said assessment heretofore paid in the
respective amount hereinafter set forth be refunded to the respective Loan Company,
and upon receipt of a signed verified claim, that the Mayor and clerk be hereby
authorized to issue warrants in payment of such refund to the respective Loan Co.

Quit Claim Deed
On motion of Trustee Jorvig, seconded by Trustee Middleton, the quit claim
deed furnished the Village by Richard J. Westling and Marlys J. Westling, husband
and wife, dated July 22, 1952, for the following described property to be used
for street purposes, was approved and accepted, and the Village Attorney was
instructed to file same with the Office of Register of Deeds, by unanimous vote
of all Members of the Council:
That part of the Southwest Quarter (SWr) of the Southeast
Quarter (SE -41) of Section Seven, Township One Hundred
Seventeen (117), Range Twenty-one (21) Hennepin County,
Minnesota described as follows: Beginning at the most
Northerly corner of Lot One (1), Block Two (2), WEST LYNN
SECOND ADDITION; thence Northeasterly along the Northwesterly
line of Aquila Avenue One Hundred Twenty Seven and Four
Tenths (127.4) feet to the Southwest corner of Lot One (1)
WEST LYNN SECOND ADDITION; thence West at right angles Fifty
(50) feet; thence South at right angles One Hundred (100)
feet; thence Southeasterly Fifty Seven and Two Hundredths
(57.02) feet more or less to the point of beginning, according
to the duly recorded map or plat thereof.
Licenses
On motion of Trustee Middleton, seconded by Trustee Jorvig, the following
applications for 1952 licenses were approved, and the Mayor and Clerk were author-
ized to issue licenses to expire December 31, X952, by unanimous vote of all
Members of the Council:

On motion of Trustee Middleton, seconded by Trustee Jorvig, on the recom-
mendation of Village Engineer, Phil W. Smith, the employment of John L. Holm,
3341 Dakota Avenue as an inspector on construction work from August 1, 1952 to
October 1st, 1952, at a rate of $1.622 per hour, was approved by unanimous vote
of all Members of the Council.
Bid Award - Grading
On motion of Trustee Middleton, seconded by Trustee Jorvig, the bid of
Western Underground Construction Company, received July 21, 1952, for grading and
graveling Improvements Nos. 52-180 to 52-184, 52-188, 52-186 to 52-194, 52-102
and 52-101, was determined to be the lowest bid of a responsible bidder, and the
Mayor -and Clerk were authorized to execute contract for the Village with the
bidder for the work at price bid of $28,652.60, by unanimous vote of all Members
of the Council.
Application for License to Sell 3.2 Beer On -Sale
It was moved by Trustee Middleton that the application of James P. Howley
for a license to sell 3.2 beer on -sale at his restaurant located at 6033 Walker
Street (Howley's Snack Shop) be approved. No second. Motion lost.
Letter - Re: Project Minn. 21-P-1002
Letter from Housing and Home Finance Agency, dated July 23, 1952, relative
to the Village's request for an'extension of time within which to complete plan
preparation for Project Minn. 21-P-1002, Extensions to Water Distribution System;
and Water Treatment and/or Iron Removal Plant was read.
On motion of Trustee Middleton, seconded by Trustee Bolmgren, the Mayor
and Clerk were authorized to sign WAIVER AND EXTENSION OF TIME RESPECTING AGREE-
MENT FOR PUBLIC WORKS PLAN PREPARATION, by unanimous vote of all Members of the
Council.

