REGULAR MEETING MAY 5. 1952
A regular meeting of the Village Council was called to order by Mayor
C. L. Hurd at 8:12 P. M.
Rabbi Haber gave invocation.

Request for Permit to Build Commercial Building
Mr. Resop presented plans for a Commercial and'Office Building to be cons-
tructed on the north side of Excelsior Boulevard on the Engell property (Nos.
4950 to 4994).
On motion of Trustee Middleton, seconded by Trustee Jorvig, the application
of Mr. Resop for the above mentioned building permit was granted subject to the
Planning Commission's and Building Inspector's approval, and the Building Ins-
pector was instructed to issue permit for same, by unanimous vote of all Members
of the Council present.
West 36th Street Rezoning
Mr. L. E. Brophy, Attorney, representing the following persons who filed
a petitionfor the revocation of Ordinance -No. 393, adopted by the Village Council
on February 4, 1952, for the rezoning of property on West 36th Street between
Highway No. 100 and Yosemite Avenue, from Multiple Dwelling to Light Industrial
Use, appeared and presented the petition which reads as follows, and which was
signed by Wesley Warren Fitch, Arthur F. Scheuble, Loren R. Ferch, Ray Olson, and
Edward Thompson:
"PETITION
TO THE ST. LOUIS PARK VILLAGE COUNCIL:
The undersigned being property owners and residents within 200 feet
of the property on West 36th Street re -zoned by action of the Village Council
February 4, 1952, having had no knowledge or actual notice of any kind of any
hearing on such re -zoning, hereby petition the Village Council to revoke the action\\
taken by the Council on February 4, 1952 re -zoning said property for commercial
use." (Dated May 5, 1952).
L. R. Ferch, 5625 West 36th Street said he wanted to keep the community
as it was. The new industrial building will lower the value of his property. 1gr.
Arthur F. Scheuble, 5709 -West 36th Street said that with the building of the
proposed new building, there will be others following, and it would not be safe
for children with all the traffic. Ray Olson, 5618 West 36th Street, owner of
a new home next to new building said it will shut off the light on the east and
it will come close to his property line. Edward Thompson, 5626 West 36th Street
said he was not in favor of it as it will be bad for the kids as well as his
property. Wesley W. Fitch, 5710 West 36th Street said a warehouse so close
would not do his property any good. Said they should have been notified of the
hearing, and were promised same by the Council last November.
Mr. Ferch was asked what trouble he has had with the lowering of the value
of his property. He said a man was looking at it, but now has lost interest.
Another prospect saw the warehouse and walked away. He said he purchased his
home in 1949. He was born in the place 25 years ago.
Mayor Hurd explained the method of zoning and explained that all of 36th
Street was zoned light industrial in 1932, and later in 1947 was rezoned for
multiple dwelling, and then in 1951 an application for rezoning to light indus-
trial came in. The area is not conducive to residdntial use, but for commercial
or industrial use.

• Mr. Brophy asked if the Council would be willing to, rezone to Multiple
Dwelling Use, the lots not now occupied. No reply. No action taken at
this time.
Complaint Re: Dumping
J. C. Causey, 3305 Yukon Avenue appeared. Said that the gravel pit
north of his home is being -used for dumping_, and feels that the dump should be
moved elsewhere. Mayor Hurd stated -that a. plan is being worked out for this,
and told of the Citizens Committee who will work up some plan, and bring in
their recommendations. Mr. Causey said when he moved to his present address
last November, he didn't know they were dumping there.
Application for Plumbing License
On motion of Trustee Middleton, seconded by -Trustee Jorvig, the applica-
ti-on of Hubbard Plumbing & Heating Company for a plumbing license was approved,
subject to the approval of the Building'Inspector, and the securing the signa-
tures of Master plumbers in Hennepin County., to the effect that he is qualified
to carry on the business of a licensed plumber. Motion was passed by unanimous
vote of all Members of the Council present..

Dumping & Burning of Refuse
David A. Klatke, 3756 Aldrich Avenue North, Minneapolis and Sig Johnson,
4712 West 28th Street, St. Louis -Park appeared in -response -to a request by
Trustee Jorvig, to explain the dumping and fire on property north of Cedar Lake
Road at the Great Northern Railway bridge. These men stated that they had been
regularly dumping refuse, tin cans, plaster and industrial waste -material which
is inflammable. The claimed to be owners of the premises. They stated they
had covered the burning refuse with sand by bulldozer. They were informed that
the Village Attorney would notify them as to what restrictions are imposed by
law on their use of these premises for dumping.
Resolution
On motion of Trustee Jorvig, seconded by Trustee Middleton, the following
resolution was adopted by unanimous vote of all Members of the Council present:
RESOLUTION CANCELLING #497 SANITARY SEWER 2-P ASSESSMENT
WHEREAS it appears that by resolution of the Village Council adopted
September 4, 1951, levying assessments for #497 Sanitary Sewer 2-P, Lots 3 and
4, Block 2, Meadowbrook Addition wereinadvertantly charged for said improve-
ment; whereas these lots were not serviced by said sewer; therefore,
BE IT RESOLVED by the Village Council of the Village of St. Louis Park
that the entire assessment levied against the following described lots, in the
amounts set forth be hereby cancelled, and that the Treasurer and the Auditor of
Hennepin County be hereby authorized to cancel the same upon their respective
records.

