REGULAR MEETING
OCTOBER 29, 1951
A regular meeting of the Village Council was called to order by Mayor
0. B. Erickson at 8:20 P. M., with the following Council Members, present at roll
call as follows:

As advertised in the St. Louis Park Dispatch October 18, 1951, sealed
bids were received from the following bidders for the construction of a lift
station for Sanitary Sewer District 2-K:

On motion of Trustee Bolmgren, seconded by Trustee Perkins, the above bids
were referred to the Village Engineer and Chairman of the Sewer Department Com-
mittee for tabulation and reconmendation, by unanimous vote of the Council. -
Bids for Movina Church•Buildin
As advertised in the St. Louis Park Dispatch October 18, 1951, no bids
were received for moving the building formerly occupied by the Holy Family
Catholic Church from its present location at Lake Street and Zarthan Avenue and
placing it on a foundation at the intersection of Brunswick Avenue with Lake
Street.
On motion of Trustee Perkins, seconded by Trustee Bolmgren, the accepting
of bids for moving the above church was deferred to the meeting of November 5,
1951, by unanimous vote of the Council.
Bids for Storm Sewer 51-266
As advertised in the St. Louis Park Dispatch October 18, 1951, sealed bids
were received from the following bidders for the construction of storm sewer
No. 51-266 to drain Alley in Block 300, Rearrangement of St. Louis Park:
1. Phelps -Drake Company, Inc. x$12705.00
2. Western Underground Construction Co. 1,580.00
On motion of Trustee Bolmgren, seconded by Trustee Perkins, the above bids
were referred to the Village Engineer and Chairman of the Sewer Department Com-
mittee for checking and recommendation, by unanimous vote of the Council.
Building Inspector's Weekly Report
The Building Inspector's report for week ending October 26, 1951, showing
that 19 building permits were issued, totaling $$107,800.00 was read and ordered
filed.

Minnehaha Gables Addition was approved and accepted, and the Mayor and Clerk were
authorized to sign same for the Village, subject to the Village Attorney's
opinion as to title, by unanimous vote of the Council.
Application for Incinerator Permit - Red Owl"Stores
On motion of Trustee Perkins, seconded by Trustee Jorvig, the application
of the Red Owl Stores for a permit to construct an incinerator at the read of
their store building located in the Miracle Mile on Excelsior'Boulevard, was
approved, and the Building Inspector was authorized to issue same, by unanimous
vote of Council Members present, except Trustee Bolmgren who voted NO.
Street Light Ordered
On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the Northern
States Power Company was instructed to install a 2500 lumen street light on the
existing pole at the SE Croner of Lot 38, Highwood Tract, Lake Forest Addition,
to light the public bus walk connecting France Avenue with Glenhurst Road, by
unanimous vote of the Council.
Contract for Office Rental to�Rural Public Health Nursing Office
On motion of Trustee Perkins, seconded by Trustee Bolmgren, the Mayor and
Clerk were authorized to sign in behalf of the Village a contract prepared by
the Village Attorney for the rental on a month to month basis of office space
consisting of two rooms presently not needed by the Village, in the Village Hall,
to the Hennepin County Rural Public Health Nurses, to become effective November
1, 1951, in the amount of $125.00 per month. Motion was passed by unanimous
vote of the Council.
Report on Plans for Water Main Extensions
Minnesota Department of health
A report from Minnesota Department of Health, Division of Municipal Water
Supply, dated October 10, 1951, approving plans and specifications for water
main extensions in the Village, was read and ordered filed.
Resolution
On motion of Trustee Bolmgren, seconded by Trustee Perkins, the following
resolution was adopted by unanimous vote of the Council:
RESOLUTION CANCELLING NO -176 WATER MAIN ASSESSMENT
WHEREAS it appears that by resolution of the Village Council adopted
September 26, 1949, levying assessments for N-176 Water Main, the following lots
were inadvertantly assessed, whereas these lots were not serviced by water;
therefore
BE IT RESOLVED that installments of such assessments heretofore paid in
the respective amounts hereinafter set forth be refunded to the respective
property owner, and, upon receipt of a signed verified claim, the Mayor and the
Clerk be hereby authorized to issue warrants in payment of such refund to the
respective property owner.

On motion of Trustee Bolmgren, seconded by Trustee Perkins, the following
resolution was adopted by unanimous vote of the Council:
RESOLUTION REFUNDING AND CORRECTING P-1-43 WATER MAIN ASSESSMENT
WHEREAS it appears that by resolution of the Village Council adopted
October 16, 1950, levying assessments for Water Main P-1-43, the following error
occurred: Parcel ##2020, Section 17, Twp. 117, Range 21 was charged for 493
feet (which included the side and front of this property whereas it should have
been charged for 330 feet only, because 133 feet was side footage and should not
have been assessed, and 30 feet was a vacated street, deeded to the Village for
street pubposes; therefore,
BE IT RESOLVED by the Village Council of the Village of St. -Louis Park
that the 1951 installment of such assessment heretofore paid in the respective
amount hereinafter set forth be refunded to the respective property owner, and,
upon receipt of a signed verified claim and a paid tax statement, that the Mayor
and the Clerk be hereby authorized to issue warrants in payment of such refunds
to the respective property owner.

