REGULAR MEETING MAY 19, 1952
A regular meeting of the Village Council was called to order by Acting
Mayor, Torval Jorvig at 8:00 P. M.
Invocation was given by Rev. Lyle Halvorsen, First English Luthern Church
of St. Louis Park.
The following Council Members were present at roll call as follows:

On motion of Trustee Bolmgren, seconded by Trustee Middleton, the following
-verified claims were approved, and the Mayor and Clerk were authorized to issue

Sewer Extension
A hearing was had on proposed extension of sanitary sewer in Monterey Avenue
from 25th Street to 27th Street.

Resolution
On motion of Trustee Bolmgren, seconded by Trustee Middleton, the follow-
ing resolution was adopted by unanimous vote of all members of the Council
present:
RESOLUTION ORDERING SANITARY SEWER EXTENSION
WHEREAS, the Village Council has met at the time and place specified in a
notice published in the St. Louis Park Dispatch May 1 and 8, 1952, relating to
the improvements hereinafter described and has heard all interested persons
appearing in regard thereto and determined the necessity for said improvements,
therefore,
BE IT RESOLVED by the Village Council of the Village of St. Louis Park
that Village sanitary sewer be hereby ordered extended in Monterey Avenue from
25th Street to 27th Street as Improvement No. 52-195, the work be done in
accordance with plans and specifications prepared by the Village Engineer which
are hereby approved. The Clerk is directed to advertise for bids for said
improvements to be opened by the Village C6uncil June 9, 1952•
Feasible Run for Sanitary Sewer
On motion of Trustee Bolmgren, seconded by Trustee Middleton, the Village
J Engineer was instructed to check feasibility of running'above sewer down 26th
Street to Lynn Avenue, by unanimous vote of all Members of the Council present.
Opposition to Sanitary Sewer
Zarthan between 41st & 42nd
A number of residents including Joe Smith living on Zarthan Avenue between
41st and 42nd Streets appeared in opposition to the construction of sanitary
sewer in their block. They were told that it was already in the contract under
2-K, but they claimed that they knew nothing about it.
On motion of Trustee Bolmgren, seconded by Trustee Middleton, the Village
Engineer was instructed to hold up construction of sanitary sewer in this
block, and check the feasibility of leaving this block out'of the contract, and
to report his findings at meeting to be held May 26, 1952. Motion was passed
by unanimous vote of all Members of the Council present.
Hearing Date Set for Opening Alle
On motion of Trustee Bolmgren, seconded by Trustee Middleton, June 9, 1952
was set as'date for hearing on proposed opening of alley two rods in width,
being the east 162 feet of the NE -14 of the NW4 of Section 18, Township 1172 Range
21 lyin adjacent to Lots 1 to 12 inclusive, -Block 12 Belmont Terrace, and the
west 1621 feet of the NW4 of the NE -14 of Section 189`Township 117, Range 21, lying
adjacent to Lots 1 to 13, inclusive, Block*l, Towles Minnetonka Boulevard
Addition. The area -proposed to be assessed for said alley opening and acquisition
will be said Lots 1 to 12 inclusive, Block'l, Belmont Terrace and Lots 1 to 13
inclusive, Block 1, Towles Minnetonka Boulevard Addition. Motion was passed
by unanimous vote of all Members of the Council present.
Building Permit Revoked
On motion of Trustee Bolmgren; seconded by Trustee Middleton, Building
permit No. 10263 issued December 21, 1951 to M. P. Johnson Sales Company was re-
voked on the following grounds:
1. The building not having been started, it cannot be completed r
within the time specified in the permit.
2. A proceeding has been commenced for acquisition of the premises
for a public alley.
3. It appears that a person who was not the person to whom the permit
was issued is about to proceed with construction of the building.
Motion was passed by unanimous vote of all Members of the Council present.