On motion of Trustee Middleton, seconded by Trustee Jorvig, the following,_
resolution was adopted by unanimous vote of all Members of the Council present:
RESOLUTION CANCELING #497 SANITARY SEWER 2-P ASSESSMENT
WHEREAS it appears that the following property owner was inadvertantly
assessed for two sewers - #497 Sanitary Sewer P-208 (which serves the property);
and #497 Sanitary Sewer 2-P (which does not serve this property); therefore
BE IT RESOLVED by the Village Council of the Village of St. Louis Park
that the entire assessment for #497 Sanitary Sewer 2-P levied against the follow-
ing lot in the amounts set forth below be hereby cancelled and that the Treasurer
and the Auditor of Hennepin County be hereby authorized to cancel the same upon
their respective records.

Resolution
On motion of Trustee Jorvig, seconded by Trustee Middleton, the following
resolution was adopted by unanimous vote of all Council Members present:

WHEREAS it appears that by resolution of the Village Council adopted
September 24, 1951, levying assessments for #497 Alley Grading 51-2, Lot 4, Block
2, Blakeman's 3rd Addition was inadvertantly charged for 53' instead of 20' and
Lot 25, Block 2, Oak Lawn Addition, was charged for 251 instead of 581; therefore,
BE IT RESOLVED by the Village Council of the Village of St. Louis Park
that the above assessments heretofore levied against the following lots be
corrected to the amounts set forth below, and that the Treasurer and the Auditor
of Hennepin County be hereby authorized to correct the same upon their res-
pective records.

On motion of Trustee Jorvig, seconded by Trustee Middleton, the above
petition was referred to the Planning Commission for checking and recommendation,
by unanimous vote of all Members of the Council present, and the Clerk was
instructed to contact Mr. Held with regard to his being present at the Planning
Commission meeting on May 7, 1952•
Applications for Commercial Electric Service,
On motion of Trustee Middleton; seconded by Trustee Jorvig, the Mayor
and Clerk were authorized to sign applications for Commercial Electric Service
for Sewer Lift Station at Webster -Avenue and West 26th Street; and for Sewer
Lift Station at SW Corner of Meadowbrook Boulevard and Brunswick Avenue, by
unanimous vote of all Members of the Council present.
Bid Awarded for 3/4 Ton Pickup Truck
On motion of Trustee Middleton, seconded by Trustee Jorvig, the bid of
International Harvester Company received April 28, 1952 for the furnishing of
one 3/4 ton pickup L-122 truck, was deemed to be the lowest bid of a responsible
bidder, and the Clerk was instructed to issue a purchase order for same to
the Bidder, at price bid of $1,545.56, by unanimous vote of all Members of the
Council present.
Bid Awarded for Grading & Graveli
On motion of Trustee Middleton, seconded by Trustee Jorvig, the bid of
Terry Brothers, Inc. received April 28, 1952, for the grading and graveling of
Louisiana Avenue from Minnetonka Boulevard to 27th Street, was determined to be
the lowest bid of a responsible bidder, and the Mayor and Clerk were authorized
to execute contract for the Village with Terry Brothers, Inc. for the work at
price bid of :6,608.50, by unanimous vote of all Members of the Council present.
Employment of Block Layer Approved .
On motion of Trustee "Middleton, seconded by Trustee Jorvig, the employment
of a cement block layer to construct a foundation at the Lake & Brunswick
Recreational Center, at a wage of $2.90 per hour was approved by unanimous vote
of all Members of the Council present.
Proposal - Intercommunication System
Letter from Northwestern Bell Telephone Company, dated April 28, 1952,
quoting cost of intercommunication system for the Village Hall, connected to
ten telephones with a push button and buzzer system of $22.14 per month, plus
a $3.50 installation charge, was"read.
On motion of Trustee Middleton, seconded by Trustee Jorvig, the above
proposition was approved, and`the Clerk was instructed to write Northwestern
Bell Telephone Company, informing them of the Council's acceptance of the
intercommunication on a monthly rental basis, by unanimous vote of all Members
of the Council present.
Petition for Vacating Alley
On motion of Trustee Jorvig, seconded by Trustee Middleton, the petition
signed by H. Vance Rorbach, 3523 Rhode Island Avenue and others, dated May 5,
1952, for the vacation of Alley in Block 309, Rearrangement of St. Louis Park,
was referred to the Planning Commission for checking and recommendation, by
unanimous vote of all Members of the Council present.
Amendment to Ordinance No. A-13 Ordered
On motion of Trustee Jorvig, seconded by Trustee Middleton, the Village
Attorney was instructed to prepare an amendment to Ordinance No. A-13, entitled
AN ORDINANCE RELATING TO THE BURNING OF TRASH, -providing for hours burning is
to be permitted --- "No burning from 6:00 A. M. to 12:00 Noon, Monday thru
Friday," by unanimous vote of'all members of the Council present.
Loan of Four Voting Machines Approved
On motion of'Trustee Middleton, seconded by Trustee Jorvig, the Clerk
was instructed to secure receipt especially prepared by the Village Attorney,
for the loan of four voting machines for use by the Minnesota Federation of
Women's Clubs at their general convention to be held in Minneapolis Auditorium,
May 12th thru May 17th, 1952, by unanimous vote of all Members of the Council
present.
League of Minnesota Municipalities Convention
On motion of Trustee Jorvig, seconded by Trustee Middleton, the following
persons were authorized to attend the League df Minnesota Municipalities Con-
vention to be held at St: Cloud, June 11, 12, and -13, 1952, with necessary ex-
penses paid, by unanimous vote of all Members of the Council present: Village
Attorney, Village Engineer, and all Members of the Village Council, Assessor.

