SPECIAL MEETING AUGUST 28, 1950
A meeting of the Village Council was called to order by Mayor Erickson
at 8:00 P. M., with the following Council Members present at roll call as follows:

On motion of Trustee Perkins, seconded by Trustee Holmgren, the following
verified claims were approved, and the Mayor and Clerk are hereby authorized to

Bids for Motor Grader
As advertised in the St. Louis Park Dispatch, sealed bids were received
from the following bidders for the furnishing of two Diesel powered motor graders
with twelve -foot mold board, and two -foot extension; both equipped with scarifiers.
One motor grader to be equipped with V plow snow wing, and one motor to be equipped
with snow plow wing only; with one Caterpillar -No.. 12 motor grader complete with
V -plow and snow wing to be traded in:

Hearing - Proposed Curb and Gutter and Sidewalk Improvements
Pursuant to notice published in the St. Louis Park Dispatch, a hearing
was held on proposed curb and gutter and sidewalk construction described in the
following resolution: No one appeared.
Resolution
On motion of Trustee Perkins, seconded by Trustee Bolmgren, the following
resolution was adopted by unanimo'us.vote of all members of the Council present:
RESOLUTION ORDERING CURB AND GUTTER AND SIDEWALK
IMPROVEMENTS
WHEREAS, the Village Council has met and held public hearing at the time
and place specified in notice published in the St. Louis Park Dispatch August
8 and 16, 1950, with respect to proposed•sidewalk and curb and gutter construct-
ion at the following locations in said Village, and it appearing necessary and
in.the public.interest that said improvement$ be made, therefore,
BE IT RESOLVED by the Village Council of the Village of St. Louis Park
that curb and one foot gutter andJive foot Sidewalk be hereby ordered cons-
tructed on Wooddale Avenue adjacent to Lots 1 to 7, inclusive, Block 1, Browndale
in.accordance with plans and specifications for sidewalk and curb and gutter on
file in the office of the VillagelEngineer, and the Village Clerk is directed to
adyertise for bids to be opened September 25, 1950.
Extension of Bryn Mawr Bus Line
A large group were present to discuss the requested extension of the Bryn
Mawr Bus Line. Trustee Bolmgren read a letter dated August 8, 1950, received
frgm the Twin City Lines regarding the impossibility of making extension for the
area of the Bryn Mawr Bus Line. Nor. Rolph of the Twin City Lines was present and
spoke to the audience regarding this matter. the following questions were asked:
1. Was an adequate survey been made? 2. Could we get four or six buses
per day? 3. How many buses are made to Bryn Mawr district? (about 100 trips)
4..Why is there a six minute layover at 22nd.Street and France Avenue? (to allow
for accidents, etc.) 5. Trustee jorvig asked how the survey was made (we counted
each home and spotted them on the map). Trustee Jorvig said that was not a good
survey. Should be house to houselcontact to.find out what number of persons
would use the bus if it was available. Mr..Rolph said if the people would do
as.they say, they would OK, but the people would not come thru. Our experiences
on.all lines give this information. The Bryn Mawr line is losing us money. -
Trustee Jorvig said I still ;don't feel.your survey is good enough. Mr.
Rolph said that in this area, one rider from.each seven homes is average. Approxi-
mately two miles would be included' in this extension and it would take an extra
bus. It was suggested that a bus1be put on -for one week. Would it be possible
to.run an experimental bus and we subsidize?. Mr. Rolph said yes, at $6.00 per
hour. All monies collected would be credited to the cost. They would have to
charge from 22nd and France to 26th & Monterey.

It was suggested that the Bus Company make a two week trial and see if it
world work. Mr. Rolph said he did not think .the Company would make this ex-
terision. The Company cannot afford to do this. It was auggested that the Bryn
MaWr service be cut down to five or six timed a day and.extend the line to St.
Louis Park. Someone asked why not start anather company? What about the Deep -
haven Bus Company? Get a jitney to cover this territory. Cut down Minneapolis
service and give us the service requested.
Can we go direct to the Railroad and Warehouse Commission? It was suggested
that a Committee be picked and go direct to the Railroad and Warehouse Commission.
Trustee Bolmgren suggested that the Railroad and Warehouse Commission be petitioned
to come out and make a survey.. Trustee Jorvig said there was no reason for asking
for a subsidy. No other utility asks this and are making extensions. Mr.
Rolph stated that the Company does'not want to make this extension as a trial.
The question was asked, "would thelDeephaven Bus Company run a shuttle bus?
On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the Village
Attorney was instructed to preparela petition to the Railroad and Warehouse Com-
mission requesting that they order,the Twin City Lines to extend the Bryn Mawr
Bus Line along France Avenue from 22nd Street to 26th Street; thence West to
Monterey Avenue, by unanimous vote'of the Council.
Sanitary Sewer for Xenwood-33rd to34th
Sanitary sewer for Xenwood Avenue from 33rd Street to 34th Street was
discussed again. A petition signed by persons opposed and a petition signed by
persons in favor were presented. Mr. Caswell appeared in opposition, and quoted
costs, interest, etc. No furtherlaction was taken.

