REGULAR MEETING - APRIL 28, 1952,
A regular meeting of the Village Council was called to order by Mayor
C. L. Hurd at 8:02 P. M.
Invocation was given by Reverend Bennett G. Brudevold, pastor at
Aldersgate Methodist Church.

were referred to the Village Attorney for checking and recommendation, by unani-
mous vote of all Members of the Council. - '
Resolution
On motion of Clerk Justad, seconded -by Trustee Bolmgren, the following
resolution was adopted by unanimous vote of all Members of the Council present:
RESOLUTION FOR AWARD AND SALE OF CERTIFICATES OF INDEBTEDNESS
WHEREAS, the Village Council has received the following bids for purchase
of Certificates of Indebtedness for Street Construction and Maintenance Equip-
mbnt pursuant to notice published in the St. Louis Park Dispatch April 17, 1952,
and which bids were opened and publicly read at this present meeting of the
Council:

be the highest and best bid, and the Mayor and Clerk be hereby authorized to
eXecute Certificates of Indebtedness for purchase of Street Construction and
Maintenance Equipment in the aggregate sum of $40,000.00 in the form and with
maturity dates as specified in resolution for issuance of said certificates adopted
April 14, 1952, and to deliver said Certificates of Indebtedness to said purchas-
e'rs upon receipt of the face amount thereof plus accrued interest and premium of
$35.00. Said certificates are to bear interest at the rate of Two per cent

be issued in denominations of $1,000.00 each with maturities as follows:

BE IT FURTHER RESOLVED that there is hereby levied upon all taxable property
in the Village a direct annual ad valorem tax which shall be spread upon the tax
rolls and collected with and as a part of other real estate taxes in said Village

BE IT FURTHER RESOLVED that the Clerk,is hereby authorized and directed
to file a certified copy of this resolution with the County Auditor of Hennepin
County together with such other information as he shall require and to obtain
from the County Auditor a certificate that said Certificates of Indebtedness
have been entered on his register and said tax has been levied as required by
law, and,
BE IT FURTHER RESOLVED that said tax levy shall be irrepealable until all
of the principal and interest on the Certificates of Indebtedness issued here-
under shall be paid; provided, however, that the Clerk is directed to certify to
the County Auditor on or before October 15th in each year the amount on hand and
available from any source, and which has been appropriated to the sinking fund
to be used to pay principal or interest on said bonds, and directing the County
Auditor to reduce the levy for such year by such amount, and,
BE IT FURTHER RESOLVED, that the Mayor and Clerk be authorized to execute
agreement submitted by the purchasers and to arrange for printing of the Certifi-
cates at the expense of the Village -and to secure the opinion of Messrs Faegre
& Benson certifying to the validity of the certificates, also at the expense of
the Village.
Bids'for Grading - Improvement 52-3
As advertised in the St. Louis Park Dispatch April 17, 1952, sealed bids
were received from the following bidders for the furnishing of all labor and
material for grading Improvement #52-3 --- for the grading of Louisiana Avenue
from Minnetonka Boulevard to 27th Street:

On motion of Trustee Middleton, seconded by Trustee Bolmgren, the above
bids were referred to the Village Engineer and Chairman of the Street Department
Committee for checking and recommendation, by unanimous vote of all Members of
the Council present.
Bids for 3/4 Ton Pickup Truck
As advertised in the St. Louis Park Dispatch April 17, 1952, sealed bids
were received from the following bidders for the furnishing of a new 3/4 ton
pickup truck, according to specifications on file in the Office of the Village
Clerk:

On motion of Trustee Perkins, seconded by Trustee jorvig, the above bids
were referred to the Village Engineer and Chairman of the Sewer Department Com-
mittee for tabulation and recommendation, by unanimous vote of all Members of
'the Council.

