REGULAR MEETING APRIL 7. 1952
A regular meeting•of the Village Council was called to order by Mayor
C. L. Hurd at 8:00 P. M.
Invocation was given by Robert Law of Cross of Christ Luthern Church.

resolution was adopted by unanimous
vote of all Members of the Council present:
RESOLUTION PROVIDING FOR AWARD AND SALE OF
WATER SUPPLY SYSTEM REVENUE BONDS
WHEREAS, the Village Council on March 17, 1952 adopted a resolution for
issuance of Water Supply System Revenue -Bonds -aggregating $75,000.00 to be dated
April 15, 1952, and to be issued in
denominations with maturities and in the
form therein specified, and
WHEREAS,"in response to 'advertisement --for bids for purchase of said bonds
published in the St. Louis Park -Dispatch March 20, 1952, and in Commercial West
March 22, 1952., the Village -Council -has
met at the time and place specified in
said advertisement and opened and considered the following bids for purchase of
said bonds:

WHEREAS, the Council has determined that the bid of Piper Jaffray & Hopwood,
Allison Williams Company and J. M. Dain & Company is the highest and best bid,
therefore,
-BE IT RESOLVED by the Village Council of the Village of St. Louis Park that
said offer of Piper Jaffray & Hopwood, Allison Williams, and J. M. Dain & Company
to purchase said Water -Supply System Revenue Bonds, April 15, 1952 Series,
aggregating $75,000.00, at a price of par and accrued interest plus $97.50 premium,
is deemed the highest and best offer and a favorable offer, and is hereby accepted;
that the Mayor and Clerk are hereby authorized and directed to deliver to said
purchaser upon payment of the purchase price the said bonds in form, with
maturities and in denominations as specified in said -resolution of March 17, 1952
and upon the terms and conditions of said resolution, and -bearing interest payable
semi-annually at 2z% per annum for bonds maturing April 15,1955/65 and 2.60% per
annum for bonds maturing April 15,1966/69, and
BE IT FURTHER RESOLVED that the proceeds from the sale of said bonds be
placed in the Water Utility Fund of the -Village for uses and purposes described
in said resolution of March 17, 1952, and
BE IT FURTHER RESOLVED, that the Mayor and Clerk of the Village be authori-
zed to execute the purchase agreement submitted by -the said purchasers, and to
return forthwith the good faith checks of the unsuccessful bidders.

