16 September 24, 1951 Hearing on Proposed Street Grading A hearing was had on proposed grading Improvement No. 51-260 of Flagg Avenue from Cedar Lake Road north to north line of South of Section 7, Township 117, Range 21. No one appeared. Resolution On motion of Trustee Perkins, seconded by Trustee Bolmgren, the following resolution was adopted by unanimous vote of all members of the Council present: RESOLUTION ORDERING GRADING OF STREET WHEREAS, the Village Council has met at the time and place specified in a notice published in the St. Louis Park Dispatch September 6 and 13, 19512 relating to grading Improvement No. 51-260 and has conducted a public hearing and heard all interested persons and determined the necessity for said improve- ment, therefore, BE IT RESOLVED by the Village Council of the Village of St. Louis Park that Improvement No. 51-260 for grading of Flagg Avenue from Cedar Lake Road north to north line of South of Section 7, Township 117, Range 21, be hereby ordered in accordance with plans and specifications for the same which have been prepared by the Village Engineer. Hearing for 144s for Sanitary Sewer - 3000 Block, Dakota _Advertise On motion of Trustee Bolmgren, seconded by Trustee Jorvig, October 29, 1951 was set as date for hearing on the construction of sanitary sewer in Dakota Avenue from Minnetonka Boulevard to 31st Street, by unanimous vote of Council Members present. Proposed Homes on Utah Adolph Fine A group appeared in opposition to the proposed small homes to be built by Adolph Fine,on Utah Avenue, without basements. Someone asked if the valuation of such homes could be regulated by ordinance. Mayor Erickson answered that this could only be done in the property deed, and that our.ordinance calls for houses not smaller.than 22 x 22. die stated that he would be infavor of passing an ordinance that would limit houses of the same design to 5 in a group. The group indicated that they wanted the Ordinance changed so that the minimum size ofany home would be 24' x 241. Mr. Pickett told about the shanties being built in his block. Mrs. Pickett said the Veterans were not protected. Mayor Erickson suggested that she sees that a warning is given to the Veterans in various ways. Irwin Johnson stated that these houses are Veteran Approved. Mayor Erickson said he would like to talk to the group again before they leave. Plans for Drainage - Louisiana -29th Mtka On motion of Trustee Perkins, seconded by Trustee Jorvig, the Village Engineer was instructed to prepare plans and specifications and drainage area for draining of Blocks 7 and 8, High Holborn Addition, to drain low spot on Louisiana Avenue between 29th Street and Minnetonka Boulevard, by unanimous vote of Council Members present. Property for.Storm Sewer Drainage On motion of Trustee Perkins, seconded by Trustee Jorvig, the Village Attorney was instructed to purchase Lots 13, 14, 15, Block 7, High Holborn Addition for use as storm sewer drain sump to drain the low spot on Louisiana Avenue between 29th - Street and Minnetonka Boulevard, by unanimous vote of the Council. October 1, 1951 19, Plat Approved -- Texa-Tonka Second Addition On motion of Trustee Perkins, seconded by Trustee Bolmgren, the Plat of Texa-Tonka Second Addition was approved, and the Mayor and Clerk were authorized to sign same for the Village, by unanimous vote of the Council, subject to examination of title by the Village Attorney. Resolution Ordering Sanitary Sewer Improvement No. 51-201 On motion of Trustee Bo]mgren, seconded by Trustee Perkins, the following resolution was adopted by unanimous vote of the Council: BE IT RESOLVED that reconsideration of Sanitary Sewer Improvement No. 51-201 (Brooklawns) be abandoned and said Improvement be hereby ordered to be in- cluded in contract dated September 24, 1951 with Western Underground Construction Company. Bus Turn Around A group appeared regarding the Village property now being used for a bus turn around, near the water tank and pump house on Idaho Avenue at 29th Street, Trustee Bolmgren brought them up to date on this. Someone asked if a fence would be put around the turn around. Mayor Erickson said that the Park Board have agreed to take care of a fence to protect children. Use of Machines for Digging Cesspools . A group of Builders, Plumbers and Terry Excavating Company appeared and discussed the present ordinance prohibiting the use of machines for digging cess- pools. Trustee Perkins suggested that we have a meeting with the Village Engineer, the Building Inspector, Plumbers and Builders. On motion of Trustee Perkins, seconded by Trustee Jorvig, the Clerk was instructed to send notices to the Village Engineer, Building Inspector, Plumb- ing Inspector and Council Members for a meeting with the Plumbers and Builders to discuss Ordinance No. 379 (An Ordinance Amending Ordinance No. A-3 Relating toConstruction and Maintenance of Cesspools), on Friday, October 5, 1951, at 7 P. M. at the Village