Montgomery, dated September 14, 1950 was read relative to the claim of William Devitt in the amount of $44.50 to his car-; damages which occurred on July 19, 1950, when he drove East on 28th Street just before crossing the M. N. & S. Railroad tracks and struck a Village manhole which was projecting above the level of the Street. On motion of Trustee Jorvig, seconded by Trustee Bolmgren, the above claim was approved, and the Mayor and Clerk were authorized to issue warrant to Mr. Devitt in the amount of $y44.50, by unanimous vote of Council Members presents. Bank, Mpls. 10,565.13 Bids for Sidewalk, Curb & Gutter Construction As per advertisement published in the St. Louis Park Dispatch September 13, 1950, sealed bids were received from the following bidders for the construction of sidewalk and curb and gutter improvements at various locations in the Village in accordance with plans and specifications on file and available at the office of the Village Engineer ----- Name of Bidder Curb & Gutter Sidewalk Victor Carlson & Sons, Incorporated $1.75 per L. F. $.40 per Sq. Ft. On motion of Trustee Perkins, seconded by Trustee Bolmgren, the above bid was determined to be the lowest bid of a responsible bidder, and the Mayor and Clerk were authorized to execute contract between the Village and said Bidder in form heretofore approved at the prices specified in said bid. Motion was passed by unanimous vote of Council Members present. Assessment Hearings - Sidewalk Pursuant to notice published in the St. Louis Park Dispatch, August 23, 1950, separate hearings were had on proposed assessments covering the cost of the following ireprovements now completed ----- 0-11 West side Vernon Avenue from 28th to 29th Sts. 0-13 West side Idaho Avenue from 28th to 29th Sts. No one appeared. Resolution On motion of Trustee Perkins, seconded by Trustee Bolmgren, the following resolution was adopted by unanimous vote of all members of the Council present: ASSESSMENT RESOLUTION WHEREAS, pursuant to resolution adopted by the Village Council August 14, 1950, and published in the St. Louis Park Dispatch August 23, 1950, the Village Council has met at the time and place specified in said resolution and has heard all -testimony offered by interested persons in connection with proposed assess- ments for each of the following sidewalk improvements: IMPROVEMENT NUMBER LOCATION 0-11 West side Vernon Avenae from 28th to 29th Streets 0-13 West side of Idaho fr6m 28th to 29th Str&ets therefore, BE IT RESOLVED by the Village Council of the Village of St. Louis Park that there be hereby levied and assessed against each of the lots and tracts of land described in said'proposed assessments an assessment equal to the sums therein respectively det forth payable in three annual installments, the first of which ' shall be due June 30, 1951, with interest at 5% per annum from date of this reso- lution, and BE IT FURTHER RESOLVED that each lot and tract of land described in said proposed assessments is hereby determined to be benefited in an amount equal to the said assessments therein levied against it. September 25, 1950 Hearing A hearing was had on proposed assessment roll for Sanitary Sewer District No. 1-s. No one appeared. Resolution On motion of Trustee Bolmgren, seconded by Trustee Perkins, the following resolution was adopted by unanimous vote of Council Members present: RESOLUTION ADOPTING ASSESSMENT FOR SEWER DISTRICT NO. 1-S WHEREAS, the Village Council has met at the time and place speci.f ied in a notice published in the St. Louis Park Dispatch September 13, 1950, of hearing on proposed assessments for Sanitary Sewer District No. 1-S, and the Council has conducted a public hearing and has heard all interested persons, and it appearing that the proposed assessment roll in duplicate covering the cost of construction of sanitary sewers at the following locations in said District has been duly filed with the Village Clerk ----- L O C A T I O N S Ottawa Avenue from West 28th Street to West 27th Street Ottawa Place from Princeton Avenue to Ottawa Avenue West 27th Street from Princeton Avenue to Ottawa Avenue Princeton Avenue from Ottawa Place to West 27th Street Abandoned R. R. R/W from West 27th Street to Alley, Block 2, Barretts Addition therefore, BE IT RESOLVED by the Village Council of the Village of St. Louis Park that said proposed assessment roll be hereby approved and that there be hereby levied and assessed against each and every tract, lot and parcel of land described in said assessment roll an assessment equal to the sums therein respectively set forth, said assessments to be payable in ten equal annual installments with interest at 5% per annum. The first of said installments shall be payable con- current with taxes levied in the year 1950 for the year 1951. Each of said lots, tracts and parcels of land is hereby found to be benefited in a sum equal to the assessment levied herein, and BE IT FURTHER RESOLVED that the total assessable cost of said sewers is hereby determined to be $19,062.00. Hearing Separate hearings were had on proposed assessments for Sanitary and Storm Sewer Projects