Report on Walk on Lynn from 28th N. of Bog The Village Engineer's report on the request of Mrs. Alberts, 2721 Lynn Avenue for the construction of sidewalk on Lynn Avenue from 28th Street nprth across the bog was read as follows: "Please be advised that the Street Commissioner and I inspected the -conditions and decided the best procedure is to start filling immediately with dirt which is available in the neighborhood. We will give it a coat of gravel*an d a shot of tar'to hold it through the winter. Next summer we can continue to fill to bring it up'to a higher level and give it another shot of tar before school opens in the fall. Work is already under way on this project." The Village Clerk was to so inform Mrs. Alberts. Acceptance of Gas Ordinance A resolution accepting Ordinance No. 370, entitled AN ORDINANCE AMENDING AN ORDINANCE GRANTING TO MINNEAPOLIS GAS LIGHT COMPANY, ITS SUCCESSORS AND_ ASSIGNS, THE RIGHT TO MANUFACTURE, IMPORT, TRANSPORT, SELL, AND DISTRIBUTE GAS FOR HEATING, ILLUMINATING AND OTHER PURPOSES IN THE VILLAGE OF ST. LOUIS PARK, AND TO USE THE STREETS, AVENUES, AND ALLEYS THEREOF FOR THAT PURPOSE", was read and ordered filed. Meeting Adjourned The meeting was adjourned by Trustee H. W. Bids for Garbage and Refuse Collection As advertised in the St. Louis Park Dispatch September 20 and 27, 1950, sealed bids were received from the following bidder for the furnishing of labor and equipment necessary for the collection and disposal of garbage and refuse in the Village of St. Louis Park from December 15, 1950 to December 15,-1952 ---- Suburban Sanitary Drayage Company 72¢ per month for each home 25¢ for each business collection On motion of Trustee Perkins, seconded by Trustee Bolmgren, the above bid was referred to the Village Engineer and Chairman of Committee on Sanitation for checking and recommendation, by unanimous vote of Council Members present. Hearing on Proposed Storm Sevier Construction - District No. 24 Pursuant to notice published in the St. Louis Park Dispatch September 20 and 27, 1950, a hearing was had on proposed construction of storm sewer for Storm Sewer District No. 24. The following persons appeared: E. Ehlen, 3413 Bruns- wick Avenue representing Ken Foster, 3405 Brunswick Avenue and Albert Peterson, 3409 Brunswick Avenue stated that this is not in their District. Resolution On motion of Trustee Perkins, seconded by Trustee Bolmgren, the following resolution was adopted by unanimous vote of Council Mdmbers present: RESOLUTION FOR STORM SEWER CONSTRUCTION WHEREAS, the Village Council has met at the time and place specified in a notice published in the St. Louis Park Dispatch September 20 and 27, 1950 for hearing on storm sewer for Storm Sewer District No. 24, and beard all interested persons, therefore BE IT RESOLVED by the Village Council of the Village of St. Louis Park that Storm Sewer be.hereby ordered constructed for Storm Sewer District No. 24 at the following locations: 34th Street from Xenwood Avenue to Zarthan Avenue Zarthan Avenue from West 34th Street to 240' north 96 October 9, 1950 Resolution for Storm Sewer Construction, Cont'd. 1 7111 in accordance with plans and specifications on file in the Office of the Vil-jage Engineer which are hereby approved,.and advertisement for bids heretofore published is also hereby approved. The area of Storm Sewer District-.N`o.24 as described in said notice is approved. Hearing - Vacation of Alley, Block 4, Supreme Park First . Pursuant to notice published in the St. Louis Park Dispatch, a hearing was,had on the, petition of Ingolf Haugen and others for the vacation of ALLEY IN BLOCK 4, SUPREME PARK FIRST DIVISION. Roger S. Camp, 2024 Georgia Avenue. appeared in favor of same. He agreed to get additional signers. On motion of Trustee Bolmgren, seconded'by Trustee Perkins, action on above petition was deferred to meeting of October 16, 1950. Hearing on Sidewalk Improvements , Pursuant to notice published in the St. Louis Park Dispatch September 20 and 27, 1950, a hearing was had on sidewalk .projects numbered P-652 to P-659 inclusive. No one appeared. Re so,lut ion . On motion of Trustee Perkins, seconded by Trustee. Co. 211635.00 Sanstrom & Haffner 23,740.00 Bart Carlone 19,671.50 On motion of Trustee Perkins, seconded by Trustee Bolmgren, the above bids were referred to the Village Engineer and Chairman of the Sewer Department Com- mittee for checking and recommendation, by unanimous vote of Council Members present. 