Hurd at 8:05 P. M. Reverend Paul Obenauf of Wooddale Luthern Church gave invocation. Hearing on Petition for Rezoning - M. A. Fingerman Pursuant to notice published in the St. Louis'Park Dispatch March 6, 1952, a public hearing was had on the petition of*M. A. Fingerman for the rezoning of Lots 12, 13, and 14, Block 21, Park Manor Addition from Residential Use to Com- mercial Use, for the purpose of off-street parking only, to serve commercial buildings in the vicinity. The following persons appeared: Hymen Edelman, Attorney for M. A. Fingerman and tenants of commercial' stores on the NE Corner of Dakota Avenue and Minnetonka Boulevard appeared. He stated that their desire was for a special permit to use Lots 12, 13, and 14, Block 21, Park Manor Addition for off-street parking only. There will be no buildings on these three lots. He discussed the traffic tangle on the corner of bakota Avenue and Minnetonka Boulevard. 'He presented a drawing showing the proposed parking lot with landscaping. He'also presented a petition with 200 names, approving the above mentioned off-street parking. Clarke W. Taube, 2937 Colorado Avenue appeared. Asked what the difference is between Commercial Use and Residential Use, for off-street parking. Mr. Edelman explained that on an off-street permit for parking in a Residential area, no buildings could be erected for any'commercial purposes. It takes cars off the street for parking purposes. Mr. Taube presented a petition opposing the rezoning of this property or its use fo'r off-street parking, signed by Henry E. Larson, 2929 Colorado Avenue and 35 others. He also presented a colored plat showing the area and the parking places available at various hours. Mr. Edelman answered that the need for off-street parking is real. Mr. Taube read from a record he'had made over a'period of 3 weeks showing the vacant parking spaces at various times. Mr. Klein, operator of Klein's Market ans- wered that they have not done anything yet.' Mrs. Ben J. Gross, 2936 Colorado Avenue said that she has received promotionhl mail on this. Mr. Hines, 3000 Brunswick Avenue said he would rather have a parking lot at the above location than the hole that is there. Mr. Taube said if this property goes into parking or commercial, then the property across the street coming up on'April 7, 1952 will also be rezoned. Mr.'Edelman said fears apparent, are not coming up. That Commercial people want to do a better job, and have spent money to purchase ground, and will put it in shape. He says that Commercial development is necessary for the overall picture in the village from the tax standpoint. James Frank, 3011 Colorado Avenue appeared and talked of their investment. Said Mr. Klein knew of the situation when he moved in. W. J. Wallace, 2925 Colorado Avenue said this matter keeps coming up and should be taken care of once and for all against change. There are 35 children in this block. Said folks are not patronizing Kleins because of his attitude. C� 1 �I March 24,1952 229. Hearing on Petition for Rezoning, Continued Rev. J. B. Burnside, 2940 Colorado Avenue said when he purchased his property it was understood that these lots were residential, and was assured that the zoning would never be changed. Trustee Bolmgren asked how many cars would be parked on this parking lot? Mr. Klein said about 35. G. E. Sommers, 6220 Minnetonka Boulevard said he bought his property November 1, 1951 and was told that the lots in question were zoned residential. Semi trailers park out in the street. Said this will not in any way increase the value of residential property in the area. Fred Thwing, 6200 Minnetonka Boulevard said he has been here six times regarding rezoning in this neighborhood, and if this application is approved, how can the Council turn down the Fine request coming up on April 7th. Mr. Edelman said that this request is for limited use - for off-street parking only. Clyde Sorensen, 2941 Colorado Avenue asked if parking ordinance amendment had been changed since Kleins'Market request came in. Mayor Hurd answered yes, and told why. - Reverend Burnside asked, what protection do people have against commercial zoning coming into a