REGULAR MEETING MAY 26, 1952
A regular meeting of the Village Council was called to order by Mayor
C . ` L . Hurd at 8:10 P. M.
Invocation was given by Reverend Paul Obenauf of Wooddale Luthern Church.

Hearing to Reconsider Ordinance No. 393
Pursuant to notices mailed to residents of the area in vicinity of Lots
6, 7, and 8, except the West 10 feet of Lot 8, Block 45, Rearrangement of St.
Louis Park, a hearing was had for the purpose of reconsidering Ordinance No.
393 with respect to rezoning of said lots. Loren Ferch and others from the area
were present and the subject was discussed. No action taken at this time.
Licenses
On motion of Trustee Middleton, seconded by Trustee Bo7mgren, the follow-
ing applications for 1952 licenses were approved, and the Mayor and Clerk were
authorized to issue licenses to expire December 31, 19522 by unanimous vote of
all Council Members present:

Garbage Disposal Committee
Mr. Bursell,of the Citizens Committee studying the garbage disposal problem
attended this meeting with Pat -Sharp of the Gober`Incinerator Corporation, 407
South Dearborn, Chicago, Illinois who gave some information on the incinerators
built and installed by his Company. No action taken on the matter at this
meeting.
Load Limits on Louisiana Avenue
A group of citizens appeared asking about load limits on Louisiana Avenue
from Minnetonka Boulevard to Lake Street as per their petition dated April 26,
1952• Mayor Hurd explained that the street would have to be set up (type, etc.)
and then limits could be set. He assured them that the matter is being worked
on, and that the limit would be established as soon as possible.
Hearing Date Set for Proposed Improvement
_ of Village Playground
On motion of Trustee Middleton, seconded by Trustee Jorvig, June 23, 1952
was set as date of hearing for proposed improvement of Village Park Playground
at Webster Avenue at 29th Street by erection of a 15' x 25' shelter, grading,
draining, construction of walks and fence and the installation of playground
equipment, by unanimous vote of all Members of the Council. The area proposed
to be assessed is the area bounded on the south by Minnetonka Boulevard,on the
-north by 26th Street, on the east by Utica Avenue, and on the west by vacated
alley in Block 2, Greenwood Addition.
Garage Setback
On motion of Trustee Middleton, seconded by Trustee Bolmgren, the Building
Insnector was instructed to allow garage being built at 2601 Monterey Avenue to
keep setback that matches the north line of the house, by unanimous vote of all
Members of the Council.
Special Permit to Connect to Water Main
On motion of Trustee Bolmgren, seconded by Trustee Jorvig, a special permit
was granted to Terry Brothers, Inc: to connect their building now under cons-
truction at 3336 Republic Avenue to the water main on Walker Street for water
service, with the understanding that they will pay an assessment of $67.50 at the
time they take out the regular permit, and that they will receive credit for this
assessment payment when the water main is constructed past said property. Motion
was passed by unanimous vote of all Members of the Council.
Petitions for Street Improvements
-On motion of Trustee Bolmgren, seconded by Trustee Middleton, the following
petitions were referred to the Village Engineer and Street Department Committee
for checking and recommendation, by unanimous vote of all Members of the Council:
P-1135 PETITION FOR SIDEWALK, signed by Mrs. Robert Bruning, 2914
Colorado Avenue and others, for the construction of sidewalk on the WEST SIDE OF
COLORADO AVENUE FROM MINNETONKA BOULEVARD TO 29TH STREET.
P-1136 PETITION FOR CURB AND GUTTER, signed by Robert J. Bruning, 2914
Colorado Avenue and others, dated May 17, 1952, for the construction of curb and
gutter on the WEST SIDE OF COLORADO AVENUE FROM MINNETONKA BOULEVARD TO 29TH

Resolution
On motion of Trustee Bolmgren, seconded by Trustee Middleton, the follow-
ing resolution was adopted by unanimous vote of all Members of the Council:
RESOLUTION REFUNDING #492A WATER MAIN M-46 ASSESSMENT
WHEREAS it appears that on May 2, 1952, when Twin City Federal Savings
and Loan Company paid the Village of St. Louis Park the full assessment for
#492A Water Main N-46 (Receipt #12993A), the amount on the invoice was
erroneously figured as $196.00 instead of $171.50; therefore
BE IT RESOLVED that the overpayment of said assessment heretofore paid in
the respective amount hereinafter set forth be refunded to the respective Loan
Company, and, upon receipt of a signed verified claim, that the Mayor and the
Clerk be hereby authorized to issue warrant in payment of such refund to the res-
pective Loan Company:

Resolution
On motion of Trustee Middleton, seconded by Trustee Bolmgren, the follow-
ing resolution was adopted by unanimous vote of all Members of the Council:
RESOLUTION CANCELING ##498 SANITARY SEWER 2-H ASSESSMENT
WHEREAS it appears that by resolution of the Village Council adopted
September 10, 1951, levying assessments for ##498 Sanitary Sewer 2-H, the follow-
ing property was charged for said improvement, whereas -said property was not
served by said sewer; therefore,
BE IT RESOLVED by the Village Council of the Village of St. Louis Park
that the entire assessment for above sewer heretofore levied against the follow-
ing property, in the amounts set forth below, be hereby cancelled, and that the
Treasurer and the Auditor of Hennepin County be hereby authorized to cancel the
same upon their respective records.

On motion of Trustee Middleton, seconded by Trustee Bolmgren, the follow-

WHEREAS it appears that by resolution of the Village Council adopted
September 10, 1951, levying assessments for #498 Sanitary Sewer 2-I, the follow-
ing lot was inadvertantly assessed for 75 feet instead of for 50 feet; therefore
BE IT RESOLVED by the Village Council of the Village of St. Louis Park
that the 1952 thru 1961 installments of the above assessment for 25 feet at $8.00

Resolution
On motion of Trustee Jorvig, seconded by Trustee Bolmgren, the following
resolution was adopted by unanimous vote of all Members of the Council present:
RESOLUTION CANCELING #497 SANITARY SL70R 2 -CB ASSESSMENT
WHEREAS it appears that by resolution of the Village Council adopted
September 4, 1951, levying assessments for #497 Sanitary Sewer 2 -CB, the follow-
ing error occurred: The following property owner was inadvertantly assessed for
the above sewer on Brookside Avenue and also on 41st Street, whereas neither of
these sewers serves this property; therefore
BE IT RESOLVED by the Village Council of the Village of St. Louis Park
that the entire duplicate assessments for #497 Sanitary Sewer 2 -CB heretofore
levied against the following described property, in the amounts set forth below,
be hereby canceled, and that the Treasurer and the Auditor of Hennepin County

Lease - Little League Baseball of Minnesota, Inc.
On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the Mayor and
Clerk were authorized to sign lease by and between the Village of St. Louis Park
and Little League Baseball of Minnesota, Incorporated, for the use of the portion
of Carpenter Park described therein, for the purpose of conducting Junior League
Baseball. Motion was passed by unanimous vote of all Members of the Council.
Grade and Alley Stakes Ordered
On motion of Trustee Bolmgren, seconded by Trustee Middleton, the Village
Engineer's Office was instructed to set grade stakes on Webster Avenue from
West 36th Street North to Alley; and Alley stakes from Webster to Xenwood Avenues,
by unanimous vote of all Members of the Council.
Permit for Industrial Building Approved
On motion of Trustee Bolmgren, seconded by Trustee Middleton, the Building
Inspector was instructed to issue a building permit to Jerry Holt for an industrial
building to be constructed on Lots 6, 7, and 8, except the West 10 feet of Lot 8,
Block 45, Rearrangement of St. Louis Park as recommended by the Planning Com-
mission in their report of May 9, 1952 -- "that his plot plan provides for the
parking of eight automobiles off the street, instead of ten, as required, and upon
the condition that Mr. Holt will stucco the east and south elevations of the