1 1 1 Hearing on Proposed Grading Projects Pursuant to notice published in and 27, 1950,'a hearing was had on the October 9, 1950 the St. Louis Park Dispatch September 20 following proposed projects (grading) P-251 Texas Avenue from Minnetonka Boulevard to 28th Street 28th Street from Texas Avenue to Virginia Avenue P-254 Ottawa Avenue from 42nd Street to 4001 North3501 south 42nd Street from Princeton Avenue to St. Louis Park boundary N-166 Princeton,,Avenue from 422 Street to 42nd Street ;• f 97 . A petition signed by A. J. Johnson and others opposing N-166 and P-254 was read. The Village Council agreed to meet on this site Saturday, October 14, 1950. On motion of Trustee Perkins, seconded by Trustee Bolmgren, P-251 is to be included in advertisement for bids for grading to be opened October 30, 1950 (See following), and action on P-254 and N-166 was deferred until decision has been reached by Committee of Whole, by unanimous vote of Council Members present. Advertise for Grading Bids On motion of Trustee Bolmgren, seconded by Trustee Perkins, the Clerk was instructed to advertise for bids for the following grading ----- South 30 ft. of 34th Street from Utah Avenue to Xylon Avenue; and Texas Avenue from Minnetonka Boulevard to 28th Street; and 28th Street from Texas Avenue to Virginia Avenue, bids to be opened October 30, 1950, subject to approval of the Village Engineer. Motion was passed by unanimous vote of Council Members present. Hearing on Proposed Grading Pursuant to notice published in the St. Louis Park Dispatch, September 20 and 27, 1950, a hearing was had on the proposed grading of Cambridge Street from Colorado Avenue to Edgewood Avenue. No one appeared. Resolution On motion of Trustee Perkins, seconded by Trustee Bolmgren, the following resolution was adopted by unanimous vote of all members of the Council present: RESOLUTION ORDERING STREET GRADING WHEREAS, the Village Council of the Village of St. Louis Park has met at the time and place specified in a notice published in the St. Louis Park Dispatch September 20 and 27, 1950, of hearing on proposed grading of Cambridge Street from Colorado Avenue to Edgewood Avenue and has heard all persons interested at said meeting in regard to said project, therefore, BE IT RESOLVED by the Village Council of the Village of St. Louis Park that said grading project be hereby ordered in accordance with plans and specifi- cations prepared by the Village Engineer which it hereby approves, and the Clerk be directed to advertise for bids to be opened October 30, 1950. Trustee Jorvig Trustee Jorvig arrived at the meeting at this time - 9:30 P. M. Eide & Martin1s Second Addition Plat On motion of Trustee Perkins, seconded by Trustee Jorvig; the plat of Eide & Martin's Second Addition was approved and accepted subject to approval of the Village Engineer and Village Attorney, and the Mayor and Clerk were authorized to sign same for the Village, by unanimous vote of the Council. Resolution Ongmotion of Trustee Bolmgren, seconded by Trustee Jorvig, the following resolution was adopted by unanimous vote of the Council: RESOLUTION FOR PERMISSION TO CONSTRUCT WATER MAINS WHEREAS,'the Village has made application to the Department of Highway, State of Minnesota for permission to install water mains along the north side of Highway ##169 in Excelsior Boulevard from Huntington Avenue to France Avenue and said Department requires that the Village assume all responsibility for backfilling and maintaining of trenches on the Trunk Highway Right-of-way, therefore, 98 October 9, 1950 Resolution for Permission to Construct Water Mains, Cont. BE IT RESOLVED by the Village Council of the Village of St. Louis Park that said Village assume all responsibility to the Department of Highways of the State of Minnesota for backfilling, finishing and maintaining of water main trenches on said Trunk Highway Right-of-vray. Elevated Water Tank #3 Accepted The Village Engineer, Phil W. Smith reported that Pittsburgh -Des Moines Steel Company has completed the Million Gallon Elevated Water Tank #3, located on 34th Street, west of Texas Avenue, in accordance with plans