Re: Tar Mat on Rhode Island Avenue
Oscar Erlanson, 3612 Rhode Island Avenue appeared and spoke regarding
tar mat on Rhode Island Avenue, one-half block south of Walker. Said that two
years ago the Gas Company cut a swatch six feet wide on the east side of the
street, and tar mat has never been replaced. The Street Department put on a
dust coat in 1951 and 1952.
On motion of Trustee Middleton, seconded by Trustee Bolmgren, the above
matter was referred to the Village Engineer for checking and report on May 26,
1952, by unanimous vote of all Members of the Council present.
Condition of Alley - Walker to Highway #7 Service Road
Rhode Island to Sumter Avenues
Oscar Erlanson, 3612 Rhode Island Avenue spoke about the condition of the
alley between Rhode Island and Sumter Avenues, from Walker Street to Highway
No. 7 Service Road.
On motion of Trustee Bolmgren, seconded by Clerk Justad, the condition of
Alley between Walker Street and Highway No. 7, and Sumter and Rhode Island Avenues
was referred to Councilman Middleton for checking, by,unanimous vote of all
Members of the Council present.
Street Light Ordered
On motion of Trustee Bolmgren, seconded by Trustee Middleton, the Northern
States Power Company was instructed to install a street light on Meadowbrook
Boulevard just south of L+3rd Street, by unanimous vote of all Members of the
Council present.
Request for Building Permit for Dairy Way
Letter from C. J. Amlaw, dated May 20, 1952, requesting a permit to build
a building (plans and photographs enclosed) on the NW Corner of Utica Avenue
and Minnetonka Boulevard, to be used for dispensing soft ice milk products to
the public, was read. Property owned by 0. B. Erickson.
On motion of Trustee Bolmgren, seconded by Trustee Middleton, the request
of Mr. Amlaw for a permit to construct a Dairy Way building on Mr. Erickson's
property at the Corner of Utica Avenue and Minnetonka Boulevard was referred to
the Planning Commission for checking and recommendation, by unanimous vote of all
Members of the_Council present.
Petition for Vacating Alley, Block 3. Browndale Addn.
On motion of Trustee Bolmgren, seconded by Trustee Middleton, the petition
signed by St. Anthony Holding Company, 529 South Seventh Street, Minneapolis,
Minnesota, dated May 14, 1952, for the vacation of Alley adjacent to Lots 1, 2,
and 5, Block 3, Browndale Addition was referred to the Planning Commission for
checking and recommendation, by unanimous vote of all Members of the Council
present.
Approval of Election District Ma
On motion of Trustee Bolmgren, seconded by Trustee Middleton, the map
showing Eight (8) Election District boundary lines was approved, and the Clerk
was instructed to have same published.as_an advertisement in the issued of the
St. Louis Park Directory now in the process of publication by Mrs. Lydia Rogers,
by unanimous vote of all Members of the Council present.
Telephone Booth - Brunswick and 28th
On motion of Trustee Middleton, seconded by Trustee Bolmgren, the North-
western Bell Telephone Company were granted permission to install a temporary
public telephone booth on the SE Corner of Brunswick Avenue and 28th Street to
give residents in that area telephone service until the necessary cable is
available to give individual service to them, by unanimous vote of all Members
of the Council.
Licenses
On motion of Trustee Middleton, seconded by Trustee Bo1mgren, the following
applications for 1952 licenses were approved, and the Mayor and Clerk were
authorized to issue licenses to expire December 31, 19523 by unanimous vote of
all Members of the Council present:

Letter Re: Weeds

to the weeds next to their home, was read.
On motion of Trustee Bolmgren, seconded by Trustee Middleton, the above
matter was referred to the Weed Inspector for checking, and necessary action, by
unanimous vote of all Members of the Council present.

Resolution
On motion of Trustee Middleton, seconded by Trustee Bolmgren, the follow-
ing resolution was adopted by unanimous vote of all Council Members present:
RESOLUTION CANCELING #498 SANITARY SEWER 2-J ASSESSMENT
WHEREAS it appears that by resolution of the Village Council adopted
September 10, 1951, levying assessments for #498 Sanitary Sewer 2-J, the follow-
ing property owner was charged for two sanitary sewers, whereas only one serves
his property; therefore,
BE IT RESOLVED by the Village Council of the Village of St. Louis Park
that the entire assessment for said improvement heretofore levied against the
following lot, in the amounts set forth below be hereby canceled, and that the
Treasurer and the Auditor of Hennepin County be hereby authorized to dancel
the same upon their respective records.