petitions were referred to the Village Engineer and Chairman of the Street
Department Committee for checking and recommendation, by unanimous vote of the
Council:
P-644 PETITION FOR CURB AND GUTTER, signed by Max
Renner, 4806 Minnetonka Boulevard, dated August
18, 19501, for the construction of curb and gutter
on the North Side of Minnetonka Boulevard adjacent
to Lots 12, 13, 14, and 15, Oak Manor.
P-646 PETITION FOR GRADING, signed by Adolph Fine, Inc.
dated August 24, 1950, for the grading of Ottawa
Avenue from 42nd Street to North End; and 42nd
Street from East Village Limits to Princeton Avenue.
P-649 PETITION FOR CURB AND GUTTER, signed by Albert
T. Nelson, 2800 Edgewood Avenue, dated August 281,
1950, for the construction of curb and gutter on
the West side of Edgewood Avenue from 28th Street
to 29th Street.
Building Inspectorls Weekly -Report
The Building Inspector's weekly report for week ending August 25, 1950,
showing that 54 building permits were issued, totaling $1,232,900.00, was read
and ordered filed.
Ordinance No. 370
On motion of Trustee Bolmgren, seconded by Trustee Perkins, the following
Ordinance was adopted by unanimous vote of Council Members present.
ORDINANCE NO. 370
AN ORDINANCE AMENDING AN ORDINANCE GRANTING
TO MINNEAPOLIS GAS LIGHT COMPANY ITS SUCCESSORS
AND ASSIGNS, THE_RIGHT TO MANUFACTURE, IMPORT,
TRANSPORT, SELL AND DISTRIBUTE.GAS FOR HEATING.,
ILLUMINATING AND OTHER PURPOSES IN THE VILLAGE
OF ST. LOUIS PARK, AND TO USE THE STREETS. -AVENUES.,
AND ALLEYS THEREOF FOR THAT PURPOSE
1NHEREAS, by Ordinance No. 290 the Village of St. Louis Park granted a
franchise to the Minneapolis Gas Light Company which company has heretofore
assigned all its right, title and interest in said franchise to Minneapolis gas
Company which has assumed all obligations thereunder, and
WHEREAS, the said Minneapolis Gas Company sells and distributes straight
natural gas throughout its entire gas distribution system which is located in the
City of Minneapolis and in a number of suburban communities and in the territory
adjacent to and near the said city including the corporate limits of the Village
of St. Louis -Park, and it appearing that the natural gas distributed by the
Company is furnished to it through a pipe line system owned and operated by the
Northern Natural Gas Company which is a 11natural gas company" under the Federal
Natural Gas Act and said Northern Natural Gas Company is subject to the juris-
diction of the Federal Power Commission, and
WHEREAS, it appears that the provisions of Section 5 of said franchise
might be construed to require the company to furnish an unlimited supply of gas
to its customers without regard to emergencies or its ability to acquire a
sufficient quantity of natural gas from its supplier to satisfy the requirements
of all customers at all times, and
WHEREAS, it appears that an emergency,exists with respect to demands for
gas and the ability of the supplier to furnish sufficient quantities to meet the
demand, and in the judgment of the Village Council modification of said Section
5 will be in the interests of the Village and its citi zens as a whole, therefore,
The Village Council of the Village of St. Louis Park ordains:
Section 1. Section 5 of Ordinance No. 290 entitled:
"AN ORDINANCE GRANTING TO MINNEAPOLIS GAS LIGHT COMPANY, ITS
SUCCESSORS AND ASSIGNS, THE RIGHT TO NLUtUFACTURE, IMPORT,
TRANSPORT, SELL, AND DISTRIBUTE GAS FOR HEATING, ILLUMINATING
AND OTHER PURPOSES IN THE VILLAGE OF ST. LOUIS PARK, AND TO
USE THE STREETS, AVENUES, AND ALLEYS THEREOF FOR THAT PURPOSE.."

