REGULAR MEETING MARCH,10, 1952
The meeting was called to order by Mayor C. L. Hurd at 8:00 P. M.
Invocation was given by Father Roger Schmuck of St. Georges Protestant
Episcopal Church.

Quit Claim Deed - Salkin & Linoff
On motion of Trustee Bolmgren, seconded by Trustee Middleton, the quit claim
deed of Salkin and Linoff, Incorporated, dated February 26, 1952, for the follow-
ing described property, to be used for sanitary and storm sewers, and water mains,
was approved and accepted; and the Village Attorney was instructed to file same
with Office of Register of Deeds, by unanimous vote of all Members,of the Council
present:
An easement in and over a strip of land fifteen (15 feet in width for sewer
and water main purposes described as follows, to -wit: Beginning at a point in
the west line of Brooklawns Addition, a_distance of one hundred thirty-eight
(138) feet south of the northwest corner of Lot Twenty-two, Block One (1), Brook -
lawns Addition; thence north on the west line of said addition to the northwest
corner thereof; thence west along the north line of said addition extended a
distance of three hundred fifty-eight and 8/100 (358.8) feet; thence south
parallel with the west line of said addition a distance of 15 feet; thence east
parallel with the north line of said addition a distance of three hundred forty-

Said easement is more particularly described as the free right to
forever enter upon said premises at all reasonable times and excavate the soil
and construct and install therein public sanitary and storm sewers and water
mains and to forever use and maintain said sewers and water mains as a part of
the public utility system of said Village and including the right to enter upon
the premises at all reasonable times for the purpose of inspecting, repairing
and reconstructing any sewer or water main constructed therein, provided always that
in the event of any excavation of the soil, the same will be replaced and the
surface restored as nearly as practicable to the condition it was in at the time
the excavation was made.
Quit Claim Deed - Robert & Betty Nelson and Anna Sampson
On -motion of Trustee Bolmgren, seconded by Trustee Middleton, the quit
claim deed of Robert S. Nelson and Betty Nelson, husband and wife, and Anna
Sampson, dated February 28, 1952, for the following described property to be used
for storm and sanitary sewers, and water mains, was approved and accepted; and
the Village Attorney was instructed to file same with the Office of Register of
Deeds of Hennepin County, by unanimous vote of all Members of the Council present:
An easement for sewer and water main purposes in and over that part of
Lot Twenty-one (21), Block One (1), Brooklawns Addition, according to the plat
thereof on file and of record in the office of the Registrar of Titles of said
Hennepin County, lying northerly of a line drawn parallel to and measured at
right angles seven and 510 (7.5) feet south from the northerly line of Lot
Twenty-one (21).
Said easement is more particularly described as the free right to forever
enter upon said premises at all reasonable times and excavate the soil and cons-
truct and install therein public sanitary and storm sewers, and water mains and
to forever use and maintain said sewers and water mains as a part of the public
utility system of said Village and including the right to enter upon the premises

Request to Raise Street - Sam Segal
Building Contractor, SarA Segal appeared and requested that Louisiana
Avenue from 27th Street to 28th Street be graded to proposed grade so that the
Gas -Company will install a 10 inch gas main.as soon as possible. Asked if the
grading could be started by May lst. The Village Engineer stated that this
job is tied in with the new bridge and approaches.
On motion -of Trustee Bolmgren, seconded by Trustee Middleton, the above
matter was referred to the Village Engineer and Clerk to check whether the job
as set up needs a hearing, etc. and report back to the Council at meeting of
March 17, 19522 by unanimous vote of all Members of the Council present.
Application for Used Car Lot Denied
On motion of Trustee Bolmgren, seconded by Trustee Middleton, the applica-
tion of Robert J. Book, DBA Luke and Nute Auto Service, for a license to operate
a used car lot at 4040 West Lake Street was denied, and the Clerk was authorized
to issue check for fee paid in the amount of $50.00, by unanimous vote of all
Members 'of the Council presents it being determined that same would be detrimental
to adjacent residential property values.

