Mr. Wilson, Mr. Lash, Mr. Laidlaw and others appeared in regard to Improvement No. 51-4, Mr. Laidlaw said that the street should be widened to 28 feet. -On motion 6f Trustee Bolmgren, seconded by clerk Justad, action on Improvements 51-2 thru 51-15, inclusive was deferred to meeting of April 16,.G��J 1951;'and Improvement No. 51-4 (Jersey Avenue from Wayzata Boulevard to 14th Street) was referred to the Village Engineer for recommendation and report, by unanimous vote of Council Members present. Study Building Ordinances On motion of Trustee Bolmgren, seconded by Clerk Justad, the Village Attorney was instructed to study the Building Ordinance to see if we can control water levels and cesspool depths so that proper drainage can be had, by unanimous vote of Council Members present. See Page ##292•for Discussion. 1951 Licenses 11 On motion of Trustee Bolmgren, seconded by Clerk Justad, the following applications for 1951 licenses were approved, and the Mayor and Clerk we're authorized to issue licenses to expire December 31, 1951, by unanimous vote of Council Members present: Richfield Heating and Sheet Metal Co. Heating Wayzata Sheet Metal Works it M. A. Pearson (Dairy Queen) Restaurant Bonds On motion of Clerk Justad, seconded by Trustee Bolmgren, the following bonds were approved by unanimous vote of Council Members -present: HEATING LICENSE BOND with Wayzata Sheet Metal Works as principal, and United States Fidelity and Guaranty Company as surety, dated April 6, 1951, in the amount of $1,000.00. HEATING LICENSE BOND with Harris Brothers Plumbing Company as principal, and Western Surety Company as surety, dated March 19, 1951, in the amount of $1,000.00. HEATING LICENSE BOND with Richfield Heating and Sheet Metal Company as principal, and St. Paul - Mercury Indemnity Company as surety, dated March 23, 1951, in the amount of $1,000.00. Resolution On motion of Trustee Bolmgren, seconded by Clerk Justad, the following resolution was adopted by unanimous vote of Council Members present: RESOLUTION CANCELING 33 FEET OF GRADING N-132 ASSESSMENT WHEREAS, it appears that by resolution of the Village Council adopted 286 April 9, 1951 Resolution Canceling Grading Assessment October 10, 1949 levying assessments for'Grading N-132, the following lot was inadvertantly assessed for 73 feet instead'of 40 feet, therefore BE IT RESOLVED that installments of such assessments heretofore paid in the respective amount hereinafter set forth be refunded to the respective property owner, and that the Mayor and Clerk:be,hereby authorized to issue warrants in payment of such refund's -to the'resp6etive property owner upon a receipt of a signed verified,claim(N AMOUNT REFUNDED -TO-M- NAME LOT - BLOCK ADDITION REFUND 1950 " 011ie L. On motion of Trustee Bolmgren, seconded by Clerk Justad, the building inspector was authorized to issue a building permit to Ohme and Rutledge for the construction of a store building on Lots 44 and 45, Block 175, Rearrange- ment of St. Louis Park for Edward J. Mc Devitt, 3393 Brownlow Avenue, accord- ing to plans submitted, by unanimous vote of Council Members present. _ Special Permit to Construct 20' x 15' Building forRefreshment Stand - Wm. V. B. Eddy The Planning Commission's report dated April 61 1951 on the request of William V. B. Eddy for a building permit to construct or move in on Lots 11 and 12, Block 1, Lewiston Park Addition, a 20' x 15' frame building from which to serve soft drinks and hamburger sandwishes in connection with his miniature golf course, was read. On motion of Trustee Bolmgren, seconded by Clerk Justad, the Building Inspector was authorized to issue a building permit to William V. B. Eddy for the construction of a 20' x 15' frame building on Lots 11 and 12, Block 1, Lewiston Park Addition from which to serve soft drinks and hamburger sandwiches in connection with his miniature golf course, by unanimous vote of Council Members present. Request for Permit to Operate a Used Car Lot (S. C. Peterson, E. J. Danielson) The Planning Commission's report dated April 6, 1951`on the application of Stanley C. Peterson and Elof J. Danielson, for a permit to operate a used car lot on Minnetonka Boulevard between Louisiana Avenue and Maryland Avenue (Lots 2, 3, Block 1, Boulevard Heights Addition), was read. On motion of Trustee Bolmgren, seconded by Clerk Justad, as recommended by the Planning Commission, the above mentioned