Hurd at 8:00 P. M. Invocation was given by Reverend Bennett Brudevold, pastor, Aldersgate Methodist Church. Motion was passed by unanimous vote of all Members of the Council. 328 June 9, 1952 Bids for Sanitary Sewer Construction As advertised in the St. Louis Park Dispatch May 29, 1952, sealed bids were received from the following bidders for the construction of Sanitary Sewer Improvement No. 52-195 - in Monterey Avenue from 25th Street to 27th Street: 1. Ferron Construction Co.' 8,976.50 The following persons appeared -regarding the above sewer construction: Wm. Mc Masters, 2637 Monterey Avenue, representing a group of residents who are opposed to the construction of proposed sewer, said there was no need for same, and they cannot afford it. Mrs. M. J. Mc Carty, 2601 Monterey Avenue said cesspool is not workable ,in their home. Mr. Theodore Ptashne, 2529 Monterey Avenue said the sewer is definitely needed for health reasons, -for the whole area. Mr. Norton Rockler, 2605 Monterey Avenue said we are badly -in need of the sewer at this time.- Mr. H. E. Pulver,,2620 Monterey Avenue stated that he needed the sewer badly. On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the above bids were referred to the -Village Engineer and Chairman of the Sewer Department Committee for checking and recommendation, by unanimous vote of all Members of the Council. Later The Village Engineer reported on'his tabulation of above bids, and recommended that the bid awarded to Terry Brothers, Incorporated. On motion of Trustee Bolmgren, seconded by Trustee Middleton, the bid of Terry Brothers, Incorporated received this meeting -was determined to be the lowest bid of a responsible bidder for the construction of sanitary sewer in Monterey Avenue from 25th Street to 27th Street (Improvement No. 52-195), and the Mayor and Clerk were authorized to execute contract for the Village with Terry Excavating Company for the work at price bid of $8,419.50, by unanimous vote of all Members of the Council. Mr. La Mere spoke about the grade not being where it should be in the 2700 Block. On motion of Trustee Bolmgren, seconded by Trustee Middleton, action on above hearings was deferred to meeting of June 16, 1952, by unanimous vote of all Members of the Council. Hearing on Application for Rezoning Pursuant to notice published in the St. Louis Park Dispatch May 22, 1952, a public hearing was had on the application of J. W. Held and F. J. Swenson for rezoning -THAT PART OF THE E2 OF THE-NW11 OF THE SW4 OF SECTION 30, TOWNSHIP 29, RANGE 24, from open development to commercial use. The following persons appeared: Mr. Held appeared in favor of his -petition. Mr. R. H. White appeared for Mr. F. J. Swenson in favor of the petition. Roger Shandeling, 1620 South Lilac Drive and C. P. Mc Cauley, 1600 South Lilac Drive appeared in opposition to the rezoning. They -said it would cause a traffic hazard, and would lower the valua- tion of their property. On motion of Trustee Bolmgren, seconded by Trustee Jorvig, action on above request for rezoning was deferred to meeting of June 23, 19523 by unanimous vote of all Members of the Council. Hearings on Proposed Street Improvements Pursuant to notices published in the St. Louis Park Dispatch May 22 and 29, 1952, separate public hearings were had on street improvements described therein. The following persons appeared: Regarding Improvements 136 and 158 - R. W. Vaugh, 7301 Minnetonka Boulevard said he would like to have both sidewalk and curb and gutter stopped at the alley line south of his home as he cannot afford to pay for such a long stretch at this time. Regarding Improvements 142 and 175 - Sidney Goldstein, 7225 Minnetonka Boulevard made the same request as Mr. Vaughn. Regarding Improvement 138 - The block was divided-. The owners of the north six lots on the West Side of Texas Avenue were in favor, and would like the sidewalk in front of their homes while the owners of the south six lots of the block wou4d like the walk left out at this time. (Petitions on file for and against). Regarding Improvement 144 - Messrs: Jordan; 3029 Nevada Avenue, Lee, 3033 Nevada Avenue, Gagnon, 3045 Nevada Avenue, Wilson, 3049 Nevada Avenue, and Huber, 7325 Minnetonka Boulevard appeared in opposition to sidewalk on the East Side of Nevada Avenue from Minnetonka Boulevard to 31st Street. Regarding Improvement 52-150 - Petitions for and against the construction of sidewalk on the East Side of Texa-Tonka Avenue from Virginia Avenue to Vir- ginia Avenue were discussed. Regarding Improvement 52-222 - Owners of Lots .59 and 60, Auditors Sbu- division No. 350 said they do not -want and did not petition for curb and gutter on