residential area? Mayor Hurd said that there is no way to determine that new commercial zoning would not be extended as progress goes on. There is no guarantee that zoning will not change. Mrs. Burnside said that com- mercial zones should be setup at time of development, and not changed. Mayor Hurd said that Mrs. Burnside should tell the Legislature they should pass a law not allowing residential property to encroach on industrial or commercial property, etc. W. J. Wallace, 2925 Colorado Avenue said that they have the nicest street and homes in St. Louis Park, and they want to keep it so. Mrs. Sommers said they were definitely affected by this change. Spoke of living in Canada. Said if parking lot is put in, they would want to move out of the Country. Mayor Hurd told her about democracy, etc. Mr. Taube said that two years ago when commercial buildings were proposed, that the neighborhood brought up the need of parking, and they were informed that the parking space available was satisfactory, and no new parking area would be necessary. Mrs. Gross said she was surprised and startled at the turn out at this meeting. John Uhlarik, 3248 Edgewood Avenue criticised Mrs. Gross for living in St. Louis Park for ten years, and not knowing Councilman's name. Said he would like to have a decision on this question made tonightt Trustee Jorvig stated that if the Council acts on this request, he will go along on a special permit for off-street parking only as there is need for this parking area. Fred Thwing asked if the Council grants this permit, can there be an appeal by injunction? E. T. Montgomery, Village Attorney said he could not answer for him, and suggested that he see a private legal advisor. Clyde Sorensen said that there is no traffic hazard here. There is more need for it on Excelsior Boulevard at the Miracle Mile; that the parking lot will not bring in more taxes. Wallace Johnson, 3354 Brownlow Avenue asked how a parking lot would stop the backing out from in front of Klein's Store. Will they allow parking in front of the store, if parking lot is approved? Trustee Jorvig said that no doubt parallel parking will be instigated, if parking lot is permitted." Mr. Johnson asked if Mr. Klein was a St. Louis Park citizen. Mr. Klein said that the enterprise is good for all over St. Louis Park. He has a ten year lease on the property; and that trucks will go through the alley for the next ten years, parking lot or no parking lot. He talked about what they have done elsewhere. Mr. Burnside asked Mr. Klein if he would sell the lots t6 residents. Mr. Klein said he did not own the property. Mr. Burnside said he would like to see a playground made on the site. Asked what assurance they would have that a commercial building would not be constructed there. Mr. Klein said that his lease is for the use of these lots for parking lot only. We are in the middle on this, and want to do all we can to satisfy the people of St. Louis Park. Mayor Hurd read what could be put on residential property, including churches. Mrs. Gross said that church was turned down, and the Penny Store was there when they moved in. On motion of Trustee Bolmgren, seconded by Trustee Middleton, the applica- tion of M. A. Fingerman for a special permit for use of Lots 12, 13, and 14, Block 21, Park Manor for the parking of automobiles was approved according to the following conditions: 230 March 24, 1952 (a) The premises will be landscaped in accordance with the plan presented by the Applicant, and the surface improved and kept improved with asphalt or tar surfacing. (b) A fence will be erected and maintained -on the rear of the lots at the alley and on the Colorado Avenue side of Lot 12 which shall be screened by the planting of shrubery. , (c) Any flood lights erected shall be so controlled as to avoid the lights -being directed upon residences in the vicinity and turned off by 9:30 P. M. each night. (d) There shall be no entrance to said lots except from Minnetonka Boulevard-. (e) The premises shall not be operated in such a manner as to become a nuisance to surrounding property. (f) The owner of the premises will reconstruct a concrete sidewalk on the north side