Letter Re: Drainage-System for Parklands Tract
Letter from Robert W. Hill, 4516 Cedarwood Road and others, dated July
CL
26, 1952, requesting that the Village provide a drainage system for the
draining of a stagnant water pool between Lots 17, 18, "X" and 23, Parklands
Tract was read.
On motion of Trustee Bolmgren, seconded by Trustee Middleton', the above
mentioned letter and matter was referred to the Village Engineer for consideration
and recommendation as to the effect the water taken off will have on other
property that has to take it, by unanimous vote of all Members of the Council.
Building Inspector's Weekly Report
The Building Inspector's weekly report for week ending July 25, 1952,
showing that 31 building permits were issued, totaling $228,425.00, was read
and ordered filed.
Letter - Re: Building Permit for Double Bungalow
Letter from Carlyle D. Jacobson (Builder), 4164 Browndale Avenue, dated
July 26, 1952, requesting a building permit to build a double bungalow on Lot
6, Block 4, Boulevard Heights (7521 Minnetonka Boulevard) was read.
On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the above
request was referred to the Planning Commission for checking and recommendation
by unanimous vote of all Members of the Council.
Bid Awarded - Water Main Extension
On motion of Trustee Bolmgren, seconded by Trustee Middleton, the bid of
Phelps -Drake Company, Incorporated, received July 21, 1952, for the construction
of water mains (Jobs 52-228 thru 52-236; 52-238 thru 52-240; 52-242 and 52-249)
was determined to be the lowest ibd of a responsible bidder, and the Mayor and
Clerk were authorized to execute contract for the work with the Bidder at price
bid of $201,696.05, by unanimous vote of all Members of the Council.
Report on Plans & Specifications on Water Main Extensions
Report from the Minnesota Department of Health, dated July 21, 1952,
covering an examination of plans and specifications on water main extensions for
various locations in the Village, was read and ordered filed.
Building Permit for Store Building Approved (Park Cleaners)
The Planning Commission's report dated July 28, 1952, on the request of
The Park Cleaners (Gerald H. La Sere) for a permit to build a building on Lots
32 and 33, Block 2, Rearrangement of St. Louis Park, was read.
On motion of Trustee Jorvig, seconded by Trustee Middleton, the above
request for a permit to build a building on Lots 32 and 33, Block 2, Rearrangement
of St. Louis Park was approved subject to a ten foot (101) setback from
Louisiana Avenue because of the unusual situation in that block, by unanimous
vote of all Members of the Council.
Resolution
On motion of Trustee Bolmgren, seconded by -Trustee Middleton, the following
resolution was adopted by unanimous vote of all Members of the Council:
RESOLUTION ORDERING SPECIAL ELECTION
WHEREAS, the Village has entered into a contract with PITTSBURGH -
DES MOINES STEEL COMPANY for construction of an overhead steel water tank, the
cost of which with appurtenances and necessary piping connections will be
One Hundred Eighty-two Thousand and no/100 ($182,000), and
WHEREAS, due to rapid growth of the Village population and consequent
increase in consumption of water by residents of the Village, it appears
necessary that said overhead steel water tank be constructed in accordance with
said contract and that in order to finance construction of said tank it is
necessary to issue general obligation bonds of the Village, therefore
BE IT RESOLVED by the Village Council of the Village of St. Louis Park
that it is hereby determined to be necessary and expedient to issue the negotiable
coupon bonds of the Village in the amount not to exceed One Hundred Eighty-two
Thousand and no/100 ($182,000) Dollars for the purpose of providing money to pay
the cost of construction of an overhead steel water tank of one million
(1,000,000) gallons capacity to be erected on Village property adjacent to
Louisiana Avenue at Great Northern Railway Right -of -Way. Said bond to bear
interest at a rate to be determined by the Village Council upon receipt of bids
for same, and that the proposition for issuing said bonds shall be submitted
to the electors of the Village at a special election which is hereby called to

be held in and for the Village on the 9th day of September, 1952, between the
hours of 7:00 A. M. and 8:00 P. M., and which shall be held concurrently with the
State Primary Election which shall be held in the Village on said day.

election setting out the proposition in substantially the following form:

Resolution
On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the following
resolution was adopted by unanimous vote of all Members of the Council present:
RESOLUTION ORDERING SPECIAL ELECTION
WHEREAS, it appears to the Village Council that it is necessary in order
to protect the public health of the inhabitants of said Village to construct an
incinerator for disposal of garbage collected by the Village Garbage Contractor
and it appears that the estimated cost of a suitable incinerator is estimated to
be Two Hundred Thousand and no/100 Dollars ($200,000), therefore
BE IT RESOLVED by the Village Council of the Village of St. Lbuis Park
that it is hereby determined to be necessary and expedient to issue the negotiable
coupon bonds of the Village in the amount not to exceed Two Hundred Thousand
and no/100 Dollars ($200,000) for the purpose of providing money to'pay the cost
of constructing a suitable incinerator to be used for the disposal of garbage
and refuse which have been collected within the Village by the Village Garbage
Contractor, said bonds to bear interest at such rate, payable semi-annually, as
shall be determined by the Council on the basis of bids received, and that the
proposition of issuing said bonds shall be submitted to the electors of said
Village at a special election which is hereby called to be held in and for the
Village on the 9th day of September, 1952, between 7:00 A. M. and 8:00 P. M., con-
currently with the State Primary Election which shall be held in the Village on
said day.
BE IT FURTHER RESOLVED that the Clerk shall prepare ballots for said
election setting out the proposition in substantially the following form:

Letter Re: Street Signs for Cedarwood Road
Letter from H. Gordon Taylor, dated July 22, 1952, requesting the placing
of street and directional signs on Cedarwood Road was read. (Attorney for R. Chase)
On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the Street
Commissioner was ordered to place the following signs: One at the intersection
of France Avenue and Forrest with a sign reading "Enter Here for 4500 — 4900
Cedarwood Road"; One at the corner of Forrest and Parklands Road with an arrow
pointing the direction to take to find Cedarwood Road; One at the corner of
Cedarwood and Parklands Road reading "Cedarwood Road and Parklands Road", and
one at the intersection of Westridge Lane and Cedarwood Road indicating Cedar -
wood Road. Motion was passed by unanimous vote of all Members of the Council.
Eviction of Tenants in Veterans Housing Area
On motion of Trustee Bolmgren, seconded by Trustee Middleton, the Village
Attorney was in$tructed to start action to evict the following tenants living
in the St. Louis Park Veterans Housing Area for the non-payment of rent, by
unanimous vote of all Members of the Council:

Use of Property for Slopes - Berkwitz
On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the letter from
Marie Berkwitz and others, dated July 28, 1952, granting permission to the Village
to use the Northerly 3 feet of Lot 1, Auditors Subdivision No. 53 for slopes, was
read and accepted, by unanimous vote of all Members of the Council.
No Chance in Zonin
The Planning Commission's report dated July 28, 1952 on the request of S. B.
Lindsey and C. A. Welliver, Mechanical Engineers for the rezoning of Lot 19,
Block 3, Earlsfort Terrace Addition (2625 Louisiana Avenue) from commercial use
to light industrial use, was read.
Concurring with the Planning Commission's report, it was moved by Trustee
Middleton, seconded by Trustee Jorvig, that no change be made in the zoning of
Lot 19, Block 3, Earlsfort Terrace Addition. Motion was passed by unanimous
vote of all Members of the Council.
Street Licht Ordered
On motion of Trustee Bo]mgren, seconded by Trustee Jorvig, the Northern
States Power Company were instructed to place a street light on Alabama Avenue,
midway between 37th Street and Oxford Street, by unanimous vote of all Members
of the Council.
Bid Award - Storm Sewer District #30
On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the bid of
Lametti & Sons received July 14, 1952, for the construction of storm sewers for
July 28, 1952