the East Side of Zarthan Avenue adjacent to their property. However, they felt that Lots 56 and 57 did want same. On motion of Trustee Bolmgren, seconded by Trustee Jorvig, action on above proposed street improvements was deferred to meeting of June 16, 1952, by unani- mous vote of all Members of the Council. Hearings on Proposed Sanitary Sewer Extension Separate hearings were had on proposed sanitary sewer extensions Improve- ments Nos. 52-223 and 52-224. The following persons appeared: Mr. Lamere appeared in favor of No. 52-223• Resolution On motion of Trustee Bolmgren, seconded by Trustee Middleton, the follow- ing resolution was adopted by unanimous vote of all Members of the Council: RESOLUTION ORDERING SEWER EXTENSIONS WHEREAS, the Village Council has met at the time and place specified in a notice relating to the following -described improvements which was published in 330 June 9, 1952 Resolution Ordering Sewer Extensions, Cont'd. the St. Louis Park Dispatch May 22 and 29, 1952, and has heard all interested persons appearing at said meeting and determined the necessity for said im— provements, therefore, BE IT RESOLVED by the Village Council of the Village of St. Louis Park as follows: 1. That the following sanitary sewer extensions,be hereby ordered: IMPROVEMENT NUMBER LOCATION 52-223 On easement over Lots 5 and 6, Lamerels Addition from Xenwood Avenue to Yosemite Avenue and on Yosemite Avenue from south line Lamere's Addition to West 27th Street. 52-221 Dakota Avenue from West 32nd Street -to north line of Lot 13, Block 4, Adolph Fine Addition. 2. That said sewer extensions be made in accordance with plans and speci— fications for the same which have been prepared by the Village Engineer and which are hereby approved. 3. That the Clerk be directed to advertise for bids for said sewers to be opened by the Village Council at its meeting of July 7, 1952• Hearing on Proposed Opening of All A hearing'was had on proposed opening of alley adjacent to Lots 1 to 12, Block 1, Belmont -Terrace. A petition in favor of this improvement signed by George Daellenbach, 3007 Cavell Avenue and 22 others was presented. Resolution On motion of Trustee Jorvig, seconded by Trustee Middleton, the following resolution was adopted by unanimous vote of all Members of the Council: RESOLUTION ORDERING OPENING OF ALLEY AND ACQUISITION OF RIGHT OF WAY WHEREAS, the Village Council has met at -the time and place specified in a notice published in the St. Louis Park Dispatch May 22 and 29, 1952, relating to opening and acquiring alley hereinafter described and has conducted a public hearing and heard all interested persons and determined the necessity for said opening and acquisition, therefore, BE IT RESOLVED by the Village Council of the Village of St. Louis Park as follows: 1. That alley be hereby opened described as follows: Two rods in width,being the east 162 feet of the.NE of the NWy� of Section 1$, Township 117, Range 21 lying adjacent to Lots 1 to 12 inclusive, Block 1, Belmont Terrace, and the West 162 feet of the NW -1 of the NEw of Section 1$, Township 117, Range 21 lying adjacent to Lots 1 -to 13 inclusive, Block 1, Towle's Minnetonka Boulevard Addition. 2. That the Village Attorney be,authorized to commence negotiations for acquisition of said premises from the owner thereof, and if no price for the same acceptable to the Village Council is negotiated within thirty days, to commence proceedings in the District Court of Henne— pin County for the taking of said right of way by condemnation proceed— ings. Hearing on Proposed Assessmentsfor Street Improvements Pursuant to resolution published in the St. Louis -Park Dispatch May 8, 1952, setting assessment hearings on proposed.assessments for grading of streets and alleys described therein; said public hearings were had at this time. No persons appeared. On motion of Trustee Middleton, seconded by Trustee Bolmgren, action on above assessment hearings were deferred to meeting of June 16, 1952, by unani— mous vote of all Members of the Council. + Assessment Hearing on Proposed Assessment for Sanitary Sewer Pursuant to notice published in the St. Louis Park Dispatch May B, 1952, a public hearing was had on proposed assessment covering the cost of Sanitary 1 1 1 C�) June 9, 1952 33 1 ?'40 -; Assessment Hearing oil Proposed Assessment for Sanitary Sewer, Cont'd. Sewer Improvement No.'51-265 - in Glenhurst Avenue 170 feet south of 39th Street to serve Lots 3, 4, 9,,-10., 11, and 12, Minikanda Park Addition. No one appeared. On motion of Trustee Bolmgreri, seconded by Trustee Middleton, action on above assessment hearing was deferred to meeting of June 16, 1952, by unanimous