B. Erickson at 8:20 P. Phelps -Drake Company, Inc. 9,120.00 On motion of Trustee Bolmgren, seconded by Trustee Perkins, the above bids were referred to the Village Engineer and Chairman of the Sewer Department Com- mittee for tabulation and reconmendation, by unanimous vote of the Council. - Bids for Movina Church•Buildin As advertised in the St. Louis Park Dispatch October 18, 1951, no bids were received for moving the building formerly occupied by the Holy Family Catholic Church from its present location at Lake Street and Zarthan Avenue and placing it on a foundation at the intersection of Brunswick Avenue with Lake Street. On motion of Trustee Perkins, seconded by Trustee Bolmgren, the accepting of bids for moving the above church was deferred to the meeting of November 5, 1951, by unanimous vote of the Council. Bids for Storm Sewer 51-266 As advertised in the St. Louis Park Dispatch October 18, 1951, sealed bids were received from the following bidders for the construction of storm sewer No. 51-266 to drain Alley in Block 300, Rearrangement of St. Louis Park: 1. Phelps -Drake Company, Inc. x$12705.00 2. Western Underground Construction Co. 1,580.00 On motion of Trustee Bolmgren, seconded by Trustee Perkins, the above bids were referred to the Village Engineer and Chairman of the Sewer Department Com- mittee for checking and recommendation, by unanimous vote of the Council. Building Inspector's Weekly Report The Building Inspector's report for week ending October 26, 1951, showing that 19 building permits were issued, totaling $$107,800.00 was read and ordered filed. 51" 52 October 29, 1951 CC) LOT BLOCK Bids for Grading Alley, Block 1, The Bronx X As advertised in the St. Louis Park Dispatch October 18, 1951, sealed bids were received from the following bidders for grading alley'in Block 1, The Bronx: 1. Walbon Excavating Company 3,930.00 176 On motion of Trustee Bolmgren, seconded by Trustee Perkins, the above bids Park $645.23 were.referred to the Village Engineer and Chairman of the Street Department Com- mittee for tabulation and recommendation, by.unanimous vote of the Council. Plat -Accepted - Minnehaha Gables Addition by Trustee Bolmgren, the plat of On motion of Trustee Perkins, seconded . Minnehaha Gables Addition was approved and accepted, and the Mayor and Clerk were authorized to sign same for the Village, subject to the Village Attorney's opinion as to title, by unanimous vote of the Council. Application for Incinerator Permit - Red Owl"Stores On motion of Trustee Perkins, seconded by Trustee Jorvig, the application of the Red Owl Stores for a permit to construct an incinerator at the read of their store building located in the Miracle Mile on Excelsior'Boulevard, was approved, and the Building Inspector was authorized to issue same, by unanimous vote of Council Members present, except Trustee Bolmgren who voted NO. Street Light Ordered On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the Northern States Power Company was instructed to install a 2500 lumen street light on the existing pole at the SE Croner of Lot 38, Highwood Tract, Lake Forest Addition, to light the public bus walk connecting France Avenue with Glenhurst Road, by unanimous vote of the Council. Contract for Office Rental to�Rural Public Health Nursing Office On motion of Trustee Perkins, seconded by Trustee Bolmgren, the Mayor and Clerk were authorized to sign in behalf of the Village a contract prepared by the Village Attorney for the rental on a month to month basis of office space consisting of two rooms presently not needed by the Village, in the Village Hall, to the Hennepin County Rural Public Health Nurses, to become effective November 1, 1951, in the amount of $125.00 per month. Motion was passed by unanimous vote of the Council. Report on Plans for Water Main Extensions Minnesota Department of health A report from Minnesota Department of Health, Division of Municipal Water Supply, dated October 10, 1951, approving plans and specifications for water main extensions in the Village, was read and ordered filed. Resolution On motion of Trustee Bolmgren, seconded by Trustee Perkins, the following resolution was adopted by unanimous vote of the Council: RESOLUTION CANCELLING NO -176 WATER MAIN ASSESSMENT WHEREAS it appears that by resolution of the Village Council adopted September 26, 1949, levying assessments for N-176 Water Main, the following lots were inadvertantly assessed, whereas these lots were not serviced by water; therefore BE IT RESOLVED that installments of such assessments heretofore paid in the respective amounts hereinafter set forth be refunded to the respective property owner, and, upon receipt of a signed verified claim, the Mayor and the Clerk be hereby authorized to issue warrants in payment of such refund to the respective property owner. October 29, 1951 Resolution On motion of Trustee Bolmgren, seconded by Trustee Perkins, the following resolution was adopted by unanimous vote of the Council: RESOLUTION REFUNDING AND CORRECTING P-1-43 WATER MAIN ASSESSMENT WHEREAS it appears that by resolution of the Village Council adopted October 16, 1950, levying assessments for Water Main P-1-43, the following error occurred: Parcel ##2020, Section 17, Twp. 117, Range 21 was charged for 493 feet (which included the side and front of this property whereas it should have been charged for 330 feet only, because 133 feet was side footage and should not have been assessed, and 30 feet was a vacated street, deeded to the Village for street pubposes; therefore, BE IT RESOLVED by the Village Council of the Village of St. -Louis Park that the 1951 installment of such assessment heretofore paid in the respective amount hereinafter set forth be refunded to the respective property owner, and, upon receipt of a signed verified claim and a paid tax statement, that the Mayor and the Clerk be hereby authorized to issue warrants in payment of such refunds to the respective property owner. 