Pursuant to notice published in the St. Louis Park Dispatch, separate hearings were had on each of the water main, extensions described in the follow- ing resolution. No one appeared. . On motion of Trustee Bolmgren, seconded by Trustee Perkins, the follow- ing, resolution was adopted by unanimous vote of all members of the Council present: , RESOLUTION ADOPTING WATER MAIN ASSESSMENTS • WHEREAS, proposed assessments for the- cost of extension of water mains at the following locations in said Village have been duly filed with the Village Clerk and opened to public inspection and notice has been published in the St. Louis Park Dispatch that the Village Council would pass upon said proposed assessments at its present meeting, and said Council has met at the time and place specified in said notice and heard and passed upon all objections to said assessments: Jersey Avenue from 27th Street to 28th Street Idaho Avenue from 26th Street to 28th Street . Quentin Avenue from 26th Street to 27th•Street III Oxford Street from Zarthan Avenue to Alabama Avenue • Kentucky Avenue from 27th Street to 28th Street West 24th Street from Lot 19; Block 6, Forest Tract, Lake Forest to Lot 22, Westridge • Rhode Island Avenue from 321- Street to 35th Street . therefore, - • - BE IT RESOLVED by the Village Council-of the Village of St. Louis Park that said proposed assessments which are hereby referred to and made a part hereof, be hereby adopted, and an assessment be hereby levied against each of the lots, parts of lots, pieces and parcels of land described therein in the sums therein June 5, 1950 429 Resolution Adopting Water Main Assessments, Cont'd. respectively set forth, and each of said tracts of land is hereby found to be benefited in the amount of the assessment levied against it herein, and BE IT FURTHER RESOLVED that each assessment shall be payable in equal annual installments extending over a period of ten years, the first to be payable on the first day of June, 1951, all deferred payments to bear interest at the rate of 5% per cent per annum, said assessments to be a lien upon the property therein specified concurrent with general taxes as authorized by Gh&p.t -5 I,&ws o-�- }c o-191-9ra-s ide Section 452.116 to 432.24, Minnesota Statutes. Trustee Jorvig Trustee Jorvig came to the meeting at this time. Application for Electric Power at New Lift Station On motion of Trustee Jorvig, seconded by Trustee Perkins, the Mayor and Clerk are hereby instructed to sign the application for electric power service for the new lift station on Excelsior Boulevard, West of France Avenue, by un- animous vote of Council Members present. Building Permit (Coast to Coast Stores) The Planning Commission's reports dated May 26, and June 2, 1950 on the request of N. B. Phillips, owner of property on the NE corner of Excelsior Boulevard and Highway No. 100, for approval of a store building to be located south of the Mobile Gas Station with front to the south, was read. On motion of Trustee Bolmgren, se Bonded by Trustee Perkins, the Building Inspector was authorized to issue a building permit as per plans on file, with a 20 foot setback from the Highway Service Road, for a store building, by unanimous vote of Council Members present. Building Permit - Contractor's Office Building On the recommendation of the Planning Commission, it was moved by Trustee Bolmgren, seconded by Trustee Perkins that the Building Inspector be authorized to issue a building permit to Clarence K. Bros for the construction of a Con- tractor's Office Building on Lots 46, 47, and 48, Block 174, Rearrangement of St. Louis Park, with 20 foot setback on Gorham Avenue and side yards for fire pro- tection between it and any other building, by unanimous vote of Council Members present. Building Permit - Light Industrial Building On the recommendation of the Planning Commission, it was moved by Trustee Perkins, seconded Trustee Bolmgren, that the Building Inspector be authorized to issue a building permit to Don Malone, 5818 Cambridge Street, St. Louis Park for the construction of a light industrial building on Lots 31 and 32, Block 176, Rearrangement of St. Louis Park, facing on Lake Street west of Cooper's Industrial Building; building to have same setback as the adjacent SW corner of Cooper Building, and the front parallel with Lake Street. Motion was passed by unanimous vote of Council Members present. Hearing Date Set for Rezoning (Clarence K. Bros.) On the recommendation of the Planning Commission, it was moved by Trustee Perkins, seconded by Trustee Bolmgren, that July 10, 1950 be set as date for hear- ing on the petition of Clarence K. Bros for the rezoning of Lots 18, 19, and 20, Block 2, Minikanda Vista Second Addition, from Residential Use