SPECIAL MEETING APRIL 10, 1950
A meeting of the Village Council was called to order by Mayor Erickson
at 8:00 P. M., with the following Council Members present at roll call as follows:

Bids for Water Main Construction
III Pursuant to advertisement for bids in the St. Louis Park Dispatch, sealed
bids were received for the construction of water main extensions at various
locations in the Village totalling 24,498 L. F. of 6" C. I. Pipe; 200 L. F. 8"
C. I. Pipe, and 12,371 L. F. of 12" C. I. Pipe, together with valves, hydrants
and appurtenances, from the following bidders:

On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the above bids

Bids for Water Main Construction, Cont'd.
were referred to the Village Engineer and Chairman of the Water Department
Committee for tabulation and recommendation, by unanimous vote of the Council.
Building Permit
On motion of Trustee Jorvig, seconded by Trustee Perkins, the Building
Inspector was authorized to issue a building permit to the Pure Oil Company
for a new building to be constructed on the SW Corner of France Avenue and
Excelsior Boulevard as per plans dated February. 13, 1950. _ Motion was passed by
unanimous vote of the Council.
Hearing - Street Improvements
Separate hearings were had on proposed assessments for each of the im-
provements described in the following resolution. No one appeared.
Resolution
On motion of Trustee Perkins, seconded by Trustee Bolmgren, the following
resolution was adopted by unanimous vote of all members of the Council:
ASSESSMENT RESOLUTION

WHEREAS, pursuant to resolution adopted by the Village Council March 6,
1950, and published in the St. Louis Park Dispatch March 8, 1950, the Village
Council has met at the time and_place specified in said resolution and has heard
all testimony offered by interested persons in connection with the proposed

BE IT RESOLVED by the Village Council of the Village of St. Louis Park
that the total cost of each of said improvements is hereby determined to be in
the respective amounts hereinafter set forth in the following list and the
amount of benefits conferred by said improvement upon each lot, part of lot,
piece or parcel of ground so benefited thereby rateably and in proportion to the
special benefits conferred upon it is hereby determined to be as respectively
set forth in the following list, and there is hereby levied and assessed against
each lot, piece or parcel of ground 4escribed therein an assessment equal to
the sums therein respectively set forth as,,authorized by Chapter 382, Laws of
Minnesota, 1903, payable in three equal annual installments the first of which
shall be payable concurrent with real estate taxes levied in 1949 and collected
in 1950 together with a penalty of ten per cent if not paid in full within 30
days after publication of this resolution, and interest at 6% per_`annum from the
date of issuance of orders for financing this improvement. 3

Request for Permit for Commercial Building
On motion of Trustee Jorvig, seconded by Trustee Bolmgren, the request
of M. 0. Anderson for a building permit to construct a store building on the
SWly 10 feet of Lot 4, and all of Lot 5, Bassford's Addition to St. Louis Park
(except that part taken for Highway), was referred to the Planning Commission

Bid Awarded - Copperhorns and Corporation Stops
On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the bid of
Crane Company of Minneapolis received April 3, 1950, for the furnishing of
copperhorns and corporation stops, was deemed to be the lowest bid of a res-
ponsible bidder, and the Village Clerk was authorized to issue a purchase
order for same in the amount bid ($890.00), by unanimous vote of the Council.
Bid Awarded - Water Meters
On motion of Trustee Bolmgren, seconded by Trustee Perkins, the bid of
Badger Meter Manufacturing Company of Milwaukee, Wisconsin received April 3,
1950 , for the furnishing of water meters, was deemed to be the lowest bid of
a responsible bidder, and the Clerk was authorized to issue a purchase order
for same in the amount bid ($15,197.00), by unanimous vote of the Council.
Permission to Place Poles
On motion of Trustee Bolmgren, seconded by Trustee Perkins, the Northern
States Power Company was granted permission to place poles at the following
locations, by unanimous vote of the Council:

FOR GARDEN VILLAGE ADDITION IMPROVEMENTS
WHEREAS, petition of C. 0. Field Company and Garden Village, Incorporated,
has filed with the Council wherein it appears that said petitioner, Garden
Village, Incorporated, is the owner of a subdivision in said Village of St.
Louis Park, known as Garden Village Addition, and that Raleigh Avenue is ad-
jacent to the easterly side of said subdivision, and it appearing that the