and specifications, and recommends its acceptance. On motion of Trustee Bolmgren, seconded by Trustee Perkins, the Village Council hereby accepts the completed Million Gallon Elevated Water Tank #3 above mentioned, and releases Pittsburgh -Des Moines Steel Company's bond, by unanimous vote of Council Members present. Resolution On motion of Trustee Bolmgren, seconded by Trustee Perkins, the following resolution was adopted by unanimous vote of the Council: RESOLUTION APPROVING 1950 LEVY, COLLECTABLE 1951 RESOLVED, by the Village Council of the Village of St. Louis Park, Hennepin County, Minnesota, that the following sums of money be levied for the current year 1950, collectable in 1951 upon the taxable property in said Village of St. Louis Park for the following purposes: General Fund $192,875.00 Fire Dept. Relief Assn. 2/10 of 1 Mill 1,513.00 Musical Entertainment 500.00 Welfare Fund 15,000.00 Park Purposes 15,132.00 Village Contribution to Public Employees Retirement Board 2,812.61 TOTAL ----- $227,832.61 Resolution On motion of Trustee Perkins, seconded by Trustee Bolmgren, the following resolution was adopted by unanimous vote of the Council: RESOLUTION LEVYING ASSESSMENT FOR COLLECTION AND DISPOSAL OF GARBAGE AND REFUSE WHEREAS, the'Village Council has, during the annual period from September 1, 1949 to August 31, 1950, provided by contract for collection and disposal of garbage and refuse from dwellings and places of business within the Village of St. Louis Park at a cost of $49,883.40, said cost being allocated on a monthly basis as set forth in Ordinance No. 339, and, WHEREAS, the Village Clerk has prepared an assessment roll providing for an assessment of a service charge for such collection and disposals against each residence and place of business served on a basis set forth in said Ordinance, therefore, BE'IT RESOLVED by the Village Council of the Village of St. Louis Park that said assessment roll is hereby adopted and there is hereby levied and assessed against each lot or parcel of ground set forth in said assessment roll an assess- ment equal to the sums therein respectively set forth, payable concurrently with taxes levied in the year 1950 and collected in the year 1951. Special Permit to Connect to Water Main On motion of Trustee Bolmgren, seconded by Trustee Perkins, a special permit was granted to Ecklund and Swedlund Construction Company to connect the house now under construction at 7908 West 31st Street to the water main in Texas Avenue with the understanding that he pay an assessment of $101.75, this assessment to be credited to the property when the water main is constructed past said property. This work to be done under the supervision of the Superintendent of the Water Department. Motion was passed by unanimous vote of the Council. Petition for Alley Grading and Graveling On motion of Trustee Perkins, seconded by Trustee Bolmgren, the following petition was referred to the Village Engineer and Chairman of the Street Depart- ment Committee for checking and recommendation, by unanimous vote of the Council: 1 1 1 October 9, 1950 1 Petition for Alley Grading & Graveling, Cont'd. P-671 PETITION FOR GRADING, signed by Robert Merrick, 2809 Alabama Avenue and others, dated October 5, 1950, for the grading and graveling of the North Portion of Alley in Block 16, Park Manor, adjacent to Lots 1 thru 10; and Lots 21 thru 30. Special Permit to Connect to Sanitary Sewer On motion of Trustee Perkins, seconded by Trustee Bolmgren, a special permit was granted Wilson -Albrecht Company, Incorporated, 3565 Wooddale Avenue to connect to the sanitary sewer manhole on Wooddale Avenue in front of their building at said address with the understanding that they pay an assessment charge of $280.00 at the time they take out the regular permit, this assessment payment to be credited to said property when the lateral sewer is constructed past said property. Gas Main Extension On motion of Trustee Bolmgren, seconded by Trustee Perkins, the following gas main extension was approved by unanimous vote of Council Members present: In Edgewood Avenue from 26, South of North Line of West 22nd Street to Metalloy Corpora- tion South of West 22nd Street. Proposed Plat - Part of Lot 10, Auditors Subdivision No. 350 ,On motion of Trustee Bolmgren, seconded