Petition in Favor of Incineration
Ed Bacher presented petitions signed by 750 persons in favor of garbage
incineration. A member of the audience asked that the petition signed by
V. R. Peterson and others from the area of Minnetonka Boulevard and Aquila
Avenue presented last year regarding garbage disposal be added to this group
of petitions. Considerable discussion ensued.
On motion of Trustee Bolmgren, seconded by Trustee Middleton, the Mayor
was requested to appoint a committee of citizens (seven members) to study the
garbage disposal program, including plans and cost of disposal by incineration,
and to bring in a recommendation. Motion was passed by four yeas and one nay —
Mayor Hurd voting nay.
Opposition,to Grading Withdrawn
Contractor to Deposit Surplus Gravel
Verner P. Thomey, 2560 Byrd Avenue, Golden Valley appeared in regard to
the grading of Virginia Avenue adjacent to Lot 11, Auditors Subdivision No. 302,
owned by him (subject to dedication of adjacent streets). He stated that if
the Village would direct the Contractor to deposit the surplus soil to be re—
moved in grading adjacent to his lot, that he would withdraw any and all ob—
jections previously raised to grading of Virginia Avenue adjacent to said lot.
On motion of Trustee Middleton, seconded by Trustee Bolmgren, the Village
Engineer was directed to direct Terry Brothers, Inc. as Contractor on said
grading job to have soil removed in grading of the W2 of Virginia Avenue ad—
jacent to said Lot 11, be deposited on said Lot 11 at the place designated by
Mr. Thomey (not exceeding 50 loads), on the understanding and condition that he
withdraw and release all claims and objections to completion of grading of said
street as,agreed by him at this Council meeting. Motion was passed by unanimous
vote of all Members of the Council.
Licenses Approved
On motion of Trustee Jorvig, seconded by Trustee Bolmgren, the following
applications for 1952 licenses were approved, and the Mayor and Clerk were
authorized to issue licenses to expire December 31, 1952, by unanimous vote of
all Members of the Council:

On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the following
bonds were approved by unanimous vote of all Members of the Council present:
HEATING LICENSE BOND with Albert Ostrin,
DBA Ostrin Heating Company as principal, and
United States Fidelity and Guaranty Company
as surety, dated April 16, 1952, in the amount
of $1,000.00.
SIDEWALK OR CURB AND GUTTER CONSTRUCTION BOND,
with Roy Fure and John Fure, DBA Fure Brothers
Cement Construction Company as principal and
Standard Accident Insurance Company as surety,
dated February 18, 1952, in the amount of
$10,000.00.
Permission to Place Buried Cable
On motion of Trustee Bolmgren, seconded by Trustee Middleton, the North—
western Bell Telephone Company was granted permission to open the Street to
re—lay buried cable in Wyoming Avenue between 35th Street and 36th Street, by
unanimous vote of all Members of the Council present.
Bid Awarded for Traffic Signals
On motion of Trustee Jorvig, seconded by Trustee Bolmgren, the bid of
Langford Electric Company received April 14, 1952, for the furnishing and install—
ing of traffic signals at Excelsior Boulevard and Brookside Avenue in the amount
-of $1,760.00; and at Excelsior Boulevard and Alabama Avenue in the amount of
$642.00, was deemed to be the lowest bid of a responsible bidder, and the Mayor
,and Clerk were authorized to execute contract with Langford Electric Company for
same at prices bid, by unanimous vote of all Members of the Council present.

Resolution
On motion of Trustee Bolmgren, seconded by Trustee Middleton, the following
resolution was adopted by unanimous vote of all Members of the Council:
RESOLUTION CANCELING #497 GRADING 0-91
AND #493 WATER MAIN P-1-43 ASSESSMENTS
WHEREAS it appears that in levying assessments for #497 Grading 0-91 and
#493 Water Main P-1-43, the County Auditor inadvertantly spread these assessments
on his rolls twice, thus making a double assessment; therefore
BE IT RESOLVED by the Village Council of the Village of St. Louis Park that
the installments of above assessments levied against the following property in
the amounts set forth below be hereby cancelled and that the Treasurer and the
Auditor of Hennepin County be hereby authorized to cancel the same upon their res-
pective records.

Resolution
On motion by Trustee Bolmgren, seconded by Trustee Jorvig, the following
resolution was adopted by unanimous vote of all Members of the Council:
RESOLUTION CANCELING GARBAGE COLLECTION ASSESSMENT
WHEREAS it appears that by resolution of the Village Council levying assess-
ments for Garbage Collection, the following property was inadvertantly assessed,
whereas said property was vacant and therefore not serviced by Garbage Collection;
therefore
BE IT RESOLVED that the 1951 installment of such assessment heretofore paid
in the respective amount hereinafter set forth be refunded to the respective
property owner, and, upon receipt of a signed verified claim and the paid tax
statement, that the Mayor and Clerk be hereby authorized to issue a warrant in
payment of such refund to the respective property owner.
BE IT FURTHER RESOLVED by the Village Council of the Village of St. Louis
Park that the 1951 installment heretofore levied against the said property in
the amount set forth below be hereby canceled and that the Treasurer and the
Auditor of Hennepin County be hereby authorized to cancel the same upon their res-
pective records.

