REGULAR MEETING FEBRUARY 5, 1951
A regular meeting of the Village Council was called to order by Mayor
0. B. Erickson at 8:40 P. M., with the following Council Members present at roll
call as follows:

Gas Company was granted permission to extend gas mains in PENNSYLVANIA AVENUE
FROM 61 NORTH OF SOUTH LINE OF 29TH STREET WEST to LOT 192 BLOCK 4, HIGH HOLBORN
ADDITION, by unanimous vote of the Council. -

Resolution
On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the following
resolution was adopted by unanimous vote of the Council: -
RESOLUTION CANCELING ASSESSMENT FOR MAIN TRUNK SEWER #2
WHEREAS, it appears that by resolution of the Village Council adopted
September 222 1947, levying assessments for MAIN TRUNK SEWER #2, the following
lot was charged incorrectly by the County Auditor's Office, at the time a
division of lots was made, therefore,
BE IT RESOLVED that installments of such assessments heretofore paid
in the respective amounts hereinafter set forth be refunded to the respective
property owners, and the Mayor and the Clerk be hereby authorized to issue
warrants iu payment of such refunds to the respective property owner, upon
receipt of a signed verified claim.

Planning. -Commission's -Report RE:
Violation of the -Zoning Ordinance
An Inter -Office Memorandum from the Planning Commission, dated February
53 1951, stating that over a period of years there has developed a nonconform-
ing use for industrial work in a residential district, first on Lot 5, and now
on Lot 6, Block 2, Wildrose Addition, on Salem Avenue. This involves .the use'of
power machinery and is noisy. The Planning Commission recommends that the
Village Council take appropriate action to put a stop to this violation "of the
Zoning Ordinance, was read.
On motion of Trustee Bolmgren, seconded by Trustee Jorvig; a copy of
the Planning Commission's report above mentioned was referred to the Village
Attorney for a legal opinion, by unanimous vote of the Council.
Special Permit to Operate Bituminous Mixing_Plant-
On'motion of Trustee Bolmgren, seconded by Trustee Perkins, the application
of -Bury and Carlson, dated January 22, 1951, for permission to operate -their
bituminous mixing plant located approximately 300 feet west of Cedar Lake Road
and Raleigh Avenue for period ending November 30, 1951, was approved by unanimous
vote of the Council.
Reports on Plans for Water Main Extensions

Two reports one dated January 22, 1951 and the other dated January 25,
1951) from the Minnesota Department of Health, Division of Municipal Water Supply,
on proposed water main extension plans�for the Village were read and ordered
filed.
Payment Approved on Balance Due on

On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the Mayor and
Clerk were authorized to issue check for $5,175.00 to Terry Excavating Company
for final payment of Lots 1 thru�4, Block 4, C611.ins Second Addition, subject to
approval of abstract by the Village Attorney. Motion was passed by unanimous
vote of the Council.

Notice of Hearing - Proposed,Extension of
Deephaven Bus Route
A notice of hearing set for February 14, 1951 at 10:00 A. M. in the SLP
Village Hall, by the Minnesota Railroad and Warehouse Commission, on the petition
of the Deephaven Bus Company, Incorporated for an extension of the route granted
it by A. T. C. Order No. 569, between Minneapolis and Deephaven, was read; and
the Clerk was requested to get out about 50 letters to various in the neigoborhood
of Texas Avenue from Minnetonka Boulevard south to State Highway No. 7.
Building Permit for Two -Family Dwelling
The Planning Commissionts report dated,February 21 1951 on the request of
L. T. Bjorklund, 241 Maple Hill Road to erect a two-family dwelling on Lot 6,
Block 14, St. Louis Park Addition (Corner of West 35th Street and Brunswick Avenue)
was read. "
On motion of Trustee Jorvig, seconded by Trustee Bolmgren, the request
of L. T. Bjorklund, 241 Maple Hill Road for permission to erect a two-family
dwelling on Lot 6, Block 14, St. Louis Park Addition,was approved and the Build-
ing Inspector was authorized to issue a building permit for same, by unanimous
vote of the Council.
Request for Silo Construction
Culligan Soft Water Service
On motion of Trustee Jorvig, seconded by Trustee Perkins, the request of
Culligan Soft Water Service for permission to build.a silo for their soft water
treating plant at 36th Street and Brunswick Avenue was approved, and the Build-
ing Inspector was authorized to issue permit for same, by unanimous vote of
the Council.
Power Rates for Lift Station
On motion of Trustee Perkins, seconded by Trustee Jorvig, the Mayor and
Clerk were authorized to sign for the Village, Application for Commercial
Electric -Service for Sewer Lift Station at the SE Corner of Browndale Avenue
and Devaney Avenue, by unanimous vote of the Council.
Check for Damages Accepted - Gold Medal Beverage Co.
On motion of Trustee Perkins, seconded by Trustee Bolmgren, the Treasurer
was authorized to accept check from Manufacturers and Merchants Indemnity Co.
No. R 1281, dated December 18s 1950 in full payment of damages against the Gold
Medal Beverage Company for claim due to accident with Village Squad car,
October 5, 1950; and the Clerk was authorized to sign release of all claims
covering'the transaction, by unanimous vote,of the Council.
Proposal for Architectural Services for
Proposed New Fire and Police Station
On motion of Trustee Perkins, seconded by Trustee Jorvig, the Mayor and
Clerk were authorized to sign proposal dated January,31, 1951 of Mc Enary
and Krafft, Architects, for complete architectural services for proposed new
fire and police station building, by unanimous vote of the Council.
Claim for Damages
A letter from Jonas H. Bessler, and a copy of letter from Jonas H. Bessler
to the Phelps -Drake Company, dated February 1, 1951 relative to damage done to
his property in the installation of sewer at 3922 Basswood Road in November,
1950 was read. On motion of Trustee Perkins, seconded by Trustee Bolmgren,
the above matter was referred to the Village Attorney for checking and report,
by unanimous vote of the Council.
Request for Damage to Lawn -
A letter dated February 11 1951, from Robert S. Ersted, 4261 Browndale
Avenue, stating that in the process of laying sewer in front of his home, a
considerable part of his front lawn was dug up, and he expected this damage to
be repaired in the Spring, was read. On motion of Trustee Perkins, seconded
by Trustee Bolmgren, the above matter was referred to the Village Attorney for
checking and report, by unanimous vote of the Council.

