A regular meeting of the Village Council was called to order by Mayor
C. L. Hurd at 8:02 P. M.
Invocation was given by Reverend Roger Schmuck of St. Georges Episcopal
Church.

were referred to the Village Engineer and Chairman of the Sewer Department Com-
mittee for tabulation and recommendation, by unanimous vote of all Members of
the Council present.

No Bids Received for Water Main
As per advertisement for bids published in the St. Louis Park Dispatch
September 18, 1952, no bids were received for the construction of water main ext-
ension in Minnetonka Boulevard from Aquila Avenue to 834.0 Minnetonka Boulevard.
Hearing on Application for Rezoning - Billman Property -
Pursuant to notice published in the St. Louis Park Dispatch September 18,
1952, a public hearing was had on the application of Joe Billman to rezong from
Residential Use to Commercial Use, that portion of his property lying south of
the present Commercial Use District on which the Billman Mortuary is situated at
Wooddale Avenue and Excelsior Boulevard, which property is described as follows:
Commencing at a point which is S. 34. degrees
12.min. E. 279.62 feet from a point 6.06 chains
E. of S. W. corner of NW4 of NW4, Section 7,
Township 28, Range 24.; thence north 34 degrees
12 min. W. 120.3 feet; thence S. 67 degrees,W.
191 feet; thence S. 34 degrees 12 min. E. to a
point which bears south 55 degrees 4.8 min. west
from point to beginning;thence NEly to,beginning
Attorney H. Edelman appeared for Father Brady of Most Holy Trinity Church
in opposition to proposed rezoning. He left a letter and a number of cards signed
by parishoners of the church.
Joe Billman appeared in his own behalf for the rezoning. He feels that
the church could have put their front door on Wooddale Avenue. Said he has no
plans at present but needs it to be so rezoned that his entire 120 foot depth can
be used for Commercial. Mr. Edelman said that the church built as they did due
to the fact that the property inquestion was residentially zoned. He suggested
that the matter be referred back to the Planning Commission for further study and
checking for use it is to be put to.
On motion of Trustee Bolmgren, seconded by Clerk Justad, action on this
matter was deferred to meeting of October 20, 1952, by unanimous vote of all Mem-
bers of the Council present.

On motion of Clerk Justad, seconded by Trustee Bolmgren, action on above
was deferred to meeting of October 20, 1952, by unanimous vote of all Members of
the Council present.
Hearing on Proposed Widening and Grading of Street\
Pursuant to notices published in the St. Louis Park Dispatch September 18
and 25, 1952, a public hearing was had on proposed widening and grading of Yosemite
Avenue from 27th Street to 4.20 feet north by acquisition of the 30 feet lying
adjacent to and east of the present R/W and grading thereof. No persons appeared.
On motion of Trustee Bo1mgren; seconded by Clerk Justad, action on the above
was deferred to meeting of October 20, 1952, by unanimous vote of all Members of
the Council present.

