HomeMy WebLinkAbout1951/09/10 - ADMIN - Minutes - City Council - Regular486 September 4, 1951 Resolution On motion of -Trustee Bolmgren, seconded by Trustee Perkins, the following �7 resolution was adopted by unanimous vote of all members of the Council present: �C RESOLUTION AUTHORIZING INJUNCTION PROCEEDINGS WHEREAS, it appears to the Village Council of the Village of St. Louis Park that Ruth Commers and Don G. Commers, owners and occupants of premises known as 3259 Zarthan Avenue, and have been for more than one year prior hereto conduct- ing a retail ready to wear business in said residence within the residence use district; that said business is not -in the nature of a home occupation engaged in solely by occupants of the home and is in violation of the Zoning Ordinance of the Village; that the Council has been informed that the said Ruth Commers and Don G. Commers intend to continue the operation of said business at said location, therefore, BE IT RESOLVED by the Village Council of the Village of St. Louis Park that the Village Attorney be hereby authorized to commence an action in the District Court of Hennepin County in behalf of the Village for the purpose of en- joining and restraining said Ruth Commers and Don G. September 18, 1951 Set for Bus Meeting A number of persons were present regarding bus service for 28th Street North from France to Monterey Avenues. It was determined to have a meeting re- garding this at the New Fern Hill School, Tuesday, September 18, 1951, at 8:00 P. M. das Main Extension On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the following gas main extension was approved by unanimous vote of the Council: #353 In Goodrich Avenue from 127' E E Walk Yosemite Avenue to Aldersgate Methodist Church. Application for Off -Sale Liquor License On motion of Trustee Perkins, seconded by trustee Bolmgren, the application of Henry E. Kent, 6325 Minnetonka Boulevard for an Off -Sale liquor license was read and referred to the Committee of the Whole, by unanimous vote of the Council. Report on Extension of Bus Route Minn. Railroad and Warehouse Commission A report from the Minnesota Railroad and Warehouse Commission, dated September 6, 1951, in the matter of the petition of the Village of St. Louis Park, Minnesota for an extension of the route of the Minneapolis Street Railway Company in the Village of St. Louis Park was read and ordered filed. Street Lights Ordered On motion of Trustee Perkins, seconded by Trustee Jorvig, the Northern States Power Company was ordered to install street lights at the following loca- tions, by unanimous vote of the Council: Corner of 26th Street and Jersey Avenue Corner of 26th Street and Kentucky Avenue Corner of 27th Street and Kentucky Avenue Request for Permit to Build Incinerator A builder of incinerators asked for a permit to build an incinerator for Warner Hardware Company at their store in the Miracle Mile. He was referred 488 September 102 1951 Lead and Copper Pipe Connections for Water Main On motion of Trustee Perkins, seconded by Trustee Jorvig, the matter of lead and copper pipe connections for water main in Parkview Addition was re- ferred to Trustee Bolmgren for a complete report, by unanimous vote of the Council. Application for Permit to Erect Gas Station - Adolph Fine The Planning Commissionts report dated September 7, 1951s on the request of Adolph Fine, Contractor for permit to erect a one story gas station and four small store spaces in one building to be located on the unplatted area 1321 wide by 1301 deep on the NE Corner of Minnetonka Boulevard and Texas Avenue, with a 20 ft. setback for the pumps from the Boulevard, a-40 ft: setback for the building from both streets, and 5 feet from the E boundary of the property, and facades finished to harmonize with the surrpundings, was read. On motion of Trustee Perkins, seconded by Trustee Jorvig, the above request was approved, and the Building Inspector was authorized to issue permit for same, by unanimous vote of the Council. Letter Offering to Sell Lots to Village - Terry Brothers, Inc. A letter from Yngve and Yngve, Attorneys for Terry Brothers, Incorporated, dated September 10, 1951, offering to sell Lot 30, Block 170, and Lot 28, Block 330, Rearrangement of St. Louis Park for $10,000.00, was read. Action was deferred to meeting of September 17, 1951. Application for Permit to Erect Store Building M. L. Gordon The Planning Commission's report dated September 7, 1951, on the request of M. L. Gordon, 2824 Vernon Avenue, for permit to erect a one story store building on Lots 1 thru 4s Block 34,*Rearrangement of St. Louis Park (SW Corner of Dakota Avenue and Walker Street) was read. On motion of Trustee Jorvig, seconded by Trustee Bo]mgren, the above request was approved, and the Building Inspector' was authorized to issue permit for same, subject to his approval of same, by,.unanimous vote of the Council. Application for Off -Sale Liquor License L. V. Foye On motion of Trustee Perkins, seconded by Trustee Bolmgren, the applica- tion of L. V. Foye for an off -sale intoxicating liquor license was read, and referred to the Committee of the Whole, by unanimous vote of the Council. Application for On -Sale Liquor License Douglas L. Bond Approved