Hearing on Proposed Grading - 52-3
A hearing was had on proposed grading improvement -number 52-3. A group
from the area appeared and looked -over the -profiles from the Engineers office
with Village Engineer Phil W. Smith who explained that a 40 foot roadway was
proposed.
Resolution
On motion of Trustee Bolmgren, seconded`by Trustee Middleton, the follow-
ing resolution was adopted by unanimous vote -of all Members of the Council
present:
RESOLUTION ORDERING STREET GRADING I1UUIROVEMENT
WHEREAS, the Village Council has met -at the --time and place specified in a
notice published in the St. Louis Park Dispatch -March 20'and 27, 1952, relating
to grading Improvement Number-52-3'and has conducted -a -public -hearing at said
meeting and heard all interested persons in_regard to said improvement and de-
termined the necessity for the same, therefore,
BE IT RESOLVED by the Village Council of the Village of St. Louis Park
that improvement of Louisiana Avenue from -Minnetonka Boulevard to -27th Street by
grading to grade established by the-Village'Engineer-be-hereby ordered, and
grading to be done in accordance with plans, specifications and profiles which
have been prepared by -the Village Engineer and which are hereby approved. The
Village Clerk is authorized to advertise for bids for said grading to be opened
April 28, 1952•
Hearing on Application for Rezoning - Adolph Fine, Inc.
Pursuant to notice published in the St: Louis Park Dispatch on March 203
1952, a public hearing was had on the application -of Adolph Fine, Inc. to rezone
Lots 1, 23 3, and 4. Block 3, and Lot 16, Block 2, Adolph Fine's Addition, from
residential Use to Commercial Use. The following persons appeared:
Attorney M. L. Grossman, representing Adolph Fine, Incorporated spoke in
favor of -the rezoning.
Fred Thwing, James Frank, and Ned Joubert spoke at length for the residents
in the area in opposition to the proposed rezoning. They presented the follow-
ing petition signed by 154 residents:
"We, the undersigned residents and/or property owners
of the Village of St. Louis -Park, residing at the
addresses set after our respective names, being affected
to our loss, damage, and prejudice by any change made
in the rezoning from residential to commercial of Lots 1,
21 3, and 4, Block 3, and Lot 16, Block 2, Adolph Fine's
Addition to said Village and by any license for the use
of said lots for -other thanresidential purposes, do hereby
oppose and object to any such rezoning of said lots from
residential to commercial:"
Attorney H. Edelman representing the merchants on the corner of Dakota
Avenue and Minnetonka Boulevard said that the merchants wanted to go along with
the residents in this matter, and oppose this proposed rezoning.
The Planning Commission's report on this application dated April 4, 1952,
was read.
Trustee_Middleton moved that the Zoning Ordinance be amended to include
Lots 1, 21 3, and 4, Block 3, Adolph -Fine's Addition in the Commercial Use
district, with the restriction that the buildings be set back so as to allow for
front parking. Motion was lost for want of a second.
On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the petition
of Adolph Fine, Inc: for the rezoning from Residential Use to Commercial Use,
Lots 1, 2, 3, and 4, Block 3, and Lot 16, Block 2, Adolph Fine's Addition was
denied by the following roll -call vote: -Trustee Bolmgren, yea; Trustee
Middleton, nay; Mayor Hurd, yea; Clerk Justad, yea, and Trustee Jorvig, yea.
Protest Use of Louisiana Avenue -Cedar Lake Road
to Wayzata Boulevard by Heavy Trucks
Iner Johnson, 1605 Louisiana Avenue and Fred Roessel, 1810 Louisiana Avenue
appeared, requesting a regulation of speed and -load limits on Louisiana Avenue
from Cedar Lake Road to Wayzata Boulevard. After considerable discussion, Mayor
Hurd said he-would"take the matter up within 24 hours, and try to work out a
relief of the problem.

Stageberg Property for Park Purposes
Walter -Menzel, -President of -the Park Board informed the Council that the
Stageberg Property -lying -just west of Fern Hill -School on'28th Street was now
available and he strongly urged the Village -Council -to -cooperate with the Park
Board and School Board to acquire this -piece of property for future Village use.
The piece is 350 feet facing on 28th Street, is approximately 300 feet deep, and
has a large home on it.
On motion of Trustee Bolmgren, seconded -by Trustee Middleton, the Village
Attorney was instructed to'study-the-possibility of the Village acquiring the
Stageberg property, as recommended by Mr. Menzel, by unanimous vote of all Members
of the Council present.
Petition for Removal of Standing Water
(Texas between 34th& 35th Sts.)
On motion of -Trustee Bolmgren, seconded by Trustee Middleton, petition
signed by G. -W. Brower, 3414 Texas Avenue and others, dated -April 7, 1952, for
the removal of -standing water on the west side of Texas Avenue between 34th Street
and 35th Street, was referred to-the'Village Engineer for action, by unanimous
vote of all Members of the Village Council.
Petition for Storm Sewer
On motion of Trustee Bo]rngren, seconded by Trustee Jorvig, the petition
signed by G. W. Brower, 3414 Texas -Avenue and -others, dated April 7, 1952, for
the construction of a storm sewer to service the area now draining surface water
to the low ground on the west side of Texas Avenue between 34th Street and 35th
Street, was referred to the Village Engineer -for checking and recommendation, by
unanimous vote of all Members of the Council.
Petition Opposing Dump -on West 36th & Belt Line
Clayton W. Muzzy, 3613 Raleigh Avenue -presented the following petition
signed by Walter V. Pavey, 5021 West 36th -Street and 88 others, dated March 25,
19521, was read and ordered filed with Committee'on-Garbage Disposal:
"PETITION: Against Dump on West 36th Street and Belt Line
To whom it may concern -
In regards to various verbal statements -in concern of a village
dump between the Milwaukee railroad tracks and West 36th Street on
the Beltline, Highway 100.
We the undersigned do not -and -are 100,% -against a dump in our
neighborhood. It is so very unsanitary as far as rats, disease,
smell are concerned for the people living in this locality. Also,
the carrying of debries'by dogs and having them spread garbage all
around our yards. Not only -do we the people contend with Minneapolis
and surrounding personal dumping garbage, paper, boxes and so on
all the time but -now it will be far worse when the village starts
to dump here also.
We already have a dump on 36th -Street being operated by Minnesota
Tree Service, they dispose of old roots, trees over the bank accross
the road from the Milwaukee tracks. Then the -one to the south by
Lilac Way which is an inferno of flame all summer long which smolders
and smells and drives rats and insects into our homes.
St. Louis Park certainly could -and -should fine a more sanitary way
of disposing of garbage away from oiir homes or residential areas.
Also away from our very nice drive on Highway 100 its beauty is
being smothered by Lilac Way dump, holes, unnecessary scenic des-
troyers.
The following people who are signing this petition are asking to
have this dump put else where -and out -of a residential district. Here
is hoping the development of this dump will be discontinued."