Hall. Motion was passed by unanimous vote of the Council. Bin o A request from the Church of the Holy Family, dated September 26, 1951, for permission to conduct bingo games at theri bazaar to be held November 3 and 42 1951, and on December 8 and 15, 1951, was read. No objections were raised. No action taken. New Grade for Alley. Block 3, Boulevard Heights On motion of Trustee Perkins, seconded by Trustee Bolmgren, the new grade for Alley, Block 3, Boulevard Heights as set by Village Engineer, Phil W. Smith was approved, and the Village Engineer was authorized to spend an amount not to exceed $120.00 to grade the back yard at 3048 Nevada Avenue, subject to approval of the owner, in full payment for any claim by the owner for damages. Motion was passed by unanimous vote of the Council. Petition for Rezoning L. N. Smith On motion of Trustee Jorvig, seconded by Trustee Perkins, the petition of L. N. Smith, dated October 1, 1951, for the rezoning of the following described property from Multiple Dwelling to Commercial Use, was referred to the Planning Commission for checking and recommendation, by unanimous vote of the Council: Thirty (30') Feet (as shown on sketch) - Commencing at NW corner of SE� of SE's; thence S 3571; thence E 38.85' to NWly line of Excelsior Boulevard; thence NEly along said road line 135' to actual point of beginning; thence deflect 87 degrees to the left 179.9' to a point in W line of SE4 of SEw; thence N 130.8' to NW corner thereof; thence 254.51; thence S 45 degrees 36' E to Nally line of Excelsior Boulevard; thence Sally to beginning. Bid Awarded for Storm Sewer #2 On motion of Trustee Perkins, seconded by Trustee Bolmgren, the bid of Western Underground Construction Company received earlier this meeting for the construction of Storm Sewer #25 was deemed to be the lowest bid of a responsible, bidder, and the Mayor and Clerk were authorized to execute contract with Western Underground Construction Company for the work at price bid of $3,870.00, by unanimous vote of the Council. Contractor's Bond On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the following bond was approved by unanimous vote of the Council: 20 October 1, 1951 Bond, Continued CONTRACTORS BOND with Phelps=Drake Company, Inc. as principal, and Peerless Casualty Company as surety, dated September 4, 1951, in the amount of $176,992.50, covering the construction of sanitary sewers in Sanitary Sewer District No. 2-K. Bid Awarded for � Ton Pickup _Truck On motion of Trustee Bolmgren, seconded by Trustee Perkins, the bid of The Woodhead Company, Incorporated received September 24, 1951, for the furnish- ing of One (1) 2 Ton Pickup Truck, according to specifications for same on file with the Office of the Village Clerk, was deemed to be the lowest bid of a responsible bidder, and the Clerk was authorized to issue purchase order for same at the amount bid of $1,282.95, by unanimous vote of the Council. Special Permit to Connect to Water Main On motion of Trustee Bolmgren, seconded by Trustee Perkins, a special permit was granted to Clair F. Wendt to connect their home at 3200 Lynn Avenue, located 100 feet west of Lynn Avenue, to the water main on Lynn Avenue, with the understanding that he pay an assessment of $101.25 at the time he takes out the regular permit; this assessment to be credited to the property when the water main is constructed past said property. Work shall be done under the supervision of the Superintendent of the Water Department. Motion was passed by unanimous vote of the Council. Permission to Place Poles On motion of Trustee Perkins, seconded by Trustee Bo]mgren, the Northern States Power Company was granted permission to place poles at the following locations, by unanimous vote of the Council: One (1) pole on Natchez Avenue and 41st Street. 1951 Licenses On motion of Trustee Jorvig, seconded by Trustee Bolmgren, the following applications for 1951 licenses were approved, and the Mayor and Clerk were author- ized to issue licenses to expire December 31, 1951, by unanimous vote of the Council: Harry's Pure Oil Station Soft Drink Brookside Dairy Bar Milk - Retail Resolution On motion of Trustee Perkins, seconded by Trustee Bo]mgren, the following resolution was adopted by unanimous vote of the Council: RESOLUTION -REFUNDING 0-39 ALLEY GRADING ASSESSMENT WHEREAS it appears that on November 9, 1950, the following property owner paid $33.88 on Alley Grading 0-39 assessments for years 1951, 1952 and 1953; and whereas on April 19, 1951, the Village Council cancelled the payments for years 1952 and 1953 for Alley Grading 0-39 (because tree removal had been charged erroneously to this job instead of to Job 0-94, and thus the 1951 amount covered the cost of the entire job); therefore, BE IT RESOLVED that installments of such assessment.heretofore paid for 1952 and 1953 in the respective amount hereinafter set forth, be refunded to the respective property owner; and, upon receipt of a signed verified