On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the following bond was approved by unanimous vote of the Council: CONTINUATION CERTIFICATE for Plumbing License Bond No. 84064-12-974-50, with Allen 0. Larson, DBA Paragon Plumbing Company, dated October 23, 1951, in the amount of $4,000.00, and United States Fidelity and Guaranty Company as surety. Justice of Peace Report of Fines - Linnee Justice of Peace E. A. Linnee's report of fines, dated August 31, 1951, was read and ordered filed. Justice of Peace Report of Fines - Yngve Justice of Peace Anton Yngve's report of fines dated September 1, 1951, was read and ordered filed. Building Inspector's Weeklv Reports The Building Inspector's reports for week ending August 31, 1951, showing that 37 building permits were issued, totaling $156,350.00; and week ending September 7, 1951, showing that 10 permits were issued, totaling $22,200.00, were read and ordered filed. Bid Awarded for Gradi On motion of Trustee Perkins, seconded by Trustee Bolmgren, the bid of Terry Brothers, Incorporated received September 4, 1951, for grading Jobs 51-88, 51-89, 51-90, 51-91, 51-93 and 51-195, was deemed to be the lowest bid of a responsible bidder, and the Mayor an& Clerk were authorized to execute contract with the bidder for the work at price bid -of $12,868.10, by unanimous vote of the Council,_except 51-195 which will be decided on September 24, 1951. Rex Pickett On motion of Trustee Perkins, seconded by Trustee Bolmgren, the letter from Rex Pickett, dated September 6, 1951, relative to special permit to connect his home to water main and special assessment for same, was read and referred to the Water Superintendent and Chairman of the Water Department Committee for checking and report, by unanimous vote of the Council. Hearing on Petition for Alley Vacation Pursuant to notice published in the St. Louis Park Dispatch August 30, 1951, a hearing was had on the petition of Mrs. Gertrude Swanson, 4013 West 31st Street and others, for the vacation of Alley in Block 6, Manhattan Park Addition to St. Louis Park. No one appeared in opposition. Resolution On motion of Trustee Perkins, seconded by Trustee Jorvig, the following resolution was adopted by unanimous vote of all members of the Council present: RESOLUTION VACATING ALLEY WHEREAS, the Village Council has met at the time and place specified in a notice relating to vacation of alley in Block 6, Manhattan Park, published in the St. Louis Park Dispatch August 30, 1951, which notice was also duly posted in three public places in said Village, and the Council has at said meeting heard all interested persons relating to said petition and having determined that said alley has never been graded or used as such and serves no public purpose, therefore, Purchase of Typewriter Authorized The proposal of Royal Typewriter Company, Incorporated, dated September 7, 1951, for the furnishing of One (1) Royal 11" Elite Typewriter for the Clerk's Office at On a net price of $137.50, was read. motion of Trustee Perkins, seconded by ' Trustee Bolmgren, the above proposal was approved, and the'Clerk was authorized to purchase One (1) Royal 11" Elite Typewriter at price bid, by unanimous vote of the Council. Hearing on Proposed Sanitary Sewer Extensions A hearing was had on proposed extension of sanitary sewers to serve Lots 3, 4, 9, 10, 11 and 12, Minikanda Park Addition, as Improvement No. 51-265. Jerome Segal appeared in behalf of the petition, and there were no opponents. Resolution On motion of Trustee Bolmgren, seconded by Trustee Perkins, the following resolution was adopted by unanimous vote of all members of the Council present: RESOLUTION ORDERING SEWER EXTENSIONS WHEREAS, the Village Council has met at the time and place specified in a notice relating to the following sewer extensions published in the St. Louis Park Dispatch August 22-amd 291,, 1951, and has heard all permons appearing at said meeting and determined the necessity for said improvement, therefore, BE IT RESOLVED by the Village Council of the Village of St. Louis Park that sanitary sewer be extended in Glenhurst Avenue from 39th Street to South end to serve Lots 3, 43 9, 10, 11 and 12, Minikanda Park Addition in accordance with plans and specifications for the same which have been prepared by the Village Engineer and which are hereby approved, and the Clerk is authorized to advertise for bids for the same to be opened October 15 1951. Hearing Date Set to Discuss Sewers for Brooklawns_ A group of residents from Brooklawns appeared to get information on sewers for their district. They were given two figures - one with Brunswick and one without Brunswick. Questions were asked on why the cost is higher than Lauderdale, when the contract would be started and completed, how much the lift station would cost them, the amount of front footage cost, and whether or not dust coat will be put on after the sewer is in until the tar mat is applied. They asked why sewer was cheaper in Robbinsdale. They were told that (1) no sheathing, (2) no stubs to curb line, (3) no repair of streets. It was suggested that a meeting be had with the Village Engineer and folks from Brooklawns be had. On motion of Trustee Bolmgren, seconded by Trustee Perkins, a meeting