M. Knutson 75¢ 36¢ 11¢ On motion of Trustee Bolmgren, seconded by Trustee Middleton, the above bids were referred to the Village Engineer and Chairman of the Street Department Committee for tabulation and recommendation, by unanimous vote of all Members of the Council present. Hearing on Proposed Sewer Assessment Pursuant to notice published in the St: L6uis Park Dispatch October 9, 1952, a public hearing was had on proposed assessment for Sanitary Sewer No. 52-224 which has been constructed in Dakota Avenue from 32nd Street to the North line of Lot 13, Block 4, Adolph Fine's Addition, which proposed assessment is on file in the office of the Village Clerk. No persons appeared. Resolution On motion of Trustee Bolmgren, seconded by Trustee Middleton, the following resolution was adopted by unanimous vote of all Members of the Council present: ASSESSMENT RESOLUTION WHEREAS the Village Council has met at the time and place specified in a notice published in the St. Louis Park Dispatch October 9, 1952 relating to assessment for Sewer Improvement No. 52-224, and has heard all interested persons, therefore BE IT RESOLVED that the proposed Assessment for Sanitary Sewer No. 52-224, in Dakota Avenue from 32nd Street to the North line of Lot 13, Block 4, Adolph Fine's Addition be hereby approved and that there be hereby levied and assessed against each and every lot and parcel of land described in said proposed assessment an,assessment in the sums therein respectively set forth, payable in ten annual instalments, the first of which shall be due and payable concurrently with taxes levied in 1952 and payable in 1953 with interest at four per cent (4%) per annum, computed from the date of this resolution to August 15th of each year. Petition District Court for Permission to Open Voting-Machines, December 2. 1952_ On motion of Trustee Bo]mgren, seconded by Trustee Middleton, the Village Attorney was instructed to petition the District Court for an order authorizing the Village Clerk to open -the voting machines for the Village Election on December 2, 1952, by unanimous vote of all Members of the Council present. Hearing Date Set for Proposed Sanitary Sewer On, motion of Trustee Bolmgren, seconded by Trustee Middleton, December 15, 1952 was set as date for hearing on proposed construction of sanitary sewer in Maryland Avenue from north line of Lot 8, Block 1, Boulevard Heights Addition, to 32nd Street, it being understood that the adjacent property will be assessed. Motion was passed by unanimous vote of all Members of the Council present. Permission to Place Buried Cable On motion of Trustee Bolmgren, seconded by Trustee Middleton, the North- western Bell Telephone Company was granted permission to place buried cable- in Minnetonka Boulevard (County Road #5) near intersection of Ensign Avenue, by unani- mous vote of all Members of the Council present. Permission to Place Poles On motion of Trustee Bolmgren, seconded by Clerk Justad, the Northern States Power Company was granted permission to Place poles at the following locations in the Village, by unanimous vote of all Members of the Council present: 2 Poles on Cedar Lake Road and Brunswick Avenue 2 It on Inglewood Avenue and West 25th Street 1 " on West 25th Street between Huntington and Inglewood Avenues 1 " on Georgia Avenue and 18th Street 1 " at Sewer Lift Island - Hunting Avenue and West 25th Street Gas Station License Approved On motion of Trustee Bolmgren, seconded by Trustee Middleton, the application of Theodore Davison, Lessee, Sinclair Oil Company for a license to operate a Four-Pump Gas Station at 5619 Excelsior Boulevard was-approved, and the Mayor and Clerk were authorized to 'issue license to expire December 31, 1952, by unanimous vote of all Members of the Council present. 44 November 10, 1952 Bonds �7 On motion of Trustee Bolmgren, seconded by Trustee Middleton, the follow- I ing bonds were approved by unanimous vote of all Members of the Council present. PLUMBING LICENSE BOND, with Virgil L. Beck and Elmer L. Swanson, DBA Hopkins Plumbing Company as principal, and Hartford Accident and Indemnity Company as surety, dated October 24, 1952, in the amount of $42000.00. HEATING LICENSE BOND with Northwestern Heating Engineers, Incorporated as principal, and The Aetna Casualty and Surety Company as surety, dated October 17th, 1952, in the amount of $1,000.00. PLUMBING LICENSE BOND, with Clare Nordwall, DBA Clare Nordwall Plumbing and Heating as principal, and United States Fidelity and Guaranty Company as surety; dated November 5, 1952, in the amount of $4,000.00. CONTRACTORS BOND with Western Underground Cons- truction Company as principal, and Peerless Casualty Company as surety, dated October 13, 19521, in the-amount of $62,548.30, covering the construction of Sanitary Sewer Improvement No. 52-429: Resolution On motion of Trustee Middleton, seconded by Trustee Bo]mgren, the following resolution was adopted by unanimous vote of all Council Members present: RESOLUTION CANCELING 2-P SANITARY SEWER #497 ASSESSMENT WHEREAS it appears that by resolution of the Village Council adopted September 4, 1951, levying assessments for 2-P Sanitary Sewer #497, the following lot was inadvertantly assessed for 801, whereas it should have been charged for 401 ; therefore BE IT RESOLVED that the 1952 instalment of such assessment heretofore paid in the respective amount set forth be refunded to the respective property owner, and, upon receipt of a signed verified claim and a paid tax statement, that the Mayor and the Clerk be hereby authorized to issue warrant in payment of such refund'to the respective property owner. Building Inspector's Weekly Report The Building Inspector's report for week ending November 7, 1952, showing that 29 building permits were issued, totaling $254,050.002 was read and ordered filed. Building Inspector's Report for October. 