Storm Sewer District No. 30, was determined to be the lowest bid of a responsible
bidder, and the Mayor and Clerk were authorized to exedute contract for the Village
with the bidder for the work at price bid of $104,196.70, by unanimous vote of
all Members of the Council.
Load Limit Check - Louisiana Avenue
On motion of Trustee Middleton, seconded by Trustee Bolmgren, Chief of Police
Andy Nelson was instructed to make a survey of loads being lauled on Louisiana
Avenue between Lake Street and Minnetonka Boulevard and make a report to the
Village Council on August 11, 1952, by unanimous vote of all Members of the Council.
Complaints on Smoke Nuisance - Astlefords Ready Mix Plant
Cldrk Justad reported that complaints have been coming in on the smoke
nuisance caused by Astleford's ready mix black top plant, adjacent to the Republic
Creosoting Company.
On motion of Trustee Bolmgren, seconded by Trustee Middleton, the Building
Inspector was instructed to check the smoke nuisance caused by Astleford's
Ready Mix Plant operating adjacent to the Republic Creosoting Company, and enforce
the ordinance in said matter, by unanimous vote of all Members of the Council.
Lease for Parking Propert
On motion of Trustee Bolmgren, seconded by Trustee Middleton, the Mayor
and Clerk were authorized to sign lease for the Village with Minnesota Rubber and
Gasket Company, to use part of Block 1, Collins Second Addition for a parking
lot for period ending December 31, 1954) by unanimous vote of all Members of the
Council.
Building Permit for Store Building
On motion of Trustee Jorvig, seconded by Trustee Bolmgren, the Building
Inspector was authorized to issue a building permit to Minneapolis Iron Store for
the construction of a store building at 3885 Wooddale Avenue, by unanimous vote
of all Members of the Council.

On motion of Trustee Bolmgren, seconded by Trustee Jorvig the purchase 'of'��Q�
the 33 foot strip of land approximately 1200 feet long lying between Block 3, a
Belmont Terrace on the east, and Block 1, Towles Minnetonka Boulevard on the west,
at a price of 91,100.00, was approved, subject to approval of title by the
Village Attorney. Motion was passed by unanimous vote of all Members of the
Council.
Hearing Date Set for Storm Sewer
On motion of Trustee Bolmgren, seconded by Trustee Jorvig, August 25, 1952
was set as date of hearing for the construction of Storm Sewer along the South
10 feet of the North 50 feet of Lot 3$, Block 1, Highwood Tract, Lake Forrest
Addition; the area to be assessed is as follows:
Commencing at the NW Corner of Lot 12, Highwood Tract, Lake Forest
Addition; thence NEly along the south line of Great Northern Railroad R/W to
East Corporate Limit Line; thence south along said line to Mll.y line of France
Avenue; thence Northwesterly -to the.Southeast corner of Lot 3$, Highwood Tract,
Lake Forest Addition; thence NWly to Swly corner of said Lot 3$; thence Nally
along L/o of Highwood Road to West Line and the NW corner of Lot 12, Highwood Tradt,

Motion was passed by unanimous vote of all Members of the Council present.

On motion of Trustee Bolmgren, seconded by Trustee Middleton, August 25,
1952 was set as date of hearing for the construction of storm sewer in Block 3,
Lenox Addition; -the area to be assessed is as follows:
All of Block 3, Lenox, bounded on the East by Florida Avenue; on the
South by 31st Street; on the West by Georgia Avenue; and on the North by Minnetonka
Boulevard. Motion was passed by unanimous vote of all Members of the Council.

On motion of Trustee Bolmgren, seconded by Trustee Middleton, the Street
Commissioner was ordered to place street signs as the following locations, by
unanimous vote of all Members of the Council:

Smoke Nuisance
The Clerk reported that complaints have been coming in on the smoke
nuisance caused the the blacktop mixing plant operated by Alexander Construction
Company on Lots 7 and 8, Home Addition -- also known as the State Pit.
On motion of Trustee Jorvig, seconded by Trustee Middleton, the Village
Attorney was instructed to start proceedings in Justice Court against Alexander
Construction Company for the violation of the Village Zoning Ordinance by
operating a tar mixing plant in State Pit 2638, located on lots 7 and 8, Home
Addition, by unanimous vote of all Members of the Council.
Ordinance No. 399
On motion of Trustee Bolmgren, seconded by Trustee Middleton, the following
ordinance was adopted by unanimous vote of all Members of the Council.
AN ORDINANCE REGULATING GAS APPLIANCES AND THE
INSTALLATION, ALTERATION, MAINTENANCE AND USE
OF GAS EQUIPMENT CONNECTED THERETO, AND LICENSING
THE REPAIR, ALTERATION AND INSTALLATION OF GAS
PIPING AND GAS BURNING DEVICES.
THE VILLAGE COUNCIL OF THE VILLAGE OF ST. LOUIS PARK ORDAINS:
SECTION 1, License Required: No person, firm or corporation shall hereafter
repair, alter, or install any gas piping or gas burning devices, as set forth in
this Ordinance, without first having secured a license from the Village Council
authorizing him to do so, and shall pay the fee, and furnish a bond hereinafter
provided for. Each such license shall terminate December 31st of each year of
the year the license has been issued, and shall not be assignable or transferable.
SECTION 2. License Application: Every person, firm or corporation'
desiring to engage in, or carry on, the business as above mentioned shall make
a written application to the Village Clerk for a license to do so, stating
therein the name of the person, firm or corporation desiring such a license and
the address of his or its place of business and such additional information as
the Clerk shall require.
SECTION 3. Qualifications of Applicants: Each person, firm or corpora-
tion desiring to engage in, or carry on, the business as above mentioned shall
be well qualified to do so. Each applicant -must pass a written examination to
determine his qualifications before ewe* n ,his license. Such examination
shall be conducted by the Building s C in consultation with the'Minne-
apolis Gas Company.
SECTION 4. Bond Requirement: With each application for a license, the
applicant shall furnish a surety bond to the Village of St. Louis Park in the
sum of $1,000.00 conditioned that the licensee shall pay all license fees, fines,
and penalties required of him by this Ordinance and shall in all materials and
equipment by him furnished and in all work by him done and performed in the
construction, installation, alteration and maintenance of all gas burning
devices and the installation, alteration, or extension of any system of piping
to such devices as above mentioned, strictly comply with the provisions of this
ordinance as provided herein.
SECTION 5. License Fee: The fee for each such license is hereby fixed
at the sum of $15.00, and shall be paid at the time of the filing of the applica-
tion and will be refunded in case the applicant is rejected by the Village
Council of the Village of St. Louis Park.
SECTION 6. Permits: It shall be unlawful for any person, firm or corpora-
tion, to do any of the work described in Section 1 of this Ordinance without
first obtaining a permit therefore from the Building Inspector, and upon demand
of said Inspector, any person applying for such permit shall furnish him with
all necessary plans in duplicate, for all proposed work, and with all proper and
sufficient information relating thereto, and shall secure the approval of the
Building Inspector before starting such work.
(a) Permit Fees: Such permits shall be issued by the Building
Inspector, only to licensees licensed under this ordinance. No licensee shall
secure a permit for others under his license. The fees for such permits shall
be as follows: For installing gas piping, providing for not to exceed 10 gas
fixtures or gas devices $1.50. For any such permit providing for from 11 to 25
such fixtures or devices $2.00. For any such permit providing for more than
25 such fixtures or devices $2.00. For any permit for installing gas stoves,
ranges, hot plates, steam tables, dental devices, regrigerators, retorts, bake

