Vfaalstad- 26.46 Wilson-Albrecht 3.00 Young Fuel Company 24.22 Hearing on Application for Rezoning - Victor•Carlson & Sons, Inc.- Pursuant to notice published in the" St. Louis Park Dispatch, November 272 1952, a hearing was had on the application- of Victor Carlson & Sons, Inc. to rezone from Residential Use to Light Industrial Use that part of Block 204, Rearrangement of St. Louis Park which lies SW1y of Gorham Avenue extending from the NW Corner of said Block SEly across said Block to 2nd Street NW as dedicated by deed to the Village of St. Louis Park.' The following persons appeared: A. C. Clark, 3301 Brownlow Avenue and K. D. Sandstad, 3338 Brownlow Avenue appeared in opposition to the rezohing. Clarence Bros, owner of property on Gorham Avenue between Walker 'Street and 2nd Street NW appeared. A 'discussion was had of what is to be done with Gorham Avenue nortli of 2nd St. W. Mr. Clark said he was opposed to a storage area so close to his home as it will mean more truck driving; he feels that it would be just a beginning, and other blocks will come later. Mayor Hurd said the new street is set to take traffic off Louisiana Avenue. Mr. Sandstad said the traffic from Rodgers Hydraulic Company and Republic Creosoting Company is heavy, and if Victor 'Carlson-is granted a permit he feels Gorham Avenue should be finished and 1st Street cut down for drainage toward Walker Street from Brownlow Avenue. Mr. Bros said he has had a-request-in for two years which was tabled until this came up. He feels his property should be taken care of now, and that there is a need right now to take care of the zoning of his property. Trustee Bolmgren asked if the Village Engineer-has-the necessary plans for the new Gorham Curve. The answer was yes, and same should be a 1953 project. Mr. Clark asked that in view of approving Carlson's request, could we request trees along the road to act as a buffer from the homes along Brownlow Avenue and Louisiana Avenue. Mayor Hurd and others felt that that would be a good deal for the Village to take over.' On motion of Trustee Middleton, seconded by Trustee Bolmgren, the request of Victor Carlson & Sons, Inc. to rezone 'from Residential Use to Light Industrial Use that part of Block 204, Rearrangement of St. Louis Park which lies SWly of Gorham Avenue extending from the NW Corner of said Block SEly across said Block to 2nd Street NW as dedicated by deed to the Village of St. Louis Park, was approved as recommended by the Planning Commission in their report dated Nov- em'ber 15, 19522 by unanimous vote of all Members of the Council present. r� December 8, 1952 75 Hearing on_,Reguest for Rezoning -- Donovan Construction Co. Pursuant to notice published in the St. Louis Park Dispatch November 27, 1952, a hearing was had on the request of Donovan Construction Company for the rezoning from Multiple Dwelling Use District to Commercial Use District of a triangular shaped area located east of the present Meadowbrook Manor Apartment property, north of Excelsior Boulevard and SW of Minnehaha Creek, for the purpose of establishing thereon a shopping center including a gasoline filling station. No persons appeared. On motion of Trustee Middleton, seconded by Trustee Bolmgren, the request of Donovan Construction Company for rezoning the following described property from Multiple Dwelling Use to Commercial Use was approved, and the Village Attorney was instructed to prepare an ordinance covering same, by unanimous vote of all Members of the Council present: That part of Section 20, Township 117, Range 21 ----- Starting at a point on the north line of Excelsior Boulevard, such point being 1"0.34 feet east of the north and south center line of Section 20, Twp. 117, Range 21; thence north 0.00 a distance of 810.63 feet; thence SEly along the center line of Minnehaha Creek approximately 1200 feet to the north line of Excelsior Boulevard; thence Wly along the north line of Excelsior Boulevard approximately 750 feet to the point of beginning. Hearing on Application for Rezoning -- G. F. Lohman Pursuant to notice published in the St. Louis Park Dispatch November 27, 1952, a hearing was had on the application of G. F. Lohman to rezone that part of the following tract of land, not now zoned Commercial, from Residential Use or Open Development Use to Commercial Use --- that tract of land lying north of Highway No. 7 west of Texas Avenue, south of 36th Street and east of Minnehaha