On motion of Trustee Jorvig, seconded by Trustee Middleton, the following
applications -for 1952 licenses were approved, and -the Mayor and Clerk were
authorized to issue licenses to expire December 31, 19522 by unanimous vote of
all Members of the Council present:

petitions were referred to the Village Engineer and Chairman of the Sewer Depart-
ment Committee for checking and recommendation, by unanimous vote of all Members
of the Council:

Zinran-Avenue and others, dated'March 26, 1952, for the
construction of sanitary sewer in ZINRAN AVENUE BETWEEN
33rd and 34th STREETS.

September 10, 1951, levying assessments for #498 Sanitary Sewer 2-H, the follow-

Resolution
On motion of Trustee Bolmgren,-seconded-by Trustee Middleton, the follow-
ing resolution was adopted by unanimous vote of all Members of the Council:
RESOLUTION CORRECTING #491 SANITARY SEWER 2-L ASSESSMENT
WHEREAS'it appears that by resolution of the Village Council adopted
October 3, 1949, levying assessments for #491 Sanitary Sewer District 2-L on
Lots 1 and 19 thru 29, Block 2, Lenox; the wrong parcel numbers were inadvert-
antly used, thus moving the assessment to Block 3 -instead of -Block 2. For the
1950 payment, the parcel numbers were corrected by the County Auditor and paid on
Block 2. In 1951, the incorrect parcels were used and thus this assessment was
paid by Block 2, which had no sewer (with the exception of L6t-29, which was
corrected by -the County Auditor). The 1952 amounts were also corrected by the
County Auditor; therefore'
BE IT RESOLVED that -the 1951 installments -of such asaessments heretofore
paid in the respective amounts hereinafter -_set -forth be refunded to -the respect-
ive property -owners, and, upon -receipt of a signed verified claim and a paid
tax statement,,that the Mayor and the Clerk -be -hereby authorized to issue war-
rants in payment of such refunds to the respective property owners.

On motion of Trustee Bolmgren, seconded by Trustee Middleton; Deputy
Assessors and Clerks for the -Assessors Office -are to receive an hourly wage of

Letter Reauestina Zonina to Protect Property Owners
A letter from Charles C. Barnum, 3241 Edgewood Avenue, dated -April 1, 1952,
commenting on the action taken by the Village -Council recently, approving a parking
lot on Minnetonka Boulevard and-Colorado`Avenue, and asking that an ordinance be
adopted to protect residential property owners, was read and ordered filed.
ADDlication for Commercial Electric Service
On motion -of Trustee Bolmgren, seconded by_Trustee Jorvig, the Mayor and
Clerk were authorized to sign application for commercial electric service for
Sewer Lift Station at DAKOTA AVENUE AND WEST 31ST STREET, by unanimous vote of all
Members of the Council present.
Transfer of Gas Station License Approved
On motion of Trustee Bolmgren, seconded by Trustee-Jorvig,-the request of
Lauren Johnson and Norman Tevik, DBA Bud and Norm's Cities Service at 8240 Minnetonka
Boulevard, to have License -#514 issued -to Ervin C. Pagel'on-March 11, 1952, to
operate a three -pump -gas station transferred to them without fee (license only
sed one week) was approved by unanimous vote of all Members of the Council present.