Nos. 0-146 and 0-155. No one -appeared. Request for Sidewalk Mrs. Alberts=, 2721, Lynn Avenue asked about sidewalk on Lynn Avenue from 28th Street north across bog, for children to use to go to the Fern Hill School. On motion of Trustee Perkins, seconded by Trustee Bolmgren, the above matter was referred to the Village Engineer for checking and recommendation, by unanimous vote of Council Members present. ' Proposed Oak Park Addition A letter from H. E. Chard, District Engineer, Minnesota State Highway Dept., dated September 25, 1950, relative to Service Drive for proposed Oak Park Addition was read. On motion of Trustee Perkins, seconded by.Trustee Bolr�gren, the proposed plat of Oak Park Addition with copy of MrX. Chard's letter were referred to the Planning Commission for checking and recommendation, by unanimous vote of Council Members present. Trailer Permit On motion.of Trustee Bolmgren, seconded by Trustee Perkins, the application of Donald E. Maddox to inhabit a trailer home at the rear of 4050 Yosemite Avenue was approved, and a permit for period ending February 28, 1951 was granted by unanimous vote of Council Members present. Building Inspectors Weekly Report - The Building Inspector's weekly report for week ending September 22, 1950 showing that 53 building permits were issued totaling $467,000.00, was read and ordered filed. Licenses On motion of Trustee Perkins, seconded by Trustee Bolmgren, the following applications for 1950 licenses were approved, and the Mayor and Clerk were author- ized to issue licenses to expire December 31, 1950, by unanimous vote of Council Members present: 1 1 1 September 25, 1950 7 Licenses, Continued ----- Minneapolis Golf Club Trap Shooting Heller Electric Co. Electric Everett Taylor Electric Hearing Date Set for Water Main On motion of Trustee Bolmgren, seconded by Trustee Perkins, October 23, 1950 was set as date for hearing on the construction of water main in BLACKSTONE AVENUE FROM 28TH STREET TO 27TH STREET; IN OTTAWA AVENUE FROM WEST 422 STREET TO LOT 4, MORNING PARK ADDITION; IN LEARY AVENUE FROM OTTAWA AVENUE TO PRINCETON AVENUE; and IN PRINCETON AVENUE FROM LEARY AVENUE TO 421 STREET - the area to be assessed is the adjacent lots and parcels of land. Motion was passed by un- animous vote of Council Members present. Permission to Place Pole On motion of Trustee Bolmgren, seconded by Clerk Justad, the Northern States Power Company was granted permission to place One (1) pole on Lynn Avenue South of Highway No. 7, by unanimous vote of Council Members present. Bingo - A letter from St. George's Episcopal Church, dated September 24, 1950, re- questing permission to play Bingo at their Annual Bazaar on November 11th, 1950 was read. No objections raised. No action taken. Report on Plans and Specifications on Water Main Extensions, St: Louis Park A report from the Minnesota Department of Health, Division of Municipal Water Supply, dated September 18, 1950 on the plans and specifications on water main extensions, St. Louis Park was read and ordered -filed. Resolution - List 316-C Trustee H. J. Bolmgren offered the following resolution and moved its - adoption: RESOLUTION APPROVING NON CONSERVATION LIST NO. 316-C WHEREAS, the Village Council of the Village of St. -Louis Park, Hennepin County, Minnesota, has received from the County Auditor of Hennepin County, Minnesota, a list of lands in said Village which became the property of the State of Minnesota under the provisions of law declaring the forfeiture of lands to the State for non payment of taxes, which said list has been designated as List 11316-C", September 19, 1950, and WHEREAS, each parcel of land described in said list has heretofore been classified by the Board of County Commissioners of Hennepin County, Minnesota as non -conservation land and the sale thereof has heretofore been authorized by said Board of County Commissioners; , NOW, THEREFORE, be it resolved by said Village Council, acting pursuant to Minnesota Statutes for 1945, Section 282.01, that the said classification by said Board of County Commissioners -of each parcel of land described in said list as non -conservation land be and the same is hereby approved and that the sale of each such parcel of land be and the same is hereby approved. Re: Additional Trunk Line A letter from the NW Bell Telephone Company, dated September 21, 1950, relative to an additional trunk line to the Village Switchboard, was read. On motion of Trustee Perkins, seconded by Trustee Bolmgren, the Clerk was authorized to order one more trunk line to the Village Switchboard, by unanimous vote of Council Members present. Trustee Jorvig Trustee Jorvig arrived at this time - 9:40 P. 141. Letter from St. Louis Park Public Schools Re: Charges for Polling Places A letter from the St. Louis Park Public Schools, signed by H. R. Enestvedt, Supt., informing the Village Council of revised rental schedule of school build- ings, effective September 1, 1950, for polling places for -elections would be 4$25.00 for each school for each election, was read and ordered filed. University Evening Course in Municipal Law, Etc. A Bulletin