Salem Avenue and Highway Number 7 Service Road easterly along .said Service Road

Raleigh Avenue adjacent to the dedicated parking area from the south line of
Garden Village Addition to the north end thereof be improved by grading to a
grade approved by the Village Engineer; and by application of tar mat and cons-

by Perry E. Crosier and Son, Incorporated, and which have been approved by the
Village Engineer, also that sidewalk be constructed along the westerly side of

BE IT FURTHER RESOLVED that it is necessary and expedient that said
improvements _be made, and the Mayor and Clerk of the Village be hereby authorized
to enter into contract with said C. 0. Field Company for furnishing all labor
and material necessary for the completion of said improvements in accordance
with said plans and specifications according to standard Village contract
conditions approved by the Village Attorney, said contract to provide that the
work will be completed by August 1, 1951, at no cost to the Village and that all
of said improvements shall become the property of the Village on completion
thereof without cost to the Village; said contract to provide further that the
contractor shall furnish the Village with a contractor's performance bond
guaranteeing faithful performance of the contract in the usual form of a public
contractor's performance bond in a penal sum of $36,000.00, said bond to be
approved by the Village Attorney as to form and to be executed by a corporate
surety acceptable to the Village Council.
BE IT FURTHER RESOLVED that any expense incurred by the Village in
connection with said project shall be paid by petitioners within sixty days
after rendering statement by the Clerk, and in default of such payment, the
same shall be assessed against said Garden Village Addition together with any
cost incurred by the Village for completion of said improvements in event of
default by the contractor or its surety on said contract.
Contractor's Performance Bond

AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE VILLAGE
OF ST. LOUIS PARK _
The Village Council of the Village of St. Louis Park ordains:
Section 1. The Zoning Ordinance of the Village of St. Louis Park as
amended by Section 2.2 of Ordinance No. 349 adopted December 19, 1949, is
hereby amended by deleting from the residence district all that part of Gerard's
Meadowbrook Addition not heretofore included within the commercial district
and including the whole of said gerard's Meadowbrook Addition within the com-
mercial district, and the same shall be subject to all the regulations and
provisions of said ordinance relating to the commercial use district.
Section 2. The zoning maps referred to in said Section 2 of Ordinance
No. 349 may be modified to conform to this amendment.
Section 3. This ordinance shall take effect from and after its publica-
tion.
Resolution
On motion of Trustee Perkins, seconded by Trustee Bolmgren, the following
resolution was adopted by unanimous vote of the Council:
RESOLUTION CANCELING ASSESSMENTS
WHEREAS the Village Council levied an assessment on October 11, 1948
against Lot 30, Block 4, Meadowbrook Addition for sidewalk, and it now appears
that said assessment was levied against said lot through inadvertance, side-
walk having been constructed as said location and assessed at a previous date,
and,
WHEREAS, the Village Council levied an assessment on October 10, 1949
against Lots 1 and 2, Suburban Homes Company Addition, and Lots 44 and 45, Block
1, Suburban Homes Company Addition for sanitary sewer in Webster Avenue, and
it now appears that said assessment was included by inadvertance, said lot
facing on Excelsior Boulevard and to be served by sewer in Excelsior Boulevard,
therefore,
BE IT RESOLVED by the Village Council of the Village of St. Louis Park
that said assessments be hereby canceled, and the Treasurer and Auditor of
Hennepin County be hereby authorized to cancel the same upon their respective
records, and

to refund any part of said assessments heretofore paid.
Building Permit (Burton Meyers)
On motion of Trustee Perkins, seconded by Trustee Jorvig, the application
of Burton Meyers for a permit to build a Dairy Queen Store on Lot 2, Block 1,
Suburban Homes Company Addition, was approved as recommended by the Planning
Commission's report dated April 7, 1950; and the Building Inspector was
instructed to issue permit for same, by unanimous vote of the Council.
Rezoning Denied (Adolph Fine, Inc.)
As per Planning Commission's recommendation that the request of Adolph
Fine, Incorporated for the rezoning of Lots 1, 2, 3, 4, Block 3, and Lot 16,
Block 2, Adolph Fine's Addition from Residential to Commercial Use be denied,
it was moved by Trustee Perkins, seconded by Trustee Bolmgfen that the Clerk be
instructed to return the $25.00 fee that accompanied the request for rezoning
as no hearing would be advertised or held. Motion was passed by unanimous vote
of the Council.
Plat of Lee Valley Approved
On motion of Trustee Perkins, seconded by Trustee Bolmgren, the plat of

