Hearing on Proposed Sanitary Sewer -Extensions and Lift Station Separate hearings were held on Sanitary Sewers #51-245 to #51-251, and #51-142. No one appeared in opposition. Raanliit.i an On motion of Trustee Bo1mgren, seconded by Trustee Jorvig, the following resolution was adopted by unanimous vote of all members of the Council present; RESOLUTION ORDERING SANITARY SEWER EXTENSIONS 31 WHEREAS, the Village Council has met at the time and place specified in a notice relating to the sanitary sewer extensions #51-245 to #51-251, inclusive, and #51-142 published in the St. Louis Park Dispatch September 2q and 27,, 1951, and has heard all persons interested appearing at said meeting and determined the necessity for said improvement,therefore, BE IT RESOLVED by the Village Council of the Village of St. Louis Park that sanitary sewer extensions be hereby ordered at the following locations in said Village to be done in accordance with plans and specifications which have been prepared by the Village Engineer and which are hereby approved: IMPROVEMENT NUMBER LOCATION 51-245 West 25th Street from France Avenue to Joppa Avenue 51-246 Joppa Avenue from West 26th Street to West 25th Street 51-247 Inglewood Avenue from West 26th Street to West 25th Street 51-248 Huntington Avenue from West 26th Street to West 25th Street 51-249 Basswood Road from France Avenue west 915 feet 51-250 France Avenue from West 25th Street to Basswood Road 51-251 Lift Station No. 6 51-142 Wooddale Avenue from Hamilton Street 165 feet south, and the Clerk was instructed to advertise for bids to be opened October 22, 1951. Hearing on Proposed Storm Sewer Construction A hearing was had on proposed storm sewer to drain alley in Block 300, Rearrangement of St. Louis Park. No one appeared in opposition. Resolution On motion of Trustee Perkins, seconded by Trustee Bolmgren, the following resolution was adopted by unanimous vote of the Council: RESOLUTION ORDERING STORM SEWER WHEREAS, the Village Council has met at the time and place specified in a notice relating to the storm sewer improvement #51-266 published in the St. Louis Park Dispatch September 19 and 26, 1951, and has heard all persons interested appearing at said meeting and determined the necessity for said improvement, therefore, BE IT RESOLVED by the Village Council of the Village of St. Louis Park that storm sewer be hereby ordered as Improvement #51-266 to drain alley in Block 300, Rearrangement of St. Louis Park, the same to be constructed in accord- ance with plans and specifications which are hereby approved; and the Clerk authorized to advertise for bids for the construction of said sewer to be opened October 29, 1951. Building Permit for 2 Car Garage Jerry's Shell Service On motion of Trustee Perkin's, seconded by Trustee Bolmgren, Jerry's Shell Service Station was granteda building permit to erect a two -car garage at their station located at 5430 Minnetonka Boulevard, by unanimous vote of the Council. 32October Cn 8, 1951 Cn C--1 Ordinance No. 384 On motion of Trustee Jorvig, seconded by Trustee Bolmgren, the follow— ing ordinance was adopted by unanimous vote of the Council: AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE VILLAGE OF ST. LOUIS PARK The Village Council of the Village of St. Louis Park ordains: Section 1. Section 4 of the Zoning Ordinance of the Village of St. Louis Park as amended December 28, 1949, by Ordinance No. 349 is hereby further amended by adding the following sub—section thereto: "Section 4.1-19. Whenever any application for building permit is'made to the Building Inspector by or on behalf of any person owning, directly or in— dir6ctly, any premises in a residence district upon which the applicant proposes to build five or more residences on the same side of a street in the same block at or about the same time, the cost or sale price of each of which shall appear to the Building Inspector to be less than $9000, the Building Inspector shall refer such application to the Village Council. Upon receipt of any such appli— cation so referred, the Village Council shall notify the applicant to appear before it and furnish such information as the Council deems necessary to determine the architectural design, nature of construction, cost, sale price and the nature and character of the residences for which permit is applied for and existing residences and improvements in the immediate