Pfeifer to connect his home now under construction on Lots 17 and 19, Auditors Subdivision #176, to the water main on the East side of High- way #169 at West 44th Street with the understanding that he pay an assessment of $175.00 at the time he takes out the regular permit; and the construction of same be made as directed by the State Highway Department and Village Engineer. Motion was passed by unanimous vote of Council Members present. Letter Re Bus Service A letter from the Twin City Rapid Transit Company, dated September 14, 1950, informing the Village Council that they would not be able to make the requested three trips to the Oak Hill District, was read and ordered filed. Building Inspector's Weekly Report The Building_Inspector's weekly report of building permits issued for week ending September 15, 1950, showing that 38 permits were issued, totaling $352,550. was read and ordered filed. Proposed Plat of Underwood's Addition On motion of Trustee.Bolmgren, seconded by Trustee Jorvig, the proposed plat of Underwoods Addition, presented by Cortie A. Underwood was referred to the Planning Commission for checking and report, by unanimous vote of Council Members present. Constable Lawrence E. Holm Resigns On motion of Trustee Jorvig, seconded by Trustee Bolmgren, the resignation of Lawrence E. Holm as Constable was accepted, by unanimous vote of Council Members present. 74 September 18, 1950 Resolution On motion of Trustee Bolmgren, seconded by Trustee J-orvig., the follow- ing resolution was adopted by unanimous vote of Council Members present: RESOLUTION AUTHORIZING CONVEYANCE OF E2 OF LOT 79, AUDITORS SUBDIVISION NO. 301 WHEREAS, it appears to the Village Council that by deed recorded April 26, 1939, Ion Russell Patch and wife conveyed the West 2 of Lot 79, Auditors Sub- division No. 301 to Roy E. Olson and wife; that under date of November 12, 1940 said Patch and wife delivered a deed to said Lot 79 to the Village of St. Louis Park, which deed was recorded in Book 1572 of deeds, page 326 in the office of the Register of Deeds; that on January 5, 1946, a deed was recorded in Book 1704, Page 46, purporting to convey the East z of said Lot 79 to William H. Rafferty and wife; that said Rafferty and wife appear to have acted in g6od faith and had commenced construction of a house before discovering the prior Village deed; and WHEREAS it appears to the Village Council that the West z of said Lot 79 is not owned by the Village, and that said Lot will never be of any use to the Village as a street or otherwise, therefore BE IT RESOLVED that the Mayor and Clerk be hereby authorized to execute and deliver a quit claim deed of the Village conveying the East 2 of Lot 79, Auditors Subdivision #301 to William H. Rafferty and Mary B. Rafferty as joint tennants on the payment of the sum of $25.00 to the Village Treasurer. Minute s The minutes of meeting held September 11, 1950 were read and approved as read. Lease for Garbage and Refuse Disposal On motion of Trustee Jorvig, seconded by Trustee Bolmgren, the Mayor and Clerk were authorized to sign for the Village a lease with Landers, Norblom, Christenson Company for property to be used for garbage and refuse disposal which has been prepared by Village Attorney, E. T. Montgomery. Motion was passed by unanimous vote of Council Members present. Form of Garbage Collection Contract Approved On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the form of Garbage Collection Contract prepared by Village Attorney, E. T. Montgomery was approved for submission to bidders, by unanimous vote of Council Members present. Ordinance No. 371 On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the following ordinance was adopted by unanimous vote of Council Members present: ORDINANCE NO. 371 AN ORDINANCE AMENDING THE ZONING ORDINANCE f OF THE VILLAGE,OF ST. LOUIS PARK The Village Council of the Village of St. Louis Park Ordains: Section 1. The Zoning Ordinance of the Village of St. Louis Park adopted January 20, 1932 as amended is hereby further amended by deleting the following described area of the Village from the Commercial Use District as prescribeddby Section 22 of said Ordinance and the Zoning Maps referred to therein That portion of Lot A, Block 3, Brooklawns lying north of a line drawn at right angles to the East line of said Lot through a point in the East line distant 93 feet northerly measured along said east line from the southeast corner of said Lot having a frontage of 60 feet on Brunswick Avenue; and by including the said area within the Residence District, and the same shall be subject to all the regulations of said ordinance applicable to said Residence District. Special Building Permit for Gas Station On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the Building Inspector was authorized to issue a special building permit to Douglas Rees Associates and the Kunz Oil Company for the construction of a gas filling station on Lot "A", Block 3, Brooklawns Addition, by unanimous vote of Council Members present. 1 1 1 1 J September 18, 1950 Claim for Damages Approved (Wm. Devitt) A report from Village Attorney, E. T. Montgomery, dated September 14, 1950 was read relative to the claim of William Devitt in the amount of $44.50 to his car-; damages which occurred on July 19, 1950, when he drove East on 28th Street just before crossing the M. N. & S. Railroad tracks and struck a Village manhole which was projecting above the level of the Street. On motion of Trustee Jorvig, seconded by Trustee Bolmgren, the above claim was approved, and the Mayor and Clerk were authorized to issue warrant to Mr. Devitt in the amount of $y44.50, by unanimous vote of Council Members presents.
