Hearing on Application for Rezoning Pursuant to notice published in the St. Louis Park Dispatch August 22, 1951, a public hearing was had on the application of Minneapolis Glass Company to rezone Lots 111 to 116 inclusive, Richmond Addition (SE corner of Wayzata Boulevard and Idaho Avenue) from Residential Use to Commercial Use, in order to construct a retail glass store thereon. The following persons appeared: Mr. and Mrs-. Jack Lash and J. C. Wilson. They were told that property would be rezoned only for the Minneapolis Glass Company's project. Ordinance No. 383 On motion of Trustee Perkins, seconded by Trustee Bolmgren, the following ordinance rezoning the above ddscribed property for construction of a retail glass store as per sketches presented, was adopted by unanimous vote of the Coun- cil: ' ORDINANCE NO. 383 AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE VILLAGE OF ST. LOUIS PARK The Village Council of the Village of St. Louis Park ordains: Section 1. The Zoning Ordinance of the Village of St. Louis Park adopted January 20, 1932, as heretofore amended, is hereby further amended by reclassification of the area of the respective use districts as defined in Section 2.2 of said ordinance and the use district maps therein referred to as follows: Lots One hundred eleven (111) to One Hundred Sixteen (116), inclusive, Richmond Addition shall be deleted from the residence use district and shall be included within the Commercial District and shall be subject to all the regulations of said ordinance relating to the Commercial Use District, provided that the said premises be improved within one year from date herof by construction of a build- ing for Minneapolis Glass Company conforming to plans filed with the Village Clerk, otherwise this Ordinance to be of no effect and the above rezoning to be void. l Section 2. This Ordinance shall take effect from and after its publi- cation. Building Permit for Commercial Building On motion of Trustee Bolmgren, seconded by Trustee Perkins, the Building Inspector was instructed to issue a Building Permit to Minneapolis Glass Co. for permit to erect a -commercial building on Lots 111, 112, 1132 115, 1162 Richmond Addition, by unanimous vote of the Council. ® September 4, 1951 Hearing on Proposed Sewer Assessment Pursuantto notice published in the St. Louis Park Dispatch August 22, 1951, a public hearing was had on proposed assessment for the construction of sanitary sewers for Sanitary Sewer District 1-S --- In Ottawa Avenue from Lot 3, Block 2, Woodridge, North to West 27th Street, and in 27th Street to Princeton Avenue; also in Princeton Avenue from 27th Street to Ottawa Place, and in Ottawa Place from Princeton Avenue to Ottawa Avenue, which has been_ duly approved by the Village Council and is on file in the office of the Village Clerk. No persons appeared. Village Attorney; E. T. Montgomery advised that Sanitary Sewer District 1-S had already been assessed. No action taken. Trustee Jorvig Trustee Jorvig arrived at the meeting at this time -- 9:08 P. M. Assessment Hearings Pursuant to notice published in the St. Louis Park Rispatch August 1, 1951, separate hearings were had upon each of the proposed assessments for the improvements described in the following resolution. Application for Licenses to Sell 3.2 Beer - On -Sale and Off -Sale Application for licenses to sell 3.2 beer on -sale and off -sale, made by Mrs. Dorothy J. Mc Donald, owner of Old Dutch Grill, 7121 Wayzata Boulevard, dated September 4, 1951, was read; On motion of Trustee Perkins, seconded by Trustee Bolmgren, the above mentioned application for a license to sell 3.2 Beer Off -Sale was approved, and the Mayor and Clerk were authorized to issue same to expire December,31, 1951; and the application for a license to sell 3.2 Beer On -Sale was denied, and the Clerk was instructed to refund the $100.00 fee left with application upon the receipt of a verified claim signed by the Applicant. Motion was passed by un- animous vote of'the Council. Letter Opposing Proposed Bus Route (26th & Lynn, Etc.) A letter from Everett A. Drake, 2608 Huntington Avenue, Dated August 30, 1951, opposing the proposed bus route on 26th Street to Lynn Avenue, Etc. was read and ordered placed on file for future reference. Petition, and_ Lette'r'OAposinP_:Curt ailment of Bus Service on Minnetonka Boulevard A petition presented by Harold Kaplan of the St. Louis Park Theatre Company, signed by several hundred residents of the area of Minnetonka Boulevard from Joppa to Webster Avenues and 28th to 31st Streets opposing any curtailment of bus service on Minnetonka Boulevard; and