1951 Amt. Resolution On motion of Trustee Perkins, seconded by Trustee Jorvig, the following resolution was adopted by unanimous vote of the Council: RESOLUTION REFUNDING 0-39 ALLEY GRADING ASSESSMENT WHEREAS it appears that on August 31, 1951, the following property owner paid $7.08 ($3.52 per year and $.04 interest) on Alley Grading 0-39 Assessments for years 1952 and 1953; and whereas on April 19, 1951, the Village Council had cancelled the 1952 and 1953 payments for Alley Grading 0-39, because tree re- moval had been charged erroneously to this job instead of to Job 0-94, and thus the 1951 amount covered the cost of the entire job; therefore, M BE IT RESOLVED that installments of such assessments heretofore paid for 1952 and 1953, in the respective amount hereinafter set forth, be refunded to the respective property owner; and, upon receipt of a signed verified claim, that the Mayor and the Clerk be hereby authorized to issue warrants in payment of such refund to the respective property owner. Quit Claim Deed Accented On motion of Trustee Perkins, seconded by Trustee Bolmgren, the quit claim deed with Carlyle D. Jacobson and Maxine L. Jacobson, husband and wife as parites of the first part, and the Village of St. Louis Park as party of the second part for the following described property, was approved and accepted, and the Village Attorney was instructed to file same with the Office of the Register of Deeds in Hennepin County, by unanimous vote of the Council: FOR STORM SEWER PURPOSES, an easement over and across the N four (4) feet of Lot 17, and the S six (6) feet of Lot 16, Block 302, Rearrangement of the St. Louis Park, according to the plat thereof on file and of record in the office of the Register of Deeds of said Hennepin County, Minnesota, said easement being more particularly described as the free right to enter upon said premises and to excavate the soil and construct therein a storm sewer for the drainage of storm and surface waters and to forever use and maintain said storm sewer for drainage of storm and surface waters including the right to enter upon said premises at all reasonable times to inspect, October 29, 1951 Quit Claim Deed, Continued repair or reconstruct said sewer, said easement being granted upon the condition and understand- ing that the grantee shall restore the surface of the ground whenever any excavation is made for any repair, construction•or reconstruction to the same condition it was in prior thereto as nearly as possible. Complaint Re: Condition of Pennsylvania-Mtak.-31st Al White, 3042 Pennsylvania Avenue and others appeared regarding the condition of Pennsylvania Avenue from Minnetonka Boulevard to 31st Street. On motion of Trustee Perkins, seconded by Trustee Jorvig, the Village Engineer was instructed to confer with the Street Commissioner and see that the foregoing street is put in good condition, by unanimous vote of the Council. Petitions On motion of Trustee Perkins, seconded by Trsutee Bolmgren, the following petitions were referred to the Village Engineer and Chairman of the Street Department Committee for checking and recommendation, by unanimous vote of the Council: P-984 PETITION FOR SIDEWALK, signed by Harold H. Steffens, 3037 Monterey Avenue and others, dated October 29, 1951, for the construction of Sanitary Sewer in MONTEREY AVENUE FROM MINNETONKA BOULEVARD TO NORTH SERVICE DRIVE OF HIGHWAY NO. 7. Planning Commission's Report on Rezonin The Planning Commission's report dated October 13, 1951, on the Village Council's request for the rezoning of Lot 28, Block 330, and Lot 30, Block 170, Rearrangement of St. Louis Park, from Light Industrial Use to Residential Use, was read. No action taken at this time. Application for Off -Sale Intoxicating Liquor License R.M.Pratt The application of Robert M. Pratt, dated October 23, 1951, for a license to sell Intoxicating Liquor, Off -Sale at 5101 -Excelsior Boulevard, was read. On motion of Trustee Bolmgren, seconded by Trustee Perkins, the above appli- cation was referred to the Committee of the Whole, by unanimous vote of the Council. October 29, 1951 57 Statement for Appraisal Services Increased On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the statement of Appraisel Service Company, which was approved on July 30, 1951 in the amount of $250.00, is hereby approved in the amount of $300.00 to include the appraisel of 1 new pump house and 1 new water tank, not included in the original proposal, by unanimous vote of the Council.