vicinity. If the Council hsall determine that the construction of the residence or residences for which application is requested will result in construction of a row of five or more residences on the same side of a street in the same block, the architectural design and arrangements of which is substantially identical, and the size of which is substantially smaller, and the cost and nature of construction of which is substantially cheaper than existing residences in the same block on the same or opposite side of the street, and the Council shall determine that the erection of such number of residences as will result from granting of the application or applications then pending will result in substantial depreciation of the value of improved residential property in the block and vicinity and will result in blighting and deterioration of the neighborhood, the application or applications may be denied. It is hereby determined and declared that erection or rows of five or more residences in any residential district which are of similar design which cost less than $9000 and which are substantially cheaper and smaller in size than existing residences in the neighborhood has a blighting effect on the area as detrimental to surrounding property values and'the health, safety and welfare of the inhabitants of the Village as would be the use of such land for Commercial or Multiple Dwelling Uses contrary to the restrictions of this Ordinance . " Section 2. This ordinance shall take effect from and after its publication. Permission to Place Poles On motion of Trustee Jorvig, seconded by Trustee Bolmgren, the Northern States Power Company was granted permission to place poles at the following locations in the Village, by unanimous vote of the Council: Two (2) poles on Walker Street between Texas and Utah Avenues. License to Sell Milk Retail On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the application of Red Owl Store, 5015 Excelsior Boulevard, to sell milk at retail for the bal— ance of 1951 was approved, and the Mayor and Clerk were authorized to issue license to expire December 31, 19512 by unanimous vote of the Council. ' Bonds Approved On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the following bonds were approved, by unanimous vote of the Council: HEATING LICENSE BOND with Tom Motzko as principal, and American Automobile Insurance Company as surety, dated September 11, 19512 in the amount of $1,000.00. PLUMBING LICENSE BOND with Tom Motzko as principal, and American Automobile Insurance Company as surety, dated September 11, 1951, in the amount of $4,000.00. October 8, 1951 Justice of Peace Report of Fines -- Linnee Justice of Peace E. A. Linnee's report of fines dated September 29, 1951 was read and ordered filed. Justice of Peace Report of Fines -- Yngve Justice of Peace Anton Yngvets report of fines dated October 1, 1951, was read and ordered filed. Letter from Fire Fighterts Assn. Re:`Legal Holidays A letter from the Fire Fighter's Association, Local #993, dated October 69 1951, requesting that the St. Louis Park Firemen be granted 10 legal holidays a year, was read. On motion of Trustee Perkins, seconded by Trustee Bolmgren, the above letter was referred to the Chairmen of the Fire and Police Department Committees for checking and report, by unanimous vote of the Council. 1 Gas Main Extensions On motion of Trustee Perkins, seconded by Trustee Jorvig, the following gas main extensions were approved by unanimous vote of the Council: #387 In North Willow Lane from Forest Road to Lot 9, Block 3, Lake Forest Addition #388 In Alley North of Minnetonka Boulevard from Texas Avenue to East`20t Lot 19, Block 2, Texa-Tonka Addition #389 In West 36th Street from Lynn Avenue to Lot 3, Huntington Woods lst Addition #402 In Brunswick Avenue from 811 S. S. Line of West 28th Street to Lot 3, Block 4, Park Manor Addition #403 In West 38th Street from Ottawa Avenue to #4900 Block 6, Minikanda Vista Second Addition; and in Princeton Avenue from West 38th Street to Lot 13, Block 4, Minikanda Vista Second Addition #405 In Cedar Lake Road from Virginia Avenue to Burd Place; and in Burd Place from Cedar Lake Road to South line of Lot -10, Auditors Subdivision #302. 