by Trustee Perkins, the proposed Plat of Part of Lot 10, Auditors Subdivision No. 350, presented by L. J. La Mere was referred to the Planning Commission for checking and recommendation, by unanimous vote of Council Members present. Permission to Place Poles On motion of Trustee Perkins, seconded by Trustee Bolmgren, the Northern States Power Company was granted permission to place One (1) Pole on Kentucky Avenue at West 22nd Street, by unanimous vote. of,the Council. Notice of Hearing - Railroad & Warehouse Commission Re: Rates and Charges for Tel. Service A notice of hearing from the Minnesota Railroad and Warehouse Commission, dated October 2, 1950, in the matter of the Investigation by the Minnesota Rail- road and Warehouse Commission of rates and charges for public telephone service, and the reasonableness thereof; including the application of the Northwestern Bell Telephone Company to place in effect new schedules for rates in the State of Minnesota was read and ordered filed. Fire Department's Report for September, 1950 The Fire Departmentfs report of fires for the month of September, 1950, was read and ordered filed. Justice of Peace Report of Fines - Yngye Justice of Peace Anton Yngve's report of fines dated October 2, 1950 was read and ordered filed. Petition for Water Main On motion of.Trustee $olmgren, seconded by Trustee Jorvig, the petition of Douglas Rees Associates, signed by Consulting Engineer, A. C. Godward, dated October 5, 195Q, for the construction of water mains in West 25th Street, Joppa Avenue, Inglewgod Avenue and Huntington Avenue - all in the Plat of Cedarwood was read, and Nove4iber 6, 1950 was set as date for hearing on same, by unanimous vote of the Council. Building Inspector's Weekly.Report The Building,Inspector►s weekly report for weekending October 6, 1950, show- ing that 17 building permits were issued, totaling $55,350.00, was read and ordered filed.. Building Inspector's Quarterly Report The Building Inspectors Quarterly Report of building permits issued during the Third Quarter of 1950, showing that 562 permits were issued in the amount of $4,997,425.00, was read and ordered filed. Quit Claim Deed -On motion of Trustee Perkins, seconded by Trustee Jorvig, the Quit Claim Deed furnished by Minneapolis, Northfield and Southern Railway, dated October 9, \� 1950 for use as public street the W 30' of the E2 of the NWI of the NEI of the p� SEI, Section 8, Twp. 117, Range 21 West was accepted and ordered filed by unani- mous vote of the Council. 1166. October 9, 1950 Bid Awarded for Motor Graders ` The Village Engineer's tabulation and recommendation on the bids received' August 28, 195U, for the furnishing of two motor graders, was read. On motion of Trustee Perkins, seconded by Trustee Bolmgren, the bid of Rosholt Equipment Company was deemed to be the lowest bid of a responsible bidder for the furnishing of Two (2) New Model 550 Adams Motor graders in the amount of $624,897.00, and the Clerk was authorized to issue purchase order for same to Rosholt Equipment Company in the amount bid, by unanimous vote of Coun- cil Members present. Plat Approved - Underwood Addition On motion of Trustee Perkins, seconded by Trustee Bolmgren, the plat of Underwood Addition was approved and accepted, and the Mayor and Clerk were authorized to sign same for the Village, by unanimous vote of the Council. Resolution On motion of Trustee Perkins, seconded by Trustee Jorvig, the following resolution was adopted by unanimous vote of the Council: RESOLUTION MEMORIALIZING THE BOARD OF COUNTY COMMISSIONERS - OF HENNEPIN COUNTY WHEREAS, it appears to the Village Council that there has been a substantial increase during the past two years in traffic passing over Minnetonka Boulevard and Excelsior Boulevard which are county highways within the Village of St. Louis Park, which increase in -traffic is due to a substantial increase in population west and south of the boundaries of said Village and construction of industrial plants west of the Village in the City of Hopkins, and it appears to the Village Council that said boulevards are not in a condition to adequately serve such traffic, therefore, BE IT RESOLVED by the Village Council of the Village of St. Louis Park that it hereby respectfully memorializes the Board of County Commiszioners