Deferred Hearing on Application for Rezoning - Carl W. Sherer
Due to a death in the family of petitioner Carl W. Sherer, the hearing
scheduled for September 22, 1952 for the rezoning of Lots 15, 16, -and 17,
Block 3, Latham's Minnetonka Boulevard Tract from Multiple Dwelling Use to
Commercial Use was deferred to this meeting. Said hearing was called, and the
following persons appeared: Mr. Sherer appeared in favor of his petition.
Mayor Hurd asked him if in the event the rezoning was denied if he would still
ask for a special permit. He said no - he wants the property rezoned for
Commercial Use. He complained about the taking of trees from his front yard
when the Contractor was getting ready for sidewalk, and feels that the property
has been ruined thereby and feels that his only recompense would be rezoning.
Mr. Fred N. Furber appeared on behalf of St. Georges Episcopal Church
in opposition to rezoning the Sherer property to Commercial. He presented a
petition in opposition, signed by Jack L. Roberts and others. Mr. Sherer said
St. Georges Church have wanted to purchase this property. Jack Roberts, 5221
Minnetonka Boulevard said he purchased his property on the strength of the
property across the street being zoned Multiple Dwelling, and feels that rezoning
of same to Commercial Use would devaluate his and other properties in the area.
He does not feel that Kay Motors on the SE Corner of Salem and Minnetonka Blvd.
and Garden Village should have been permitted. Mrs. Sherer says her property
has been violated and they should be repaid with rezoning.
On motion of Trustee Bolmgren, seconded by Clerk Justad, action on above
matter was deferred to meeting of October 20, 1952, by unanimous vote of all
Members of the Council present.
Bus Detour
Matt Levitt appeared regarding the bus detour on Glenhurst Avenue from
Cedar Lake Avenue to 29th Street, due to France Avenue paving. He feels that
the busses should be ordered to travel slower to save the bumping, etc. and
that they should be routed on other streets for relief.
Mayor Hurd said the Twin City Rapid Transit Company would be contacted
tomorrow morning ans asked to slow up their busses; also the Police Department
would be ordered to check same. Jack Robbins, 29th -and Glenhurst said he has
called the Twin City Rapid Transit Company and they promised him they would
have the busses slowed down to 20 MPH but they have not adhered to same except
for one or two, and asked if the Village Council could please help them. He
asked how long before France Avenue paving would be done. Mayor Hurd said about
one month longer.
Ordinance No. 402
On motion of Trustee Bolmgren, seconded by Clerk Justad, the following
ordinance was adopted by unanimous vote of all Members of the Council present.
ORDINANCE NO. 402
AN ORDINANCE AMENDING AN ORDINANCE ADOPTED SEPTEMBER 29,
1952, REGULATING PRIVATE DRIVEWAYS INTERSECTIONS WITH
PUBLIC STREETS IN VILLAGE OF ST. LOUIS PARK, MINNESOTA
The Village Council of the Village of St. Louis Park ordains as follows:
Section 1. Section 2 of the Ordinance Regulating Private Driveway Inter-
sections with Public Streets adopted on September 29, 1952, is hereby amended to
read as follows:
"Section 2. No driveway from private property crossing a public sidewalk
and entering a public street of the Village shall be constructed in
excess of 22 feet in width at the center of the sidewalk line. Upon a
showing of necessity and public convenience, the.Village Council may
grant a variance permit allowing a greater width. The Village Engineer
shall determine at what angles the driveway may approach the curb line
from the sidewalk in order to provide for safe ingress and egress to
the driveway."
Section 2. Except as herein provided said ordinance adopted on September
29, 1952, shall remain in full force and effect.
Section 3. This ordinance shall take effect from and after its publication.
Petition for Rezoning
On motion of Trustee Bolmgren, seconded by Clerk Justad, the petition of
Edward B. Herman, dated October 6, 1952, for the rezoning of Lots 232, 2312 230,
119 and 118, Richmond Addition from residential use to commercial use, was referred
to the Planning Commission for checking and recommendation, by unanimous vote of
all Members of the Council present.

Variance Permit Granted for Driveway Openings
On motion of Trustee Bolmgren, seconded by Clerk Justad, a variance permit
was granted under Ordinance No. 401 as amended by Ordinance No. 402, to Western
Oil & Fuel Company for driveway openings for gasoline filling station on Lot 8,
Auditors Subdivision No. 323 as follows:
Two driveway entrances on Minnetonka Boulevard, west of existing pumps,
22 feet in width at the sidewalk line, measured at right angles to the flow of
traffic, one driveway 33 feet in width at the sidewalk line at the point of inter-
section of Lake Street and Minnetonka Boulevard, and one driveway 22 feet in width
at the sidewalk line on Lake Street which 22 feet is to be measured at right angles
to the flow of traffic.
The County Engineer is authorized and directed to provide for such driveway
openings in curbs now being constructed on the southerly side of Minnetonka Boule-
vard adjacent to said property.
Said permit is issued on condition that said Western Oil and Fuel Company
shall dismiss pending action in Hennepin County District Court for injunction
prohibiting restriction of said driveways. Motion was passed by unanimous vote
of all Members of the Council present.