33 - Permission to Place Poles and Anchor On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the Northwestern Bell Telephone Company was granted permission to place five (5) poles and one (1) anchor on West 22nd Street and Florida Avenue, by unanimous vote of the Council. Permission to Place Conduit On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the Northwestern Bell Telephone Company was granted permission to place conduit along side of existing conduit and rebuild one manhole in the east side of Wooddale Avenue be- tween Morningside Road and Excelsior Boulevard, by unanimous vote of the Council. Resolution On motion of Trustee Perkins, seconded by Trustee Bolmgren, the following resolution was adopted by unanimous vote of the Council: R E S O L U T I O N WHEREAS, it appears to the Village Council that a sufficient sum has been paid into the Permanent Improvement Revolving Fund from assessments levied for improvements financed out of the fund to pay principal and interest on Permanent Iinprovement Revolving Fund Bonds, October 1, 1948 Series, maturing in the year 1952. Now therefore, BE IT RESOLVED that the levy for payment of said principal and interest contained in resolution adopted October 9, 1950 is hereby cancelled in the sum of $646,599.00, and the Village Clerk is hereby instructed to send a copy of this resolution to the County Auditor of Hennepin County, Minnesota, Bid Awarded for Grading & Gravelin On motion of Trustee Perkins, seconded by Trustee Bolmgren, the bid of Terry Brothers, Incorporated, received October 1, 1951, for grading and gravel- ing of Alley in Block 300, Rearrangement of St. Louis Park, was deemed to be the lowest bid of a responsible bidder, and the Mayor and Clerk were authorized to execute contract for the Village with Terry Brothers, Incorporated for the work at price bid of $535.30, by unanimous vote of the Council. October 8, 1951 Cc Bid Awarded for Sanitary Sewer to Serve Lots Z-4 3, 4, 9, 10, 11, 12, Minikanda Park CXR On motion of Trustee Bolmgren, seconded by Trustee Perkins, the bid of Qr Lametti and Lametti received October 1, 1951 for the construction of Sanitary Sewer in 39th Street from Glenhurst Avenue to France Avenue to serve Lots 3, 11, 4, 9, 10,',and 12, Minikanda Park Addition, was deemed to be the lowest bid of a responsible bidder, and the Mayor and Clerk were authorized to enter into a contract for the Village with Lametti and Lametti for the work at price bid of $2594.05, by unanimous vote of the Council. Bid Awarded for Storm Sewer 17-2-D On motion of Trustee Perkins, seconded by'Trustee Bolmgren, the bid of Western Underground Construction Company received October 1, 1951 for the cons- truction of Storm Sewer 17-2-D, was deemed to be the lowest bid of a responsible bidder, and the Mayor and Clerk were authorized to execute a contract for the Village with Western Underground Construction Company for the work at price bid of $7658.00, by unanimous vote of Council Members present. Bid Awarded for Storm Sewer 51-237 On motion of Trustee Perkins, seconded by Trustee Bolmgren, the bid of Lametti and Lametti, received October 1, 1951, for the construction of Storm Sewer (51-2371 was deemed to be the lowest bid of a responsible bidder, and the Mayor '01 n and Clerk were authorized to execute a contract for the Village with Lametti and Lametti for the work at price bid of $29402.602 by unanimous vote of the Council. Bid Awarded for Storm Sewer #26 On motion of Trustee Perkins, seconded by Trustee Bolmgren, the bid of Western Underground Construction Company received October 11 1951, for the cons- truction of '-' Storm;- Sewer #26, was deemed to be the lowest bid of a responsible bidder, and the Mayor and Clerk were authorized to execute contract for the Village with Western Underground Construction Company for the work at price bid of $9319.60, by unanimous vote of Council Members present. Letter Re: Traffic Problem in 2700 Block, Webster A letter from Wm. B. Jolly, 2725 Webster Avenue, dated October 2, 1951, describing the traffic problem in the 2700 Block on Webster Avenue, was read. On Motion of Trustee Perkins, seconded by Trustee Boimgren, the foregoing letter was referred to the Chairman of the Police,Department Committee for checking and recommendation, by unanimous vote of the Council. 