M. Invocation was given by Reverend Orval Peterson of Oak Hill Baptist Church. On motion of Clerk Justad, seconded by Trustee Bolmgren, the construction of above proposed storm sewer was denied by the following roll call vote: Trustee Bolmgren, yea; Clerk Justad, yea; Mayor Hurd, yea. Trustee Jorvig not voting. Re Sanitary Sewer in Texas, 3300 Block With regard to sanitary sewer in Texas Avenue in 3300 Block now in contract with St. Louis Park Constructors. Village Engineer, Phil W. Smith was instructed to ask Contractor to start on this spot at once. Plumbing License On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the following application for 1952 license was approved, and the Mayor and Clerk were authorized to issue license to expire December 31, 1952, by unanimous vote of all Members of the Council present: Sachs and Company Plumbing Building Inspector's Weekly Report The Building Inspector's report for week ending October 24, 1952" showing that 17 building permits were issued, totaling $110,175.00, was read and ordered filed. October 27, 1952 Bonds On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the following bonds were approved by unanimous vote of Council Members present: PLUMBING LICENSE BOND with Abram Sachs and H. C. Olson, DBA Sachs & Company as principal, and Royal Indemnity Company as surety, dated October 24, 1952, in the amount of $ 42000. PUBLIC CONTRACTORS BOND with Western Underground Construction Company as principal, and Peerless Casualty Company as surety, dated September 8, 1952, in the amount of $19,402.70, covering the construction of sanitary sewer extensions Nos. 52-251 through 253, and 413. PUBLIC CONTRACTORS BOND with Western Underground Construction Company as principal, and Peerless Casualty Company as surety, dated September 29, 1952, in the amount of $ 76,048.30, covering the construction of sanitary sewer extensions No. 52-429. Petitions for Street Improvements On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the following petitions were referred to the Village Engineer and Chairman of the Street Depart- ment Committee for checking and recommendation, by unanimous vote of all Members of the Council present: P-1216 -- PETITION FOR CURB AND GUTTER, signed by Mrs. Mary B. Phillips, 3316 France Avenue and others, dated October 21, 1952, for the construction of curb and gutter on the WEST SIDE OF FRANCE AVENUE FROM RANDALL AVENUE TO 34TH STREET. P-1217 PETITION FOR SIDEWALK, signed by Mrs. ,Mary B. Phillips, 3316 France Avenue and others, dated October 21, 1952, for the construction of sidewalk on the WAST SIDE OF FRANCE AVENUE FROM RANDALL AVENUE TO 34TH STREET. Petition for Water Main On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the following petition was referred to the Village Engineer and Chairman of the Water Department Committee for checking and recommendation, by unanimous vote of all Members of the Council present: P-1219 PETITION FOR WATER MAIN, signed by C. P. Mc Cauley, 1600 South Lilac Drive and others, dated October 27, 1952, for the construction of water main in the WEST SIDE OF HIGHWAY NO. 100 FROM 16TH STREET TO CEDAR LAKE ROAD. , Street Light Ordered On motion of Trustee Bolmgren, seconded by Clerk Justad, the Northern States Power Company were ordered to install a street light at the NORTHEAST CORNER OF WEST 31ST STREET AND TEXAS AVENUE, by unanimous vote of all Members of the Council present. Petition for Stop Sign Petition signed by Mrs. Glenn L. Mc Learen, 3020 Texas Avenue and others, dated October 21, 1952, for a stop sign on Minnetonka Boulevard at Texas Avenue, was read. On motion of Clerk Justad, seconded by Trustee Bo1mgren, the above matter was referred to the Village Engineer to discuss with the Police Chief and bring in a proposal on same, by unanimous vote of all Members of the Council present. Bingo Letter from Dr. Warren J. Hanson, Vice President, Lenox School PTA, dated October 22, 1952, requesting permission to play Bingo at their Annual Carnival on Saturday, November 22, 1952, was read. No opposition. No action. 