A letter from the Planning Commission, dated February 1, 1950, protesting the amendment to the Zoning Ordinance #349, by Ordinance r#354. repealing Section 19.21 of Section 1, was read and, ordered filed. Hearing - Alley Vacation A hearing was had on the petition of Lucille Bohnhoff and others to vacate III portion of.alley in Block 143, Rearrangement of St. Louis Park. No one appeared. Re solution On motion of Trustee Perkins, seconded by Trustee Jorvig, the following resolution was adopted by unanimous vote of all members of the Council present: RESOLUTION VACATING ALIEY WHEREAS, -;petition of Lucille Bohnhoff and others who are a majority of the owners of property adjacent to alley in Block 143, Rearrangement of St. Louis Fark, has been filed with the Village Council in which vacation of said alley is requested, and the Council has met at the time and I1ace specified in a notice 326 i Pbruary 20, 1C5C CD Resolution Vacating Alley, Cont►d. • embracing a copy of said petition duly published in the St. Louis Park Dispatch >14 February 1, 1950, and duly posted in three public places in said Village, the Cbincil having heard all interested persons, and it appearing that said alley has never been graaed or used and because of the topography of the ground, it will not be practical to grade same, therefore, RE IT RESOLVED by the Village Council'of the Village of St. Louis Park that alley in Block 143, Rearrangement of St. Louis Park, as the same is now dedicated and laid-out within tJ�e corporate'limits of said Village be hereby vacated. Action Deferred - Hamburger Restaurant The report of the Planning Commission; dated February 18, 1950, on the reriuest of W. J . Bolduc, 5520 Kellogg Avenue, Edina, for a permit to erect a prefabricated steel frame building with masonry basement to be used as a Ham- burger Restaurant, on Lot 3 and the East i Of Lot 4, Block 4, Minikanda Vista Addition, was read and action deferred to meeting of February 27, 1950. License Approved On motion of Trustee Perkins, seconded by Trustee Jorvig, the application of Brooks Service Station, 4300 Excelsior Boulevard, for a license to operate a three-pump gas station, was approved and the Mayor and Clerk are hereby authorized to issue license to expire December 31, 1950. Motion was passed by unanimous vote of the Council. Report of Building Permits The report of the Building Inspector on permits issued for week beginning February 13, 1950 and ending February 17, 1950, was read as follows 24 Dwellings $199,200.00 1 Porch 650.00 1 Garage 500.00 Total ;?200,350.00 Non Conservation Land List No. 305-C On motion of Trustee Perkins, seconded by Trustee Bolmgren, the following resolution was adopted by unanimous vote of the Council:' RESOLUTION APPROVING NON CONSERVATION LIST • NO. 305-C WHEREAS, the Village Council of the Village of St. Lovas Park, Hennepin County, Minnesota, has received from the County Auditor of Hennepin County, Minnesota, a list of lands in said village which became the property of the State of Minnesota under the provisions of law declaring the forfeiture of lands to the State for non-payment of taxes, which said list has been designated as List No. 305-C, February 20, 1950, and ,'IHEREAS; each parcel of land described in said list has heretofore been classified by the Board •of County Commissioners of Hennepin County, Minnesota as non-conservation land and the sale thereof has heretofore been authorized by said Board of County Commissioners; NOW, THEREFORE, be it resolved by said Village Council, acting pursuant to Minnesota Statutes for 1945, Section 282.01, that the said classification by said Board of County Commissioners of each parcel of land described in said list as non conservation land be and the same is hereby approved and that the sale of each such parcel of land be and the same is hereby approved. Cigarette and Liquor Taxes Tne Clerk read a report on receipt from the State of Minnesota of monies from cigarette and liquor taxes, as follows: 1. Cigarette Tax 43,945.87 2. Liquor Tax 3,791.13 Total ;7,737.00 Deputies & Clerks for Assessor's Office On motion of Trustee Bolmgren, seconded by Trustee Perkins, the Village Assessor was authorized to hire Deputy Assessors and Clerks to assist with the 1950 assessing of Personal Property and Real Estate. Motion was passed by unani- mous vote of the Council. Building Permits - Apartment Buildings On motion of Trustee Perkins, seconded by Trustee Bolmgren, the Building Inspector was authorized to issue building permits to Sauers Construction Company for two (2) ten (10) apartment buildings on the following described property, subject to approval of the Planning Commission -- by unanimous vote of the Council: That part of the NE4 of the SE of Section 6, Township 28, lunge 24, described as follows: Begin- ning at the point of intersection of the May line of Excelsior Boulevard with the NEly line of Hunting- ton Avenue as laid out and dedicated in the plot of Huntington Woods First Addition; thence NEly along the N;"lly line of said Excelsior Boulevard 102.3 feet; 328 ` � February 20, 1950 Building Permits - Apartment Buildings, Conti d. thence at a right angle NWly 207.74 feet; thence Sally 104.08 feet more or less to a point in the NWly line of aforesaid Huntington Avenue distant 188.57 feet Illy from point of beginning; ,thence SEly along said NEly line of said Huntington Avenue 188.57 feet to the point of beginning. Resolution On motion of Trustee Boltrigren, seconded by Trustee Perkins, the following III resolution was adopted by unanimous vote of the Council: RESOLUTION CANCELING GARBAGE COLLECTION ASSESSMENT BE IT RESOLVED by the Village Council of the Village of St. Louis Park that the following assessments levied pursuant to resolution adopted September 16, ' 1948 be hereby canceled Tor the reason that said lands were used either for business or were vacant lands and were not served by the garbage collection service of the Village, and the. President and Clerk are hereby authorized to refund the amount paid on receipt of a verified claim signed by the taxpayer. R. 0. Harper Lot 19, Block 1, Birchwood D 8.40 2643 'tebster Ave. G. B.