was set for 7:00 P. M., Friday, September 14, with Village Engineer, Phil W. Smith and all the folks in Brooklawns Addition to discuss the matter of sewers for Brooklawns, by unanimous vote of the Council. Hearing on Proposed Street Improvement A hearing was had on proposed paving of France Avenue from 27th Street to Minnetonka Boulevard. No one appeared. Resolution On motion of Trustee Perkins, seconded by Trustee Jorvig, the following resolution was adopted by unanimous vote of all members of the Council present:, RESOLUTION ORDERING STREET PAYING WHEREAS, the Village Council has met at the time and place specified in a notice published in the St. Louis Park Dispatch August 23 and 30, 1951, relating to the following street improvement and has heard all interested persons appearing at said meeting and determined the necessity for said improvement, therefore, BE IT RESOLVED by the Village Council of the Village of St. Louis Park that France Avenue from 27th Street to Minnetonka Boulevard be improved by paving, provided that an agreement be entered into jointly between the Village, the County of Hennepin and the City of Minneapolis for said improvement, the terms of which shall be subject to approval by the Village Council. Hearing on Proposed Street Improvements Separate hearings were had on proposed street improvements 51-224 to 51-231 inclusive. The following persons appeared -in opposition to Improvement No. 51-230: R. L. Bohlig, 2853,,George Dycie, 2801, Ed O'Neil, 2$29, H. Wilson, 2805,'Messrs. White, 2809, Pfeiffer, 2816, Sjerven, 2821, Kirkpatrick, 2813, and Brown, 2825 --- all on Colorado Avenue. BE IT FURTHER RESOLVED that 51-224 to 51-226 inclusive be included in contract heretofore authorized between the Village and Ashworth & Son, dated August 27, 1951. Hearing on Proposed Sanitary Sewer Extensions Separate hearings were had on proposed sanitary sewer extensions 51-238 to 51-241 ihclusive and 51-84. The following persons appeared: Nels Larson appeared in opposition to 51-242 (In 'Jersey Avenue from 31st Street to 33rd St.). He said folks understand that the sewer would be connected right to their homes while being installed. Resolution On motion of Trustee Bolmgren, seconded by Trustee Perkins, the following resolution was adopted by unanimous vote of all members of the Council present: RESOLUTION ORDERING SEWER EXTENSIONS WHEREAS, the Village Council has met at the time and place specified in a notice published in the St. Louis Park Dispatch August 22 and 29, 1951, relat- ing to sanitary sewer extensions, and has heard all interested persons and determined the necessity for the improvements ordered herein, therefore, BE IT RESOLVED by the Village Council of the Village of St. Louis Park that Village sanitary sewer extensions be ordered at the following locations in said Villages: IMPROVEMENT NUMBER LOCATION 51-238, Colorado Avenue from 37th Street to Oxford Street 51-84 Colorado Avenue from Goodrich Avenue to Oxford Street _51-239 37th Street from Brunswick Avenue to Colorado Avenue 51-240 37th Street from Colorado Avenue to Dakota Avenue 51-244 Dakota Avenue from 37th Street to Oxford Street .51-241 Jersey Avenue from Minnetonka Boulevard to 31st Street 51-242 Jersey Avenue from 31st Street to 33rd Street 51-243 Natchez Avenue from 310 ft. North of 31st Street according to plans and specifications which have been prepared by the'Village Engineer and which are hereby approved, and the Village Clerk is authorized to 492 -September 10, 1951 Resolution Ordering Sewer Extensions, Cont'd. advertise for bids for construction of said sewers to be opened October 15 1951, advertisement to provide that Improvement No. 51-242 and No. 241 may be removed by the Council at the time of letting of the bids, and the Council reserves the right to reconsider said sewer extension at said time. Hearing on Sewer Assessments Districts 2-H, 2-I, 2-J Pursuant to notice published in the St. Louis -Park Dispatch August 22 1951 public hearings were had on proposed assessments covering the cost of sanitary sewer extensions which have been previously ordered, and which proposed assess- ments are on file in the office of the Village Clerk, for Districts 2-H, 2-I and 2-J. No one'appeared. Resolution On motion of Trustee Jorvig, seconded by Trustee Perkins, the following resolution was adopted by unanimous vote of all members of the Council present: Assessment Resolution WHEREAS, pursuant to notice published in the St. Louis Park Dispatch August 223 1951, the Village Council has met and passed upon proposed assessments for construction of sanitary sewers for Sanitary Sewer Districts Nos. 2-H, 2-I and 2-J, and there being no objections filed or made to said proposed assessments, therefore, BE IT RESOLVED by the Village Council of the Village of St. Louis Park that said proposed assessments be hereby affirmed and adopted and shall constitute a special assessment against the lands named therein, and each lot, piece and parcel of land included in each assessment is hereby found to be benefited by said improvement in the amount of the assessment- levied against it. BE IT FURTHER RESOLVED that such assessments shall be paid in ten equal annual installments over a period of ten years, the first