On motion of Trustee Bolmgren, seconded by Trustee Middleton, the follow-
ing petitions were referred to the Village Engineer and Street Department Com-
mittee for checking and recommendation, by unanimous vote of all Members of the
Council present:

Planning Commission's Report on Rezoning Petition
The Planning Commission's report on the petition of Adolph Fine, Inc.,
dated March 4, 1952, for the rezoning of Lots 1, 2, 3, and 4, Block 3; and Lot
16, Block 2, Adolph -Fine's Addition for Commercial Use, was read.
Hearing Date Set for Rezoning
To concur with the recommendation made by the Planning Commission, it was
moved by Trustee Middleton, seconded by Trustee Bolmgren, that April 7, 1952
be set as date for hearing on the request of Adolph Fine, Incorporated for the
rezoning of Lots 1, 22 3, and 4. Block 3; and Lot 16, Block 2, Adolph Fine's
Addition, for\Commercial Use, by unanimous vote of all Council Members present.
Planning Commission's Report on Request for Special Permit for Parking Only
The Planning Commissionts report dated March 7, 1952, on the application of
M. A. Fingerman for a special permit to use Lots 12, 13, and 14, Block 21, Park
Manor Addition for off-street parking in order to relieve the congestion and
traffic hazards on Minnetonka Boulevard between Dakota, Colorado and Edgewood
Avenues, was read, and ordered filed with application for parking permit hearing
to be held March 24, 1952.

The Village Engineer's recommendation on the application of Richard J.

STREET IN WEST LYNN, was read. On motion of Trustee Bolmgren, seconded by
Trustee Middleton, April 14, 1952 was set as date of hearing on the above
mentioned petition, by unanimous vote of all Members of the Council present.
Justice of Peace Report of Fines
Justice of Peace Anton Yngve's report of fines for February, 1952 was read
and ordered filed.
Letter from Building Inspector Re: Midwest Conference
of Building Officials
A letter from Building Inspector, Peter Stienstra, dated February 5, 19522
relative to the Midwest Conference of Building Officials and Inspectors held at
Michigan State College, East Lansing, Michigan, was read, and the Clerk was
instructed to send copy of same to Village Attorney.
Village Engineer Approves Tentative Plat of Oak Hill Manor 3rd
Village Engineer, Phil W. Smith submitted his approval of Tentative Plat
of Oak Hill Manor Third Addition, with the understanding that profiles for grad-
ing must be approved later.
Resolution
On motion of Trustee Bolmgren, seconded by Trustee Middleton, the follow-
ing resolution was adopted by unanimous vote of all Members of the Council
present:
RESOLUTION CANCELING LATERAL SEWER DISTRICT 1-t ASSESSMENT
WHEREAS it appears that subsequent to the resolution of the Village Council
adopted October 20, 1941, levying assessments for Lateral Sewer District 1-E,
the following property was divided; and whereas due to said division, this
assessment was inadvertantly charged against said property, which was not served
by said sewer, therefore
BE IT RESOLVED that installments of such assessment heretofore paid in
the respective amounts hereinafter set forth be refunded to the respective
property owner., -and, upon receipt of a signed verified claim and the paid tax
statements, that the Mayor and the Clerk be hereby authorized to issue warrant
in payment of such refunds to the respective property owner.

RESOLUTION AUTHORIZING ACQUISITION OF PROPERTY FOR
GARBAGE AND REFUSE DISPOSAL
PURPOSES
WHEREAS, it appears necessary that lands be acquired by the Village which
may be made available to the Village garbage collection contractor for disposal
of garbage by the sanitary land fill method, and
WHEREAS, G. M. Orr Company in its "Report on Sanitary Disposal of Refuse
and Garbage", dated November 5, 1951, has recommended the following described
premises as the site of future sanitary land fill for Village garbage and refuse
disposal, and it appears to the -Village Council that said site is the most
favorable site for that purpose within the Village, therefore,
BE IT RESOLVED by the Village Council of the Village of St. Louis Park as
follows:
1. That it is determined necessary that the Village take and acquire the
premises hereinafter described as a site for disposal of garbage and refuse by
the sanitary land fill method.
2. That the lands above referred to are described as follows:

24 West of the fifth principal meridian described as follows:
Commencing at the intersection of the east right of way line of
State Highway 100 and the north line of West 36th Street; thence