of the County of Hennepin to proceed with a survey and plans for the -permanent improve- ment of Excelsior Boulevard and Minnetonka Boulevard in said Village of St. Louis Park. Resolution On motion of Trustee Perkins, seconded by Trustee Bolmgren, the following resolution was adopted by unanimous vote of the Council: RESOLUTION PROVIDING FOR TAX LEVY FOR PAYMENT OF PERMANENT IMPROVEMENT REVOLVING FUND BONDS, OCTOBER 1, 1948 SERIES BE IT RESOLVED by the Village Council of the Village of St. Louis Park as follows: 1. In order to provide money to pay the principal and interest due on Permanent Improvement Revolving Fund Bonds October 1, 1948 Series maturing annual- ly October 1, 1951-61, there is hereby levied upon all taxable property in the Village a direct annual ad valorem tax to be spread upon the tax rolls and collected with and as a part of other general Village taxes in the -years and amounts as follows: 1951 X647.764.50 1952 46,599.00 1953 45,433.50 1954 z'ti3�300:00- 28,518.00 1955 27,825.00 1956 27,132.00 195730o -0o- 26,,439-00- 6;439.001958 1958 25,746.00 1959 25,053.00 1960 22, 260.00 1961 -a3-000,9� 212630.00 2. The Village Clerk shall deliver a certified copy of this resolution to the County Auditor of Hennepin County with such information as said County Auditor shall require, and shall direct him to enter the same on the bond register and to cause said taxes to be extended on the tax rolls and collected as other Village taxes are extended and collected, and the proceeds therefrom shall be credited to the sinking fund created by resolution of the Village Council adopted r 30, 1948, creating a Permanent Improvement Revolving Fund and providing for the - issuance of bonds to create and maintain said Fund. The Village Council reserves the right to determine by resolution adopted on or before October 15 in any year the amount of any moneys from assess- ments then or thereafter to be credited to the Permanent Improvement Revolving Fund and which will not be needed in such Fund, and to direct the Village Clerk to transfer such moneys to the sinking fund created by said resolution and to notify the County Auditor to reduce or cancel the levy for such year by the amount so transferred or to be transferred to the said sinking fund. 4. It appearing to the Council that a sufficient sum has been paid into the Permanent Improvement Revolving Fund from assessments levied for improvements financed out of the Fund to pay principal and interest on the bonds maturing in the year 1951 in full, the aforesaid levy for 1951 is hereby cancelled. 5.- It appearing that $47,764.50 of the principal amount of said Permanent Improvement Revolving Fund Bonds October 1, 1948 Series having been paid out of moneys paid into the Fund from assessments collected, and it appearing desirable to reduce the amount of the Fund in said amount, the Treasurer is hereby dir- ected to reduce the Permanent Improvement Revolving Fund in a sum equal to $47,764.50. Cedarwood Plat Approved On motion of Trustee Perkins, seconded by Trustee Bolmgren, the plat of Cedarwood Addition was approved and accepted, and the Mayor and Clerk were authorized to sign same for the Village, subject to receipt of bond covering the completion of streets, and approval of Village Engineer and Village Attorney. Motion was passed by unanimous vote of the Council. Certify Monies to Take Up Water Works Bonds On motion of Trustee Bolmgren, seconded by Trustee Perkins, the Clerk was instructed to write a letter to the Auditor of Hennepin County, Minnesota, certi- fying that there is on hand in Water Department Funds $81,060.00, or sufficient amount to take up Water Works Bonds due May 15, 1951 and pay interest on same issue due May 15, 1951 and November 15, 1951. Motion was passed by unanimous vote of the Council. Lease Accepted - Garbage & Refuse Burial On motion of Trustee Perkins, seconded by Trustee Bolmgren, the agreement between Landers-Norblom-Christenson Company and the Village of St. Louis Park for leasing the property described therein for the burial of garbage and refuse, dated September 1, 1950 was approved and accepted, by unanimous vote of the Council. Contract for Connection of Sewers of the Villages of St. Louis Park and Edina and For Construction of Certain Sewers On motion of Trustee