letter from Harold D. Field, dated September 4, 1951, opposing same, were read and ordered filed for future reference. Letter Re: Hiring a Doa Catcher A letter from Arthur C. Bredesen, Jr., Trustee; Village Council of Edina, dated August 28, 1951, suggesting that the Villages of Robbinsdale, Golden Valley, St. Louis Park, Richfield and Edina cooperate in hiring a full time Dog Catcher, was read. Clerk Justad was asked to work with Mr. Bredesen on this matter. Report of Railroad and Warehouse Commission Re: Authority to Establish-& Maintain a Highway Grade Crossing at W 34th & G.N. Railroad RM A report dated August 28, 1951, from the Minnesota Railroad and Warehouse Commission, on the request of the Village Council of St. Louis Park for authority to establish and maintain a Highway Railroad Grade Crossing at the point where West 34th Street, a public street in the Village of St. Louis Park, when extended, crosses the R%1 and tracks of the Great Northern Railway Company in Section 18, Township 117, Range 21, was read and ordered filed. Draftsman for Assessor's Office On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the Clerk was authorized to hire a draftsman to put material received from the County Auditor's Office on plat book in Assessor's Office, at wage rate of $1.75 per hour, by unanimous vote of the Council. 2 September 4, 1951 Sidewalk Bond On motion of Trustee Perkins, seconded by Trustee Bolmgren, the bond furnished by Warren P. Bostrom of St. Louis Park as principal, and Leslie W. Stien of St. Louis Park as surety, dated August 29, 1951, in the amount of $500.00, covering the construction of sidewalk in front of Lot 18, Block 1, Adolph Fine's Addition to St. Louis Park, was approved by unanimous vote of the Council. Letter Re: Damage to Tree A letter from Mrs. D. Saucier, 4380 Wooddale Avenue, dated September 3, 1951, reporting serious damage to a boulevard oak tree on their property during the recent laying of sewer in Wooddale Avenue, was read. On motion of Trustee Jorvig, seconded by Trustee Bolmgren, the Village Engineer was asked to contact Sewer Contractor and have this damage repaired, by unanimous vote of the Council. Street LiKhts Ordered On motion of Trustee Perkins, seconded by Trustee Bolmgren, the Northern States Power Company was ordered to install street lights at the corner of Lynn Avenue and 362 Street, and at France Avenue at 26th Street, east of France Avenue, by unanimous vote of the Council. Petition for Sanitary Sewer On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the following petition was referred to the Village Engineer and Chairman of the Sewer Depart- ment Committee for checking and recommendation, by unanimous vote'of the Council: P-943 PETITION FOR SANITARY SEWER, signed by Mr. and Mrs. Eugene E. Johnson, 7810 West Lake Street and others, dated September 4, 1951, for the construction of Sanitary Sewer in WEST LAKE'STREET FROM WOODLAND DRIVE TO PENNSYLVANIA AVENUE. Special Permit to Connect to Water Main On motion of Trustee Bolmgren, seconded by Trustee Perkins, a special permit was granted to James'R. Rice to connect his home now under construction at 4242 Ottawa Avenue to the water main located in 422 Street for water service, with the understanding that an assessment of $252.00 will be paid at the time the permit is taken out, said payment to be credited to amy future assessment when the water main is constructed past this property. Motion was passed by unanimous vote ofthe Council. 1 1 1 September 4, 1951 483 Bid Awarded for Sidewalk Construction On motion of Trustee Bolmgren, seconded by Trustee Perkins, Victor Carlson and Sons, Incorporated bid received this meeting for the construction of sidewalk (Improvements Numbered 51-104 to 51-114 cinlusive), was deemed to be the lowest bid of a responsible bidder, and the Mayor and Clerk were authorized to execute contract with Bidder for the work at price bid of 65¢ for excavation, 45¢ for 32 inch walk and 25¢ for 22 inch walk. Motion was passed by unanimous vote of the Council. Hearing Date Set for Tar Mat On motion of Trustee Perkins, seconded by Trustee Bolmgren, October 1, 1951 was set as date for hearing for the application of tar mat to (51-263) Wooddale Avenue from 35th Street to North Service Drive of State Highway No. 7, and to (51-264) 35th Street from Wooddale Avenue to North Service Drive of State Highway #71 by unanimous vote of the Council. Hearing Date Set for Sanitary Sewer On motion of Trustee Bolmgren, seconded by Trustee Jorvig, October 1, 1951 was set as date for hearing on proposed sanitary sewer No. 51-262, in Webster Avenue