Bids for Installation of Sewer and Water Main House Connections
As advertised in the St. Louis Park Disp&tdh_-June'20,_l951; sealed bids

from Village Water Mains and Village Sewer Nfains in Minnetonka Boulevard to
property line from France Avenue to Dakota Avenue:

On motion -of Trustee-Bolmgren, seconded by Trustee Perkins, the above bids
were referred to the Village Engineer and Chairman of the Sewer and Water Com-
mittee for tabulation and recommendation, by unanimous vote of the Council.
Hearings on Proposed Water Main Extensions
Separate hearings were had on -each of'the-proposed water main extensions
described in the following resolution. No persons appeared.
Resolution
�On mmotion'of Trustee Bolmgren, seconded by Trustee Jorvig, the following
resolution was adopted by unanimous vote of'all members of the Council present:
RESOLUTION ORDERING WATER'MAIN EXTENSIONS
WHEREAS, the Village Council has -met at the time and place specified in
a notice published in the St. Louis_Park-Dispatch June 13 and 20, 1951, relating
to proposed extension of water mains at the following locations -and has heard
all interested persons and determined the necessity for said improvements,
therefore,
IBE IT RESOLVED by the Village Council'of the Village of St. Louis Park
that Village water mains be hereby ordered extended at'the following locations in
said Village in accordance with plans and specifications foF the same which have
been prepared by the Village Engineer and which are hereby approved:
Boone Avenue from a point 50'ft. north of the SW corner
of Lot 1, Block 1, Minnehaha-Gables to 34th Street
Cavell Avenue from Boone Avenue to North end
West 34th Street from Boone Avenue to most NWly corner y,
of Lot 9, Block 3, proposed plat of Minnehaha Gables, and
the Clerk is authorized to advertise for bids for constructing said water mains

Hearinjz Date Set for Acquisition of -Property for Park Pili -poses
On motion of Trustee Jorvig, seconded'by_Trustee Bolmgren, a -hearing was
set"for July 30, 1951 on proposed acquisition of-Lot-30,-Bl6ck 170, and Lot 28,
Block 330, Rearrangement of St. Louis Park for public park u6e; the area to be
assessed being bounded on the West by Texas'Avenue, on the North by Highway
No. 7, on the East by Taft Avenue,_and_on-tYie South by the Minneapolis and St.
Louis Railway R%W, by unanimous vote of Council Members present except Trustee
Perkins, not voting.

On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the following

On motion of Trustee Jorvig, seconded by -Trustee Bolmgren, the Mayor was
instructed to wire Minnesota Congressmen to get figures for the 1950 Census, by

On motion of Trustee Jorvig, seconded -by Trustee Bolmgren, the following
applications for 1951 licenses were approved; and the Mayor and Clerk were author-

Bid Awarded for Storm Sewer
On motion of Trustee Perkins, eeconded by Trustee"Bolmgren, the bid of
Lametti and Lametti received June 25; 1951, for the construction of Storm Sewer
for Storm Sewer District #24, was deemed to be the lowest bid of a responsible
bidder, and the Mayor and Clerk were authorized to enter into a contract with
Lametti and Lametti for the Village for said work at price bid of $21,066.15,
by unanimous vote of Council Members present.
Reauest to Use Basement for Plastics Assembly_
On motion -of Trustee Bo1mgren, seconded by Trustee Perkins, the request
of Ray Nacennius, DBA -Master Craft -Plastics for the_use-of basement at 4815
Excelsior Boulevard for an assembly place of plastic -materials was referred to
the Planning Commission for checking and recommendation by unanimous vote of
Council Members present.

The Building Inspector's weekly report for week ending June 29, 1951, showing
that 49 building permits were issued totaling $501,850.00, was read and ordered