Examination for Patrolmen
On motion of Trustee Perkins, seconded by Trustee Perkins, the Police
Civil Service Commission were requested to certify the names of two men to be
employed by the,Village as Patrolmen, by unanimous vote of the Council.
Special Meeting for Fire Chiefs
On motion of Trustee Jorvig, seconded by Trustee Perkins, Chief C. M.
Williams and Don Whalen were authorized to attend a special meeting of Fire
Chiefs of the Great Lakes Division of the International Associations of Fire
Chiefs to be held in Chicago, Illinois, Saturday, February 17, 1951, to discuss
Civil Defense Fire Protection, with all necessary expenses paid, by unanimous
vote of the Council.
Permit to Construct Sewer for Federal
Tool and Manufacturing Company
On motion of Trustee Bolmgren, seconded by Trustee Perkins, the Federal
Tool and Manufacturing Company were granted permission to construct a six—inch
sewer connection from their plant on the SW corner of Alabama Avenue and West
36th Street to Wooddale Avenue, under the supervision of the Village Engineer,
subject to the following conditions:

1. Permit granted with no charge by Village
2. When the proposed 12 inch sewer is constructed in the
center of 36th Street, the 6 inch line can be abandoned,
and a new connection made to the 12 inch sewer opposite
their building
3. Federal Tool and Manufacturing Company to pay their
share of assessment for the construction of 12 inch sewer
when same is done at some future date.
Motion was passed by unanimous vote of the Council.
Refund for Special Assessments for Water Main Extensions
(Veterans Housing Project)
A letter from Public Housing Administration, Washington, D. C., dated
January 22, 1951, stating that $533.31 was due the Village of St. Louis Park for
special assessments for water mains constructed in West 37th Street from Wooddale
Avenue to the Belt Line, to service the Veterans Housing Area was read.
On motion of Trustee Jorvig, seconded by Trustee Perkins, the Clerk was
instructed to write the Public Housing Administration that the above mentioned
amount ($533.31) was approved. Motion was passed by unanimous vote of the
Council.

Statement for Work on Street Dept. Building Addition
-Jerry Holt Construction Company
. The Clerk reported that on October 16, 1950, the Village Council instructed
the Jerry Holt Construction Company to lay footings and four rows of concrete
blocks as foundation for the new addition to the Street Department Building, due to
the lateness of the Season, at a total cost of $653.76 (bids for balance of work
to be taken November 13, 1950); the Village to pay direct for concrete blocks, etc.
and to pay Jerry Holt Construction Company for the labor. Thru a misunderstanding,
the Jerry Holt Construction Company paid all bills, and has furnished us with a
verified claim for the full amount. . The work has been completed satisfactorily
and .payment of the bill in the amount of $653.76 is recommended.
On motion of Trustee Perkins, seconded by Trustee Bolmgren, the claim of
Jerry Holt Construction Company for the above.work, in the amount of $653.76 was
approved and ordered paid. Motion was passed by unanimous vote of the Council.