from 26th Street to 250 ft. South to serve Lots 1 &o 6 and 25 to 30 inclusive, Block 1, American Security Investment Company's Addition, which lots are the area proposed to be assessed. Motion was passed by unanimous vote of the Council. Advertise for Bids for 1/2 Ton Pickup On motion of Trustee Bolmgren, seconded by Trustee Perkins, the Clerk was instructed to advertise for bids for One (1) 1/2 Ton Pickup truck for the water department, bids to be opened September 24, 1951, by unanimous vote of the Council. Advertise for Bids for Rust Arrestors ,On motion of Trustee Bolmgren, seconded by Trustee Perkins, the Clerk was instructed to advertise for bids for the furnishing of cathodic protection equip- ment for four steel water tanks, bids to be opened September 25, 1951, by unanimous vote of the Council. Advertise for Bids for Radio Communication Equipment On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the Clerk was instructed to advertise for bids for furnishing of two-way radio communication equipment for Water Department trucks and Transmission Station, bids to be opened October l 1; , -1951; ,,by 'unanimous vote of the Council. American Water Works Meeting On motion of Trustee Perkins, secohded by Trustee Jorvig, all Councilmen, Village Engineer and Water Superintendent were authorized to attend the Minnesota Section, American Water Works meeting to be held at the Nicollet Hotel, Minneapolis, September 12, 13, and 14, 1951, with necessary expenses paid, by unanimous vote of the Council. Resolution On motion of Trustee Perkins, seconded by Trustee Bolmgren, the following resolution was adopted by unanimous vote of all members of the Council present: RESOLUTION CHANGING THE DISBURSING AGENT DESIGNATED FOR IMPROVEMENT BONDS BE IT RESOLVED by the Village Council in order to comply with request of John Nuveen & Company & Associates, as purchasers of $465,000 Improvement Bonds of the Village to be dated September 1, 1951, The American National Bank & Trust Company of Chicago, Chicago, Illinois is hereby designated as disbursing agent to be named in said bonds and the Village Treasurer is authorized to make payment of principal and interest as the same matures upon said bonds to said bank as disbursing agent of the Village and to pay said bank for its services its custom- ary charge for acting as such disbursing agent. Curb and Gutter Authorized On motion of Trustee Perkins, seconded by Trustee Bolmgren, Victor Carlson and Sons, Incorporated were authorized to proceed with the construction of curb and gutter at the following locations in Texa-Tonka Addition, including same in their Contract #115 at prices specified therein, by unanimous vote of Council Members present: Both Sides Texa-Tonka Avenue from Virginia Avenue to Virginia Avenue East Side Virginia Avenue from Texa-Tonka Avenue to Texas Avenue West Side Texas Avenue from Lots 12 through south line of Lot 1, Rearrangement in Part of Block 2. Engineering Report on Garbage.& Refusal -Disposal A proposal from G. M. Orr Engineering Company, dated August 13, 1951, to furnish ars engineering report on the Villages problem of garbage and refuse disposal, was read. On motion of Trustee Perkins, seconded by Trustee Bolmgren, the proposal of G. M. Orr Engineering Company was approved, and the Mayor and Clerk were authorized to execute agreement with them for the work, by unanimous vote.of the Council., said agreement to be prepared by the Village Attorney. 486 September 4, 1951 Resolution On motion of -Trustee Bolmgren, seconded by Trustee Perkins, the following �7 resolution was adopted by unanimous vote of all members of the Council present: �C RESOLUTION AUTHORIZING INJUNCTION PROCEEDINGS WHEREAS, it appears to the Village Council of the Village of St. Louis Park that Ruth Commers and Don G. Commers, owners and occupants of premises known as 3259 Zarthan Avenue, and have been for more than one year prior hereto conduct- ing a retail ready to wear business in said residence within the residence use district; that said business is not -in the nature of a home occupation engaged in solely by occupants of the home and is in violation of the Zoning Ordinance of the Village; that the Council has been informed that the said Ruth Commers and Don G. Commers intend to continue the operation of said business at said location, therefore, BE IT RESOLVED by the Village Council of the Village of St. Louis Park that the Village Attorney be hereby authorized to commence an action in the District Court of Hennepin County in behalf of the Village for the purpose of en- joining and restraining said Ruth Commers and Don G.