vote of all Members of the Council. Request for Permit to Build Gas Station - B. Berkwitz The Planning Commission's report dated June 5, 1952, in which reconsidera- tion was given to the request of Mr. Ben L. Berkwitz for permission to build a gasoline station on the SE Corner of Salem Avenue and Minnetonka Boulevard, and moving the old store building now on that corner to the east end of the lot, was read. Concurring in the recommendation -of the Planning Commission, it was moved :by Trustee Middleton, seconded by Trustee Holmgren, the Building Inspector was :authorized to grant a permit for the erection of a gas station on the corner of :Salem Avenue and-Minrietonka Boulevard (SE Corner), by the following roll call :vote: Trustee Bolmgren, yea; Trustee Middleton; yea; Mayor Hurd, yea; Clerk :Justad, yea; Trustee Jorvig, nay. _ The opposition headed by Jack Roberts, 5221 Minnetonka Boulevard claimed that a gas station at the above location would be more detrimental than a retail store, would be open until 10 P. M., lights would be flashing all around, would lower the value of the residential property nearby. FHA says they would not approve loans across the street or next to a gas station. School children on Salem Avenue would have to pass the station to go to the Park Hill School. He asked if the 20 foot setback would or could (in front of the grocery store) be used for a driveway. The answer was yes, the same as at Kay Motors, Garden Village driveway, etc. Said that this makes too many driveways for children to have to cross with out adding more outlets at the gas station. There are a number of renters in this area who do not want the gas station. Mr. Edelman, representing Mr. Berkwitz spoke in favor of the station. He said that this property has been zoned for commercial use since 1932• The owners are old time residents. He does not -believe that the gas station will lower the values on nearby residential property. The Minneapolis report for 1951 shows that gas stations are not more hazardous: Mr. Woods of the Texaco Company showed a picture of a Texaco Station. Mr. Berkwitz said what is best for St. Louis Park should be our aim. We could build five stores on this spot (150 ft., 30 ft. stores), and that means traffic. A Texaco Station wouldn't bring nearly as much traffic; and,the present taxes of $$100.00 on a gas station would bring in about $$500.00. Mr. Woods of Texaco Company said cars on the Belt Line need a gas station. We have 571 stations, and in the past four years there have been no accidents. Maurice Silverman, 2912 Salem Avenue -said he has protested against things in this Council in the past, due to selfish reasons. Protested three different projects, and not any of the things happened that -he brought up in his protesta- tions. This improvement will be a definite improvement for the area. We are sympathic with the folks here tonight, but feel their fears are unfounded. The Berkwitz family do not want to trade dollars for children's lives, and if they thought it would, they wouldn't ask for this permit. Mr. Woods explained that they have two stations in the Park one at Excelsior and Lynn, and one at Excelsior and Xenwood. They have had no complaints about reduced property values. Mr. Andres of Calhoun Realty Company was asked if gas -station would depreciate the nearby property: He said yes, to the first house, but it would be the same if it was a store. Trustee Jorvig asked if the Council would object to store buildings at this location. Trustee Bolmgren, said no. It's the open driveways that make the traffic hazard. Mr. Edelman said that stores would cause more of a traffic hazard. Trustee Bol.mgren said the solution to our tax problem is not a gas station on every corner. Mr. Edelman said that children have not been hurt with the present 6 driveways. Mrs. Phillip Dennet, 2940 Salem Avenue spoke in opposition to proposed gas station. Said the lights from cars would annoy residents in the area, it would lower the valuation of surrounding property. Said the occupant has lived there for a long time, and doesn't seem -to be doing anything about it. He is a Village Employee, and the Police car takes him to and from lunch: They have a big dog that eats more than the family can afford. The property is not kept up - not a blade of grass on the place. It is not healthful for the children. The appearance of this property lowers the value of surrounding residences. Public Telephone for VillageHall On motion,of Trustee Jorvig,-seconded by Trustee Middleton, the Clerk was authorized to sign contract for a -public telephone to -be installed in the Village Hall, by unanimous vote of all Members