"THIS AGREEMENT, entered into this day of -March, 1952, by and between
the Midland National Bank of Minneapolis, -as Special Guardian of the Estate of
Michael J. Kelley, Ward, and the Village of St. Louis Park, Minnesota, a Municipal
Corporation, Witnesseth:
That the above named Village of St. Louis Park has -offered to purchase for
the sum of Three Hundred Dollars -($300:00) the interest of the'above named Ward -
in the following described property; to -wit:- Lot -Sixteen (16), Block Three (3),
Boulevard Heights Second Addition to -the Village of St. -Louis Park; an easement
for underground sewer purposes over -the South Five (5) feet -of Lot 7, Block Four
(4), Boulevard Heights Second Addition to the Village of St. Louis Park.
That without liability of any kind -on -the part of said Midland -National
Bank or on the part of it's officers -or agents, and subject to the approval of the
Probate Court for Hennepin County, the said Midland National Bank of Minneapolis
accepts said -offer and agrees to provide a deed without warranty for said above

Request for Commercial Building
The -Planning -Commission's report -on -the request of Adolph Fine, Inc. for
approval of commercial building development on property in the Texa-Tonka Addition
on the North Side of Minnetonka Boulevard and East of Virginia Avenue, was read.
On motion of Trustee Middleton,-seoonded-by Trustee Jorvig,-the above
request was approved as -recommended by the Planning Commission, by unanimous vote
of all Members of the Council present.
Planning Commission Report on Setbacks for New Homes
in Oak Hill Manor Second Addition
The Planning Commission's report dated April 4, 1952, on the request of
Ecklund and Swedlund Construction Company to build -nine homes on Yukon Avenue
between 35th and 36th Streets with a maximum setback of 25 feet rather than the
regular 35 feet, was read.
On motion of Trustee Jorvi.g, seconded by Trustee Middleton, Ecklund and
Swedlund Construction Company was granted permission to build nine homes on Yukon
Avenue between 35th and 36th Streets with setbacks as recommended by the Planning
Commission, by unanimous vote of all Members of the Council present.

Request for Permission to Conduct Carnival - VFW
A letter from Cyril -C. Doyle for the VFW Post"#5632, St. Louis Park,
dated March 30, 1952, requesting permission to conduct their Annual Carnival
on Village property located at the corner of West 37th Street and the Belt
Line, from May 26th to June 2nd, 1952, was read.
On motion of Trustee Middleton;"seconded by'Trustee Bolingren, permission
was granted to VFW Post #5632, St. Louis Park -to use Village property at West
37th Street and State Highway No._100-for their Annual Carnival, subject to
filing not less than 20 days before the opening of the Carnival -an approved
certificate of liability insurance, noting -the Village of St. Louis Park as
additional assured in amounts of $25,000 for injury; $50,000 for one accident,
and $25,000 for property damage; -the original policy and certificate to be fur-
nished the Village Attorney for approval more -than -twenty days before the
Carnival opens. Motion was passed by unanimous vote of all Members of the Coun-
cil present.

On motion of Trustee Jorvig, seconded by C1erk-Justad, Phil W. Smith, Ira
Vraalstad and H. J. Bolmgren were authorized to -attend the American Water Works
Conference at Kansas City, -Missouri, May 4 -to 9, 1952, with necessary expenses
paid. Motion was passed by 4 ayes and one nay. Mayor Hurd voting nay.
Contractor's Bond
On motion of Trustee Bolmgren, seconded by Trustee Middleton, Contractor's
Bond #43669 with Lametti and Sons, -615 Drake Street, St. Paul, Minnesota as
principal, and Seaboard Surety Company of New -York as surety, dated March 29,
1952, in the amount -of $42,360.60, covering contract for the -construction of
Sanitary Sewer in Louisiana Avenue - District 52-1, was approved by unanimous