and Schedule of courses for Fall Semester at University of Minnesota Extension Division, was read. On motion of Trustee Perkins, seconded by Trustee Bolmgren, R..B. Connery was authorized to attend the above evening course in Municipal Law with expenses in the amount of $16.00 paid. Motion was passed by unanimous vote of the Council. Grading and Graveling - Bid Awarded The tabulation of bids for grading and graveling projects P-224 to P-236 inclusive, received September 18, 1950, presented by Village Engineer, Phil W. Smith was read. On motion of Trustee Perkins, seconded by Trustee Bolmgren, the bid of Terry Brothers, Incorporated, received September 18, 1950, for grading and gravel- ing projects 167, thru P_-236 was deemed to be the lowest bid of a responsible bidder, and the Mayor and Clerk were authorized to execute contract between the Village and Terry Brothers, Incorporated for the work in the amount bid of $$152881.00, by unanimous vote of the Council. Water Main Extensions - Bid Awarded On motion of Trustee Bolmgren, seconded by Trustee Bolmgren, the bid of Western Underground Construction Company, received September 18, 1950, for the construction of water main extensions P -22T '& 250; 252,&, 253 was deemed to be the lowest bid of a responsible bidder, and the Mayor and Clerk were authorized to execute contract be Western Underground Construction Company for the work in the amount bid of x$63,364.40, by unanimous vote of the Council.(Except P-248.) Letter Re: Curb & Gutter, Tar Mat and Sidewalk (Ruben F. Anderson) A letter from Ruben F. Anderson, 2757 Vernon Avenue, dated September 23, 1950, requesting that the Village Council come over and look at the curb that was put in last fall. Stating further that the,tar mat was scraped off and the street lowered about one foot, and that they are now putting in forms for side- walk - which they would also like checked, was read. On motion of Trustee Perkins, seconded by Trustee Bolmgren, the above matter was referred to the Village Engineer for action, by unanimous vote of the Council. Change in ;Mage Rate - Donald Sorensen On motion of Trustee Perkins, seconded by Trustee Jorvig, on the recommenda- tion of Village Engineer, Phil W. Smith, the temporary wa-ge rate of Donald Sorensen of x$1.50 per hour was increased to $1.75 per hour, by unanimous vote of the Council. 1 1 iJ 1 1 September 25, 1950 Change in Wage Rate - Carl Miller On the, recommendation of Phil W. Smith, Village Engineer, it was moved by Trustee Perkins, seconded by Trustee Bolmgren, that the wage rate of Carl Miller of $1.75 per hour be increased to y$1.85 per hour, effective October 1, 1950, by unanimous vote of Council Members present. Minutes The minutes of meeting held September 18, 1950 were read and approved as read. Return of Bid Check Authorized On motion of Clerk Justad, seconded by Trustee Bolmgren, the Treasurer was authorized to return the bid checks left with bids for sewer cleaning equipment, received August 14, 1950 to All State Pipe Cleaning Company The Turbind Sewer Machine Company Motion was passed. by unanimous vote of the Council. Application for Permit to Erect Gas Station (Phillips 11661,) An application from Phillips Petroleum -Company, 212 -Sixth Street, Minnea- polis 2, Minnesota, dated September 25, 1950, for a building permit to erect a Model 116611 A, two enclosured gas station on the NE Corner of 362 Street and Ex- celsior Boulevard, was read. On motion of Trustee Bolmgren, seconded by Trustee Perkins, the above application was referred to the Planning Commission for checking and recommenda- tion, by unanimous vote of the Council. Grading of Sumter Avenue -34th to 35th A letter from Arvid E. Carlson & Son, Inc., dated September 20, 1950, requesting permission grade and fill Sumter Avenue from 34th to 35th Streets, was read. On the recommendation of Phil W. Smith, Village Engineer, it was moved by Trustee Perkins, seconded by Trustee Bolmgren that Arvid Carlson and Sons, Incorporated be permitted to grade and fill Sumter Avenue between 34th Street and 35th Street (in front of their properties) under the supervision of the Village Engineer, subject to receipt of bond in amount to be determined by the Village Engineer. Motion was passed by unanimous vote of the Council. Street Lights Ordered On motion of Trustee Perkins, seconded by Trustee Bolmgren, the Northern States Power Company was authorized to install a street light.,on Salem Avenue and 41st Street, Vilest of Wooddale Avenue; and three lights on Excelsior Boulevard adjacent to Meadowbrook Manor Project, by unanimous vote of the Council. Resolution On motion of Trustee Jorvig, seconded by Trustee Bolmgren,/'the following resolution was adopted by unanimous vote of.all Members of the -Council: RESOLUTION ORDERING DEMOLITION OF BUILDING WHEREAS, the Building Inspector of the Village of St. Louis Park has in- formed the Village Council that the building which was partially constructed on Lot 13, Block 2, High Holborn, was built in violation of the building ordinance of the Village of St. Louis Park in several particulars including improper spacing of