of the Council. Licenses On motion of Trustee Middleton; -seconded by Trustee Jorvig, the following applications for 1952 licenses were approved, and the Mayor and Clerk were authorized to issue licenses to expire December 31, 1952, by unanimous vote of all members of the Council: Mc Williams Plumbing & Heating Co. Plumbing Canfield Plumbing Company it H. P. Mc Dermott Used Car Lot Special Permit to Connect to Sewer On motion of Trustee-Jorvig, seconded by Trustee Bolitgren, a special permit was granted -to J. B. McGuire to connect his home at 3836 West 31st Street to the manhole at the intersection of France Avenue and West 31st Street for sewage disposal service with the understanding that he pay to the Village of St. Louis Park an assessment of -$600.00 as their share of the cost of the construction of said sewer in West 31st Street at the time he takes out the regular permit. It is -further understood that he agrees to pay to the Village of St. Louis Park a sewer rental for each year at -the rate set by the Village Council. These charges shall be paid every"three months: Motion was passed by unanimous vote of all members of the Council, subject to approval of Minneapolis. Special Permit to Connect to Water Main'_ On motion of Trustee Bolmgren, seconded by Trustee Jorvig, a special permit was granted to Alexander Construction Company to lay a temporary water line from the hydrant at the SW Corner of Louisiana Avenue and Cedar Lake Road north to their mixing plant for a water supply during this season. It is understood that the Water Department will meter the water used and the Alexander Construction Company will pay the Water rental rate of 20¢ per 100 cubic feet as specified in the ordinance. Motion was passed by unanimous vote of all Members of the Council. Continued Hearing on Proposed Paving of Minnetonka Boulevard Separate hearings were continued from the June 2nd meeting on proposed paving of Minnetonka Boulevard - Improvement No. 52-216. Resolution On motion of Trustee Bolmgren, seconded by Trustee Middleton, the following resolution was adopted by unanimous vote of all Members of the Village Council: RESOLUTION ORDERING PAVING OF MINNETONKA BOULEVARD WHEREAS, the Village Council has met at the time and place specified in a notice relating to Improvement No. 52-216 published in the St. Louis Park Dispatch May 15 and 22, 1952, and has heard all persons appearing at said meeting in regard thereto and has determined the necessity for said improvement, therefore, BE IT RESOLVED by the Village Council of the Village of St. Louis Park as follows: 1. That Improvement No. 52-216 consisting of construction of concrete paving on Minnetonka Boulevard from the end of existing concrete pavement at the intersection of Minnetonka Boulevard and West Lake Street and thence westerly to a point 200 feet west of Dakota Avenue and also from the end"of existing pave- ment on Joppa Avenue east to Glenhurst Avenue be hereby ordered. 2. The said paving shall be done in accordance with plans and specifications which have been prepared by the County Highway Engineer of Hennepin County and which are hereby approved. 3. The Clerk is hereby directed to advertise for bids for said paving construction to be opened by the Village Council at its meeting to be held June 23, 1952. 4. The above paving construction is to be undertaken by the Village only on the condition that the County of Hennepin shall enter into an agreement with the Village in form substantially identical with the contract entered into between the Village and the County in 1951 for paving of Minnetonka Boulevard from Joppa Avenue to State Highway No. 100, and which shall provide for equal division of the construction cost and furnishing of the plans and specifications and engineer- ing services at the sole expense of the County. 5. The Village Attorney is authorized to commence proceedings in District Court of Hennepin County .for condemnation of additional right of way for Minne- tonka Boulevard and slope easements at the points indicated on the plans prepared by the County Engineer. Letter Re: Employee Parking Space - Minn. Rubber & Gasket Co. Letter from Minnesota Rubber and Gasket Company, dated June 9, 1952, relative to agreement with the Village to use Village owned property located on West 37th Street for the parking of their Employees' cars, was read. On motion of Trustee Jorvig, seconded by Trustee Middleton, the Mayor and Clerk were authorized to sign an agreement with Minnesota Rubber and Gasket Company as outlined in above mentioned letter which reads as follows: "Tare propose that our firm and the Village jointly undertake the following: 1. The Village would haul away the dead trees and debris-. 