Resolution
On motion of Trustee Jorvig, seconded by Trustee Bolmgren, the following reso-
lution was adopted by unanimous vote of the Council:
RESOLUTION APPROVING THE ESTABLISHMENT OF NURSING DISTRICT
WHEREAS, the Legislature of the State of Minnesota during its -1951 -Regular
Session, amended Section 145.08 -and 145.12;"M.S.A. to exclude Hennepin County from
the counties authorized to carry on a -County Nursing Service and provided that in
Hennepin County, the towns and municipalities -outside of the City of Minneapolis,
may establish a nursing district for that purpose, and
WHEREAS, the services being rendered by Hennepin County, under the Hennepin
County Nursing Program will be discontinued at the -end of the year 1951, unless a
program of a similar nature is established by the -towns and municipalities of
Hennepin County, outside of the City of Minneapolis, and
WHEREAS, we are of the opinion that such a program should be continued by the
establishment of a Nursing District by the municipalities and town of Hennepin
County desiring to participate in said program as provided for in said Section
145.08, M.S.A., therefore,
BE IT RESOLVED by the Village Council of the Village of St. Louis Park that
the establishment of such a Nursing District be approved; that the Village of St.
Louis Park be included therein and participate in the benefits thereof and the
support thereof on an apportionment basis as provided for in said Act.
Hearing Date Set for Water Main Extensions
On motion of Trustee Bolmgren, seconded by Trustee Perkins, July 30, 1951
was set as date for hearing on the -extension of water main from the South line of
Lot 6, Block 2, Wooddale Park Addition to 422 Street, by unanimous vote of the
Council.
Survey on Drainage Situation Ordered
On motion of Trustee Perkins, seconded by Trustee Jorvig, the Village Engineer
was ordered to make a survey and report on'the drainage situation on France Avenue
from 27th Street to Lake Street, by unanimous vote of the Council.
Ordinance No. 379
On motion of Trustee Jorvig, seconded by Trustee Bolmgren, the following
ordinance was adopted by unanimous vote of the Council:
AN ORDINANCE AMENDING ORDINANCE NO. A-3
RELATING TO CONSTRUCTION AND MAINTENANCE OF
CESSPOOLS
The Village Council of the Village of St. Louis Park ordains:
Section 1. Section 5 of Ordinance No. A-3 of the Village of St. Louis Park
entitled AN ORDINANCE TO PROTECT AND PRESERVE THE PUBLIC HEALTH BY REGULATING THE
LOCATION AND OPERATION OF SOIL ABSORPTION SYSTEMS FOR THE DISPOSAL OF HUMAN EXCRETA

AND PROVIDING A PENALTY FOR VIOLATION THEREOF, adopted July 26, 1926, is here-
by amended by adding thereto the following sub -sections:
"(f) No excavation shall be made for a septic tank,
cesspool or for a connection from a building to a
cesspool by -power shovel or drag -line whereby soil is
excavated for such cesspool or connection substantially
in excess of the requirements for the finished septic tank
or cesspool, or substantially -in excess of the tranch
required to properly lay and connect the sewer pipe from
the building to the cesspool or septic tank. In order to
avoid settling after completion, -in making such -excavations
the soil beneath connecting sewer pipes shall not be
disturbed.
"(g) Cesspools shall be located not less than twenty (29')
feet from any dwelling and" riot- less- than- five ( 5 1 ) feet
from the boundary line of the property upon which situated,
and shall be not less than twenty (201) feet deep (unless
water table is sooner encountered); dimensions shall be at
least 4 x 4 feet, provided that -these dimensions may be
modified where the capacity of the -cesspool -or combined
cesspools or septic tank -is not less than 1,200 gallons
below the intake pipe; where water -table is encountered at
substantially less than 20 -feet from the surface, the
Plumbing Inspector may require construction of one or more
additional connected cesspools in order to -attain the
equivalent absorption capacity of a cesspool 4 x 4 x 20
feet.
11(h) If an excavation is made for a cesspool or for a
drainage field for a septic tank and 'clay soil is'en-
countered in such quantity•that absorption of liquids
drained therein will be not suffucient-to enable the sewer
emptying therein to drain at all times, -this condition
shall be reported immediately to the Plumbing Inspector
by the person making such excavation, and if the Plumbing
Inspector shall determine -upon inspection of any such
excavation that the character of the -soil is such that
absorption of liquids will be inadequate to drain the sewer
system of the building -to which the cesspool is attached
for at least one year thereafter, the Plumbing Inspector
shall immediately so notify -the owner of such premises and
the Village Building Inspector; no certificate of occupancy
shall be issued for any new dwelling depending on such
cesspool or septic tank for drainage of the sewer system -
thereof, and a notice to that effect shall be posted and
kept posted on the premises by the building inspector until
a certificate of occupancy -may be issued. It shall be the
duty of the Plumbing Inspector in such cases to confer with
the owner of such premises and if the owner shall propose an
alternative means for disposal of sewage be cesspool, septic
tank or drainage field from the building iwhich in the
judgement of the Plumbing Inspector, with the approval of the
Village Engineer and Health Officer will absorb all such
sewage and adequately drain -the plumbing system of such dwell-
ing at all times for a period of at least one year there- '
after, the Plumbing Inspector -shall -approve such alternate
means of disposal, and upon such'approval a certificate of
occupancy may be issued.
Section 2. This ordinance shall take effect from and after its publication.