studs and construction of masonry walls which were not properly plumbed; that the building permit issued for construction of said building was canceled by the Village Council for violation of the building ordinance more than one year prior hereto and no application has been made for renewal of the permit nor has any further construction work been done on said building, and WHEREAS, it appears•t hat the Village Clerk has duly caused notice to be served upon all owners, occupants, mortgagees, lessees and agents of said premises to show cause before the Village Council at its meeting September 11th, 1950, why the building should not be demolished; that the owners of record of said premises are Donald E. Upton and Florence Upton and the same were served personally with said notice on September 9, 1950, at Mound, Minnesota; that said record owners have notified the Village Clerk by telephone that they disclaim any interest in the premises; that said building permit was taken out by and Leonard Boeche, 2505 Lowry N. E., Minneapolis, Minnesota; that said Leonard Boeche cannot be found at said address or elsewhere; that a copy of the notice was mailed to him at said address and said notice has not been returned, and 82 September 25, 1950 Resolution Ordering Demolition of Building, Contid. WHEREAS, no persons interested in said premises appeared at the Village Council meeting September 11, 1950, and the Village Council made its findings and ordered that the said building -be demolished on or before September 18, 1950; that said building has not been demolished, therefore, BE IT RESOLVED by the Village Council of the Village of St. Louis Park that said building be hereby determined to be an abandoned building and a dangerous building as defined in Ordinance No. 336 as amended, and BE IT FURTHER RESOLVED that the Village Engineer be hereby authorized and directed to cause said building to be demolished and the building materials forthwith removed from the premises and stored on Village property adjacent to the Street Department Building. Special Permit to Inhabit Trailer G. A. Devere On motion of Trustee Jorvig, seconded by Trustee Bolmgfen, G. A. De Vere was granted special permission to inhabit a trailer home at 3201 Dakota Avenue until October 5, 1950, by unanimous vote of the Council. i Advertise for Bids for Ton Truck For Water Department On motion of Trustee Bolmgren, s conded by Trustee Perkins, the Clerk was instructed to advertise for bids for 'ton truck for the Water Department with trade-in of 1941 Truck - Bids to be opened October 23, 1950, by unanimous vote of the Council. Dust Coat Ordered -- Alabama -37th to Excelsior On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the Village Engineer was instructed to apply a dust coat to ALABAMA AVENUE FROM 37TH STREET TO EXCELSIOR BOULEVARD, by unanimous vote of the Council. Hearings - Proposed Street Improvement Assessments Separate hearings were had on proposed assessments for Street Improvement Projects Nos. 0-52, 0-49, 0-50, N-88 and N-98. No one appeared. Resolution On notion of Trustee Bolmgren, seconded by Trustee Perkins, the following resolution was adopted by unanimous vote of all members of.the Council present: ASSESSMENT RESOLUTION WHEREAS, pursuant to resolution adopted by the Village Council August 14, 1950 and published in the St. Louis Park Dispatch August 23, 1950, the Village Council has met at the time and place specified in_said resolution and has heard all testimony offered by interested persons in connection with proposed assess- ments for the following street improvements: IMPROVEMENT NUMBER LOCATION 0-52 Curb and gutter for east side of Webster Avenue adjacent to Lots 16 to 20, Block 1, Birchwoods 0-49 Grading of Alley, Oak Manor 0-50 Grading Idaho Avenue from Franklin Avenue to 18th St. N-88 Tar Mat for Hampshire Avenue from 28th Street to 29th St. N-98 Tar Mat for Vallacher Avenue from Lynn Avenue to Quentin Avenue, therefore, BE'IT RESOLVED by the Village Council of the Village of St. Louis Park that the total cost of each of said improvements is hereby determined to be in the respective amounts hereinafter set forth in the following list and the amount of benefits conferred by said improvement upon each lot, part of lot, piece or parcel of ground so benefited thereby rateably and in proportion to the special benefits conferred upon it is hereby determined to be as respectively set forth in the following list, and there is hereby levied and assessed against each lot, part of lot, piece or parcel of ground described therein an assessment equal to the sums therein respectively set forth as authorized by Chapter 382, Laws of Minnesota 1 September 25, 1950 Resolution, Proposed Street Improvement Assessments, Cont'd. 1903, payable in three equal annual installments the first of which shall be payable concurrent with real estate taxes levied in 1950 and collected in 1951 together with a penalty of ten per cent if not paid in full within 30 days after publication of this resolution, and interest at 6 per cent per annum from the date of issuance of orders for financing this improvement.