Resolution
On motion of Trustee Middleton, seconded by Trustee Bolmgren, the follow-
ing resolution was adopted by unanimous vote of all Members of the Council
present:
RESOLUTION CANCELING #493 WATER MAIN P-1-43 ASSESSMENT
WHEREAS it appears that by resolution of the Village Council adopted
October 16, 1950, levying assessments for #493 Water Main P-1-43, Parcel #1000,
Section 17, Twp. 117, Range 21 was charged for 427 feet, whereas it should
have been charged for 264 feet, and
WHEREAS Parcel #1000 was subsequently divided into Parcels #1100 (641),
#1210 (1201), and #1220 (801) - which comprise the 264 feet which should be
assessed, therefore
BE IT RESOLVED by the Village Council of the Village of St. Louis Park
that the 1952 thru 1960 assessments heretofore levied in the amounts set forth
below on 163 feet of Parcel #1000 be hereby canceled, and that the Treasurer
and the Auditor of Hennepin County be hereby authorized to cancel the same upon
their respective records.

Building Inspector's Weekly Report'
The Building Inspector's report for week ending May 16, 1952, showing that
29 building permits were issued, totaling $132,650.00, was read and ordered
filed.
Sewage Dumping - Nels Larsen '
On motion of Trustee Bolmgren, seconded by Clerk Justad, the matter of
Nels Larsen dumping sewage during the day time hours was referred to Trustee
Middleton for checking and recommendation, by unanimous vote of all Members of
the Council present.

Resolution
On motion of Trustee Bolmgren, seconded by Trustee Middleton, the follow-
ing resolution was adopted by unanimous vote of all Council Members present,
subject to approval of Village Attorney and Village Engineer to advise whether
there are any serious changes in the grade.
RESOLUTION RE: SP 2714-26 (T H-12-10) STATE HIGHWAY
WHEREAS, the Commissioner of Highways of the State of Minnesota has now
determined to designate and make permanent the location of Trunk Highway No. 12
formerly designated as Trunk Highway No. 10, through the Village of St. Louis Park
as shown upon the plans which are presented herewith and made a part hereof, and
WHEREAS, said Commissioner of Highways is desirous of constructing, re-
constructing and improving said Trunk Highway through said Village and has
prepared plans for said construction; reconstruction and improvement, a copy of
which said plans are presented herewith and made a part of this resolution: and
WHEREAS, the construction, reconstruction and improvement of said Trunk
Highway requires a change in the grade of the streets in said Village along and
upon which said Trunk Highway passes, said change of grade being designated and
shown on said plans, and
WHEREAS, it is to the best interests'of said Village that said Trunk
Highway be constructed, reconstructed and improved through said village in accord-
ance with said plans and the standard Minnesota Highway specifications and upon
the grade designated therein, and
WHEREAS, said project and said plans, in order to participate in federal
funds, require the approval of the Federal Bureau of Public Roads, and
WHEREAS, the Federal Bureau of Public Roads requires as a condition
precedent to such approval, the assurance and covenant that the Village of St.
Louis Park will not license or permit hereafter, any encroachment of any nature,
including curb gas pumps or gas stations or billboards or other structures of
any kind whatsoever, on the right of way of said Trunk Highway No. 12 within the
corporate limits of said Village of St. Louis Park as shown upon the plans
attached hereto, and
WHEREAS, in the furtherance of the public well being and safety it is
desirable and necessary to eliminate traffic hazards by eliminating any encroach-
ments whatsoever including gas pumps or gas stations or billboards or other
structures of any kind whatsoever, now or hereafter existing in or upon the said
Trunk Highway right of way, and
WHEREAS, said Commissioner of Highways desires, in the interest of public
safety, that all parking of vehicles on said Trunk Highway be parallel with the
curb and at least 20 feet from any crosswalk at all public streets intersecting
said Trunk Highway within the corporate limits of said Village, and
WHEREAS, it is to the best interests of said Village that all parking of
vehicles be parallel to the curb; now therefore.,
BE IT RESOLVED, that said plans and specifications for the construction,
reconstruction, and improvement of said Trunk Highway through said Village, be
and the same hereby are approved, and said Village hereby consents to the change
in grade of the streets along which said Trunk Highway passes, as shown in said
plans, and
BE IT FURTHER RESOLVED, that said Village does hereby agree and covenant
that it will never permit or suffer, within its corporate limits, any encroach-
ment of any kind whatsoever, including curb gas pumps and gas stations, bill-
boards or other structures of any kind whatsoever, upon the right of way of
Trunk Highway No. 12 as shown on said plans and that to the above end said Village
hereby agrees that it will never issue any license, permit, or grant, or give
any leave or liberty or any other consent of whatever form for the construction
or maintenance of any encroachment whatsoever, including curb gas pumps and gas
stations, billboards or other structures of any kind whatsoever, upon said right
of way; and that said Village will cooperate insofar as possible to eliminate
existing encroachments constituting traffic hazards and will further take any
necessary action to eliminate any encroachment that may hereafter exist on said
Trunk Highway right of way, and
BE IT FURTHER RESOLVED, that said Village does hereby agree to require
the parking of all vehicles on said Trunk Highway to be parallel with the curb
and at least 20 feet from any crosswalks on all public streets intersecting said
Trunk Highway within the corporate limits of said Village.