On motion of Trustee Bolmgren, seconded by Trustee Perkins, the following
ordinance was adopted by unanimous vote of the Council:

AN ORDINANCE CHANGING THE NAME OF A PORTION
OF WEST 24TH STREET
The Village Council of the Village of St. Louis Park ordains:
Section 1. That portion of West 24th Street from France Avenue west to

Lot 25, Block , Forest Tract; Lake Forest Addition, as the said street is
dedicated and platted in the plats of Forest Tract, Lake Forest Addition and
Basswood, shall be hereafter known and designated as Cedarwood Road;
Section 2. This ordinance shall take effect from and after its publica-
tion.

On motion of Trustee -Perkins, -seconded by Trustee-Bolmgren, the following
deed was approved and accepted, by unanimous vote of the Council:

RESOLVED by the Village Council that hearing be set for July 16, 1951,
on proposed extension of 12 inch Village water main at the following locations

Agreement for Easement Accepted
On motion of Trustee Bolmgren, seconded by Trustee Jorvi.g, the follow-
ing agreement was accepted by unanimous vote of the Council:
AGREEMENT FOR EASEMENT
THIS AGREEMENT, made and entered into this 26th day of February, 1951,
by and between FRANK'HOLMQUIST and VICTORIA V. HOLMQUIST, husband and wife, of
Hennepin County and State of Minnesota, -parties -of the first part, and the
VILLAGE OF ST. LOUIS -PARK, a municipal corporation of Hennepin County, State
of Minnesota, party of the second part,
WITNESSETH, in consideration of the(nutual covenants herein contained,
the parties hereto agree as follows:
I.
First parties as 6-Wners of Lot Nineteen (19), Block Three (3), Earlsfort
Terrace, according to the -plat thereof on -file and of -record in the office of
the Register of Deeds of -said Hennepin -County, -Minnesota, -do hereby bargain,
grant, quit claim, assign -and convey unto party of the second part, its
successors and assigns, an easement in and oveithe westerly fifty (50) -feet
of said Lot 19, for the purpose of depositing soil thereon to serve as a
slope for support of Louisiana Avenue adjacent thereto when the grade of same
is changed by construction of a fill for approaches to a new bridge to be
constructed over the Great Northern Railway right-of-way.
II.
The first parties do hereby release and discharge the party of the
second part from any and all claims for damages which may result to said Lot
19 on account of the said change of grade of Louisiana Avenue.
The foregoing conveyance of easement and-the"foregoing release are made
upon the understanding and condition that the party of the second part will at
the time of said change of grade of Louisiana Avenue, bring on to said Lot 19
clean soil fill extending from the front line of -said Lot -'19 -at Louisiaxia
Avenue easterly to the front line of the existing building on the premises,
said fill to be approximately four (4) -feet at__Louisiana_Avenue and eight (8)
feet at the building line from the present grade; party -of -the second part is
also to provide and deposit fill on the existing driveway on said premises so
that the same will slope from Louisiana Avenue to the' -rear of the existing
building; the said fill is to be spread evenly over the front of the premises
and along the driveway and the driveway tamped and left in"a neat condition.

Bid Awarded for Installation of Sewer and Water Main House Connections
On motion of Trustee Perkins, seconded by Trustee Bolmgren, the bid
received this meeting for the construction of house connections from Village
water mains and Village sewer mains"in Minnetonka Boulevard to the property
line from France Avenue to Dakota Avenue, from Western Underground Construction
Company in the amount of $36,472.60, was deemed -to be the lowest bid of a res-
ponsible bidder, and the Mayor and Clerk were authorized to enter into a contract
with Western Underground Construction Company for the work at price bid, by
unanimous vote of the Council.