4 Copy of State Highway Letter Re: Grade Separation on Cedar Lake Road at Belt Line to Roger Shanedling A copy of letter dated September 28, 1951, from the Minnesota State Highway Department to Roger Shanedling, explaining the future plans of the County for Cedar Lake Road and the Belt Line to alleviate traffic conditions, was read. Writ of Mandamus - Adolph Fine On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the Village Attorney was instructed to prepare and file a return in behalf of the Village, the Mayor, and the Building Inspector in the District Court proceeding entitled Adolph Fine and Adolph Fine, Inc. Realtors vs Peter Stienstra, 0. B. Erickson, and the Village of St. Louis Park, defendents, and to appear in opposition to said writ, by unanimous vote of the Council. Street Light Ordered On motion of Trustee Perkins, seconded by Trustee Jorvig, the Northern States Power Company was ordered to install a street light at the Corner of Franklin and Hampshire Avenues on existing pole) by unanimous vote of the Council. Request for 10,000 Lumen Lamps for Garden Village A letter from C. 0. Field Company, dated October 5, 1951, requesting that the Village specify 10,000 Lumen lamps for Garden Village (on Raleigh Avenue between State Highway No. 7 Service Road and Minnetonka Boulevard). On motion of Trustee Bolmgren, seconded by Trustee Perkins, the Northern States Power Co. was ordered to install 10,000 Lumen lamps in Garden Village as shown on sketch, by unanimous vote of the Council. Building Inspector's Weekly Report The Building Inspector's weekly report for week ending September 28, 1951, showing that 26 building permits were issued, totaling $180,500.00, was read and ordered filed. Building Inspector's Monthly Report The Building Inspector's report for the month of September, 1941, showing that a total of 94 building permits were issued, totaling $589,800 was read and ordered filed. October 8, 1951 Building Inspector's Quarterly Report - Third Quarter The Building Inspector's report of building permits issued during the months of July, August and September, 1951, showing that 315 permits were issued, totalling $2,513,012.00, was read and ordered filed. Petition for Stop Signs at 28th and Ottawa A petition signed by Arthur N. Lawrence, 4805 Wdst 27th Street and others, dated September 15, 1951, for the erection of stop signs at the intersection of 28th Street with Ottawa Avenue, was read. On motion of Trustee Perkins, seconded by Trustee Jorvig, the foregoing request for stop signs was referred to the Police Chief and Chairman of the Police Department Committee for checking and recommendation, by unanimous vote of the Council. Petition for Curb and Gutter On motion of Trustee Perkins, seconded by Trustee Bolmgren,,the follow- ing petition was referred to the Village Engineer and Chairman of -the Street Department Committee for checking and recommendation, by unanimous vote of the Council Members present: P-977 PETITION FOR CURB AND GUTTER, signed by Adolph Fine for Texa-Tonka, Incorporated, dated October 8, 1951, for the construction of curb and gutter on the West side of Virginia Avenue, Commencing at the North -Line of Lot 3 to South Line of Lot 23, Block 4, Texa-Tonka Addition, and in front of , and in front of Lots 1 thru 9, Block 1 Texa-Tonka Addition. Resolution On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the following resolution was adopted by unanimous vote of the Council: RESOLUTION APPROVING 1951 LEVY, COLLECTABLE IN 1952 RESOLVED by the Village Council of the Village of St. Louis Park, Henne- pin County, Minnesota that the -following sums of money be levied for the current year 1951, collectable in 1952 upon the taxable property in said Village of St. Louis Park for the following purposes: General Fund $ 266,101.00 Fire Department Relief Association 2,757.00 Musical Entertainment 500.00 Welfare Fund 18,388.00 For Park Purposes 18088.00 Interceptor Sewer -- City of Minneapolis Charge 3,300.00 Minnetonka Boulevard paving -- Joppa Avenue to to State Highway #100, to 50 feet west of intersection of Minnetonka Boulevard with Lake Street 60,000.00 $ 369,434.00 The proceeds of levy for Minnetonka Boulevard paving is to be paid into a sinking fund to retire Street Improvement Bonds, September 1, 1951 Series for Improvement Project 497 Fund. Street Sign Ordered On motion of Trustee Perkins, seconded by Trustee Jorvi.g, the Street Com- missioner was instructed to place a street sign on the Corner of Westridge Lane and Parklands Road, by unanimous vote of the Council. Letter Re: Condition of Concrete Gutter & Driveway A copy of a letter to R. B. Connery, from 