adopted December 22, 1947, is hereby amended to read as follows:
"Section 5. STANDARDS OF SERVICE The Company shall at all times furnish
an adequate, safe and continuous 'supply of gas to the Village and its inhabitants,
subject, however, to the furtherlprovision of this section.
"The Company shall not be liable to the Village or its inhabitants, nor
shall the Village, or any inhabitant who is a customer of the Company, be liable
to the Company hereunder by reason of the failure of the Company to deliver, or
of the Village or a customer to receive natural gas as the result of acts of
God, or the public enemy, inability of pipe line supplier to furnish an adequate
supply due to an emergency, an order or decision of a public regulatory body,
or other acts beyond the control of the party affected.
"Whenever any of the occurrences named above take place, the Company shall
have the right and authority andlit shall be its duty to adopt reasonable rules
and regulations in connection with limiting, curtailing or allocating extensions
of service or supplying of gas to any customers or prospective customers and
withholding the supplying of gas;to new customers, provided that such rules and
regulations shall be uniform as applied to each class of customers; classifi-
cations of customers shall be reasonable and shall be non-discriminatory as be-
tween communities.
"The Company shall have the' right to contract for the sale of gas for
industrial use on an interruptible basis, requiring the customer to have standby
equipment for use upon notice by the Company. The Company's rules, regulations,
schedules or contracts for curtailing interruptible gas service shall be uniform
as applied to each class of interruptible customers.
"If service is temporarily suspended because of any of the reasons set
forth above, occurring through no,fault or negligent act on the part of the Com-
pany, such suspension shall not be made the basis of any action or proceeding to
terminate this franchise. The quality of the gas sold in the Village 'shall be
the same as that sold to the Company's customers in the City of Minneapolis."
Section 2. This ordinance (shall take effect from and after its publica-
tion.
Application for Off -Sale Liquor License
The application for an off -sale liquor license by L. V. Foye at 5000
Excelsior Boulevard, dated Augustl21, 1950 was read. On motion of Trustee
Bolmgren, seconded by Trustee Jorvig, the above application was denied by unani-
mous vote of Council Members present.
Execution of Agreement

On motion of Trustee Bolmgren, seconded by Trustee Perkins, the Mayor and
Clerk were authorized to execute agreement relating to use of land between the
Village and Sheldon -Thomas Company, dated August 28, 1950, which agreement was
submitted by the Sheldon -Thomas Company to fulfill the condition in its permit
granted July 17, 1950, for the construction of an extension of commercial -build-
ings at SE corner of Wooddale Avenue and Excelsior Boulevard. Motion was passed
by unanimous vote of the Council.,
Bid Awarded for Sewer Cleaning Equipment
On motion of Trustee Perkins, seconded by Trustee Bolmgren, the bid of
Municipal Equipment Company received August 14, 1950, for furnishing Power Sewer
Cleaning Equipment, was deemed to be the lowest bid of a responsible bidder-
($2,591.60),
idder(°2,591.60), and the Clerk is hereby authorized to issue purchase order for same
at price bid, by unanimous vote of Council Members present.
Letter to Continue Stop Signs on Fest 18th Street
A letter from H. 0. Wilkinson, Inc. dated August 25, 1950, requesting the
Village Council to continue with the stop signs on west 18th Street which were
placed there for the duration of the National Amateur Tournement at the Minn -
polis Golf Club, after the tourn -ement is over. On motion of Trustee Perkins,
seconded by Trustee Bolmgren, the above request was referred to the Police Com-'
mittee for checking and recommendation, by unanimous vote of the Council.
Letter Re Bowman Dump'
A letter from Village Health Officer, Dr. H. W. Darby, M. D., stating that
Harold Olson has a contract to cover the Bowman Dump on West 35th Street with
dirt and sand; and also to fill in the low land from the adjoining hill, was read
and ordered filed. i