26 October,27, 1952 Ordinance No. 1�0�. - � On motion of Trustee Bolmgren, seconded by Clerk Justad, the following ordinance was adopted by unanimous vote of all Members of the Council present: ORDINANCE NO. 404 AN ORDINANCE PROVIDING FOR THE LICENSING, REGISTRATION AND REGULATION OF BYCYCLES The Village Council of the Village of St. Louis Park do ordain as follows: SECTION 1. No person shall ride or use a bicycle upon any public street, highway, boulevard or sidewalk in the Village of St. Louis Park, unless the same shall be licensed and registered as herein provided. SECTION 2. Every owner of a bicycle shall list and register with the Village Clerk, his name and address, the name of the manufacturer of his bicycle, its number, style and general description. SECTION 3. The Clerk shall provide a metallic license plate suitable for attachment upon the frame of a bicycle which shall be attached to the frame of each bicycle licensed and he shall issue a registration card to each licensee upon payment of the fee herein provided for. Such metallic license plate shall remain attached to the bicycle during the existence of such license. The Clerk shall keep a record of the date of issue of each license, to whom issued, and the number thereof. SECTION k. The license fee to be -paid for each bicycle shall be Fifty Cents ($.50). Upon loss of any tag or duplicate, and upon application and satis- factory evidence of such loss, a new tag or a new duplicate shall be issued upon payment of a fee of Fifty Cents ($.50). SECTION 5. Licenses issued hereunder shall be transferrable only upon furnishing the Clerk with satisfactory evidence of transfer of ,title to the trans- feree and paying a transfer fee of Fifty Cents ($.50). SECTION 6. Every license issued hereunder shall be deemed to be granted subject to the following conditions: A. No person shall ride or operate any bicycle upon any sidewalk in such a manner as to interfere with any pedestrian thereon. B. No person shall ride or operate a bicycle upon any public street or sidewalk with any other person upon such bicycle. C. No person shall ride or operate a bicycle upon any public street or sidewalk abreast or beside any person riding or operating a bicycle. D. No bicycle shall be operated on any street or other public highway, or sidewalk, of the Village between 30 minutes after sunset and 30 minutes before sunrise, without a headlight visible from the front thereof for not less than 200 feet, nor without a red tail light, or in lieu thereof a reflector attached to and visible from the rear of such bicycle for a distance of not less than 200 feet. No person under the age of 16 years shall ride or operate a bicycle upon any street, highway, or sidewalk at night between 30 minutes after sunset and 30 minutes before sunrise. E. Every person riding or operating a bicycle upon any public street, highway or sidewalk in the Village shall observe all traffic rules and regulations and shall signal for all turns, ride at the extreme right side of the street or highway, and shall pass to the right when meeting other vehicles. SECTION 7. The Clerk shall cause the foregoing regulations in Section 6 hereof to be printed and furnished to each licensee, ('and he shall issue the licenses)provided for herein to such applicants as he is satisfied are familiar with and understand the foregoing regulations, and have paid the license fee herein provided for. SECTION 8. The Village Council may cancel any license issued pursuant to this Ordinance if it is satisfied that the licensee 'has violated any provision hereof, or is unfit to ride or operate a bicycle on the street, highways or sidewalks of this Village. SECTION 9. This Ordinance shall take effect and be in force from and after its publication. SECTION 10. Ordinance No. 117 adopted June 16, 1937 is hereby repealed. October 27, 1952 27 Request for Permit to Erect Signs Letter from General Outdoor Advertising Company, dated October 15, 1952, requesting a permit for the erection of four signs, size 12 feet by 25 feet `each, to be located at 3922 Excelsior -Boulevard, was read. Ori motion of Clerk Justad,• seconded by Trustee Bolmgren, General Outdoor Advertising Company were granted a one-year permit for erection of above requested signs to be located as per sketch which accompanied request for same, by unanimous vote of all Members of the Council present. Resolution Ori motion of Trustee Jorvig, seconded by Trustee Bolmgren, the following resolution was adopted by unanimous vote of all Members of the Council present: RESOLUTION AUTHORIZING SETTLEMENT OF CLAIM FOR DAMAGES WHEREAS, Mr. N. W. Joubert, 5920 Minnetonka Boulevard, has made claim for damages which he alleges will result to his property from change in grade of the sidewalk adjacent to his property on Minnetonka Boulevard and there having been no acquisition of a slope easement on this property, and it appearing to the Council desirable that said claim be settled on the following basis, therefore BE IT RESOLVED by the Village Council that the Mayor and Clerk be authorized to enter into contract with said N. W. Joubert