Creek, except Park Knoll School property. Robert Johnson, 3544 Zinran Avenue and others from the area appeared in► opposition to the rezoning. Mayor Hurd read letter,-from Calhoun Realty Company (Lohman) dated November 7, 1952, requesting the rezoning, and explained what was to be constructed and the 1801 to 2001 buffer strip, so that those present could get an idea of what is going to be done. The Occupant of 3537 Zinran said he just moved''in a -week ago and said insurance rates go up near Commercial property. Mayor Hurd said Home Owners should get their information from the right persons, and not from the man who wants to unload a piece of property. Robert Johnson' said the letter from Lohman sounds ambiguous, and Planning Commission's report is not clear. He said he would like more information as to what it is going to look like. Mr. Lohman was present and gave a story of what had gone on. He feels that folks are unduly alarmed, and wants them to know that he built Hobby Acres and Knollwood, and wants to build a shopping center that will do Hobby Acres and Knollwood credit as well as the homes north of the property. Has a 5 to 20 million dollar project in view, and taxwise will be worth much to adjacent as well as home owners at large. He showed a tentative plat of the property. It is possible that two—family dwellings will be built along 36th Street. The Highway No. 7 Service Road will be in front of the entire project. He feels that worry about children is over emphasized. Mayor Hurd explained the buffer zone as a beauty spot. He feels that the Village Council will have to define screening wanted as buffer. Traffic control from 36th Street can be taken care of on plans. Says he feels that two entries would be sufficient on 36th Street but cannot be determined as there are no plans on hand. On motion of Trustee Bolmgren, seconded by Trustee Middleton, the applica— tion of G. F. Lohman to rezone that part of'the following tract of land, not now zoned Commercial, from Residential Use or Open Development Use to Commercial Use was approved, and the Village Attorney was instructed to prepare an amend— ment to the Zoning Ordinance covering same, by unanimous vote of all Members of the Council present: The tract lying north of Highway No. 7 west of Texas Avenue, south of 36th Street and east of Minnehaha Creek, except Park Knoll School Property. Hearing Date Set for Rezoning — J. W. Held Property On motion of Trustee Bolmgren, seconded by Trustee Middleton, December 221 1952 was set for hearing on application of J. W. Held and F. J. Swenson for 76 December 8, 1952 Hearing Date Set for Rezoning. Cont'd. rezoning that portion of the east one-half (El) of the northwest quarter (NW4) of the southwest quarter (SW4), Section 30, Township 29, Range 24, which is now zoned within the open development use district, and to include the same within the commercial use district. Motion was passed by unanimous vote of all Members of the Council present. Legal Description for Deed On motion of Trustee Bolmgren, seconded by Trustee'Middleton, the Village Engineer was instructed to prepare description for the 50 foot strip on the West Side of Minnehaha Creek adjacent to Meadowbrook Manor property for the purpose of securing deed, by unanimous vote of all Members of the Council present. Permit for Industrial Building -- Jerry Holt The Planning Commission's report dated December 4, 1952, on the request of Jerry Holt for a permit to erect an industrial building on Lots 5 and 6, Block 51, Rearrangement of St. Louis Park, was read. On motion of Trustee Middleton, seconded by Trustee Bolmgren, the request of Jerry Holt for a permit to erect an industrial building on Lots 5 and 6. Block 51, Rearrangement of St. Louis Park was approved, and the Building Ins- pector was authorized to issue same with designation of proper 'setbacks, by unanimous vote of all Members of the Council present. Request for Permit to Build Motel -- H. A. Walch The Planning Commission's report on the request of Henry A. Walch, owner, for approval of permit to build a Motel on the unplatted area on the SE Corner of Wayzata Boulevard and Pennsylvania Avenue, -was read. Hearing Date Set for Change of Density On motion of Trustee Bolmgren, seconded by Trustee Middleton, December 29, 1952 was set as date for hearing to change the density of unplatted area on the SE Corner of Wayzata Boulevard and Pennsylvania Avenue (that portion of same now zoned for Commercial Use, 1001 x 125', in extent) from "CII to I'D" Density, by uhanimous vote of all Members of the Council present. 