proposed building, and that it be faced with brick veneer on the north side".
Motion was passed by unanimous vote of all Members of the Council.
Appointment of Director of Civil Defense
On motion of Trustee Middleton, seconded by Trustee Bolmgren, Ralph W.
La Hue was appointed as Director of Civil Defense for St. Louis Park, effective
at once, by unanimous vote of all Members of the Council.
Dog Catcher Appointed
On motion of Trustee Bolmgren, seconded by Trustee Middleton, Don De Muth
was appointed as Deputy Dog Catcher under Dog Control Contract with John
De Muth, DBA Merrihill Kennels, dated May 5, 1952, by unanimous vote of all
Members of the Council present.
Building Inspector's Weekly Report
The Building Inspector's report for week ending May 23, 1952, showing
that 32 building permits were issued, totaling $277;100.00, was read and ordered
filed.
Building Inspector's Quarterly Report
The Building Inspector's report for the months of January, February, and
March, 1952, showing that 109 building permits were issued, totaling X6999,800.,
was read and ordered filed.
Plat - Texa-Tonka Third Addition Approved
On motion of Trustee Bolmgren, seconded by Trustee Middleton, the plat of
Texa-Tonka Third Addition was approved and accepted, and the Mayor and Clerk
were authorized to sign same for the Village, subject to approval of Village
Engineer, Phil W. Smith, and Village Attorney, E. T. Montgomery. Motion was
passed by unanimous vote of all Members of the Council.
Permit for Dairy Way Store Approved
The Planning Commission's report dated May 26, 1952, on the application of
C. J. Amlaw, for a special permit to erect a Dairy Way Store Building on Lot 16,
Auditors Subdivision No. 351, which is now zoned along with Lot 15 of the same
Subdivision for Commercial Use, was read.
On motion of Trustee Middleton, seconded by Trustee Jorvig, the Building
Inspector was authorized to issue building permit for the above mentioned store
building according to the Planning Commission's report -- "that the building
face south on Minnetonka Boulevard, and that the building be set back 37z feet
from the old street line of Minnetonka Boulevard, or 20 feet back from the new
street line; and 75 feet back from the Service Drive which adjoins Highway #100."
Motion was passed by unanimous vote of all Members of the Council present.
Resolution
On motion of Trustee Bolmgren, seconded by Trustee Middleton, the following
resolution was adopted by unanimous vote of all Members of the Council present:
RESOLUTION SETTING HEARING IN REGARD TO ZONING LAW
VIOLATIONS OF MIRACLE MILE SHOPPING CENTER
RESOLVED,•by the"Village Council of the Village of St. Louis Park that a
hearing be set for the Village Council meeting to be held July 7, 1952, at which
time owners, lessees and occupants of premises known as Miracle Mile Shopping
Center may show cause, if any they have, why the Village should not commence
proceedings in the District Court of Hennepin County to secure a mandatory in-
junction compelling performance of the conditions of the permit granted by the
Village Council July 17, 1950, and the provisions of the agreement entered into
_between the Village of St. Louis Park and Sheldon -Thomas Company on August 28,
1950; and the Clerk is directed to provide for delivery of written notice to
the owners and lessees of said premises.
Plat - Oak Hill Manor Third Addition Approved
On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the Plat of
Oak Hill Manor Third Addition was approved and accepted, and the Mayor and Clerk
were authorized to sign same for the Village, subject to the approval of Phil
W. Smith, Village Engineer, and E. T. Montgomery, Village Attorney, by unanimous
vote of all Members of the Council present.
Hearing Date Set for Sanitary Sewer
On motion of Trustee Bo]mgren, seconded by Trustee Middleton, June 23, 1952s
was set as date of hearing for proposed sanitary sewer in Minnetonka Boulevard
from Dakota Avenue to Edgewood Avenue, by unanimous vote of all Members of the
Council present.

Agreement - Louisiana Avenue Bridge ~�
On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the Mayor and
Clerk were authorized to sign agreement for the Village with the Great Northern
Railway Company for the construction of the Louisiana Avenue Bridge, on the basis
of equal division of cost in form a6 agreement dated April 17, 1952, by unanimous
vote of all Council Members present.
Resolution
On motion of Trustee Bolmgren, seconded by Trustee Middleton, the following
resolution was adopted by unanimous vote of all Members of the Council present:
RESOLUTION SETTING HEARING FOR EXTENSION OF STORM SEATER
RESOLVED by the Village Council of the Village of St. Louis Park that the
Clerk be directed to publish notice that the Village Council will conduct a public
hearing at its meeting on June 16, 1952, on proposed extension of existing storm
sewer at Colorado Avenue and 27th Street northeasterly to existing culvert under
right of way of Minneapolis, Northfield & Southern Railroad and thence easterly
across said right of way. The area proposed to be assessed for said sewer ex-
tension is the area of Storm Sewer District No. 17 which description has been
previously established by ordinance adopted by the Village Council.