Notice of Heariniz - Railroad and WarehouseCommission & Warehouse
Notice of hearing of the Minnesota State Railroad/Commission, dated April
25, 1952, to be held on June 5, 1952 at 10:00 A. M., at Room 470 State Office
Building, St. Paul, Minnesota, in the matter of the application of the Twin City
Motor Bus Company for the fixing of just and reasonable rates of fare for the
transportation of passengers by applicant as an Auto Transportation Company,
pursuant to Chapter 221, Minnesota Statutes Annotated, was read.
On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the Village
Attorney was instructed to attend above mentioned hearing as a representative of
the Village, by unanimous vote of all Members of the Council.

Letter Re: Condition of Premises Adjacent to Underwood's Cafe
Letter from Elmer and Hazel Connors, 3722 Kipling Avenue, relative to
the condition of premises adjacent to Underwoods Cafe and Sandwich Shop on
Excelsior Boulevard and Kipling Avenue, was read.
On motion of Clerk Justad, seconded.by Trustee Jorvig, the above matter
was referred to Health Officer, Dr. H. W. Darby, M. D. for checking and report,
by unanimous vote of all Members of the Council.
Resolution
On motion of Trustee Bolmgren, seconded by Trustee Middleton, the following
resolution was adopted by unanimous vote of all Members of the Council:
RESOLUTION REFUNDING #492 TAR MAT 0-105 ASSESSMENT
WHEREAS it appears that by resolution of the Village Council adopted
October 10, 1949, levying assessments for #492 Tar Mat 0-105, the following
error occurred: Two assessment sheets were inadvertantly sent to the County
Auditor -- one with a 10% penalty added (which was correct), and one without the
10% penalty (which was incorrect). The County Auditor was to have removed the
latter from his rolls, but this he inadvertantly failed to do. Thus the follow-
ing property owner was charged twice for the above assessment - the correct
amounts of $4.85, $4.72, and $4.47 (1950 thru 1952 respectively) and the incorrect
amounts of $3.45, $3.36 and $3.18 (1950 thru 1952 respectively); therefore,
BE IT RESOLVED that the incorrect installments of such assessments here-
tofore paid in the respective amounts hereinafter set forth be refunded to the
respective amounts hereinafter set forth be refunded to the respective property
owner, and, up6n receipt of a signed verified claim and bhe paid -tax statement,
that the Mayor'and the Clerk'be hereby authorized to issue warrants in payment

Letter from Ben L. Berkwitz, 2655 Inglewood Avenue, dated April 26, 1952,
requesting a building permit to erect.a gasoline station on the corner of Salem
Avenue and West Lake Street; and permission to move the store building now on
the corner of said property to the easterly end of the lot, was read.
On motion of Trustee Jorvig, seconded by Trustee Bolmgren, the foregoing
matter was referred to the Planning Commission for checking and recommendation by
unanimous vote of all Members of the Council.
Report on Survey for Street Lighting - Texa-Tonka
Report of Northern States Power Company, dated April 21, 1952, in compliance
with our request of March 27, 1952, for a survey for street lighting in Texa-
Tonka Addition -- North of Minnetonka Boulevard and West of Texas Avenue was read.
On motion of Trustee Jorvig, seconded by Trustee Bolmgren, the Northern
States Power Company were ordered to increase the lamp size of existing street
light at the intersection of Minnetonka Boulevard and Texas Avenue from the present
2500 lumen lamp to a 6000 lumen lamp because of the shopping center located.at
the intersection; and to place 2500 lumen lamps at the following locations, by
unanimous vote of all Members of the Council:

The Building Inspector's weekly reports for weeks ending April 18 and 25,
1952, showing that 63 building permits were issued, totaling $445,700.00, was
read and ordered filed.