1952 Heating License On motion of Trustee Bolmgren, seconded by Trustee Middleton, the appli- cation of Roger M. Bjorklund, DBA Gas Heat Installations for a Heating License for 1952 was approved, and the Mayor and Clerk were authorized to issue same to expire December 31, 1952, by unanimous vote of all Members of the Council present. 1953 Licenses On motion of Trustee Middleton, seconded by Trustee Bolmgren, the follow- ing applications for 1953 licenses were approved, and the Mayor and Clerk were authorized to issue licenses to expire December 31, 1953, by unanimous vote of all Members- of the Council present: Bach and Mc Carty Texaco Service Gas Station 3 Pumps If it it " Soft Drink Brookside Drug Store 3.2 Beer Off-Sale It 11 " Restaurant it " " Cigarette Bonds On motion of Trustee Bolmgren, seconded by Trustee Middleton, the follow- ing bonds were approved by unanimous vote of all Members of the Council present: WATER REGISTRARIS BOND with J. A. Werner as principal, and American Surety Company as surety, dated December 2, 1952 - effective January 1, 1953, to expire December 31, 1953, in the amount of $2,000.00. VILLAGE CLERK'S BOND with Joseph Justad as principal, and American Surety Company as surety, dated December 2, 1952, in the amount of $ 5,000. Effective January 1, 1953, to expire December 31, 1954. CONTINUATION CERTIFICATE FOR HEATING LICENSE BOND, with Pure Oil Company of Chicago, Illinois as principal, and St. Paul Mercury Indemnity Company of St. Paul, Minnesota as surety, dated January 1, 1953, in the amount of $1,000.00. On motion of Trustee Middleton, seconded by Trustee Bolmgren, the above application was tabled,. by unanimous vote of all Members of the Council present. Report on Proposed Incinerator - G. M. Orr Engineering Co. Letter from G. M. Orr Engineering Company, Consulting Engineers, dated December 8, 1952, giving a preliminary report on the status of the proposed in- cinerator for the Village of St. Louis Park was read and ordered filed. Letter Re: Suspension of Off Sale Liquor License Copy of letter to Culbertson's Cafe, Inc., dated December 3, 1952, from Liquor Control Commissioner, Dudley C. Ericson, informing them of the suspension of their Off-Sale liquor license for period commencing on the morning of Friday, December 5, 1952 through the evening of December 11, 1952, was read and ordered filed. Letter Re: Dedication of Property - Donovan Construction Co. Letter from Donovan Construction Company, dated December 5, 1952, stating that they were agreeable to the dedication of a fifty foot strip of land on the west side of Minnehaha Creek from the north side of Excelsior Boulevard, approxi- mately 1,000 feet to the most easterly point of Meadowbrook Manor, Inc. property line; also to the dedication of the 10 acres of land for recreational purposes within the next five years, providing that the Village indicates its readiness to commence action to improve said land for recreational purposes, was read and ordered filed. 7V December 81 1952 Complaint Re: Sidewalk Level, Minnetonka_Boulevard Letter from Robert Cochrane, 5801 Minnetonka Boulevard, dated November 26, 1952, registering a complaint about the sidewalk just completed in front of their property being from 5 to 8 inches higher than their yard level, was read and referred to the Village Engineer for checking and report, by unani- mous vote of all Members of the Council present. Resolution On motion of Trustee Bolmgren, seconded by Trustee Middleton, the follow- ing resolution was adopted by unanimous vote of all Council Members present: RESOLUTION CANCELING 2-CB SANITARY SEWER #497 ASSESSMENT WHEREAS it appears that by resolution of the Village Council adopted September 4, 1951, levying assessments for 2-CB Sanitary Sewer #497, the follow- ing property owner was charged for 120 feet, whereas said sewer serves only the North 60 feet of said property, therefore BE IT RESOLVED by the Village Council of the Village.of St. Louis Park that half of the 1952 assessment heretofore paid, in the respective amounts set forth below, be refunded to the respective property owner, and, upon receipt of a signed verified claim and a paid tax statement, that the Mayor and the Clerk be hereby authorized to issue warrants in payment of such refund to the respective property owner.
