Lametti and Lametti $79,908.85 2. Western Underground Construction Co. 55,600.75 3. Phelps -Drake Company, Inc. 59,248.50 On motion of Trustee Bolmgren, seconded by Trustee Perkins, the above bids were referred to the Village Engineer and Chairman of the Sewer Department Com- mittee for tabulation and recommendation, by unanimous vote of the Council. Opposition to Sewer in Jersev-Mtka Blvd. -33rd Street Nels Larsen appeared. Said property owners on Jersey Avenue from Minne- tonka Boulevard to 33rd Street were opposed to the sewer going in at this time. Trustee Bolmgren informed him that the bids would be analyzed for the October 22nd meeting, and at that time the Village Council would decide what should be done about Jersey-Mtka. Blvd. -33rd Street project. Hdaring on Proposed Storm Sewer Construction Pursuant to notice published in the St. Louis Park Dispatch September 27 and October 4, 1951, a public hearing was had on proposed construction of storm sewer Improvement No. 51-267, to be known as Storm Sewer District No. 27, for the purpose of draining Alley in Block 4, Oak Lawn. No one appeared in opposition. Resolution On motion of Trustee Bolmgren, seconded by Trustee Perkins, the following resolution was adopted by unanimous vote of all members of the Council: RESOLUTION FOR CONSTRUCTION OF STORM SEWER M EREAS, the Village Council has met at the time and place specified in a notice published in the St. Louis Park Dispatch September 27th and October 4th, 1951, relating to Storm Sewer No. 51-267 and has heard all interested persons, appearing at said meeting and determined the necessity for said improvements, therefore, BE IT RESOLVED by the Village Council of the Village of St. Louis Park that construction of Storm Sewer Improvement No. 51-267 for Storm Sewer District No..27 for drainage of Alley in Block 4, Oak -Lawn, be hereby ordered in accord- ance titirith plans and specifications for the same which'have been prepared by the_Village Engineer; and advertisement for -bids is hereby authorized to be opened by the Village Council November 5, 1951. Sanitary Sewer 51-69 Removed from Contract On motion of Trustee Bolmgren, seconded by Trustee Perkins, Sanitary Sewer Improvement No. 51-69 for Sanitary Sewer District 1-T (Monterey Avenue from 27th Street to 26th Street) was removed from Phelps -Drake Cmmpany's Contract #113, dated June 25, 1951, subject to approval of Contractor, by unanimous v6te of the Council. Reimbursement for water main - Rex Pickett On motion of Trustee Bolmgren, seconded by Trustee Perkins, the claim of Rex L. Pickett for reimbursement of expense"in the amount of $250.00 for special water main construction to his residence at 2856 Brunswick Avenue which he alleges was incurred because of mistaken information given to him by the Village Water Department "that no Village water main extension was under consideration in said street", was allowed on a compromise basis of $175.00; the advance assessment paid by Mr. Pickett is to be retained and credited against water main assessment levied against his said property. Motion was passed by unanimous vote of the Council. Bingo - Lenox School PTA A letter from Donald Johnson, Vice President, Lenox School PTA, dated October 5, ?951, requesting that Lenox School PTA be granted permission to play Bingo at their Annual Carnival to be held on Saturday, November 17, 1951, was read. No objections raised. No action taken. 1951 Licenses On motion of Trustee Perkins, seconded by Trustee Bolmgren, the following applications for'1951 licenses were approved, and the Mayor and Clerk were authorized to issue licenses to expire December 31, 1951, by unanimous vote of the Council: C.� 1 1 1 1951 Licenses, Continued Sidney Brown Trax Oil Company Lilac Way Service Station Clark's Super Gas Station rt it if it Cigarette Incorporated " " Restaurant t' 3.2 Beer Off -Sale October 15, 1951 Soft Drink it It, Snyder's Drug Stores, If It n it It It 01 Opposition to So-called Low Cost Dwellings A group of residents from the vicinity of Alabama, Blackstone, Brunswick and Zarthan Avenues, between Cedar Lake Road on the South, and Wayzata Boulevard on the North appeared with their Counsel, N. W. Joubert, and presented a petition which read as follows: (Signed by 0. L. Davis, 6000 Cedar Lake Avenue and others). "It is currently reported that one or more builders contemplate building a number of so-called low cost residences in the vicinity of Alabama, Blackstone, Brunswick and Zarthan Avenues, and between Cedar Lake Road on the South and Wayzata Boulevard on the North. These projected houses, the undersigned understand will be built without basements and will be very small, and will not be in keeping with residences already built in the area. We believe that the proposed buildings will depreciate the character of`this portion of St. Louis Park and will depreciate the values of residences already built in this neighborhood. Each of the undersigned is an owner of property in the vicinity in question and is opposed to the proposed residence construction, and petitions the Council to do nothing to aid or further encourage the proposed construction, but to prevent such construction." Mr. Joubert urged the Council to consider every possible means to prevent construction of the proposed houses mentioned in the petition. He feels that there will be more of them built and will have a definite devaluation of the nearby properties, and make St. Louis Park the slum area of the Suburbs. At the request of Mayor Erickson, the Village Attorney, E. T. Montgomery reviewed the Mandamus Proceedings now pending against the Village to compel the issuance of building permits for similar houses on Utah Avenue. He recommended that the Council investigate these houses under construction and consider additional restrictions in the Building Ordinance to protect the purchasers and neighbors of the houses. Mr. Joubert asked what or how do other contractors or builders feel about these low cost homes. Builder Sam Segal was called on, but he felt he should not make a definite statement. A resident asked "Why doesn't the -Building Inspector do,something about this?" She was told by the Village Attorney that he has only such authority as is specified in the Building