of said installments to be payable on the 1st day of January, 1952, and subsequent installments on the first day of January of each year thereafter until the full amount of said assessments are paid. Said special assessments and each installment thereof shall bear interest at the rate of 4% per annum until fully paid, computed from the time of this resolution. Request for Permit to Build Restaurant Building Mac Gregor On motion of Trustee Jorvig, seconded by Trustee Perkins, the request of Mr. Mac Gregor for a permit to build a restaurant building on the NW Corner of Louisiana Avenue and Walker Street, was referred to the Planning Commission for checking -and report, by unanimous vote of the Council. Hearing Date Set for Grading On motion of Trustee Perkins, seconded by Trustee Jorvig, October 8, 1951 was set as hearing date on proposed grading of 26th Street from Jersey Avenue to Hampshire Avenue, by unanimous vote of the Council. Deed for Streets - Sumter & Rhode Island On motion of Trustee Perkins, seconded by Trustee Bo]mgren, the deed fur- nished by Stanley and Lillian Ecklund for Sumter and Rhode Island Avenues south to Highway No. 7, from Division Street was accepted, and the Village Attorney was instructed to file same with the Register of Deeds of Hennepin County, by unanimous vote of the Council. Storm Sewer -- Hearing Date Set, Bids On motion of Trustee Perkins, seconded by Trustee Jorvig, October 1, 1951 V r� was set as date for hearing on proposed construction of Stgrm Sewer #51-237, being all of Storp Sewer District No. 17, south of Minnetonka Boulevard and.west of Minneapolis, Northfield and Southern Railroad Tracks, and the Clerk was authorized to advertise for bids for same to be opened October 1, 1951, by un- animous vote of the Council. Street Signs Ordered On motion of Trustee Jorvig, seconded by Trustee Perkins, the Street Commissioner was instructed to place street signs on Quentin Avenue at Excelsior Boulevard, 40th Street 40th Lane and 41st Street, by unanimous vote of the Council. 1 1 1 September 10, 1951 493 Earnest Money Contract for Land Authorized On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the Mayor and Clerk were authorized to execute an earnest money contract with Landers, Norblom, Christenson Company for the purchase of land west of Louisiana Avenue, south of Cedar Lake Road known as Lots 17, 18, 21 and "A", Home Addition at a price of $201000.009 by unanimous vote of the Council. Claim for Damages Authorized On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the claim for damages and medical expenses on account of injuries received by Larry B. Keen in an accident on June 30, 1951, at or near Jersey Avenue and 16th Street, at which time it is claimed said Larry B. Keen was injured when the bicycle he was riding upset by reason of the condition of the street, signed by Mr. and Mrs. Burton K. Keen as parents of Larry Keen, in the amount of $145.00, was approved, and the Mayor and Clerk were authorized to issue warrant covering same, by unanimous vote of the Council. Resolution On motion of Trustee Bolmgren, seconded by Trustee Perkins, the following resolution was adopted by unanimous vote of all members of the Council present: RESOLUTION AUTHORIZING ENGINEERING SERVICES WHEREAS, the Village Council has heretofore entered into an agreement with G. M. Orr Engineering Company dated November 14, 1949, for furnishing en- gineering services in connection with a water treatment plant for the Village, which contract provides for furnishing a preliminary report, and if so ordered by the Village Council, complete plans and specifications for a water treatment plant, and WHEREAS, upon receipt of preliminary report from G. M. Orr Engineering Company under said contract, the Village Council referred the report to a com- mittee of citizens for investigation and study, and said advisory committee have given the matter careful study and attention and having reported to the Village Council that the majority of the committee recommends that the Village proceed with construction of a water treatment plant for softening the Village water as recommended by said engineers, and WHEREAS, the Village has heretofore entered into an agreement with the Housing and Home Finance Agency of the U. S. Government known as Project No. Minn. 21-P-1002, providing for advancement of the fees payable under said engin- eering contract on condition that the plans and specifications to be prepared under the contract are completed before August 18, 1951 , and the Village having requested an extension of time for such completion until April, 1952, therefore, BE IT RESOLVED by the Village Council of the Village of St. Louis Park that G. M. Orr Engineering Company be hereby authorized to proceed with the second stageof the work to be done under said engineering contract, i. e., prepare plans and specifications for water softening and treatment plant, provided, however, and on condition that the housing and Home Finance Agency of the U. S. Government shall grant an extension of time during which said plans and specifications may be completed until April 1, 1952, and that the Clerk be hereby directed to request such extension from the Regional Engineer of said Agency.