by M. P. Johnson, was approved, and the Mayor and Clerk were authorized to

of grading of streets. Motion was passed by unanimous vote of the Council.
Street Repairs, 41st Street between Xenwood and Yosemite
A letter dated April 10, 1950 from B. V. Iverson, 4101 Yosemite Avenue
was read, regarding the bad condition of 41st Street between Xenwood and
Yosemite Avenues, caused by rerouting traffic during the construction of Sani-
tary Sewer on Excelsior Boulevard.
On motion of Trustee Bolmgren, seconded by Trustee Perkins, the Street
Commissioner was instructed to repair 41st Street between Xenwood and Yosemite
Avenues, without assessments, by unanimous vote of the Council.
American Water Works Assn. Meeting
On motion of Trustee Perkins, seconded by Trustee Jorvig, Ira Vraalstad,
Water Superintendent, Phil W. Smith, Village Engineer, and Trustee H. J.
Bolmgren were authorized to attend the American Water Works Association meeting
to be held at Philadelphia, Pennsylvania, May 20, 29, 1950, with all necessary
expenses paid, by unanimous vote of the Council.
Specifications for Bituminous Plant Mix
On motion of Trustee Perkins, seconded by Trustee Bolmgren, the following
specifications for bituminous plant mix was approved by unanimous vote of the
Council:
SPECIFICATIONS FOR BITUMINOUS PLANT MIX
Scope of Work
The work contemplated under these specifications consists in fur-
nishing to the Village of St. Louis Park, a seasons supply to bituminous plant
mix, loaded into trucks furnished by the Village of St. Louis Park at some
point in the Village, in such quantities and at such times as may be required
by the Village.
Materials
The bituminous plant mix shall be a mixture of mineral aggregate
and tar, thoroughly and completely mixed in a central mixing plant, delivered
FOB trucks in St. Louis Park. Bidder to submit production capacity of plant
per hour. Failure_ to deliver in such quantities violates the contract agree-
ment. The Village then reserves the right to cancel agreement.
The mineral aggregate shall conform to the Minnesota Department of
Highways specifications dated July 1, 1947. Refer to 3139 (pages 504-5) which
reads as follows:
3139 - Graded aggregate for bituminous mixtures
3139.1 Scope. This specification covers graded aggregate for use in
bituminous surface mixtures prepared by road-mix or plant-mix methods.
3139.2 Requirements
A Composition - The aggregate shall consist of sound, durable particles
of gravel and sand, crushed stone and sand, or combinations thereof. If the
aggregate consists of.crushed limestone, and shall be added in an amount equal
to at least 20% of the weight of the total aggregate. It shall be free from
loosely bonded aggregations, clayey limps or other objectionable matter.
B - Shale Content - Crushed quarry rock shall be free from shale.
Gravels shall not contain a total of more than 5% by weight of shale, iron
oxides and materials having similar characteristics.
C - Crushed Particles - In the production of BA-1, sufficient oversize
material shall be crushed so that the fraction retained on the No. 4 sieve
contains at least 30% by weight, of crushed particles.
In the production of BA-2 from any gravel deposit, if crushing all the
oversize material which will pass through a grizzly or bar grate having parallel
bars 8 inches apart, will produce less than 30% of crushed particles in the
portion retained on a No. 4 sieve, all the oversize material shall be crushed.
If crushing all the oversize material will produce more than 30% of crushed
particles in the portion retained on a No. 4 sieve, sufficient material shall be
crushed to produce not less than 30% of crushed particles in the portion
retained on a No. 4 sieve, and any oversize material in excess of that amount

may be discarded.
If crushed rock or a combination of crushed rock and gravel is used
for BA-2, the fraction retained on a No. 4 sieve shall contain not less than
30% of crushed particles.
D - Los Angeles Rattler Loss - The aggregate shall not show a loss
exceeding 35% by weight. In addition, no 15% fraction (by weight) of the pre-
pared test sample, composed of particles selected by hand, shall show a loss
exceeding 50% by weight.
E - Gradation - The combined aggregate in the mixture shall be well
graded from coarse to fine, and shall comply with the following requirements:

Bituminous Material
The bituminous material shall meet the requirements of the Minnesota
Department of Highway specifications, dated July 1, 1947. Refer to 3155 on
Road Tars which follows:

Road tars shall conform to A.A.S.H.O. specification M 52 with the
additional requirement that the specific gravity of the distillate to 300
degrees C, determined at 100 degrees F, compared to water at 100 degrees F, and
shall be not less than the following:
Grades RT-1, RT-2, RT-3, RT-4 0-99 RT-5, RT-6 1.00
RT-7 1.01 RE-8 to RT-12, incl. 1.02
Samples will be taken from time to time and laboratory tests made at the
expense of the Village.
Advertise for Bids - Road Tar & Bituminous Plant Mix
On motion of Trustee Perkins, seconded by Trustee Bolmgren, the Clerk was
instructed to advertise for bids for road tar and bituminous plant mix; bids to
be opened May 1, 1950, by unanimous vote of the Council.
Sick Leave and Paid Vacations
On motion of Trustee Perkins, seconded by Trustee Jorvig, the Village
Attorney was instructed to prepare an amendment to Ordinance No. 219, increasing
accumulative sick leave from 60 days to 90 days; and to increase paid vacations
for employees who have worked for the Village continuously for ten years or more
from two weeks vacation with pay to three weeks vacation with pay, by unanimous
vote of the Council.
Building Permit for Gas Station
On motion of Trustee Perkins, seconded by Trustee Bolmgren, the Building
Inspector was instructed to issue a building permit for a Gas Station to be
erected on the NE corner of Vernon Avenue and Minnetonka Boulevard, upon presenta-
tion of plans, by unanimous vote of the Council - except Mayor 0. B. Erickson
not voting.

Rules, Regulations for Fire Department
On motion of Trustee Jorvig, seconded by Trustee Holmgren, the following
CLASSIFICATIONS, RULES, AND REGULATIONS FOR THE FIRE DEPARTMENT were approved
and accepted, by unanimous vote of the Council:
CLASSIFICATIONS
CHIEF
The chief shall have complete control of the force with power to
assign members to such duties as he may consider necessary to protect the Village
from fire under the statutes of Minnesota, and the Village Ordinances. He shall
be general supervisor of the Department and shall be responsible to the Village
Council for the conduct of the department and for the care and maintenance of
Village property assigned to the Fire Department. He shall make or assign -
someone to make periodical inspections of special hazards and regular inspections
of all public buildings, theaters, and commercial establishments within the
Village. A report of such inspections shall be made and a copy filed with the
Village Clerk. - He shall see that the rules, regulations and orders of the
Department are enforced by the Assistant Chiefs. He shall keep records of all
fire calls, fire drills; attendance of members to duty and activities of the
Fire Department, and shall render a detailed report thereof to the Village Coun-
cil at least once each month.
ASSISTANT CHIEFS
The Assistant Chiefs shall be in charge of platoons and shall be
responsible to the Chief for the training, discipline, general housework and
efficiency of their respective platoons. In the absence of the Chief, the .
Assistant Chief in command of the platoon on duty shall be Acting Fire Chief,
and responsible for any conditions that may arise involving the protection of
the Village from fire. •
FIREMAN •
The Fireman shall perform such duties as may be assigned to him
by higher authority and shall at all times be in physical condition to discharge
his duties efficiently. He shall be under the direct supervision of the
• Assistant Chief of his platoon.
GENERAL RULES •
•
ALL MEMBERS OF THE DEPARTMENT SHALL BE SUBJECT TO THE FOLLOWING
1. Every member shall thoroughly familiarize himself with the ordinances
creating the Fire Department of the Village of St. Louis Park, the rules of
The St. Louis Park Fire Department, and Civil Service Commission, and shall
conform to the same in every respect.
2. For the purpose of service and discipline, Members on duty are subject to
the orders of Superior Officers.
3. Members shall not speak disrespectfully of or to their Superior Officers.
4. Every Member shall promptly notify his superior officer of his inability to
report for duty at the time required.
5. Every Member shall be held accountable for any disorderly, disgraceful, or
unlawful conduct on his part while on duty or in uniform.
- 6. Profanity or immoral or indecent language by Members shall not be allowed
while on duty.