Code, which relates to strength of construction, plumbing, heating and electric wiring. He cannot determine prices, cost, selling price or architectural design, or prohibit construction which is in his opinion undesireable if not specifically prohibited by the Building Ordinance. The question was asked "What can the Village Council or the Village Attorney do about these homes which are spreading all over the Village?" Trustee stated that a good picture of what is contemplated in undesireable and inadequate housing has been presented, and the Village Council should do something for the protection of the prospective purchasers of the houses, and also the neighbors whose property will be depreciated by the construction of same. On motion of Trustee Jorvig, seconded by Trustee Bolmgren, the Building Inspector and Village Attorney were instructed to study our present Building Ordinance, and the Zoning Ordinance, with the view of strengthening same so that the present problem of homes now being built by Adolph Fine Company, in the 1600 Block on Blackstone and Alabama Avenues, will be adequately met. Motion was passed by unanimous vote of the Council. Bond Approved On motion of Trustee Bolmgren, seconded by Trustee Perkins, the following bond was approved by unanimous vote of the Council: PLUMBING LICENSE BOND with Benjamin Farr as principal, and The Ohio Casualty Insurance Co. as surety, dated September 27, 1951, in the amount of $4,000.00. 40 October 15, 1951 Cc CA Building Inspector's Weekly Reports C -I The Building Inspector's weekly reports for weeks ending October 5, W 1951 and October 12, 1951, showing that 73 building permits were issued, 9L totaiing $494,375.00, was read and ordered filed. Bid Awarded for Radio Communication Equipment On motion of Trustee Bolmgren, seconded by Trustee Jorvig the bid of Motorola Company, Incorporated, received October 1, 1951, for the furnishing and installation of radio equipment in Village owned mobile units, was deemed to be the lowest bid of a responsible bidder, and the Clerk was authorized to issue purchase order for same at price bid of $3,176.60, by unanimous vote of the Council. Petitions for Street Improvements On motion of Trustee Bolmgren, seconded by Trustee Perkins, the following petitions were referred to the Village Engineer and Chairman of the Street Department Committee for checking and recommendation, by unanimous vote of the Council: P-979 PETITION FOR CURB AND GUTTER, signed by John W. and Iva P. Morrison, 3065 Utah Avenue and others, dated October 15, 1951, for the construction of curb and gutter on the EAST SIDE OF UTAH AVENUE FROM MINNETONKA BOULEVARD TO 31ST STREET. Petition for Sanitary Sewer On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the following petition was referred to the Village Engineer and Chairman of the Sewer Depart- ment Committee for checking and recommendation, by unanimous vote of the Council: P-950 PETITION FOR SANITARY SEWER, signed by F. Letter from Village of Edina Re: Traffic A letter from P. Theo Olsson, Village Manager for the Village of Edina, dated October 10, 1951, in response to our letter dated October 5, 1951, regard- ing traffic to the Country Club District turning off_ Highway No. 100 at 432 Street, rather than at Sunnyside Road, was read and ordered filed. Letter from Victor Carlson & Sons, Inc. A letter from Victor Carlson & Sons, Incorporated, dated October 10, 1951, stating that they would assume no responsibility, nor liability of any kind sustained on the Adolph Fine Subdivision in Texa-Tonka Addition, was read. On motion of Trustee Perkins, seconded by Trustee Bolmgren, the foregoing matter was referred to the Village Engineer for checking and report, by unanimous vote of the Council. Demand for Stop Signs On motion of Trustee Perkins, seconded by Trustee Jorvig, the petition of M. L. Nickey, 4200 Wooddale Avenue and others, dated October 11, 1951, demanding that stop signs be placed at the intersection of Browndale and Wooddale Avenues, and at the intersection of Wooddale and 422 Street, was read and referred to the Police Chief and Chairman of the Police Department Committee for checking and report, by unanimous vote of the Council. Letter from Edina Village Re: Speeding Along the Belt Line A letter from the Village Manager of Edina, dated October 12, 1951, request- ing a meeting with the State Highway Department and Officials df the various suburbs, relative to speeding on the Belt Line was read, and the Clerk was author- ized to inform him that someone from the Village would attend. Letter from Supt. St. Louis Park Schools A letter from Harold R. On motion of Trustee Perkins, seconded by Trustee Bolmgren, November 5, 1951 was set as date of hearing on the above request for Alley Vacation, by unanimous vote of the Couhcil. 1 1 1 October 15, 1951 Purchase of Aerial Map and Atlas Approved On the recommendation of the Planning Commission, it was moved by Trustee Perkins, seconded by Trustee Jorvig, that the Clerk issue a purchase order for One (1) Mosaic Aerial Map of the Village of St. Louis Park at a cost of $148.00, and One (1) Atlas of the Village at a cost of $316.00, by unanimous vote of the Council. Storm Sewer Ordered On motion of Trustee Perkins, seconded by Trustee Bolmgren, the Village Engineer was authorized to install an 1811 Storm Sewer between W$bster Avenue and Lake Street on Minnetbnka Boulevard at an estimated cost of $950.00, payable with Minnetonka Boulevard paving project. Motion was passed by unanimous vote of the Council. J. Johnson On motion of Trustee Perkins, seconded by Trustee Jorvig, the claim of A. J. Johnson, 4217 Princeton Avenue for damages to his property by the Sewer Contractor by piling his diggings on ground just prepared for seeding, was referred to the Village Engineer for checking and recommendation, by unanimous vote of the Council. Clerk Authorized to Sign Proof of Loss Statements On motion of Trustee Jorvig, seconded by Trustee Perkins, the Clerk was authorized to sign PROOF OF LOSS statements for windstorm loss to the roof of the Ball Park on July 20, 1951, in the amount of $34.41; and for lightning loss to the Village water tank on July 20, 1951, in the amount of $237.22, by unanimous vote of the Council.
