Building Inspector's Weekly Report The Building Inspector's weekly report for week ending June 29, 1951, showing that 49 building permits were issued totaling $501,850.00, was read and ordered filed. Resolution On motion of Trustee Jorvig, seconded by Trustee Bolmgren, the following reso- lution was adopted by unanimous vote of the Council: RESOLUTION APPROVING THE ESTABLISHMENT OF NURSING DISTRICT WHEREAS, the Legislature of the State of Minnesota during its -1951 -Regular Session, amended Section 145.08 -and 145.12;"M.S.A. to exclude Hennepin County from the counties authorized to carry on a -County Nursing Service and provided that in Hennepin County, the towns and municipalities -outside of the City of Minneapolis, may establish a nursing district for that purpose, and WHEREAS, the services being rendered by Hennepin County, under the Hennepin County Nursing Program will be discontinued at the -end of the year 1951, unless a program of a similar nature is established by the -towns and municipalities of Hennepin County, outside of the City of Minneapolis, and WHEREAS, we are of the opinion that such a program should be continued by the establishment of a Nursing District by the municipalities and town of Hennepin County desiring to participate in said program as provided for in said Section 145.08, M.S.A., therefore, BE IT RESOLVED by the Village Council of the Village of St. Louis Park that the establishment of such a Nursing District be approved; that the Village of St. Louis Park be included therein and participate in the benefits thereof and the support thereof on an apportionment basis as provided for in said Act. Hearing Date Set for Water Main Extensions On motion of Trustee Bolmgren, seconded by Trustee Perkins, July 30, 1951 was set as date for hearing on the -extension of water main from the South line of Lot 6, Block 2, Wooddale Park Addition to 422 Street, by unanimous vote of the Council. Survey on Drainage Situation Ordered On motion of Trustee Perkins, seconded by Trustee Jorvig, the Village Engineer was ordered to make a survey and report on'the drainage situation on France Avenue from 27th Street to Lake Street, by unanimous vote of the Council. Ordinance No. 379 On motion of Trustee Jorvig, seconded by Trustee Bolmgren, the following ordinance was adopted by unanimous vote of the Council: AN ORDINANCE AMENDING ORDINANCE NO. A-3 RELATING TO CONSTRUCTION AND MAINTENANCE OF CESSPOOLS The Village Council of the Village of St. Louis Park ordains: Section 1. Section 5 of Ordinance No. A-3 of the Village of St. Louis Park entitled AN ORDINANCE TO PROTECT AND PRESERVE THE PUBLIC HEALTH BY REGULATING THE LOCATION AND OPERATION OF SOIL ABSORPTION SYSTEMS FOR THE DISPOSAL OF HUMAN EXCRETA July 2, 1951 Ordinance No. 379, Cont1d. AND PROVIDING A PENALTY FOR VIOLATION THEREOF, adopted July 26, 1926, is here- by amended by adding thereto the following sub -sections: "(f) No excavation shall be made for a septic tank, cesspool or for a connection from a building to a cesspool by -power shovel or drag -line whereby soil is excavated for such cesspool or connection substantially in excess of the requirements for the finished septic tank or cesspool, or substantially -in excess of the tranch required to properly lay and connect the sewer pipe from the building to the cesspool or septic tank. In order to avoid settling after completion, -in making such -excavations the soil beneath connecting sewer pipes shall not be disturbed. "(g) Cesspools shall be located not less than twenty (29') feet from any dwelling and" riot- less- than- five ( 5 1 ) feet from the boundary line of the property upon which situated, and shall be not less than twenty (201) feet deep (unless water table is sooner encountered); dimensions shall be at least 4 x 4 feet, provided that -these dimensions may be modified where the capacity of the -cesspool -or combined cesspools or septic tank -is not less than 1,200 gallons below the intake pipe; where water -table is encountered at substantially less than 20 -feet from the surface, the Plumbing Inspector may require construction of one or more additional connected cesspools in order to -attain the equivalent absorption capacity of a cesspool 4 x 4 x 20 feet. 11(h) If an excavation is made for a cesspool or for a drainage field for a septic tank and 'clay soil is'en- countered in such quantity•that absorption of liquids drained therein will be not suffucient-to enable the sewer emptying therein to drain at all times, -this condition shall be reported immediately to the Plumbing Inspector by the person making such excavation, and if the Plumbing Inspector shall determine -upon inspection of any such excavation that the character of the -soil is such that absorption of liquids will be inadequate to drain the sewer system of the building -to which the cesspool is attached for at least one year thereafter, the Plumbing Inspector shall immediately so notify -the owner of such premises and the Village Building Inspector; no certificate of occupancy shall be issued for any new dwelling depending on such cesspool or septic tank for drainage of the sewer system - thereof, and a notice to that effect shall be posted and kept posted on the premises by the building inspector until a certificate of occupancy -may be issued. It shall be the duty of the Plumbing Inspector in such cases to confer with the owner of such premises and if the owner shall propose an alternative means for disposal of sewage be cesspool, septic tank or drainage field from the building iwhich in the judgement of the Plumbing Inspector, with the approval of the Village Engineer and Health Officer will absorb all such sewage and adequately drain -the plumbing system of such dwell- ing at all times for a period of at least one year there- ' after, the Plumbing Inspector -shall -approve such alternate means of disposal, and upon such'approval a certificate of occupancy may be issued. Section 2. This ordinance shall take effect from and after its publication. Ordinance No. 380 On motion of Trustee Bolmgren, seconded by Trustee Perkins, the following ordinance was adopted by unanimous vote of the Council: ORDINANCE NO. 380 AN ORDINANCE CHANGING THE NAME OF A PORTION OF WEST 24TH STREET The Village Council of the Village of St. Louis Park ordains: Section 1. That portion of West 24th Street from France Avenue west to July 2, 1951 Ordinance No.�80, Continued Lot 25, Block , Forest Tract; Lake Forest Addition, as the said street is dedicated and platted in the plats of Forest Tract, Lake Forest Addition and Basswood, shall be hereafter known and designated as Cedarwood Road; Section 2. This ordinance shall take effect from and after its publica- tion. Deed Accepted On motion of Trustee -Perkins, -seconded by Trustee-Bolmgren, the following deed was approved and accepted, by unanimous vote of the Council: Deed of Herbert Parkinson and -Frances Parkinson, husband and wife, Christ N. Kurup and Marie Jane Kurup, husband and wife, to the Village of St. Louis Park for the South 20 feet of the north 243 feet of that part of the east 1 of the northwest 4 of the-riortheast 1, Section 6, Township 28, Range -24, lying north -of -the -State Highway No. 7, and the west -20 feet lying south of the north 243 feet of that part of the east-! of the northwest -1 of the northeast 1, Section -6, Township 28, Range 24, lying north of State Highway"No. 7; Village of St. Louis Park, State of Minnesota, according -to the map or plat thereof on file and of record in the office of the Register of Deeds in and for said County -of Hennepin, State of Minnesota, to be used as a roadway. HOLMQUIST, husband and wife, of Hennepin County and State of Minnesota, -parties -of the first part, and the VILLAGE OF ST.