Perkins, seconded by Trustee Bolmgren, the contract for connection of sewers of the Villages of Edina and St. Louis Park, and for the construction of certain sewers, dated October 9, 1950 was approved and accepted, and the Mayor and Clerk were authorized to sign same for the Village, by unanimous vote of the Council. Resolution On motion of Trustee Bolmgfen, seconded by Trustee Jorvig, the following resolution was adopted by unanimous vote of all members of the Council present: RESOLUTION CONFIRMING CONTRACT FOR WATER MAIN CONSTRUCTION WHEREAS, it appears that pursuant to advertisement for bids published in the St. Louis Park Dispatch August 23, 1950, bids were received for water main projects numbered P-237 to P-250 and P-221, and that said advertisement for bids inadvertently omitted reference to projects numbered P-221 and P-250 and that the plans and specifications delivered to all bidders pursuant to said advertise- ment included all of said projects including P-221 and P-250, and that the bids received from all bidders included all of said projects and that said projects were included in the contract entered into with the successful bidder under date of September 25, 1950, therefore, BE IT RESOLVED by the Village Council of the Village of St. Louis Park that said bids be hereby determined to be received in accordance with said adver- tisement for bids and that said contract be hereby ratified and confirmed. . 102 October 9, 1950 Resolution . On motion of Trustee Perkihs, seconded by Trustee Bolmgren, the following resolution was adopted by unanimous vote of all members of the Council present: RESOLUTION CONFIRMING AWARD OF CONTRACT FOR GRADING WHEREAS, it appears that on August 23, 1950, an advertisement for bids was published in the St. Louis Park Dispatch for grading projects numbered P-222 to P-236 inclusive, to be opened September 18, 1950, and through inadvertence said reference to project numbers was erroneous, the actual grading projects intended and listed in the plans and specifications delivered to all prospective bidders in response to said advertisement being grading projects numbered P-167, P-166, P-179, P-181. P-1821 P-183, P-218, P-224, P-225, P-226, P-227, P-228, P-229, P-230, P-231, P-233, P-234, P-235 and P-236, and it appearing that all bids received were upon proposal forms listing said projects, and it appearing that a contract was entered into for said projects dated September 25, 1950, therefore, BE IT RESOLVED by•the Village Council of -the Village of St. Louis Park that said bids be hereby determined to be received in accordance with said -ad- vertisement for bids and that said contract be hereby ratified and confirmed. Ordinance No. 372 On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the following ordinance was adopted by unanimous vote of Council Members present: ORDINANCE NO. 372 AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE VILLAGE OF ST. LOUIS PARK The Village Council of the Village of St. Louis Park ordains: Section 1. The zoning ordinance of the Village of St. Lduis Park as amended by Ordinance No. 349 adopted December 19, 1949, is hereby further amended by reclassification of the area of the respective use districts as defined in Section 2.2 of said ordinance and the use district maps therein referred to, as follows: also All that part of the Northeast Quarter (NE1) of the Northwest Quarter (NE -1) of Section Seven (7), Township Twenty-eight (28), Range Twenty-four (24), described as follows: Beginning at the intersection of the West line of Block Five (5), Minikanda Vista Second Addition and the North- westerly line of Excelsior Avenue as widened; thence Southwesterly along the Northwesterly line of Excelsior Avenue as widened forty (40) feet; thence deflecting to the right in a Northwesterly direction at an angle of 90 degrees for a distance of 260 feet; thence Northeasterly parallel to the Northwesterly line of Excelsior Avenue 156.67 feet more or less to the West line of said Block 5, in said Minikanda Vista Second Addition; thence South- erly along the West line of said Block 5, 284.97 feet more or less to the point of beginning, All property between the northwest boundary of the above tract extended westward and parallel with Excelsior Boulevard to the west boundary of the L.