WHEREAS it appears that on August 31, 1951, the following property owner
paid $7.08 ($3.52 per year and $.04 interest) on Alley Grading 0-39 Assessments
for years 1952 and 1953; and whereas on April 19, 1951, the Village Council had
cancelled the 1952 and 1953 payments for Alley Grading 0-39, because tree re-
moval had been charged erroneously to this job instead of to Job 0-94, and thus
the 1951 amount covered the cost of the entire job; therefore,

Quit Claim Deed Accented
On motion of Trustee Perkins, seconded by Trustee Bolmgren, the quit claim
deed with Carlyle D. Jacobson and Maxine L. Jacobson, husband and wife as parites
of the first part, and the Village of St. Louis Park as party of the second part
for the following described property, was approved and accepted, and the Village
Attorney was instructed to file same with the Office of the Register of Deeds in
Hennepin County, by unanimous vote of the Council:
FOR STORM SEWER PURPOSES, an easement over and across
the N four (4) feet of Lot 17, and the S six (6) feet
of Lot 16, Block 302, Rearrangement of the St. Louis
Park, according to the plat thereof on file and of record
in the office of the Register of Deeds of said Hennepin
County, Minnesota, said easement being more particularly
described as the free right to enter upon said premises
and to excavate the soil and construct therein a storm
sewer for the drainage of storm and surface waters and to

Complaint Re: Condition of Pennsylvania-Mtak.-31st
Al White, 3042 Pennsylvania Avenue and others appeared regarding the
condition of Pennsylvania Avenue from Minnetonka Boulevard to 31st Street. On
motion of Trustee Perkins, seconded by Trustee Jorvig, the Village Engineer was
instructed to confer with the Street Commissioner and see that the foregoing
street is put in good condition, by unanimous vote of the Council.

Planning Commission's Report on Rezonin
The Planning Commission's report dated October 13, 1951, on the Village
Council's request for the rezoning of Lot 28, Block 330, and Lot 30, Block 170,
Rearrangement of St. Louis Park, from Light Industrial Use to Residential Use,
was read. No action taken at this time.
Application for Off -Sale Intoxicating Liquor License R.M.Pratt
The application of Robert M. Pratt, dated October 23, 1951, for a license

On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the statement
of Appraisel Service Company, which was approved on July 30, 1951 in the amount
of $250.00, is hereby approved in the amount of $300.00 to include the appraisel
of 1 new pump house and 1 new water tank, not included in the original proposal,
by unanimous vote of the Council.
Stakes Ordered Set for Grading
On motion of Trustee Perkins, seconded by Trustee Bolmgren, the Louver
Manufactoring and Supply Company was granded permission to grade Yosemite Avenue
from the Alley to West 36th Street, and the Alley between Yosemite and Wooddale
Avenues, behind Lots 1, 2, 3, and 4, Block 44, St. Louis Park Center at no cost
to the Village, and the Village Engineer was instructed to set stakes for same,
by unanimous vote of the Council.
Bid Awarded for Sanitary Sewers
On motion of Trustee Bolmgren, seconded by Trustee Perkins, the bid of
Western Underground Construction Company, received October 22, 1951, for the
construction of sanitary sewers 51-142, 51-245 thru 51-251, was deemed to be the
lowest bid of a responsible bidder, and the Mayor and Clerk were authorized to
execute contract for the Village with Western Underground Construction Company
for the work at price bid of $57,239.75, by unanimous vote of the Council.
Bid Awarded for Water Mains
On motion of Trustee Jorvig, seconded by Trustee Bo1mgren, the bid of
Richard M. Perron, received October 22, 1951, for the construction of water main
extensions 51-268 and 51-269, was deemed to be the lowest bid of a responsible
bidder, and the Mayor and Clerk were authorized to execute contract for the
Village with Richard M. Ferron for the work at price bid of $8,118.00, by unani-
mous vote of the Council.,
Alley Grading, Block 3, Boulevard Heights
On motion of Trustee Perkins, seconded by Trustee Jorvig, Sam Segal was
granted permission to grade alley in Block 3, Boulevard Heights as per. -grade
approved by the Village Council, October 1, 1951, upon receipt by the Clerk of
his performance bond or certified check for $500.00; work to be done under the
supervision of Village Engineer, Phil W. Smith -- the Village Engineer was further
instructed to put up a retaining wall to protect yard at 3048 Nevada Avenue
(Lot 21 and south 40 feet of Lot 22, Block 3, Boulevard Heights,)by unanimous
vote of the Council.
Request for Attornev General's Opinion Re: Liquor Licenses
-On motion of Trustee Perkins, seconded by Trustee Bolmgren, the Village
Attorney was instructed to write the Attorney General, calling his attention
to Section 340.11 and Section 340.40 MSA, and ask his opinion on whether or not
this will have any bearing on our Village situation of both On -Sale and Off -Sale
licenses being in the same name and same building, by unanimous vote of the
Council.

for the furnishing and installation of cathodic protection for four steel water
tanks was determined to be the lowest bid of a responsible bidder, and the
Clerk was authorized to issue a purchase order for same at price bid of $5230.30,

Tom Maple said that they have been trying for six years to get a contractor
to build a house that a Veteran earning X650.00 a week can pay for. He was
asked if 15 houses of the same structure and design would devaluate the.houses
on the East Side of Utah Avenue. He answered that ordinarily such a row of
houses would devaluate adjacent property, but in this case, because of the gravel
pit adjacent, there is no devaluatioh.
A property owner from the East Side of Utah Avenue, across the street
from the proposed houses was also present and claimed these houses would de-
valuate his property.