1952 The Building Inspector's report for the month of October, 1952, showing a total of 67 building permits issued, totaling $514,775.00, was read and ordered , filed. November 10, 1952 45 Planning Commission's Report on'Rezoning for Shopping Center The Planning Commission's report dated November 5, 1952, on the request of Donovan Construction Company for rezoning of triangular shaped area located east of the present Meadowbrook Manor Apartment Project along Excelsior Boulevard and southwest of Minnehaha Creek, from Multiple Dwelling Use to Commercial Use, for the purpose of establishing a Shopping Center, was read. John C. Cassidy, Manager of Meadowbrook Manor, Incorporated appeared and spoke in favor of the rezoning. Hearing Date Set for Rezoning _ On motion of Trustee Bolmgren, seconded by Trustee Middleton, December 8, 1952 was set as hearing date on request of Donovan Construction Company to rezone the following described property in Section 20, Township 117, Range 21; from Multiple Dwelling Use to Commercial Use: "Starting at a point on the north line of Excelsior Boulevard, such point being 1,440.34 feet east of the north and south center line of Section 20, Township 117, Range 21; thence north 0.00 a distance of 810.63 feet; thence southeasterly along the center line of Minnehaha Creek approximately 1200 feet to the north line of Excelsior Boulevard; thence westerly along the north line of Excelsior Boulevard approximately 750 feet to the point of beginning." Motion was passed by unanimous vote of all Members of the Council present. Dedication of 50 Foot Strip Along Minnehaha Creek On motion of Trustee Bolmgren, seconded by Trustee Middleton, the Clerk was instructed to write to Donovan Construction Company regarding the`^d'edication of a fifty foot strip of land on both sides of Minnehaha Creek from Excelsior Boule- vard thru their property and also regarding the ten acres for recreation purposes, by unanimous vote of all Members of the Council present. Hearing Date Set for Rezoning On motion of Trustee Bolmgren, seconded by Trustee Middleton, December 15, 1952 was set as date for hearing on the rezoning of that part of Lot 20, Block 1, Cedarcrest Second Addition now zoned for Residential Use to Commercial Use, by unanimous vote of all Members of the Council present. 46 November 10, 1952 Planning Commission's Report on Rezoning - H. B. and P. V. Herman The Planning Commission's report dated November 6, 1952, on the petition of Howard B. and Palagia V. Herman for rezoning of Lots 232, 2312 2302 119, and 118, Richmond Addition from Residential Use to Commercial Use, was read. Action deferred until Owners give some idea of their plans for the property. American Municipal Association's Annual Conference On motion of Trustee Middleton, seconded by Trustee Bolmgren, John Palmer, L. P. Pederson and R. N. Ruedlinger of the Planning Commission, and Members of the Village Council who wish to go, were authorized to attend the Annual Con- ference of the American Municipal Association in Los Angeles, California, Dec- ember 1, 2, and 3, 1952, with necessary expenses paid, by unanimous vote of all Members of the Council present. Bingo - American Legion Letter from E. R. Seifert, Commander, Frank Lundberg Post #282, American Legion, St. Louis Park, dated November 7, 1952, requesting permission to play Bingo at the Legion Hall on Saturday evening, November 22, 1952; also on every Friday night thereafter beginning November 28, 1952, was read. No opposition. No action. Bingo - VFW Letter from Cyril C. Doyle, Commander, VFW Post #5632, St. Louis Park, dated October 8, 1952, requesting permission to play Bingo in the Post Hall on Sunday from 4:00 PM until 1.1:00 PM weekly for an indefinite period of time, commencing Sunday, November 9, 1952, was read. No opposition. No action taken. Mileage Approved for Wm. A. Reiners On the recommendation of R. B. Connery, Village Assessor, it was moved by Trustee Middleton, seconded by Trustee Bolmgren, that Wm. A. Reiners be allowed mileage for the use of his personal car in the performance of his duties for the Village at the rate of 7¢ per mile. Motion was passed by unanimous vote of all Members of the Council present. Bond Extension Approved Letter from Myles G. Iverson, VP, Iverson's, Incorporated, dated November 5, 1952, requesting the extension of their bond covering the grading of 33rd Street approximately 120 feet east of Webster Avenue, and stating that due to conditions beyond their control, they were unable to develop that property in 195?, was read. On motion of Trustee Bolmgren, seconded by Trustee Middleton, the above request for extension of bond covering the grading of 33rd Street approximately 120 feet east of Webster Avenue to July 1, 1953, was granted by unanimous vote of all Members of the Council present. Special Election, November 4th -_$10.000 Bond Issue for Water Treatment Plant On motion of Trustee Bolmgren, seconded by Trustee Middleton, the following resolution was adopted by unanimous vote of Al Members of the Council present: RESOLVED that the votes `case at the Special Election November 4, 1952 on the question of issuance of $1,650,000 bonds for water softening plant were as follows: For 3,014 Against 10,147 BE IT FURTHER RESOLVED that the question so proposed to the voters was not approved by the requisite majority of votes cast. /& Sewer Special Permit to Connect to Water Main/- C. Ed Christer 4 On motion of Trustee Bolmgren, seconded by Trustee Middleton, C. Ed. Christy was granted a special permit to connect a nine-inch sewer line to a manhole to be constructed in Hamilton Street,. 