request to operate a used car lot was denied on the basis of insufficient information concerning the contemplated use which would require a special permit on account of it's proximity to Residential Use District, by unanimous vote of Council Members present. April 9' 1951 287 Hearing Date Set for Two -Family Dwelling The Planning Commission's report on the request of Willis B. Park, 3700 Huntington Avenue, St. Louis Park, for permission to construct a two-family dwelling on Lot 9, Block 4, Hanke's Minikanda Terrace Addition, dated April 6, 1951, was read. On motion of Trustee BolMgren, seconded by Clerk Justad, May 14, 1951 was set as date for hearing on the request of Willis B. Park for permission to construct a two-family dwelling on Lot 9, Block 4, Hanke's Minikanda Terrace Addition, by unanimous vote of Council Members present. Hearing Date set for Rezoning The Planning Commission's report, dated April 6, 1951 on the•petition of Mr. and Mrs. Vernon R. Peterson, 2955 Independence Avenue and others, for the rezoning of Lots 16 and 17, $lock 4, J. F. Lyons Fourth Addition, from Commercial Use Dietrict to Residential Use District; and the Planning Commission's recom- mendation to rezone Lots 19 and 20,•Block 3,,and Lots 8, 9, 10, 11, and 12, Block 5, J. Request for Permits to Build Double Bungalows On motion.of Trustee Bolmgren, seconded by Clerk Justad, the•request of Ecklund and Swedlund Construction Company, dated April 9, 1951 for special permits to build three double bungalows on Lots k, 10, 11, 12, 13, 14, 15, 16, and the North 12 feet of Lot 17, Block 321, Rearrangement of St. Louis Park (Between Highway No. 7 Service Road and Division Street on Sumter Avenue), was referred to the,Planning Commission for checking and recommendation, by unanimous vote of Council Members present. Street .Lights Ordered On motion of Trustee Bolmgren, seconded by Clerk Justad, the Northern States -Power Company was ordered to install street lights at the following loca- tions, by unanimous vote of Council Members present: One (1) at corner of Basswood Road and France Avenue One (1) at corner -of 25th Street and France Avenue. Building Inspector's Weekly Reports The Building Inspector's weekly reports for week ending March 30, 1951, showing that -33 building permits were issued, totaling $294,500; and for week ending April 6, 1951, showing that 17 building permits were issued, totaling $332,300.00, were read and ordered filed. Discussion Re: Water in Cesspools and Basements A group of citizens from the area near Sumter Avenue between 32nd Street and 33rd Street and Utah Avenue between 33rd Street and 34th Street appeared re- garding their cesspools and water,in their basements. It waas the feeling of those who spoke that the Village should have an,ordinance that would require proper drainage for cesspools --'for instance, 20 ft. depth for cesspools. Also an ordinance that would allow refusal of building permit if,water table was such that cesspools would not drain. Mr. Jenson, 3217 Sumter Avenue talked about the special cesspool built by Clarence Bros to relieve the trouble in his block, and asked who was respon- sible for the pumping of this cesspool as it was located in the Village Street. Trustee Bolmgren said he would check with the Village Engineer and see if sewer for Oak Hill could be started at once. The group asked if they could expect the Village to pump out their base- ments now flooded due to seepage of ground water. They were told that we would do what we could and the matter would be checked at once. Complaint Re: Bus Line on Texas Avenue Mr. Fenchum, 3348 Texas Avenue appeared and stated that the bus line over Texas Avenue was making the street unbearable. He asked why the meeting re- garding the extension of this line was held in the morning. He was told that the Railroad and Warehouse Commission called and conducted the meeting. He asked if the Bus Company could be assessed for street maintenance and the answer was no. Inquiry Re: Alley I , Ed. Florhey, 2613 Hampshire Avenue appeared and inquired about the alley in his block. This matter was referred"to the Village Engineer.` - Release of Claims Victor Carlson & Sons On motion of Trustee Bolmgren, seconded by Clerk Justad, in consideration of the sum of $36.00 to be paid to the Village Treasurer, the Clerk was author- ized to sign RELEASE OF ALL CLAIMS for damages to property of A.