Gas Main Extensions
On motion of Trustee Bo]mgren, seconded by Clerk Justad, the following gas
main extensions were approved by unanimous vote of all Members of the Council
present:

1952 Licenses
On motion of Trustee Bolmgren, seconded by Clerk Justad, the following
applications for 1952 licenses were approved, and the Mayor and Clerk were authori-
zed to issue licenses to expire December 31, 19522 by unanimous vote of all Members
of the Council present:

On motion of Trustee Bolmgren, seconded by Clerk Justad, due to Columbus
Day, a Village holiday falling on Sunday, October 12, 1952, Monday, October 13,
1952 was designated as a holiday for Village Employees, by unanimous vote of all
Members of the Council present.
Plat Accepted - Jeffrey James Fine Addition
On motion of Trustee Bolmgren, seconded by Clerk Justad, the plat of
JEFFREY JiUFES FINE ADDITION was approved and accepted, and the Mayor and Clerk
were authorized to sign same for the Village, by unanimous vote of all Members
of the Council present.
Bid Award - Sanitary Sewer No. 308
On motion of Trustee Bolmgren, seconded by Clerk Justad, the bid of St.
Louis Park Constructj�y received September 29, 1952, for the construction
of Sanitary Sewer No. 52-308 was determined to be the lowest bid of a responsible
bidder, and the Mayor and Clerk were authorized to execute contract for the
Village with St. Louis Park Construction Company for the work at price bid of
$1815247.00, by unanimous vote of all Members of the Council present.

On motion of Trustee Bolmgren, seconded by Clerk Justad, the bid of St.
Louis Park Construct4WGemq9afty received September 29, 1952, for the construction
of Sanitary Sewers #52-301 thru #52-307 was determined to be the lowest bid of
a responsible bidder, and the Mayor and Clerk were authorized to execute cotract
for the Village with St. Louis Park Construction Company for the work at prie
bid of $344,820.002 by unanimous vote of all Members of the Council present.
Bid Award__- Sanitary Sewer #52-429
On motion of Trustee Bolmgren, seconded by Clerk Justad, the bid of Western
Underground ConstructdlK Company received September 29, 1952, for the construction
of Sanitary Sewer and Lift Station (#52-429) was determined to be the lowest bid
of a responsible bidder, and the Mayor and Clerk were authorized to execute
contract for the Village with Western Underground Construction Company for the
work at price bid of $62,544.30, by unanimous vote of all Members of the Council
present.
Letter Re: Condition of Road (Bury & Carlson)
Letter from Bury & Carlson, Inc. dated October 4, 1952, in reply to our
letter of October 2nd, requesting that they oil or tar mat their private road to
the Gravel Pit, was read; stating that they have tried to keep this road oiled
to eliminate dust, and have -oiled it several times this year, the last time being
October 1st. The Clerk was instructed to mail a copy of this letter to Mr.
Elmer Lind, 1670 Lilac Drive South.
Execution of Permit AD -Droved for Underground Water Pipe
On motion of Trustee Bolmgren, seconded by Clerk Justad, the Mayor and Clerk
were authorized to execute for the Village, Permit No. 52617, dated March 13, 19512
covering location of an underground water pipe crossing the Great Northern Railway
tracts in the vicinity of Louisiana Avenue in the Village, by unanimous vote of all
Members of the Council present.
Letter of Apbreciation from Building Inspector
Letter from Building Inspector, Peter Stienstra, dated October 6, 1952,
thanking the Village Council for giving him the opportunity to attend the annual
Midwest Conference of Building Officials and Inspectors in Chicago, September
28, 29, and 30, 1952, was read and ordered filed.
Building Permit for Commercial Building Authorized
The Planning Commissions report dated October 2, 1952 on the request of
Ted Johnson, 4933 Elliot Avenue, Minneapolis, for a building permit to construct
a commercial building on the NW Corner of Pennsylvania Avenue and Highway #7
Service Road, was read.
On motion of Trustee Bolmgren, seconded by Clerk Justad, the Building
Inspector was authorized to issue building permit for the above building, providing
for 201 setbacks on both streets, by unanimous vote of all Members of the Council
present.