District to Multiple Dwelling Use District; and from "C" Density to "D" Density District. Motion was passed by unanimous vote of Council Members present. Licenses On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the following applications for 1950 licenses were approved, and-the Mayor and Clerk are hereby authorized to issue licenses to expire December 31, 1950, by unanimous vote of Council Members present: Kenwood Plumbing & Heating Co. Plumbing Oliver T. Isaacson Electrical Bid Awarded - Curb and Gutter On motion of Trustee Perkins, seconded by Trustee Bolmgren, the bid of Victor Carlson & Sons, Inc., for the construction of 'curb and gutter, received May 29, 1950, was deemed to be the lowest bid of a responsible bidder, and the Mayor and Clerk are hereby authorized to enter into a contract with Victor Carlson and Sons, Inc. for same in the amount bid of $1.52 per lineal foot, Motion was passed by unanimous vote of Council Members present. 4030 June 5, 1950 CD Bid Awarded - Sidewalk Construction On motion of Trustee Perkins, seconded by Trustee Jorvig, the bid of Victor Carlson & Sons, Incorporated, for the construction of sidewalk at various locations in the Village, received May 29, 1950, was deemed to be the lowest bid of a responsible bidder, and the Mayor and Clerk were hereby authorized to enter into a contract with Victor Carlson & Sons, Inc. for same in the amount bid-of 36¢ per sq. foot for 32 inch sidewalk, and 480 per sq. ft. for 6 inch sidewalk. Motion was passed by unanimous vote of Council Members present. Petitions - Water Main On motion of Trustee Bolmgren, seconded by Trustee Perkins, the following petitions were referred to the Village Engineer and Chairman of the Water Department Committee for checking and recommendation, by unanimous vote of Council Members present: P-577 PETITION FOR WATER MAIN, signed by Arvid E. Carlson & Son, Incorporated, received May 24, 1950, for the cons- truction of water main in VIRGINIA AVENUE FROM WEST 35TH STREET TO NORTH LINE OF DONNYBROOK TERRACE SECOND ADDITION; and in WYOMING AVENUE FROM WEST 35TH STREET TO NORTH LINE OF DONNYBROOK TERRACE SECOND ADDITION. p-589 PETITION FOR WATER MAIN, signed by Mr. and Mrs. B. Approval of Securities for Citizens State Bank On motion of Trustee Perkins, seconded by Trustee Bolmgren, the deposit of U. S. A. TREASURY NOTES 12% DUE 3-15-55 ----- 1 @ $5,000.00 and 2 @ $10,000.00, totaling $25,000.00 with the First National Bank of Minneapolis by the Citizens State Bank of St. Louis Park to secure Village deposits, was approved by unanimous vote of Council Members present. Application for Permission to Operate Used Car Business (Grossman) The application of West Minneapolis Investment Company by Norman Grossman, Vice President, for permission to operate a used car business on Lots 1 and 2, Block 3, Minikanda Vista Addition (SW Corner of Intersection of Excelsior Blvd. and Lynn Avenue), dated May 4, 1950; and the Planning Commission's report on same, dated May 26, 1950, were read. On motion of Trustee Perkins, seconded by Trustee Bolmgren, the above application was referred to Committee of Whole by unanimous vote of Council Members present. Mr. A. Deinard, Attorney for West Minneapolis Investment Company offered to change their proposal to agree to do no mechanical work on the premises. Rezoning - Forster Distributing Co. The Planning Commission's report dated May 27, 1950 on the request of the Forster Distributing Company to rezone the area that is now zoned Residential Use located on the south side of Highway #7 between Monterey Avenue on the west with the Woodmark Company adjacent on the west, and Lots 9 and 10, Fern Hill • Addition on the east to Light Industrial Use, was read. On motion of Trustee Perkins, seconded by Trustee Bolmgren, the Village Attorney was directed to prepare an amendment to the Zoning Ordinance allowing the above application, by unanimous vote of Council Members present. Street Light Ordered On motion of Trustee Jorvig, seconded by Trustee Perkins, the Northern States Power Company was ordered to place a street light on pole already in place at corner of 27th Street and Florida Avenue, by unanimous vote of Council Members present. Petition for Rezoning The petition of F. A. Olsen, 7607 West Lake Street, dated June 4, 1950 for the rezoning of Lots 16 and 17, Block 158, Rearrangement of St. Louis Park from Commercial to Residential, was referred to the Planning Commission for check- ing and recommendation; also the Building Inspector is to notify the Clerk of any building permits requested. 