2. Our firm would furnish crushed rock for surfacing the lot not to exceed an expense of $500.00 3. The Village would spread and roll the crushed rock 4. Our firm would install guide rails to keep the parking back from the street 5. Our firm and the Village would sign an agreement leasing this property to Minnesota Rubber and Gasket Company for parking purposes fora period of two years at an annual rental of $500.00 payable in advance. This agreement would also include provisions for maintenance when necessary and snow removal at the expense of the Village. The term of this agreement would start January 2, 1952•" Motion was passed by unanimous vote of all Members of the Council. Employment of Temporary Engineer A memo from Village Engineer, -Phil W. Smith, dated June 4, 1952, explaining the need for services of an Engineer temporarily to get out the plans which are most urgent, was read. On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the Clerk was authorized to sign for the Village, the proposal of Toltz, King and Day, Inc. for the services of Engineer H. G. Gilbert on a temporary basis at -$$400.00 permonth, plus 100% for overhead and profit, plus mileage at 7¢ per mile, by unanimous vote of all Members of the Council. Letter Re: Parking Area - _TLe- �,_ On motion of Trustee Jorvig, seconded by Trustee Bolmgren, the letter from the Department of Highways, State of Minnesota, dated May 27, 1952, grant- ing permission to the Village to install a parking area on Trunk Highway No. 7 Right of Way, along the easterly side of Inglewood Avenue and Minnetonka Blvd., was referred to Village Engineer, Phil W. Smith, by unanimous vote of all Members of the Council. Portable Traffic Counter • A letter from Streeter-Amet Company, 4101 Ravenswood Avenue, dated May 26, 1952; enclosing prices, delivery date, specifications, etc. on portable traffic counters, was read. On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the purchase of One (1) traffic counter complete with battery, roadtube and installation accessories at price -quoted of $321.75 was approved, by unanimous vote of all Members of the Council. Peterson, 3012 Aquila Avenue, dated June 4, 1952, regard- ing the garbage problem was -read and ordered filed with other garbage disposal material. 1952 -Minnesota Municipal Director On motion of Trustee Jorvig, seconded by Trustee Bolmgren, the Clerk was authorized to purchase one copy of 1952 Directory of Minnesota Municipal Officials at $2.00, by unanimous vote of all Members of the Council. Justice of Peace Report of Fines - Ynpve Justice of Peace Anton Yngve's report of fines, dated June 3, 1952, for May., 19523 was read and ordered filed. 338 June 9, 1952 Building Inspector's Weekly Report The Building Inspector's report for week ending June 6, 1952, showing that 22 building permits were issued, totaling $112,600, was read and ordered filed. Insurance for Village Property Approved On motion of Trustee Bolmgren, seconded by Trustee Middleton, Fire and Extended Insurance covering Village owned--dwelling-at 4421 West 28th Street, in the amount of $12;500 -was approved, and the Shursen Agency was authorized to write policy for same, by unanimous vote of all Members of the Council. Group Re: Building of Inferior Houses on Northside A group appeared regarding the low cost inferior houses being built in Richmond Addition by Adolph Fine, Incorporated. Robert Hanold, 1421 Kentucky Avenue appeared, said Fine had started building these houses in an area where the houses were already built for $4000.00 and up, -and no permits taken out before the work was started. - He also said we should have a better building code, and the present one enforced. If it can't be done legally, it should be done otherwise. Harlan Strong, attorney for Richmond Addition residents asked if deed restrictions were made to call for five room dwellings, who can enforce same? Village Attorney, E.. -T. Montgomery said anyone home owner can start action. Mr. Strong suggested that the Zoning Ordinance be made more specific, and state the minimum number of rooms in a residence. The question was asked "how many in the room received copies of the 1951 Financial Statement." No one in the room said yes. The group stated that they represent more than $1,000,000.00 worth of homes on the Northside, and feel the Council should protect them. Asked if the Council would do something about the present ordinance, and what were their plans with regard to the present situation. The Council agreed to review this matter with the Building Department, the Village Attorney, and possibly some outside authority.