of Minnetonka Boulevard in front of these lots in accordance with standard Village sidewalk specifications In the event of failure to comply with the foregoing conditions, or any one of them, termination of this permit shall be justified. Hearing Date Set for Widening 35th Street On motion of Trustee Middleton, seconded by Trustee Bolmgren, April 21, 1952 was set as date for hearing on proposed widening of 35th Street from Texas Avenue to'the North and South Line of Section 18, Township 117, Range 21; the area to be assessed is the property improved by widening of said Street within the N' of the SEI, of said Section 18. Motion was passed by unanimous vote of all Members of the Council. License Applications On motion of Trustee Middleton, seconded by Trustee'Bolmgren, the follow- ing applications for 1952 licenses were approved, and the Mayor and Clerk were authorized to issue licenses to expire December 31, 1952, by unanimous vote of all Members of the Council: Kuehn Heating Company Heating Minikanda Dairy Store Restaurant Heating License Bond On motion of Trustee Bolmgren, seconded by Trustee Middleton, heating -,license bondo'ki.th J6hn Kasid of St.'Louis Park as principal, and Anchor Casualty Company of St. Paul, Minnesota as surety, dated March 6, 1952, in the amount of $1,000.00, was approved by unanimous vote of all Members of the Council. Taxicab Insurance Approved On motion of Trustee Bolmgren, seconded by Trustee Middleton, the renewal of Policy No. DP -5161, from March 5, 1952 to March 5, 1953, with the Golden Valley Cab Company and St. Louis Park Radio Cab Company, Incorporated, 2632 Noble Avenue named as the insured, and Casualty Reciprocal Exchange Company of Kansas City, Missouri as insurer, covering 1950 Ford Sedan, Serial Number HODA-223968; 1949 Ford Sedan, Serial Number'98HA-18694, and 1949 Ford Sedan, Serial Number 98HA-496144, in the amounts of $5,000.00 liability for bodily injury for each person; $10,000.00 for each accident, and $5,000.00 liability for property damage for each accident, was approved by unanimous vote of all Members of the Council. Permission to Place Poles On motion of Trustee Jorvig, seconded by Trustee Bolmgren, the Northern States Power Company was granted permission to place One (1) pole on Nevada Avenue, north of Minnetonka Boulevard, by unanimous vote of all Members of the Council. Petition for Water Main P-1046 On motion of Trustee o ren, seconded by Trustee Middleton, the petition signed by Alvin Glover, 5915 Hamilton Avenue, dated March 18, 1952, for the construction of water main in ZARTHAN AVENUE FROM 28TH STREET TO 29TH STREET, was referred to the Village Engineer and Chairman of the Water Department Com- mittee for checking and recommendation, by unanimous vote of all Members of the Council. 1 1 March 24, 1952 Petition for Sanitary Sewer On motion of Trustee-Bolmgren., seconded by Trustee Middleton, the follow- ing petition was referred -to the Village -Engineer and Chairman of the Sewer Department Committee for checking"and recommendation, by unanimous vote of all Members of the Council present: P-1048 PETITION FOR SANITARY SEWER -signed by Orville B. Gas Main Extensions On motion of"Trustee Middleton; seconded by Trustee Bolmgren, the follow- ing gas main extensions were approved by unanimous vote of all Members of the Council: #76 In Lynn Avenue and West -38th -Street from 11 N of N Line of West 38th Street to cover #4419 Excelsior Boulevard - West 801 of Lot 4, Block 14, Minikanda Vista Addition. #77 In Oregon Avenue from West Lake Street to Lot 31, Block 158, Rearrangement of St. Louis Park. 231 r Salary Change for Gilbert Senst Gilbert M. Senst, having completed his six months probation period -as rodman for the Engineering Department, it was moved by Trustee Middleton, seconded by Trustee Bolmgren, that his pay be increased to $1.872 per hour, effective April"1, 1952, by unanimous vote of all Members of the Council. Reclassification of Carl T. Miller On the recommendation of Village Engineer, Phil W. Smith, it was moved by Trustee Middleton, seconded by Trustee Bolmgren, that Carl T. Miller be advanced to the position of Assistant to Village Engineer, thereby