Resolution Authorizing Acquisition of Property for Garbage
and Refuse Disposal Purposes
along the said west line of West 1 of said Section 6, to
the southerly line of the right of way of the Chicago,
Milwaukee, St. Paul & Pacific Railroad; thence south-
westerly along said southerly right of way line to its
intersection with the east right of way line of State
Highway 100; thence southerly along the east right of way
line of State Highway 100 to the point of beginning.
3. The Village Attorney is hereby directed to commence proceedings in
behalf of the Village in the District Court of Hennepin County for the acquisition
of said premises as authorized by law.
Purchase of Property Authorized_ -. % ®►-�
On motion of Trustee Bolmgren,•seconded by Trustee Middleton, the purchase
of Lots 17, 18, and 21, Home Addition from Landers-Norblom-Christenson Company
at 920000;00 was approved, with the understanding that the vendor is to pay 2
of the 1951 taxes, due to the fact that the agreement to purchase same was
entered into in 1951. Motion was passed by unanimous vote of all Members of
the Council present.
Advertise for Bids for Dictaphone
On motion of Trustee Bolmgren, seconded by Trustee Middleton, the Clerk
was authorized to advertise for bids -for dictaphone equipment; bids to be opened
April 7, 1952, by unanimous vote of all Members of the Council present.
Classification and Salary Rate Changed - Mary Martin
'On motion of Trustee Bolmgren,• seconded by Trustee Middleton, Mrs. Mary
Martin was promoted from Clerk to Junior Clerk at a wage rate of $195.00 per
month, effective March 15, 1952, by unanimous vote of all Members of the Council
present.
Employment of Blade Operator Authorized
On motion of Trustee Middleton; seconded by Trustee Bolmgren, the Street
Commissioner was authorized to hire a blade operator at $1.921 per hour, by
unanimous vote of all Members of the -Council present.
Accoustical Tile for Room #2, Village Hall
On motion of Trustee Bolmgren, seconded by Trustee Middleton, the Clerk
was authorized to order the installation of accoustical tile in Room #2, Village
Hall at a cost approximately $375.00, by unanimous vote of all Members of the
Council present.

On motion of Trustee Bolmgren, seconded by Trustee Middleton, the follow-
ing ordinance was adopted by unanimous vote of all Council Members present:

AN ORDINANCE AMENDING ORDINANCE NO. 176
RELATING TO RATES FOR USE OF WATER
The Village Council of the Village of St. Louis Park ordains:
Section 1. Section 3'of Ordinance No. 176 entitled "An Ordinance Establish-
ing a Village Water Department, Prescribing Rates -for Use of Water, and Regula-
tions Governing Connections with Mains and Equipment and Use of Water", adopted
by the Village Council December 29, 1941, is hereby amended to read as follows:
"Section 3. Water Rates: The rates for water -taken from the Village
water supply system are hereby fixed and shall be collected at twenty
cents per hundred cubic feet, payable quarterly, provided, however,
that there shall be a minimum charge to each water customer for each
quarter year period, or fraction thereof during which water service
is furnished as follows:

Water bills shall be mailed in ample time to reach
the customers before the quarterly due date and shall
specify the water consumed and charge in accordance with
foregoing rates, and in addition a penalty of 15% which
shall be added to the amount due if not paid within 15
days after the due date.
Section 2. Section 4 of said Ordinance No. 176 is -hereby amended to read
as follows:
"Section 4. Service Charges: Charges shall be made and
collected for tapping and making connections with the Village
water mains, to be paid at the time of making application
therefor, as follows:
For connections 2 inch in diameter, $3.00 each
For connections 5/8 inch in diameter, $6.00 each
For connections 3/4 inch in diameter, $7.00 each
For connections 1 inch in diameter, $8.00 each
For larger connections, such an amount as shall be fixed by
the Registrar.
For turning on water where service has been turned off for
nonpayment of water bill, $2.00
For raising or lowering stop -box tops to correspond with
ground level, $5.00."
Section 3. Section 24 of said Ordinance No. 176 is hereby amended to read
at follows:
Section 4. This ordinance shall take effect from and after April 1, 1952•
'Village Engineer Approves Tentative Plat of Texa-Tonka 3rd Addition
The Village Engineer submitted his approval of tentative plat of Texa-
Tonka Third Addition, with the understanding that profiles for grading must be
approved later.

"Section 24. Connections Beyond Village Boundaries: In any and
all cases where water mains of the Village have been or shall
be extended to or constructed in any road, street, alley or
° public highway adjacent to"or outside the corporate limits of
the Village, the Registrar'is hereby authorized to issue permits
to the owners or occupants'of properties adjacent to, or
accessible'to, such water mains to tap and make proper water
service pipe connections with such water mains of the Village
in conformity with and subject to all the terms, conditions and
provisions of the ordinances of the Village relating to the
tapping of the Village water mains and making water service
pipe connections therewith; and to furnish and supply water
from the water works system of the Village to such owners and
occupants of properties adjacent or accessible to such water
mains of the Village through and by means of water meters
duly installed for the sum and price of 25 cents per 100 cubic
feet of water so furnished to such owners and occupants res-
pectively, until such is changed and further established by
the Village Council. Water service rendered to such persons
shall be subject to all provisions of this Ordinance, and
persons accepting such service shall thereby agree to be
bound and obligated by said Ordinance.
Section 4. This ordinance shall take effect from and after April 1, 1952•