Minn. Section, AVv'WA Conference
On motion of Clerk Justad, seconded by Trustee Bolmgren, Village Engineer,
Phil W. Smith, Water Superintendent, Ira Vraalstad, and Trustee H. J. Bolmgren,
were authorized to attend the Minnesota Section, AWWA Conference to be held in St.
Paul, September 6, 7, 8, 1950, with necessary expenses paid, by unanimous vote of
the Council.
Bid Awarded for Police Car
On motion of Trustee Bolmgren, seconded by Trustee Perkins, the bid of
Dahlberg Brothers, Incorporated received August 21, 1950, for the furnishing of
One (1) 1950 Ford Custom Tudor Sedan, 8 cylinder, 100 H. P., fresh air heater
with defrosters, 2 windshield wipers, 2 sun visors, 5 tires, 670 x 15, direct-
ional lights, color black, at a price of $1,732.25 less allowance for 1949 Ford
Tudor Sedan of $943.25, or net price of $789.00, was deemed to be the lowest bid
of a responsible bidder, and the Village Clerk is hereby authorized to issue a
purchase order for same at price bid, by unanimous vote of Council Members present.
Contractors Bond - Phelps-Drake,Co.
On motion of Trustee Bolmgren, seconded by Trustee Perkins, Contractors
Bond with Phelps -Drake Company, Incorporated of Minneapolis, Minnesota as princi-
pal, and United States Guarantee Company of New York, N. Y. as surety, dated
August 2, 1950, in the amount of $121,483.00, covering the construction -of Sanitary
Sewers and Appurtenances in Sewer District 2-H, was approved and accepted by un-
animous vote of the Council.
Deed Accepted - Lohman Propert
On motion of Trustee Perkins, seconded by Trustee Bolmgren, the deed for
the following described property was accepted from G. F. Lohman, Nella D. Lohman,
his wife, and Henry G. Lohman and Anna K. Lohman, his wife, dated August 15, 1950;
by unanimous vote of the Council:
The north 30 feet of that part of the south hald (S2)
of the southeast quarter (SEI)•of Section 18, Township
117, Range 21, described as follows: Beginning at a
point which is the intersection of the West line of Texas
Avenue in the Village of St. Louis Park, Minnesota, and
the north line of said south half (S2) of said south-
east auarter (SE4); thence south along the West line of
said Texas Avenue a distance of 499.55 feet; thence west
and parallel with said north line of said south half (S2)
of said southeast quarter (SEI) a distance of 750 feet;
thence north to a point on the north line of said south
half (S2) of said southeast quarter (SEI) 750 feet
distant from the West line of said Texas Avenue; thence

Plat Approved - Virginia Gardens

On motion of Trustee Perkins, seconded by Trustee Bolmgren, the plat of
Virginia Gardens is hereby approved, and the Mayor and Clerk are authorized to
sign same for the Village, by unanimous vote of the Council, subject to Village
Attorney's approval.
Deed Accepted - Landers. Norblom. Christenson Co.
On motion of Trustee Perkins, seconded by Trustee Bolmgren, a deed was
accepted from Landers, Norblom, Christenson Company, dedicating a strip of land
30 ft. wide for widening Utah Avenue from Minnetonka Boulevard to 32nd Street;
and also a strip along 32nd Street from Utah Avenue to Westport Addition with the
understanding that said street will be graded at the expense of owner of property'
lying easterly thereof and without expense to the Village or Landers, Norblom,
Christenson Company; deed to be returned if grading is not done by said property
owner. Motion was passed by unanimous vote of the Council.
Salaries for Election Juges and Clerks
On motion of Trustee Perkins, seconded by Trustee Bolmgren, the hourly
wage of Election Judges and Clerks was set at $.75 per hour, by unanimous vote of
the Council.

BE IT RESOLVED by the Village Council of the Village of St. Louis Park
that the Clerk be directed to publish notice of hearing to be held at the Council
meeting September 18, 1950, on the following proposed water main extensions:

BE IT FURTHER RESOLVED that the area proposed to be assessed for each of

Request for Building Permit for Gas Station
A. C. Godward, 538 Builders' Exchange, Minneapolis, representing Douglas
Rees Associates, and the Kunz Oil Company, Minneapolis, owners of all of Lot A,
Block 3, Brooklawns in letter dated August 28, 1950,- requesting permit to cmns-
truct a gasoline filling station on said lot, was read. On motion of Trustee
Bolmgren, seconded by Trustee Joryig, the above request was referred to the
Planning Commission for checking and recommendation, by unanimous vote of the
Council.
Hearing date Set
On motion of Trustee Perkins, seconded by Trustee Bolmgren, September 25,
1950 was set as date for hearing on storm sewers for Zarthan-34th Street area,
by unanimous vote of the Council.)
Deed Accepted - 111illiam J. and Dora A. Sahl
- On motion of Trustee Perkins, seconded by Trustee Bolmgren, the Village
Council was authorized to accept a deed from William J. and Dora A. Sahl for
dedication of a portion of 31st Street and Sumter Avenue with the understanding
that the Village release them from water main and grading assessments, and
receive from them a release from all claims for damages on account of the grad-
ing,of their property. Motion was passed by unanimous vote of the Council.
Meeting Adjourned
The meeting was adjourned by Mayor Erickson at 11:45 P. M.