Planning Commission's Report on Petition for Rezoning
Planning Commission's report dated October 3, 1952, on petition signed by
57 residents and home owners living adjacent to the corner of Brunswick Avenue
and Excelsior Boulevard, for the rezoning of Lot A. Block 3, Brooklawns Addition
located on the NW Corner of the junction of the above streets, except that part
now zoned for residential use, from commercial use district to multiple use district,
was read.
On motion of Trustee Bolmgren, seconded by Clerk Justad, action on the above
matter was deferred to meeting of November 10, 1952, by unanimous vote of all
Members of the Council present.
Employee for Engineering Department - Fred Stimson
On the recommendation of Village Engineer, Phil W. Smith, it was moved by
Trustee Bo1mgren, seconded by Clerk Justad, that Fred Stimson be hired for work in
the Engineering Department, effective approximately October 20, 1952, at a wage
rate of $1.622 per hour, by unanimous vote of all Members of the Council present.
Polling Places and Election Judges for General Election
On motion of Trustee Bolmgren, seconded by Clerk Justad, the following places
were designated as Polling Places for the 1952 General Election to be held November
4, 1952:

Resolution
On motion of Trustee Bo]mgren, seconded by Clerk Justad, the following
resolution was adopted by unanimous vote of all members of the Council present: m�e
RESOLUTION ORDERING SPECIAL ELECTION
FOR VOTE ON PROPOSED WATER SOFTENING PLANT
WHEREAS plans and specifications for a water softening plant and'appurten-
ances have heretofore been prepared and submitted to the Village Council by
G. M. Orr Engineering Company pursuant to contract with the Village; a Citizens
Committee appointed by the Village Council to investigate and advise the Council
with respect to the proposed construction of such'a water softening plant in
its report dated April 9, 1951 recommended construction of such a plant, and
it appears necessary in order to finance such construction that general obli-
gation bonds of the Village be issued in the sum of $1,650,000, which is the
total cost of the project as estimated by said Engineer, therefore
BE IT RESOLVED by the Village Council of the Village of St. Louis Park
that it is hereby determined to be necessary and expedient to issue the
negotiable coupon bonds of the Village which shall be general obligations of the
Village payable out of general ad valorem tax levy and, to the extent that funds
may be available after payment of outstanding revenue bonds, from net earnings
of the water department of said Village, (it being understood that the Council
proposes to increase water rates for that purpose) said bonds to be in an amount
not to exceed $1,650,000.00 for the purpose of providing money to pay the cost
of construction of a water softening plant and all necessary appurtenances in
connection therewith for use in connection with the public water supply system of
said Village. Said bonds are to bear interest at a rate to be determined by
the Village Council upon receipt of bids for same.' The proposition for issuing
said bonds shall be submitted to the electors of said Village at a special
election which is hereby called to be held in and for the Village on the 4th day
of November, 1952, between the hours of 7 A.M. and'8 P. M. and which shall be
held concurrently with the State General Election which shall be held in the
Village on said day, and
BE IT FURTHER RESOLVED that the Clerk shall prepare ballots for the
machines for said election setting out the proposition in substantially the

instructed to write a`letter to the widow of former Village Employee Gunnar
Stromer, expressing their sympathy in the recent loss of her husband, by unanimous

resolution was adopted by unanimous vote of all Members of the Council present:
RESOLUTION AUTHORIZING APPLICATION
FOR CO VEYANCE OF TAX -FORFEITED LANDS
WHEREAS it appears that the tract of land hereinafter described has been
forfeited to the State of Minnesota for non-payment of taxes and said tract is now
being used and for some time in the past has been used,by the public as a street,
and•it is essential in the public interest that said tract be acquired by the
Village and designated as a public street; therefore
BE IT -RESOLVED by the Village Council of the Village of St. Louis Park that
the Mayor and Clerk be authorized to file application with the Auditor and State
Tax Commissioner for conveyance of the following tax -forfeited lands to the Village

Section 2. The proportionate cost of such service to the respective
properties served during said period is hereby determined to be as hereinabove
set forth, and the owners of the respective properties served for the respective
portions of said twelve month period above set forth shall be obligated to pay
the Village of St. Louis Park the respective sums above set forth depending upon
the length of time of service received, said sums to be due and payable October
1, 1952. In default of such payment there is hereby levied and assessed against
each and every lot or parcel of ground served by said garbage collection service
an assessment equal to the service charge above set forth and as now set out in
the proposed assessment roll for cost of garbage collection on file with the
Village Clerk, said assessment to be payable concurrent with taxes in the year
1952 and payable in the year 1953•