4[32 June 5, 1950 Building Inspector's Weekly Report The Building Inspector's weekly report of permits issued for week ending June 2, 1950, showing a total of 39 building permits issued, totaling $317,300.00 was read and ordered filed. Building Inspector's Report for May, 1950 The Building Inspector' s report for the month of May, 1950 was read and ordered filed. Building Permit Approved (S. and L. Building) On motion of Trustee Perkins, seconded by Trustee Bolmgren, the Building Inspector was instructed to issue a building permit to S. and L. Company for their proposed building to be constructed on their property at the West End of the Village, north of Excelsior Boulevard, according to plans (Job #2671) prepared by Liebenberg and Kaplan. Motion was passed by unanimous vote of Council Members present. Used Car Dealer - Holand Motors, Inc. On motion of Trustee Perkins, seconded by Trustee Bolmgren, the application of Holand Motors, Incorporated, for a license to operate a used car business at 4419 Excelsior Boulevard was referred to Committee of the Whole, by unanimous vote of Council Members present. Bid Awarded for Automatic Voting Machines On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the bid of Automatic Voting Machine Corporation, Jamestown, N. Y. received May 29, 1950, for furnishing of 21 automatic voting machines at $1,240.00 each ($26,040.00), FOB Jamestown, N. Y. on a ten year rental purchase contract basis of $2,604.00 per year, plus interest of 3% on unpaid balances; freight to be paid by the Automatic Voting Machine Corporation to St. Louis Park at rate of $20.00 per each machine, to be reimbursed upon presentation of proper invoice -- was determined to be the lowest bid of a responsible bidder, and the Mayor and Clerk were authorized to enter into a contract with the Automatic Voting Machine Corporation for the Village at above terms, by unanimous vote of Council Members present. Resolution On motion of Trustee Perkins, seconded by Trustee Jorvig, the following -111 resolution was adopted by unanimous vote of Council Members present: RESOLUTION DESIGNATING ELECTION DISTRICTS • BE IT RESOLVED by the Village Council of the Village of St. Louis Park that pursuant to Chapter 4, Part 6, Chapter 345, Laws of Minnesota 1939, the existing election districts of the Village -of St. Louis Park are hereby divided, consolidated, and rearranged as herein provided, that after posting a copy of this resolution sixty days, the Election Districts of the Village of St. Louis'Park shall be eight in number and their boundaries shall be as follows: DISTRICT NO. 1, is bounded on the east by France Avenue (Village Limits); on the north by the Great Northern Railroad Tracks; on the west by Highway No. 100 (Belt Line); and on the south by Minneapolis and St. Louis Railroad Tracks. The Planning Commission's reports dated June 2 and 5, 1950 regarding the request of Sheldon-Thomas Company to rezone the southerly 100 feet from Excelsior Boulevard at Wooddale Avenue was read and discussed with Mr. C. M. Redman, Pres. of the Sheldon-Thomas Company. Mr. Redman's request for permission to use the Nly. 22 feet of the. Sly. 100 feet of the property in question for the rear of commercial buildings facing on Excelsior Boulevard, and the remaining portion of the N 50 feet of the S 100 feet for employee' s parking was taken under con- sideration pending receipt of more detailed data. Spur to Hopkins On the recommendation 'of the Planning Commission, it was moved by Trustee Perkins, seconded by Trustee Bolmgren, the request of R. J. Westling, owner, for approval or proposed plat north of Minnetonka Boulevard and west of the Great Northern spur to Hopkins, was approved by unanimous vote of Council Members present. Request for Permit to Remove Gravel - C. M. Freidheim The request of C. M. Freidheim for permission to remove gravel from his property was referred to the Village Attorney for checking and recommendation. Request to Erect Billboards - R. W. Farnsworth The request of the Clark Super Gas Company, made by R. W. Landquist was granted a permit to vary the setback requirement of the Village Zoning Ordi- nance for Lot 10, Block 1, Tuxedo Park to a minimum of 20 feet from West 29th Street on the ground that practical difficulty exists in development of the lot because of its unusual situation. Carlson & Son, No. 18716, dated June 5, 1950, in the amount of $2,000.00, deposited to guarantee completion of grading of streets in Donnybrook Terrace Second Addition was accepted on the understanding that if the streets of said subdivision are not graded and graveled to grade approved by the Village Engineer, and in/ accordance with his directions on or before August 1, 1950, that portion of the said $2,000.00 required by the Village to complete said grading and graveling shall be forfeited to the Village abd the remainder on com- pletion thereof shall be refunded to said Arvid E.