Letter Re: Adoption of Pacific Uniform Building Code
Letter from Suburban Building Department Administrators, dated April 24,
1952, relative to adoption of the Pacific Uniform Building Code, was read, and
the Clerk was authorized to issue a purchase order for 1 copy of 1949 Edition
of the Uniform Building Code and 1 copy of the 1949 Edition of the Uniform Build-
ing Code Short Form, with the Dwelling House Construction Pamphlet as per price
quoted of $5.50, for both.
Letter Re: Progress on Cedar Lake Road Project
Letter from Hennepin County Highway Department, dated April 22, 1952, in
reply to our letter dated April 16, 1952, relative to progress being made on the
Cedar Lake Road project, was read.
Letter Re: Paving Project on Mtka. from Lake to Dakota
Letter from the Hennepin County -Highway Department, dated April 2, 19522
in reply to our letter of April 18th, 1952, relative to the paving project on
Minnetonka Boulevard from Lake Street to Dakota Avenue was read, and the Clerk
was instructed to acknowledge letter and set date of May 8, 1952 for a meeting
with their officials, L. P. Pederson of the State Highway Department and our,
Village Attorney, Phil W. Smith, to be held at 7:30 P. M. at the Village Hall.
Annlications for Commercial Electric Service
On motion of Trustee Bolmgren, seconded by Trustee Middleton, the Mayor
and Clerk were authorized to sign applications for Commercial Electric Service
for sewage lift stations at SW Corner of Intersection of Brookside and Yosemite
Avenues; and at Intersection of Huntington Avenue and West 25th Street, by un-
animous vote of all Members of the Council.
Petitions for Street Improvements
On motion of Trustee Bolmgren, seconded by Trustee Middleton, the follow-
ing petitions were -referred to the Village Engineer and Street Department Com-
mittee'for checking and recommendation, by unanimous vote of all Members of the
Council:
P-1082 PETITION FOR CURB AND GUTTER, signed by Norman
Arneson, 3237 Dakota Avenue and others, dated
April 25, 1952, for the construction of curb and
gutter on the EAST SIDE OF DAKOTA AVENUE FROM

Re: Request for Kiddie Recreation Project
The Planning Commission's report on the request of A. A. Provencher and
L. W. Sauter, for approval of the use of the Eastern portion of the Civic Center
Area along Highway No. 100, for a Kiddie Recreation Project, was read.

Cyril Doyle, VFW Commander was present. Stated that they are the
sponsors of this project, and expect to use their share of the profits for
carrying on VFW work, and possibly will replace weekly dances now helf at the
VFW Hall at 36th Street and the Belt Line.
L. W. Sauter spoke in fav? of the project, and promised 100% coopera-
tion.
On motion of Trustee Jorvig, seconded by Trustee Middleton, the above
matter was referred to the Village Attorney to draw up a lease with two other
Members of the Council other than the Mayor and Clerk for the rental of above
mentioned property at $150.00 from June 15, 1952 to October 15, 1952, by unani-
mous vote of all Members of the Council.
Planning Commission's Report
Re: Preliminary Plat, Cedarcrest Addition
The Planning Commission's report dated April 25, 1952, on the request of
Wallace T. Bruce, Inc. for approval of preliminary plat of Cedarcrest Addition,
was read.
On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the prelimin-
ary plat of Cedarcrest Addition was approved, subject to approval of Village
Engineer, by unanimous vote of all Members of the Council.
Planning Commission's Report
Re: Temporary Permit for Root Beer Stand
The Planning Commission's report dated April 25, 1952, on the request of
Don W. Mc Gregor, 4700 West 41st Street, for a temporary permit for a root beer
stand on Lots 29, 30, and 31, Block 2, Rearrangement of St. Louis Park ---
Corner of Louisiana Avenue and Walker Street, was read.
On motion of Trustee Middleton, seconded by Trustee Jorvig, a temporary
permit was approved for one year for the above requested root beer stand as
recommended by the Planning Commission, subject to the provisions for sanitary
and health regulations; by unanimous vote of all Members of the Council.