ovens, room heaters, barbecue grills, hair dryers or other similar gas burning
devices, the fee charged shall be $1.25 for each such device included in such
$1.25 permit, which fee shall be in addition to the fee charged, as above provided,
for installation of any gas piping for said devices or for any other gas fitting
work, if any, included in said permit.
(b) Any person, firm or corporation who shall commence any work
within the scope of the provisions of this ordinance before taking out a permit
for the same, who shall thereafter apply for such permit shall be required to pay
a fee double the amount hereinbefore provided for such work.
(c) For any permit for installing gas water heaters the fee shall
be $1.50 for each device included in such permit, which fee shall be $1.50 in
addition to the fee charged as above provided for the installation of any gas
piping for said devices and for any other gas fitting work, if any, included in
said permit. For any permit for installing, altering or repairing gas burners
and for gas burning equipment the fee shall be $2.00. For use in connection with
a heating system, the fee charged shall be $2.50 for each gas burner and for its
equipment included in such permit, which fee shall be in addition to the fee
charged, as above provided, for the permit for the installation of any gas piping
for said burner and for equipment.
(d) Where any such permit is issued for both gas piping and plumbing,
the fee for such permit shall be equal to the combined fees for each of said
classes of work or installation.
SECTION 7. Safety Standards:
(a) All gas appliances and accessories hereafter installed, sold, or
offered for sale shall conform to reasonable standards of safety.
(b) The presence on a gas appliance or accessory of a safety seal or
label of a nationally recognized testing agency or a certificate or letter of
approval from such agency or the inclusion of an appliance or accessory in an
approved listing by such agency shall be prima facie evidence that such appliance
or accessory conforms to reasonable standards of safety. Such nationally
recognized testing agency shall be one qualified and equipped to perform and one
that does perform periodic inspections of current models of gas appliances and
accessories.
SECTION 8. Provisions Regulating the Installation of Appliances:
(a) All gas appliances, accessories and piping systems shall be
installed to conform to reasonable, standards of safety.
(b) Installation of appliances, accessories, and piping that fails
to comply with the standards recommended by the American Standards Association,
Inc. in its Manual entitled ItInstallation of Gas Piping and Gas Appliances in
Buildings" 1950 edition, shall be considered prima facie as failing to conform to
reasonable standards of safety, the provisions of which are incorporated herein
by reference as though set out in full; the Village Clerk shall keep available
in his office three copies of the Code, marked as official copies, for study and
inspection by any interested parties.
(c) It shall be unlawful for any person, firm or corporation,
excepting an authorized agent or employee of the gas supplier to turn on or
reconnect gas service in or on any premises where and when gas service is not at
the time being rendered. This shall not prohibit an installer from turning on
the supply of gas temporarily for the purpose of testing the installation made by
him or from turning on gas that he had temporarily turned off for the purpose of
connecting an appliance or making repairs.
(d) It shall be unlawful for any person, firm or corporation to
install any gas appliance for the purpose of space heating without first determin—
ing from the gas supplier that adequate facilities are present to supply gas to
such appliances in quantities that will assure reasonably safe and uninterupted
operation.
SECTION 9. Penalties and Enforcement:
(a) No person, firm or corporation shall sell.or offer for sale.or
install,any gas appliance or accessories,or gas piping system'if the same when
installed for use would be in violation of any of the provisions of this Code.or
would be unsafe or dangerous.

Section 9 ----
(b) The Building Inspector is,hereby authorized to disconnect or
to order disconnection of any gas appliance, accessory or gas piping which
does not conform to the requirements of this ordinance or which may be found
defective or in such condition as to endanger life or property. Where such
disconnection has been made, a notice shall be attached to such appliance,
accessory or gas piping which shall state that it has been disconnected and the
reasons therefore, and such notice shall not be removed nor shall the appliance,
accessory or gas piping be reconnected until it shall have been made to conform
with the requirements of this ordinance and its reconnection has been authorized
by the Building Inspector.
SECTION 10. Effective Date:
This ordinance shalltake effect and be in force from and after its passage
and publication.
Home Disposal Units
Salesmen for home disposal units appeared before the Council and explained
their wares, and asked the Council to pas an ordinance regarding the installation
of waste disposals. The following petition was presented and read and ordered
filed with other garbage disposal materials on hand.