claim, that the Mayor and the Clerk be hereby authorized to issue wattant in payment of such refund to the respective property owner. Suggested Ordinance for well Drilling A letter from the Suburban Building Department Administrators, dated September 24.,1951, enclosing a copy of a suggested ordinance providing for the regulation, liscensing and bonding of well drillers and establishing the minimum requirements in the installation of wells and other water supply systems, was read. On motion of Trustee Jorvig, seconded by Trustee Perkins, the above matter was referred to the Village Attorney for checking and recommendation, by unanimous vote of the Council. Hearing on Proposed Construction of Storm Sewer 51-237 A hearing was had on proposed storm sewer Improvement No. 51-237. No one appeared in opposition. PETITION FOR ALLEY GRADING, signed by Jerome Bloom, owner of Lakeland Door Company, 3715 Oregon Avenue, dated September 26, 1951, for the grading of Alley in Block 158, Rearrangement of St. Louis Park (from Lake Street to Lot 25). Hearing Date Set for Proposed Sanitary Sewer Extensions On motion of Trustee Bolmgren, seconded by Trustee Perkins, October 22, 1951 was set as date of hearing for proposed sanitary sewer extensions --- Improvement Number 51-270, in Hampshire Avenue from 28th Street to 29th Street, and in 29th Street from Georgia Avenue to Hampshire Avenue. Motion was passed by unanimous vote of the Council. Suecial Permit for Sidewalk Denied On motion of Trustee Perkins, seconded by Trustee Bolmgren, the request of Russell Sewall for a special permit to construct sidewalk in front of his home at 2620 Xenwood Avenue (Lot 4, Auditors Subdivision No. 350) was denied on the recommendation of the Village Engineer, who states that the construction of this walk would cut into a deep slope and ruin the appearance of the lawns on each side of this lot. Motion was passed by unanimous vote of the Council. Advertise for Bids for Lift Station On motion of Trustee Bolmgren, seconded by Trustee Perkins, the Clerk was instructed to advertise for bids for a lift station to be constructed at Bruns- wick Avenue and Meadowbrook Boulevard; bids to be opened October 29, 1951, by unanimous vote of the Council. International Police Officers Conference On motion of Trustee Bolmgren, seconded by Trustee Perkins, Police Chief, Andy Nelson was authorized to attend the International Police Officers Conference Resolution On motion of Trustee Perkins, seconded by Trustee Bolmgren, the following resolution was adopted by unanimous vote of all Members of the Council: RESOLUTION ORDERING ALLEY GRADING WHEREAS, the Village Council has met at the time and place specified in the notice published in the St. Louis Park Dispatch July 18 and 25, 1951, and heard all interested persons appearing at said meeting and having regularly deferred action on said hearing, and action thereon having been referred to the committee of the whole and said committee having recommended that the proposed grading be ordered, therefore BE IT RESOLVED, by the Village Council of the Village of St. Louis Park that Improvement No. P-227 for grading alley in Block 1, The Bronx, be hereby ordered in accordance with plans and specifications which have been prepared by the Village Engineer and which are hereby approved, said specifications to provide an alternate bid for a retaining wall. Overtime Authorized for Street For Street Foreman On motion of Trustee Perkins, seconded by Trustee Bolmgren, Burt Zila, Street Foreman was authorized to enter claims for his services on Saturdays when ordered to work by the Street Commissioner at a rate of $2.85 per hour during the month of October, 1951,'by unanimous vote of the Council. Two -Foot Temporary Sidewalk Authorized Village Engineer Phil'W. Smith reported that'Victor Carlson & Sons had been awarded a contract for'the construction of sidewalk on the east'side of Quentin Avenue from 27th Street to 28th Street. Because of a 121 bank along the R.'E. White property known as Tract "HII, at the NE corner of the intersection of Quentin and 28th Street, a high concrete wall would be necessary if a walk is constructed at this timep he recommended that the walk be canceled along this 137' lot. Also recommended that permission be granted to construct a temporary two -foot walk along the curb to serve the people to the north until such time as the lot is lowered and the regulation sidewalk is constructed in the proper location. On motion of Trustee Perkins, seconded by Trustee Bolmgren, the above recommendation was approved, and request granted, by unanimous vote of the Coun- cil. Claim for Personal Damages Approved - Martin Keborn The Village Attorney's report and recommendation, dated September 25, 1951, on the claim for personal damages of Martin Keborn who claims he was injured April 15, 1951, when he stepped on a sewer manhole or surface drain' in'Alabama Avenue in front of 2936 Alabama Avenue, was read.