filling the vacancy caused by the resignation of John Balich, to become effective April 1, 1952 at $2.522 per hour. Motion was passed by unanimous vote of all Members of the Council. Advertise for Bids for Bituminous Liquids On motion of Trustee Middleton, seconded by Trustee Jorvig, the Clerk was instructed to advertise for bids in the St. Louis Park Dispatch and Construction Bulletin for the furnishing of 100,000 gallons, more or less, of each of the following liquids: Road tar, medium curing cut=back asphalt, slow curing cut- back and emulsified asphalt, by unanimous vote of all Members of the Council. Bids to be opened April 14, 1952. Advertise for Bids for Bituminous Plant Mix On motion of Trustee Middleton, seconded by Trustee Jorvig, the Clerk was instructed to advertise for bids in the St: Louis Park Dispatch and Construction Bulletin, for the furnishing -of 20,000 tons, more or less, of each of the follow- ing: Road tar mix and cutback asphalt mix; bids to be opened April 14, 1952, by unanimous vote of all Members of the Council. Advertise for Bids for Traffic Signals On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the Clerk was instructed to advertise for bids in the St. Louis Park Dispatch and Construction Bulletin for the purchase and installation of AUTOMATIC TRAFFIC SIGNALS at the 232 March 24, 1952 Advertise for Traffic Signals, Cont'd. intersections of EXCELSIOR BOULEVARD AND BROOKSIDE AVENUE, and NORTH SIDE OF EXCELSIOR BOULEVARD -AND ALABAMA-AVENUE.-bids'to be opened April 14, 1952, by unanimous vote of all Members of the Council. Village Engineer's Report on Condition of Acme Stone Co. Pit The Village Engineer reported that he and Street -Commissioner Kenneth Johnson checked the gravel pit known as Acme Stone Company Pit, and -found that since their inspection made in 1951, the.Company ha`s-filled in the private alley- in rear of Lots 1 to 19,- Minikanda_Oaks Addition, and -the -banks have been sloped so as not to endanger the adjoining property to the south. The filled in property does not look particularly neat, but was -unable to state whether this is the fault of the Acme Stone Company. He suggested that a letter be written to the Owner, asking them to clean up the debris on the surface, and make it more presentable. Report ordered filed. Village Engineer's Report on Louisiana --Avenue Bride - - Village Engineer, Phil W. Smith reported that'he has tried to get an appointment with Mr. Loeffler, Assistant'Chief Engineer, and Mr. Guerin, Bridge Engineer who have been -handling the -construction -of the new bridge on Louisiana Avenue for the Great Northern Railway. Letter Complaining about Ice and Snow on Sidewalks A letter from Lucille Morrison, Minneapolis, dated March 16, 1952, stating that while visiting relatives in St. Louis Park; she slipped and fell on an un - shoveled walk and -was severely -shaken up, suffered a twisted knee, and ruined a pair of stockings, which was due -to enevene§s of ice on the walks, the slush, and large ankle-deep pools bf water caused by melting snow, was read and ordered filed. (Location of lights listed at bottom of page) Dogs - - - - - Several persons appeared regarding dog control. Mrs. Herman Jolosky, 2633 Joppa Avenue. Said large dogs -in their neighborhood were a nuisance and should be put on -leash when outdoors. Harold Nelson, West 35th Street said uncontrolled dogs do considerable damage; -and some method should be established to pick up unlicensed dogs. Said -some towns have an ordinance providing for muzzling and leashing dogs. Jerry Sudit, 2620 Quentin Avenue said he will sign complaint for a dog that bothers him - A -German Shepherd. The owner does not feel that the -dog hurts anyone. Said Hopkins -residents must keep their dogs on their own property, or leashed. - Mayor Hurd said that the Council was aware of the dog problem in intend to'do something about'it. He -spoke of -Lou Kolstad; former dog catcher, and his plans for a dog pound, which should materialize soon; also mentioned the limited space at the Fitch pound:- He asked those present to bear with us -two or three weeks longer as he felt sure something will be worked out•by then.
