HomeMy WebLinkAbout1950/04/03 - ADMIN - Minutes - City Council - Regular 356 March 27, 1950 `0 Ordinance No. 357, Cont'd. :- appointment of a special officer, the Village Clerk shall issue a commission >41 to him setting forth any conditions of his appointment and the term for which he is appointed. Section 3. No such commission shall be effective until the person to whom it has been' issued shall have filed with the Village Clerk his bond in the sum of $1,000.00 with such sureties as the Village Council shall approve conditioned as required by law for bonds to be furnished by Village Constables. Section 4. No such special officers shall be deemed as employees or officers of the Village. They shall make such reports to the Village Council or the Chief of Police as the Mayor of the Village shall direct, and they shall co- operate with the Chief of Police and the Justices of the Peace and conform to III all procedures directed by them in any law enforcement actions undettaken within the Village. The commission of ,each such special officer shall be subject to revocation at any time by the Village Council with or without cause. Section 5. Each applicant shall deposit with the Village Clerk a sum sufficient to pay the cost of a special officer's badge which will be delivered to the special officer on filing his bond with the Clerk, but such badge will remain the property of the Village and shall be returned to the Village Clerk on the revocation or termination of the commission of the special officer. Any such officer who shall fail to deliver the badge issued to him to the Village Clerk upon such revocation yr termination of his commission shall be guilty of a misdemeanor, and upon conviction thereof shall be fined not more than $100.00 or imprisoned for a period of not to exceed ninety days. Proof of the loss or destruction of such badge shall be a defense to such a prosecution, but the burden of proof of such loss or destruction shall be upon the defendent. Section 6. Hearing on Application for Rezoning Pursuant to notice published in the St. Louis Park Dispatch, a hearing was had on the application of Gerardts, Incorporated, for the rezoning of the EAST TEN ACRES OF THAT PART OF THE NE4 OF THE SEL SECTION 20, TOWNSHIP 117, RANGE 21, noxth of Excelsior Boulevard, known as Gerard's Meadowbrook Addition, from Resi- dential Use to Commercial Use. No persons .appeared. The Village Attorney was instructed to prepare an ordinance for the rezoning of the above described property. • Trustee Jorvig • Trustee Jorvig arrived at the meeting at this time - 8:36 P. M. Spe• cial Permit to Connect to Watermain On motion of Trustee Bolmgren, seconded by Trustee Jorvig, a special permit was granted to the owners of Lot 39 and the South 10 feet of Lot 40, Block 8, Thorpe Brothers Cedar Lake Heights, to connect the building at the above address to the watermain at West 26th Street and Monterey Avenue; with the understanding that when the watermain is extended in Monterey Avenue from West 36th Street to West 25th Street adjacent to said property, the special assessment will be paid. Motion was passed by unanimous vote of the Council. Hearing on Proposed Watermain Extensions Pursuant to notice published in the St. Louis Park Dispatch, hearings were had on proposed watermain extensions Nos._P-1 thru P-43. P-26 Mr. Ruedlinger appeared against watermain extension in Yukon Avenue from West 36th Street to North Line of Donneybrook Terrace Second Addition. It was .suggested that they wait for bids and see what the cost will be and then discuss same with them and Developer (Carlson) P-8B Mr. Zimmerschied, 2124 Parklands Road appeared in opposition to Parklands Road Extension. Ordinance No. 358 On motion of Trustee Jorvig, seconded by Trustee Perkins, the following ordinance was adopted by unanimous vote of the Council: ORDINANCE NO. 358 AN ORDINANCE AMENDING THE PLUMBING ORDINANCE OF THE VILLAGE OF ST. LOUIS PARK, MINN. The Village Council of the Village of St. Louis Park ordains: Section 1. Section 6 of Ordinance No. 46 of the Village of St. ]Louis Park, entitled, AN ORDINANCE TO REGULATE THE CONSTRUCTION, EXTENSION, ALTERATION AND REPAIRING OF PLUMBING WORK WITHIN THE VILLAGE OF ST. LOUIS PARK AND TO PROVIDE FOR THE .SANITARY INSTALLATION OF SUCH PLUMBING WORK, adopted by the Village Council November 19, 1930, is hereby amended by adding thereto the follow- ing: "No drain or soil connections between buildings and the Village sewers shall be constructed of pipe which is reduced in size at any point from the connection with the building plumbing to the Village sewer, and where any such drain or soil connection between the building and the Village sewer is laid over a cesspool, a continuous iron soil pipe shall be used across the entire cesspool area." Section 2. This ordinance shall take effect from and after its publication. Storm Water On motion of Trustee Bolmgren, seconded by Trustee Perkins, the matter of storm water at 4046 Brookside Avenue was referred to the Village Engineer to be taken care of in 1950. Motion was passed by unanimous vote of the Council. Proposed Sewer Construction Abandoned On motion of Trustee Perkins, seconded by Trustee Bolmgren, the request of S. M. Sitz, 3218 Alabama Avenue and others, for the abandoning of the proposed construction of sanitary sewer in Blackstone Avenue from the South Boundary of Lot 16, Block 5, Del Monte Heights north to 32nd Street, was granted and the Village Engineer was instructed to notify the Contractor, Phelps-Drake Company to take same out of their contract dated July 25, 1949, by unanimous vote of the Council. Taxicab Insurance Policy Approved On motion of Trustee Perkins, seconded by Trustee Bolmgren, Automobile Liability Insurance Policy No. CA-58154 furnished to the Golden Valley Cab Co., Incorporated and St. Louis Park Radio Cab Company, 2632 Noble Avenue, Golden Valley, Minnesota by the National Indemnity Company, Omaha, Nebraska, dated March 5, 1950 to March 5, 1951, covering four taxicabs, was approved by unanimous vote of the Council. Broom Filling Machine for Street Department On motion of Trustee Perkins, seconded by Trustee Tolmgren, the Clerk was authorized to purchase from Smith-Dunn Company, Incorporated, 2301 University Avenue SE, ONE (1) WAYNE MOTOR DRIVEN BROOM MAKING MACHINE at $495.00, as per their quotation of_October 21, 1949, and recommended by K. Johnson, Street Com- missioner. Motion was passed by unanimous vote of the Council. Grade Change, Release, Etc. On motion of Trustee Perkins, seconded by Trustee Jorvig, the change of grade of Maryland Avenue (south of Minnetonka Boulevard) adjacent to Lots 7, 8, and 9, Block 1; and Lots 1, 28 and 29, Block 2, Boulevard Heights was approved as designed by John Balich and drawn by E. Permission to Grade Street and Alley On motion of Trustee Perkins, seconded by Trustee Bolmgren, Leslie R. Easement Accepted On motion of Trustee Perkins, seconded by Trustee Bolmgren, an easement was accepted from Kay Motors for access of sewer and water mains along the East side of their property, to serve the apartments to be built on the West side of Raleigh Avenue, south of Minnetonka Boulevard to Highway No. 7, by unanimous vote of the Council. Extend Water Mains On motion of Trustee Bolmgren, seconded by Trustee Perkins, the request of Morningside Village to extend present watermains now connected to St. Louis Park main in Monterey Avenue, approximately 250 feet was approved, and permission to use water as specified in Village Water Ordinance was granted, by unanimous vote of the Council. Advertise for Bids for Gasoline On motion of Trustee Jorvig, seconded by Trustee Bolmgren, the Clerk was authorized to advertise for bids for gasoline, 20,000 gallons more or less for the next twelve months period as per specifications in the office of the Village Clerk, by unanimous vote of the Council.