Hours Set for Dumping Sewage
On motion of Trustee Jorvig, seconded by Trustee Middleton, the Village
Council ordered that no dumping of sewage shall be allowed in sewer manhole at
Wooddale and 36th, between the -hours of 8:00 A. M. and 5:00 P. M., Monday thru
Friday, and between the -hours -of -8:00"A. M.j'and 1:00 P. -M. on Saturday, by un-
animous vote of all Members of the Council present.
Petitions for Sanitary Sewer
On motion of Trustee Jorvig, seconded by Trustee Middleton, the follow-
ing -petitions were referred to the Village Engineer -and Chairman of the Sewer
Department Committee for checking and recommendation, by unanimous vote of all
Members of the Council present:

AN ORDINANCE A ENDING ORDINANCE NO. 364
(REPEALING)
The Village Council of the Village of St. Louis Park ordains:
Section 1. Ordinance No. 364 entitled "AN ORDINANCE AMENDING THE ZONING
ORDINANCE OF -THE VILLAGE OF ST. LOUIS PARK", adopted by the Village Council
May 15, 1950, is hereby repealed for the -reason that -the owner of the premises
described in said ordinance has failed to comply with -the conditions thereof,
and under date of March 21, 1952, has declined to comply with said conditions.
Section 2. This ordinance shall take effect from and after its publica-
tion.
Re: Sewer Connections - Tom Motzko
On motion of Trustee Middleton, -seconded by Trustee Jorvig, the Village
Council ordered that sewer -connections -at 2912 Natchez Avenue, and 4108 Salem
Avenue, be opened up for inspection, and the Village Plumbing Inspector's Office
is herewith notified that no more permits are to be issued to Tom Motzko until
this has been done, by unanimous vote of all Members of the Council present.

Building Officials and Inspectors
Letter from Midwest Conference of Building Officials and Inspectors,
dated April 28, 1952, to Building Inspector; Peter Stienstra, informing him that
he had been elected to membership of that Board as -the representative from
Minnesota, to fill the existing vacancy until their next general election of
officers, was'read.
On motion of Trustee Middleton, seconded -by Trustee Jorvig, the Building
Inspector, Peter Stienstra was congratulated on his appointment as Minnesota
representative to the Midwest Conference of Building Officials and Inspectors

On motion of Trustee Jorvig, seconded by Trustee Middleton, the Mayor
(or Acting Mayor) and Clerk were authorized to execute purchase agreement for the
Village with Fremont Investment Company by -Calhoun Realty Company, Agent, said
agreement to be prepared by the Village Attorney, for the purchase of the follow-
ing described property, by unanimous vote of all Members of the Council present:
The east 66.45 feet of Lot One (1), Block One (1),
Tuxedo Park, according to the plat thereof on file
and of record -in the office of the Register of Deeds
of said Hennepin County, and also the west 280 feet
of the east 598 feet of that part of the NES of the
SW4 of the SES, lying north of the south 313.5 feet
thereof. Said premises are more particularly des-
cribed in Certificates of -Title No. 143973 and No.
1+3990 issued by the Registrar of Titles of Hennepin
County, at a cost of $14,500.00.

Letter Re: St. Louis Park Theatre Marquee
Letter from Harold D. Field of the St. Louis Park Theatre Company, dated
May 7, 1952, in reply to our letter to them dated April 30, 1952, relative to
moving the marquee on Theatre Building back 31 feet, due to widing of Minnetonka
Boulevard, was read.
On motion of Trustee Jorvig, seconded by Clerk Justad, the Village Attorney
was instructed to contact Attorney, Matthew J. Levitt and bring in a recommenda-
tion as to what procedure to follow in this matter, by unanimous vote of all Members
of the Council,present.
Motion Re�-_ardina Purchase of Traffic Signals Recinded
On motion of Trustee Jorvig, seconded by Clerk Justad, motion passed by
the Village Council April 28, 1952 (MB 272), awarding bid for traffic signals at
Excelsior Boulevard and Brookside Avenue, and Excelsior Boulevard and Alabama
Avenue to Langford Electric Company, is hereby recinded, by unanimous vote of all
Members of the Council present.