207.5 feet east of the center line of Dakota Avenue; said nine-inch sewer main to be constructed within an easement of 15 feet furnished to the Village of St. Louis Park for the purpose of maintenance and repair, said sewer to go north 118 feet from the center line of Hamilton Street to a manhole; the total cost of said sewer line shall be paid by the owner and all work shall be done under the direction and supervision of the Village Engineer. Motion was passed by unanimous vote of all Members of the Council present. Justice of Peace Report of Fines (Yngve) Justice of Peace Anton Yngve's report of fines dated November 11, 1952, was read and ordered filed. November 10, 1952 47 Complaint Re: Wrong Sewer Measurements J. N. Lind, Jr., 3731 Inglewood Avenue made a complaint about the bill tendered him by Motzko Plumbing Company for connecting his home to the Village Sewer line. He said Motzko Plumbing Company had given him an estimate of $185.00 for the job, but when completed, the amount was $336.80. He said that Motzko Plumbing Company claimed that the Village was partially responsible due to giving wrong measurements. Upon conferring with Village Engineer, Phil W. Smith who felt the reverse, no action was taken. Voting Situation Wm. Jaglo and Gavin Shaw appeared to discuss the voting situation at the Village Hall on November 4th. They were concerned about the long wait many people had before they could vote. It was explained to them that the Village Council had not had a chance to discuss this matter since the election, but that they would. Various ideas were set forth, but no action taken at this meeting. Planning Commission's Report on Request for Double Bungalow The Planning Commission's report on the request of Theodore R. Goldman for a permit to build a double bungalow on Lots 15 and 16, Sunset Gables Addition, was read. Due to lack of complete information, action was deferred until Mr. Goldman is contacted. Village Primary Election On motion of Trustee Bolmgren, seconded by Trustee Middleton, the Village Attorney was instructed to prepare a proposed bill to provide for Village Primary Election on the first Tuesday after the first Monday in November, and to contact Representative Bergerud and Senator Miller in regard to same, by unanimous vote of all Members of the Council present. Deferred Action on Request to Remove Sand & Gravel - Friedheim On November 3, 1952, the Village Council referred action to this meeting on the request of Chas. M. Freidhei-m & Company for permission to remove sand and gravel from his property north of the Great Northern Tracks and West of the Belt Line 'Highway. As no profiles or grades were ready, the Council again deferred action on this matter until same are brought in by Mr. Friedheim and the Village Engineer. Letter Re: Traffic Signals for T. H. #7 and Texas Letter from J. E. P. Darrell, Traffic Engineer, Minnesota State Highway Department, dated November 4, 1952, with reference to our request for traffic signals on Trunk Highway No. 7 and Texas Avenue, in which they state "that it appears that the matter is being handled very satisfactorily a present by the school authorities, and that they can see no justification for two sets of signals within such a short distance", was read, and the Clerk was instructed to send a copy -of said letter to the St. Louis Park Board of Education. Letter Re: Traffic Signals for T. H's #121 and #169 Letter from J. E. P. Darrell, Traffic Engineer, Minnesota State Highway Department, dated November 4, 1952, with regard to installation of traffic signals at the intersection of Trunk Highways #121 and #169 was read in which they state that they are willing to enter into an agreement with the Village covering the installation of traffic control equipment at this point. On motion of Trustee Bolmgren, seconded by Trustee Middleton, the following resolution was adopted by unanimous vote of all Members of the Council present: R E S O L U T I O N BE IT RESOLVED that the Village Council enter into an agreement with the State of Minnesota, Department of Highways for the following purposes: That the Village Council of the Village of St. Louis Park, Hennepin County, Minnesota agrees to pay one- fourth of the cost of installation of traffic signal equipment to be located at the intersection of Trunk Highways #121 and #169; and after installation agrees to assume all costs of maintainence and operation of same including the furnishing of electric power. BE IT FURTHER RESOLVED that the Mayor and Clerk be hereby authorized to execute such agreement.