Re: Eaton -Glen Proposed Addition
The Planning Commission's report on new proposed Eaton -Glen Addition to
St. Louis Park (Part of Government Lot 4, Section 9, Township 117, Range 21,
Hennepin County, Minnesota), was read.
On motion of Trustee Middleton, seconded by Trustee Bolmgren, the proposed
plat of Eaton -Glen Addition was approved, subject to approval of the Village
Engineer, by unanimous vote of all Members of the Village Council.
Planning Commission's Report
Re: Light Industrial Building
The Planning Commission's report dated April 25, 1952, on the request of
Jerry Holt for approval of a building for Light Industrial Use, to be erected
on Lots 24 and 25, Block 27, Rearrangement of St. Louis Park, and Lot 9, Block
27, St. Louis Park --- on the north side of West 36th Street, West of Highway
No. 100, was read.
On motion of Trustee Bolmgren, seconded by Trustee Middleton, the Building
Inspector was instructed to issue a building permit to Jerry Holt for the above
requested building, by unanimous vote of all Members of the Council present.
Cost of Publishing 1951 Financial Statement
Letter from the St. Louis Park Dispatch, dated April 17, 1952, giving an
estimated cost for publishing the Village's 1951 Financial Statement in the St.
Louis Park Dispatch and the Shopper of $450.00, was read.
On motion of Trustee Bolmgren, seconded by Trustee Middleton, the Clerk
was instructed to accept the above offer, and issue a purchase order to the St.
Louis Park Dispatch for the publishing of the 1951 Financial Statement at
amount estimated of $450.00, by,unanimous vote of all Members of the Council
present.
Hearing Date Set for Curb and Gutter Construction
On motion.of Trustee Bolmgren, seconded by Trustee Middleton, June=Oj 1952
was set as date of hearing on the following curb and gutter jobs, by unanimous

Storm Sewer in Vicinity of Aldersgate Church
The Village Engineer reported that it is necessary to construct a storm
sewer in the vicinity of Aldersgate Church on Wooddale Avenue to relieve the
water condition on Wooddale Avenue at Cambridge, just west of Wooddale, and the
Engineer requested the Council's approval to have the Street Commissioner dig
up the trench with the new shovel, and the sewer maintenance department lay the
pipe through the property. Aldersgate Church has agreed to give an easement
for the sewer over its property on the condition that the work be done immediate-
ly, and before landscaping is done by them.
On motion of Trustee Bolmgren, seconded by Trustee Middleton, the Village
Engineer was authorized to direct the Street Commissioner to excavate the trench
for the sewer over the Aldersgate Church property, and the Sewer Maintenance
Department lay pipe for the proposed sewer in the trench, the estimated cost
appearing to be less than $1,000. Motion was passed by unanimous vote of all
Members of the council.
Fire Department's Report of Explosion at Metalloy Plant
The Fire Department's report on an explosion which occurred at the
Metalloy Plant, Cedar Lake Road and Dakota Avenue on April 22, 1952, was read
and ordered filed.
Street Lright Ordered
On motion of Trustee Bolmgren, seconded by Trustee Middleton, the Northern
States Power Company was ordered to install a street light on corner of Hillsboro
Avenue and 32nd Street, by unanimous vote of all Members of the Council.
Planning Commission's Report
Re: Sta eberg Property
The Planning Commission's report dated April 25, 1952, on the matter of
securing the so called Stageberg property - a two -acre area on West 28th Street,
just west of the school site, on the corner of West 28th Street and Joppa Avenue,
was read.
The Clerk was instructed to talk to Mr. Andreas and tell him to get'in touch
with Village Attorney, E. T. Montgomery regarding the type of contract we may
enter into for the purchase of this property.
Deed Accepted
On motion of Trustee Bo1mgren, seconded by Trustee Jorvig, the deed with
Great Northern Railway Company named as grantor, and the Village of St. Louis
Park named as grantee was accepted for the following described property, and the
Village Attorney was instructed to file same with the Office of Register of
Deeds, by unanimous vote of all Members of the Council:
"The south twenty-seven (27) feet of the east three
hundred ninety-six and seven -tenths (396.7) feet of the
northeast quarter of the southeast quarter (NE4/SE4)
of Section Seven (7), Township One hundred seventeen
(117) North, Range Twenty-one (21) West of the Fifth
Principal Meridian; also,
All that part of the right of way of the railway of the
Great Northern Railway Company in said northeast quarter
of the southeast quarter (NE4/SE4) lying within thirty
(30) feet on each side of the following described line.