and his wife for settlement of any and- all claims for change of grade above referred to as follows: The Village will replace the existing hedge along the edge of the Joubert property adjoining Minnetonka Boulevard wherever the hedge will be destroyed because of the recons- truction of sidewalk. The Village will replace so much of the existing concrete walk from the sidewalk line on the Joubert property as will be necessary to provide a step or slope as directed by Mr. Joubert. The Joubert property adjoining Minnetonka Boulevard will be sloped to meet the new sidewalk grade, the slope to extend north from the sidewalk line not to exceed 30 feet, and the Village will repsod the new slope. The Jouberts will concent to waive any and all claims upon completion of the above by the Village. Resolution On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the following resolution was adopted by unanimous vote of all Members of the Council present: RESOLUTION CONSOLIDATING SANITARY SEWER IMPROVEMENTS T&EREAS, the Village Council heretofore ordered construction of sanitary sewer Improvement No. 52-213 in Xenwood Avenue from 32nd Street to 33rd Street by resolution adopted June 9, 1952, •and also by resolution adopted September 2, 1952, the Village Council ordered sanitary sewer extensions in-Lake Street from Yosemite Avenue to Minnetonka Boulevard and in Webster Avenue from Lake Street to Service Drive Highway No. 7, and WHEREAS, all of said sewers_ should properly be consolidated as one project and have been joined together by the Engineer in specifications for contract which has been entered into between ,the Village and Western Underground Construction Company dated October 13, 1952, therefore, BE IT RESOLVED by the Village Council of the Village of St. Louis Park that said improvements be hereby consolidated as Improvement No. 52-429. Survey of Village Owned Lot Ordered It was moved by Trustee Bolmgren, seconded by Trustee Jorvig that Park Surveyors be hired "to survey Village owned lot on the SE Corner of Raleigh Avenue and 27th Street. Motion was passed by unanimous vote of all Members of the Council present. Partial Payments on Contract Work On motion of Trustee Bolmgren,, seconded by Clerk Justad, the following partial payments on contract work in progress, presented by Village Engineer, Phil W. Levitt appeared with a plat of land showing the proposed extension of Miracle Mile Building east, to take in the present Rutherford Building west of Citizens State Bank. Pending suit was discussed, and Mr. Edelman accepted service for Shopping Service, Inc. On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the Building • Inspector was instructed to issue a building permit to Shopping Centers, Inc. and Wood-Excel Company, Inc. for the construction of a commercial use building 108 feet by 175 feet as per plat presented, dated August 12, 1952, the building to be entirely on the property zoned for commercial use immediately east of the present Miracle Mile buildings. Motion was passed by unanimous vote of all Members of the Council present. Petition Opposing Driveway (Turnaround) Glenhurst Place to -Huntington Ave. Petition signed by Everett Drake, 2608 Huntington Avenue and others, oppos- ing proposed driveway from Glenhurst Place to Huntington Avenue, through the lot adjacent to and south of the residence -known as 2613 Huntington Avenue, was read. Everett Drake appeared and explained .the 'reason for said petition. No action taken at this time. Judgment for Hospital Care - Margaret Senander Letter from Village Attorney, E. T. Montgomery, dated October 24, 1952, regarding the case of City of Minneapolis vs Village of St. Louis Park in the matter of payment of hospital care given at Minneapolis General Hospital to Mrs. Margaret Senander, was read. On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the Treasurer was authorized to to pay judgment in the amount of $565.79 (District Court File No. 485923) to the City of Minneapolis for the care of Margaret Senander at the Minneapolis General Hospital in 1949 and 1950, by unanimous vote of all Members of the Council present. Hearing on Proposed Water Main Extension A hearing was had on proposed extension of Village water main in Glenhurst Road from Forest Road north to turn around at end of Glenhurst Road, and in High- wood Road from Glenhurst Road to the turn around at the end of Highwood Road. The following persons appeared: L. L. Charlson, 2212 Glenhurst Road appeared in opposition to water main in Glenhurst Road from Forest Road to Cedar Lake Road. Resolution