Letter Re: Buildings for Storage of Building Materials_
Letter from Adolph Fine, Inc. dated May 15, 1952, requesting permission
to construct temporary buildings for the temporary storage of materials used
in the construction of homes in the vicinity of Utah Avenue and Minnetonka
Boulevard, was read.
On motion of Trustee Middleton, seconded by Trustee Bolmgren, Adolph
Fine, Inc. was granted a permit for one year from date to set temporary build-
ings for storage of building materials on the SW Corner of Utah Avenue and
Minnetonka Boulevard for the storage of materials to be used in the construction
of homes in that area. Motion was passed by unanimous vote of all Members of
the Council present.
Lease of Property for Kiddie Rides Approved
On motion of Trustee Middleton, seconded by Trustee Bolmgren, the lease
dated May 26, 1952, for the use of Village owned Lots 4 to 11, and 14 to 23,•
inclusive, and parts of Lots 12 and 24, Block 6, Collins Addition by Veterans
of Foreign Wars Post #5632 (Lawrence W. Sauter, and A. A. Provencher for
Kiddie rides, etc. was approved as read, and the Mayor and Clerk were authorized
to sign same for the Village, by unanimous vote of all Members of the Council
present.
Resolution
On motion of Trustee Bolmgren, seconded by Trustee Middleton, the follow-
ing resolution was adopted by unanimous vote of all Members of the Council
present:
RESOLUTION SETTING,HEARING ON SANITARY SEWER IMPROVEMENTS
RESOLVED that hearing on the following sanitary sewer improvements be set
for the Council meeting of June 9, 1952:

The area proposed to be assessed for each of said sewers will be the lots
and tracts of land immediately adjacent to the portion of the streets in which
said sewer will be constructed.
MFOA Conference
On motion of Trustee Bolmgren, seconded by Trustee Middleton, Clerk Justad
was authorized to attend the Municipal Finance Officers Association Conference
to be held June 15 to 19, 1952 at Boston Massachusetts with necessary expenses
paid, by unanimous vote of all Members of the Council present.
Hazardous Excavations
On motion of Trustee Bolmgren, seconded by Trustee Middleton, the matter
of existing excavations reportedly made by Builder Holter at the end of Lynn
Avenue south of 27th Street, and near Parklands Road behind the Pouliott home in
Lake Forest, was referred to the Village Engineer for correction as they are both
hazards. Motion was passed by unanimous vote of all Members of the Council
present.
Minutes
The minutes of meeting held May 12, 1952, were read and approved.