7. No Member shall indulge in or be under the influence of intoxicating liquors
or drugs while on duty or in uniform.
8. No Member shall bring or have brought into the Fire Station or any Village
premises intoxicating liquor or any drugs of any kind.
9. Members shall not gamble in fire stations or on their Village property for
Money or any other article of value.
10. Every Member shall be held responsible for the safe keeping and proper care
of all Department property under his control.

11. Every Member shall immediately report to his Superior Officer any accident
or injury to himself no matter how trivial.
12. No Member shall leave his post of duty at the Fire Station or at a fire
without permission from his Superior Officer and without being properly
relieved.
13. Every Member shall be subject to call at all times and shall provide himself
with telephone communication at his residence.
14. Every Member shall report for duty at the Fire Station or at a fire im-
mediately upon knowledge of the sounding of the fire siren signal at the
Fire Station.
15. Every Member shall report to his superior officer any change of address or
telephone number.
16. Every Member upon separation from the Service shall promptly surrender all
Village property in his possession to his Superior Officer.
17. Beds shall be neatly made every day before 9 A. M. except on special days
for airing and sunning of beds.
18. No one except Members of the Department or Members of the Auxiliary Fire
Service shall be allowed to ride on the apparatus at any time without per-
mission of the Officer in charge.
19. All Members shall be subject to Off-Shift details such as funerals, parades,
etc.
20. Members shall within Thirty (30) days after appointment, equip themselves
with the proper station uniform, and within Thirty (30) days after probation
period complete regulation dress uniform.
21. The Station uniform shall consist of regulation grey shirt, black tie and
blue serge trousers, and shall be in order, after the completion of daily
routine duties at the station. No torn or .ragged clothes shall be allowed.
22. In the event of any suspicion of incendiarysm at a fire, the Officer in
command shall immediately summon the Chief of the Department. Investigation
of the cause of the fire shall be immediately made and the premises shall
not be left unguarded until the investigation is completed.
23. Each Member of the Department shall be trained to perform all duties of the
Eire Department and each Member shall acquire sufficient knowledge ,of all
apparatus and equipment maintained and used by the Department, and shall
acquire sufficient skill to be able to operate and make use of all of said
equipment.
24. Fire drill shall be held regularly at least once a week. In such drills,
. Members shall practice all phases of fire fighting and the use of the -
Village Fire Fighting Equipment and First Aid and so far as practicable
shall cover all phases of Fire Fighting and First Aid.
25. Members shall be assigned to station duty in shifts of 24 hours each with
one Kelley Day every other week.
26. Paid Members shall not give attention to or be engaged in other business or
employment for gain or compensation without consent of the Village Council.
27. Each Member is responsible to keep the Station and Premises neat, clean and

28. In absence of Officer, the Fireman in order of seniority will assume com-
mand, and shall be accorded the status of Officer until relieved by his
Superior Officer.
Transfer of 1950 Licenses
On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the request
of J. E. Farrell, 5123 Minnetonka Boulevard to transfer his 1950 licenses
(Cigarette, Milk at Retail, Soft Drinks and 3.2 Beer Off-Sale) to George Roode,
the new owner without fee was approved by unanimous vote of the Council.
Salary Adjustment -ode Sorensen
On June 20, 1949, the Village Council by motion, increased the salary
of Patrolman, Clyde Sorensen from $258.00 to $263.00 per month. As this was his
first automatic_ increase, is should have been increased to $268.00. . On
motion of Trustee Jorvig, seconded by Trustee Bolmgren, the salary of Patrolman
Clyde Sorensen was changed to $268.00 per month, effective July 1, 1949, and
the Mayor and Clerk are hereby instructed to issue a check to Clyde Sorensen
for accumulated back pay, by unanimous vote of the Council.
Water Main Extensions P-1 to P-43
The matter of action on Water Main Extensions P-1 to P-43, on which
hearings were held April 3, 1950, was referred to the Water Department Committee.