0. S. MacConnell, 5624 West 39th Street, dated July 19, 1951, relative to damage to his concrete gutter and driveway by the Village Street Department was read. On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the foregoing matter was referred to the Village Engineer for checking and recommendation, by unanimous vote of the Council. Advertise for Bids to Move Church On motion of Trustee Jorvig, seconded by Trustee Perkins, the Clerk was instructed to advertise for bids for moving the Catholic Church building from Zarthan Avenue and West Lake Street to West Lake Street and Brunswick Avenue; bids to be opened'October 29, 1951, according to specifications prepared by the Park Board. Motion was passed by unanimous vote of the Council. 36 October 8, 1951 CO Petition for Rezoning On motion of Trustee Perkins, seconded by Trustee Jorvig, the'petition of R. N. Ruedlinger for the rezoning of Lots 30, 31, and 32, Block 312, Re- arrangement of St. Louis Park from Residential Use to Commercial Use, was referred to the Planning Commission for checking and recommendation, by unani- mous vote of the Council. " Salary Increases for 1952 On motion of Trustee Jorvig, seconded by Trustee Bolmgren, the following cost of living increases in salaries and wages, effective January 1, 1952, were approved by unanimous vote of the Council: 172¢ per hour on hourly wages; $30.00 per month on monthly salaries; $40.00 per month for F. J. Senander, George Gibson and Kurt Scheibe; $50.00 per month for Kenneth Johnson, Ira Vraalstad, C. M. Williams, Andy Nelson, and Peter Stienstra. Reinstate Meadowbrook Boulevard from Alabama Avenue to Brunswick Avenue in Contract for San. Sewer 2-K On motion of Trustee Bolmgren, seconded by Trustee Perkins, that the reinstatement of Meadowbrook Boulevard from Alabama Avenue to Brunswick Avenue to the Phelps -Drake Company's contract for construction of Sanitary Sewer 2-K, was approved by unanimous vote of the Council. Hearing on Application for Rezoning Hokenson Property Pursuant to notice published in the St. Louis Park Dispatch September 27 and October 4, 1951, a public hearing was had on the application of Alpha Hokenson to rezone from Residential Use District to Commercial Use District, the following described property: That part of Lot 1, Auditor's Subdivision No. 277 described as follows: beginning at a point on the east line of said Lot 1 distant 28.5 feet north of the southeast corner thereof; thence Nally to a point on the west line of said Lot 1, distant 5.8 feet north of the SW corner thereof and there terminating. No one appeared. Hearing on Application for Rezoning Ruedlinger Propert Pursuant to notice published in the St. Louis Park Dispatch September 27 and October 4, 1951 a public hearing was had on the application of R. N. Ruedlinger for the rezoning of Lots 27, 28, and 29, Block 312, Rearrangement of St. Louis Park from Residential Use to Commercial Use, and T.Lots 23 and 24, Block 312, Rearrangement of the St. Louis Park to Commercial Use, restricted to parking use only. Mr. Ruedlinger appeared and asked that Lots 23 and 24, Block 312, Rearrangement of St. Louis Park be withdrawn from his petition. Ordinance 385. On motion of Trustee Perkins, seconded by Trustee Bol.mgren, the following Ordinance was'adopted by unanimous vote of all members of the Council: ORDINANCE NO. 385 AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE VILLAGE OF ST. LOUIS PARK The Village Council of the Village of St. Louis Park ordains: Section 1. The Zoning ordinance of the Village of St. Louis Park adopted January 20, 1932, as heretofore amended, is hereby further amended by reclassi- fication of the area of the respective use districts as defined in Section 2.2 of said ordinance and•the use district maps therein referred to as follows: That part of Lot 1, Auditor's Subdivision No. 277 described as follows: beginning at a point on the east line of said Lot 1, distant 28.5 feet north of the SE corner thereof; thence Nally to a point on the west line of said Lotl, distant 5.8 feet north of the SW corner thereof and there terminating. Lots 27, 28, and 29, Block 312, Rearrangement of St. Louis Park, shall be deleted from the residence district and included within the commercial use district and shall be subject to all of the regulations of said ordinance October 8, 1951 Ordinance No. 385, Continued relating to the commercial use district.