On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the following resolution was adopted by unanimous vote of all Members of the Council present: RESOLUTION ORDERING WATER MAIN WHEREAS the Village Council has met at the time and place specified in the notice relating to' the proposed water main extensions hereinafter described and has heard all interested persons appearing at said meeting, which notice was published in the St. Louis Park Dispatch October 9th and 16th, 1952, and the Council having determined the necessity for said improvements, therefore BE IT RESOLVED by the Village Council of the Village of St. Louis Park that the Village water main be hereby ordered extended in Glenhurst. Road from Cedar Lake Road to turn around at north end of Glenhurst Road, and in Highwood Road from Glenhurst Road to turn around at endof Highwood Road, said improvement to be designated as Improvement No; 52-446 , the same to be done in accordance with plans and specifications prepared by the Village Engineer which are hereby approved. Hearing on Proposed Street Improvements Separate hearings were had on proposed street improvements numbered 52-438, 52-439 and 52-440. The following persons appeared: John Keeley, 3804 Princeton Avenue and Mrs. Anna Scherbing, 3810 Princeton Avenue appeared in opposition to 52-438. Mrs. R. A. Engstrand,• 3805 Princeton Avenue, Mrs. Robert Acter, 3801 Princeton Avenue, W. J. Dean, 4810 West 38th Street, and Robert Johnson, 3811 Princeton Avenue appeared in favor of 52-438. No one appeared regarding 52-439. Mr. Hedberg appeared and asked what was to be done, and he was referred to Village Engineer, Phil W. Smith. No one appeared. -Resolution On motion of Clerk Justad, seconded by Trustee Bo1mgren, the following-reso- lution was adopted by unanimous vote of all Members of the Council present: RESOLUTION ORDERING SEWER EXTENSION WHEREAS, the Village Council has met at the time and place specified in the notice relating to the proposed sanitary sewer extension hereinafter described, and has heard all interested persons appearing a said meeting, which notice was published in the St. Louis Park Dispatch October 9th and 16th, 1952, and the.Council having determined the necessity for said improvement, therefore - BE IT RESOLVED by the Village Council of the Village of St. Louis Park that sanitary sewer be hereby ordered extended in 39th Street from manhole 165 feet east of Huntington Avenue to Huntington Avenue, said improvement to be - designated as Improvement No. 52-445, the same to be done in accordance with plans and specifications prepared by the Village Engineer which are hereby approved. Bids for Sanitary Sewer Construction - 52-445 f As advertised in the St. Louis Park Dispatch October 16, 1952, sealed bids were received and publicly opened and read from the following bidders for the construction of sanitary sewer extension in 39th Street from manhole 165 feet east of Huntington Avenue to Huntington Avenue: 1. Orfei & Mariani $1,397.50 2. Peter Lametti 1057.00 3. Western Underground Construction Company 1070.00 4. Wm. Terry Excavating 1,262.50 5. Lametti and Sons 1,269.50 On motion of Trustee Jorvig, seconded by Trustee Bolmgren, the above bids were referred to the Village Engineer and Chairman of the Sewer Department Com- mittee for tabulation and recommendation, by unanimous vote of all Members of the Council present. Later Village Engineer, Phil W. Smith presented his tapulation and recommendation on the above sewer bids, and stating that he is very anxious to start and complete this contract before the freeze-up. Bid Award On the recommendation of the Village Engineer, it was moved b�r,Trastee Bo]mgren, seconded by Trustee Jorvig, that the bid of William Terry Excavating Company received this meeting was the lowest bid of a responsible bidder for -the construction of sanitary sewer in 39th Street from manhole 165 feet east of Huntington Avenue to Huntington Avenue, and the Mayor and Clerk were authorized to execute contract for the Village with Wm. Terry Excavating Company for the work at price bid of x$1,262.50, by unanimous vote of all Members of the Council present. October 27, 1952 Agreement and Assignment On motion of Trustee Jorvig, seconded by Trustee Bolmgren, the assignment to B. B. Whitman of the agreement dated July 1, 1946 between the Village of St. Louis Park and J. E. Davis with regard to lease for use of Lot 2, Block 4, Sunset Gables Second Division, was approved, and the Mayor was authorized to, sign "Consent of Lessor" for the Village, by unanimous vote of all Members of the Council present.
